Abstract

The conflict between the State’s Right of Control (Hak Penguasaan Negara) and customary land rights (hak ulayat) in Timor Tengah Utara (TTU), East Nusa Tenggara, Indonesia, represents a fundamental legal-philosophical tension. This study employs a normative-qualitative approach with conceptual and hermeneutical analysis to examine the ontological, epistemological, and axiological dimensions of the dispute. The findings reveal three layers of conflict: ontologically, the state’s right is public-functional while ulayat is sacred-collective; epistemologically, the state prioritizes written documents and cadastral maps, whereas the indigenous community relies on oral tradition and natural boundaries; axiologically, legal certainty, substantive justice, and utility clash, with identity recognition often neglected. The study concludes that resolving land conflicts in TTU requires an epistemic dialogue and binding customary deliberation (musyawarah adat-besar) that grants equal standing to traditional elders. Without mutual recognition between state and indigenous knowledge systems, agrarian justice remains unattainable.

Abstract

This article aims to critically analyze the norm adequacy of restoring the original condition in Article 79 paragraph (1) of Law Number 20 of 2025 on the Criminal Procedure Code and to formulate a legal reconstruction model based on Pancasila values. The problem focuses on two main issues: the alternative formulation through the word “or” in Article 79 paragraph (1), which potentially selects partial restoration forms, and the operational implications of the seven-day execution time limit in Article 79 paragraph (3). To approach this issue, theoretical frameworks of Howard Zehr’s Restorative Justice, Jürgen Habermas’s Communicative Action, and Pancasila Legal Idea as a grand theory are utilized. Data were collected through library research on primary and secondary legal materials and analyzed prescriptively via grammatical, systematic, and teleological interpretations. This study concludes that Article 79 paragraph (1) is not purely materialistic as it explicitly includes forgiveness and medical or psychological costs, yet its disjunctive structure risks ignoring holistic victim needs assessment. The proposed reconstruction yields the God-Conscious Consensual Restorative Justice model, requiring cumulative-proportional restoration criteria, guaranteeing genuine voluntariness, and strengthening offender accountability and victim protection under Pancasila.

Abstract

The development of conventional, digital, and transnational crimes requires a criminal evidence system capable of integrating scientific evidence in an objective, accurate, and accountable manner. The Forensic Laboratory Center of the Indonesian National Police Criminal Investigation Agency plays a strategic role in supporting Scientific Crime Investigation (SCI). However, existing discussions of forensic laboratories tend to position them primarily as technical instruments of criminal investigation and have not sufficiently integrated evidentiary, institutional, and legal reform perspectives. This study aims to analyze the role of the Forensic Laboratory Center of the Indonesian National Police Criminal Investigation Agency in strengthening scientific evidence-based criminal proceedings and to formulate directions for strengthening forensic institutions within the reform of the Indonesian criminal evidence system. This study employs a normative juridical method with a descriptive-analytical approach. The research materials consist of legislation, scientific literature, previous studies, and relevant documents, supported by interviews with personnel possessing expertise in forensic science. The analysis examines the relationship between criminal evidence law, forensic science, and the implementation of SCI from investigation and inquiry to judicial proof. The findings demonstrate that the Forensic Laboratory Center plays a strategic role through five major forensic service areas: documents, printed products, and counterfeit money; ballistics and metallurgy; physics and computer forensics; chemistry, toxicology, and biology; and narcotics and controlled substances. The integration of these services strengthens the use of scientific evidence in identifying, analyzing, and validating evidence while reducing dependence on subjective forms of proof. The novelty of this study lies in positioning the strengthening of the Forensic Laboratory Center as an integral component of criminal evidence reform based on SCI rather than merely as a technical support function for investigation. This study contributes to criminal law policy by emphasizing the need to strengthen forensic regulations, institutional capacity, human resources, and forensic technologies to establish a more objective, accountable, and scientifically validated criminal evidence system.

Abstract

This study examines the resilience of local artists involved in the Kecak Ramayana performance at Uluwatu, Bali, particularly in negotiating sacred cultural values with the demands of tourism commodification. The study employs an interdisciplinary qualitative approach that integrates perspectives from performing arts, ethnomusicology, and visual communication design. Data were collected through direct observation of Kecak Ramayana performances, audiovisual documentation, and in-depth interviews with local artists and cultural practitioners. The analysis focused on three dimensions of performance: movement structure and dramaturgy, vocal rhythm as a spiritual element, and visual narratives and symbolism. The findings indicate that local artists are not passive recipients of tourism commodification but active cultural agents who selectively adapt performance elements while maintaining core ritual, spiritual, and philosophical values. Adjustments in performance duration, narrative presentation, staging, lighting, and visual communication are made to accommodate tourist audiences, whereas fundamental movement patterns, vocal practices, and spiritual values are retained. This process demonstrates that tourism commodification can become a space for cultural negotiation and adaptive resilience rather than necessarily resulting in cultural degradation. The study concludes that community-centered artistic production enables local artists to maintain cultural identity while simultaneously responding to economic and communicative demands within the tourism industry. Thus, the resilience of Kecak Ramayana artists is reflected in their ability to transform and contextualize traditional performance without abandoning its cultural and spiritual foundations.

Abstract

Pollinator insects have a crucial ecological role in supporting the reproduction of flowering plants and maintaining ecosystem balance, especially in oil palm plantation agroecosystem areas. This study aims to analyze the diversity of pollinating insects in Bridal Tear flowers (Antigonon leptopus) at PTPN IV Kebun Melati Perbaungan and develop the results of the research into a monograph book for biology learning. The research was carried out for three months (January-March 2026) at three observation stations using an exploratory survey method using a sweeping net. The results of the study found 179 individuals of pollinating insects classified into 7 species, 7 genera, 5 families, and 2 orders (Hymenoptera and Lepidoptera). Species identified include Apis cerana, Xylocopa latipes, Vespa affinis, Suastus gremius, Neptis hylas, Graphium sarpedon, and Cepora nerissa. Analysis of the ecological index showed moderate diversity values (H'=1.884), high uniformity (E=0.968), and low dominance (D=0.159), indicating a relatively stable community structure. The highest abundance is found in the morning and evening. This study concludes that Antigonon leptopus plays an important role as a source of food for pollinating insects and the results of the research have the potential to be developed as a monograph book to support biology learning.
