Abstract

The environmental problem becomes most problems. Getting many theories of the cause of enviromental crisis, finally on one theory, it is caused by spiritual crisis. It is enough sadly seeing Indonesia with the most islamic societies that can’t drop the enviromental crisis. Actually, Indonesia has had the keeping environmental instrument, but it is still weak. Consequently, the researcher discusses Urgency Of Islamic Environment Law In Development Of Islamic Modern Law As The Supportive Environmental Law Instrument. The research is library research which uses the analysis method to content analysis. The research discovers islamic environment law getting the ushul fiqih foundation that is the maslahah concept and the saddu zari’ah concept, and then a fiqih theory ((الضَّرَرُ يُزَالُ which means worse that must be deleted. The imbalance of understanding societies of the environment becomes the most of problems so that islamic environment law is urgent to develop that becomes Islamic modern law in the new knowledge and one of the supportive environmental law instruments, remembering that the religious norm gets similiar to the law norm.

Abstract

To create the feel secure in the marriage, the adult candidate is needed, physically and mentally. However, the preachers have different views about the meaning of manhood. Islamic law indicates that couples getting married have to mature physically and mentally. Thus, under the laws of our government is 1/1974, Article 7, paragraph (1), it is said that marriage is allowed only if the groom was 19 and the bride was 16. In Islam, marriage position has an important role in the survival of a family. Besides in a hadith history explained, marriage is one way for someone to reach heaven. In Indonesia, the law of marriage is also arranged. Starting from the terms of the age, the condition of validity to be a guardian. If one of the pillars is not completed, then in the view of Islam held to be invalid or void.

Abstract

This paper aims to elaborate portrait of the Prophet Muhammad’s leadership in building spirit of peace among Arabs. As the muslims leader, the Prophet Muhammad brought peace mission to uphold justice and to prevent some religious conflicts. This study used library research to understand that Islam is the religion of peace and reject violence as an instrument of justification. This study also used the descriptive method to know about the principles and values ​​of peace in Islam. The results of this study indicate that peace is the heart of religion that brings benefit to all mankind. The first, the movement of radicalism and terrorism was contradicted with religious doctrine and mission of the Prophet Muhammad in the improvement of morality of the people. The second, the jihad in Islam is a war too self defense (defense jihd) from any threat of the violence, not war frontally (ofensife jihd) without considering of humanity values. The third, the Medina Charter is one of the conflict resolution to build the spirit of peace and giving freedom to all groups to doing religious practices according to their respective beliefs. And the end, The Medina Charter became clear evidence of how the Prophet Muhammad has given full freedom to non-Muslims to coexistence with all the Muslims.

Abstract

The transgender phenomenaon in Indonesia is known as an undesirable group of people, furthermore getting backbitting. Clearly, Islam avoids the undesirable. Finally, transgender people become a minority of people and getting different dos. Consequently, the researcher discusses Islamic Conseling As The Solution Of Transgender Phenomenaon. The research is library research which uses the analysis method to content analysis. The research discovers that transgender were considered mentally ill simply. Many transgender people have reported incidence of depression varies and become significantly higher levels of suicidality. In the psychological knowledge, Spritual intervention is the most of urgent ways to cure mental illness, so that islamic conseling as the solution of transgender phenomenaon could be done with several steps; the first, giving them knowledge about self-convidence; the second, insisting fundamental Islamic belief; the third, letting them approach to Allah SWT; the fourth, giving them knowledge about Islamic law of transgender phenomenon.

Abstract

Tsunami in Aceh in 2004, has made increasingly recognized Aceh in Indonesia and even the world. This opens up opportunities for the inclusion of a wide range of influence on the people of Aceh, including the practice of religion. In 2005, boarding Suryalaya in Tasik Malaya of West Java is one of the boarding school that participated in helping the unfortunate people of Aceh tsunami with Dai and sending volunteers to Aceh. at that moment, the Dai began to introduce the tarekat Qadiriyyah Naqsyabandiyyah in Aceh. The entry of orders Qadiriyyah Naqsyabandiyyah of Pesantren Suryalaya became a new phenomenon in the practice of the Order of Aceh. because of previous orders are popular and practiced by the majority of the people of Aceh are tarekat Naqsyabandiyyah. This study aims to reveal the existence Qadiriyah Naqsyabandiyyah in Aceh, as well as its influence on the practice of tarekat in Aceh. The results showed that this tarekat since coming to Aceh in 2005 still exist and are followed by the different walks of life in Aceh. The tarekat was able to attract people of Aceh from various circles. Tarekat Qadiryyah Naqasyabandiyyah seem attractive and very easy to be carried out, so it continues to grow, and it has a very significant influence on the development of tarekat in Aceh

Abstract

The development of Islamic business thinking encourages a variety of sharia-based business practices, Sharia Insurance, meeting the two variables "Islam And Insurance", is one of them. Insurance is assumed as an industry with the principle of mutual help, but some assess the Takaful Insurance in Indonsia is not clear because it has business activities in it. Therefore, researchers raised the issue of Islam and Insurance In Indonesia. This study of literature review using content analysis method. Research results that Sharia Insurance has a historical basis called the concept of at-ta'min at-ta'awuniy, as well as ethical basis of ta'awun and takaful. There are 2 (two) Takaful products in Indonesia; first, products with elements of savings (saving); second, the product without the element of savings (non-saving).

Abstract

The investment discussed in this study is an example of investment activities in the Islamic capital market. Indonesia, which has the potential of being a majority Muslim population, is expected to be able to accommodate and actively participate as the main perpetrators of Indonesia's sharia capital market, which is supported by regulations as a counterweight to capital market transaction activities.In this study, legal issues are explained systematically in the form of the first problem formulation, what are the forms of regulations and the mechanisms that are applied in the issuance of ijarah sukuk, secondly the legal context of parties in the issuance of sukuk based on ijarah agreement. The type of research used in this research is normative, with descriptive research type.The problem approach used is inventorying legal material (data) the results of processing for the study were analyzed using qualitative analysis methods, by producing a description of the data in the form of sentences arranged in a regular, logical, and effective manner. The results of this study are 1.) Sukuk transactions in Indonesia are regulated in several regulations, namely the Law, OJK Regulations, and Fatwa. Regarding the mechanism for issuing sukuk, it follows the procedure based on the Ijarah agreement which is governed by Islamic law. 2.) The legal context of the parties to the sukuk transaction includes the rights and obligations of the parties, which are governed by the provisions of both national positive law and Islamic law.

Like stratgy with aply syariah (Islamic Law) in all aspec of life, this policy has based on receptio in complexu theory . this strategy has suxesful l and has been acept by ellite local Muslim. and than becouse of anxious at Pan Islamisme Movement in Turky will Influence Nusantara Muslim. Holand Kigdom Government change their political law with limitation in many aspec. For example limitation Absholue competension in Relegious court. The policy is based receptie theory of Snauckh Hugronje. So is clear that all of political law of holand colonial or Hindia Belanda at Relegious court to colling down muslim againts with soft politik or other way.

Abstract

The Presence of Gafatar in West Kalimantan through the transmigration which bring the story of that ended in expulsion of Gafatar. This paper tries to connect the concept of culture violence by Johan Galtung with the stereotyping to the Gafatar. The stereotyping in Gafatar is the flow of astray and dangerous of movement organization, those indicated as trigger of conflict between Gafatar and the local people. This paper uses descriptive approach. This research result indicates that there is a horizontal conflict between civil society, lead to cultural violence. There should have been mapping on the cause and trigger, why conflict happened.

Abstract

The concept of education according to Said Nursi’s view is an integration of three main elements or subjects which combine religious sciences (al-ulum al-diniyah), science of universe and modern technology (al-ulum al-kauniyah al-haditha) and the values of sufism doctrine. Nursi stated that religious knowledge is the light for heart and modern science is the light of the mind, a combination of both will guide to the truth and minimize the fanaticism and intellectual confusion. The main curriculum of learning that used is the study of the main topics contained in the Risale-i Nur. This concept will combine three holistic manners: spirituality from the religious schools (medrese), science and technology from the secular schools (mekteb) and morality from the sufistic schools (tekke).
