Abstract

This study aims to evaluate the benefits and satisfaction provided by Amanah Products at Pawnshop Syariah Makassar Branch. This article uses a qualitative research approach with a focus on descriptive analysis. The results of this study reveal that the Amanah Product at Pawnshop Syariah offers easy, structured, and inclusive requirements and procedures, facilitating various groups of individuals such as civil servants, employees, and micro entrepreneurs to obtain vehicle financing without difficulty. The transparent application process also assists customers in fulfilling their vehicle needs. The quality of service presented has met customer expectations. The professionalism shown by the employees of Pawnshop Syariah Makassar Central Branch also gives a positive impression to consumers. Overall, both aspects of the process, transparency, service, and professionalism at the Makassar Central Branch Sharia Pawnshop have met the standards of Islamic law.

Abstract

Infaq, sadaqah, and waqf are crucial instruments in promoting and realizing an economy characterized by justice and widespread community welfare. However, there are several challenges in fulfilling their significant roles, including the lack of awareness and understanding among the public regarding the concepts of Islamic philanthropy. Therefore, this research focuses on the contribution of infaq in achieving community welfare and social solidarity, the tangible expression of social concern through sadaqah in Islam, and the regulation of waqf in Indonesia. This study employs a qualitative research approach, utilizing descriptive analytical methods. The findings of this research highlight that infaq has a strong relevance to its contributions to society. By optimally implementing the concept of infaq, it can provide substantial contributions in several crucial aspects of community life. Sadaqah, as a tangible expression of social concern in Islam, has significantly contributed to fostering mutual care and has implications for the equitable distribution of wealth among the community. Furthermore, the optimization of waqf implementation in Indonesia is realized based on Law No. 41 of 2004 on Waqf, the Compilation of Islamic Law Articles 215 to 229, and Government Regulation No. 28 of 1977 on Endowments.

Abstract

For most countries in the world, including Indonesia, poverty has long been a problem. Poverty alleviation programs are basically focused on alleviating poverty. In order to provide a multiplier impact on society, an Islamic social enterprise financial inclusion approach is needed.The Sabilillah Mosque in Malang City and the Jogokariyan Mosque in Yogyakarta are the areas that are the focus of this research. The experimental information used in the subjective investigation approach is based on field perceptions of events that occurred in the investigation area with a qualitative paradigm.Research findings reveal that two mosques in Indonesia, namely the Jogokariyan and Sabilillah Mosques, in Yogyakarta City and Malang City, East Java, run Islamic social entrepreneurship as an instrument of financial inclusion aimed at alleviating poverty. The method is to maximize the use of zakat, infaq and sadaqah as an impact on changes in people's lives. These two mosques are Islamic social enterprises that help the poor in Indonesia and can become models for other mosques in Indonesia and elsewhere that are adapted to regional conditions and potential.

Abstract

This research aims to answer a problem regarding the practice of pinpri loans that have not been registered with the Financial Services Authority and how Islamic law reviews the reasons people make pinpri loans. The research method used is statute approach analysis and comparison. Based on the results of the study the practice of personal loans (pinpri) is a cash loan that has not been registered with the Financial Services Authority is the practice of lending through individuals and has not been registered or even licensed by the Financial Services Authority so that it can be said to be illegal and violates Financial Services Authority Regulation Number 77 / POJK.01 / 2016 concerning LPMUBTI, then in the practice of personal loans (pinpri) there are additional funds and have regulations that are not by the operational system listed in the cash loan rules. In terms of Islamic law, the reason why people practice personal loans (pinpri) is because of urgent needs, easy disbursement, and consumptive behavior, while this is contrary to the concept of Islamic law in qardh theory. Because in the practice of personal loans (pinpri) that have not been registered with the Financial Services Authority, several elements are not by Islamic law, namely usury, gharar, dharar, and zhulm so the law is haram and harms and brings mudharat to the community

Abstract

Sharia pawnshops are a financial institution that plays an important role in society. One of the products offered is gold investment. This study examines the effect of knowledge and promotions mediated by motivation on interest in investing in gold in sharia pawnshops. The object of the study was carried out in Banda Aceh City with 100 respondents spread across 9 districts. Determination of respondents using purposive sampling technique and analyzed by path analysis model. The results found that there was a positive effect of knowledge and promotion on the motivation to invest in gold. Promotion and investment also have a positive effect on interest in investing in gold. Meanwhile, knowledge does not have a positive effect on interest in gold investment. Other results found that motivation is not able to mediate knowledge of interest in investing in gold. However, knowledge can be mediated by the motivation to invest gold in sharia pawnshops. So, sharia pawnshops must increase promotion and outreach to the community so that the gold investment products offered are increasingly in demand.

Abstract

Islamic economics is experiencing a rapid expansion, which may lead to inevitable conflicts.  In Indonesia, the religious court is the authorized legal institution designated to resolve financial disputes related to Sharia law. Religious courts are authorized to settle financial disputes related to sharia in accordance with Law No. 7 of 1989 regarding Religious Courts and Law No. 3 as of 2006. The aim of this study is to gain a deeper understanding of the resolution of default disputes through the Supreme Court's decision titled "Implications for Arguments and Considerations in the Decision on Sharia Economic Disputes Number 5K/Ag/2023". A descriptive qualitative method was employed to conduct this research. This methodology focuses on collecting data and conducting in-depth analyses to comprehend the studied phenomenon. The findings of this study indicate that the decision of the judex facti/mahkamah sha'riyah Aceh is in accordance with the law, and therefore the cassation petition filed by the appellant must be denied. Objective analysis shows that the case was handled lawfully, without any violation of legal regulations or principles.Keywords: Sharia Economic Law, Religious Courts, Case Law

Abstract

Penelitian ini didasari oleh permasalahan perbedaan pendapat oleh kalangan ulama kontemporer hingga pakar ekonomi syariah terkait hukum transaksi jual beli emas secara tidak tunai di masyarakat, termasuk putusan fatwa DSN MUI yang mana bertentangan dengan pendapat mayoritas. Penelitian ini menggunakan metode kualitatif deskriptif, dengan teknik pengambilan sampel snowball sampling. Hasil penelitian menunjukkan, pertama DSN MUI dalam menetapkan Fatwa No. 77/DSN-MUI/V/2010 menggunakan konsep ‘urf, dan maslahah mursalah, berdasarkan telah hilangnya kebiasaan masyarakat dalam menjadikan emas sebagai uang resmi, serta bahwa transaksi ini mengandung maslahat untuk mempermudah masyarakat dalam hal kepemilikan emas. Kedua, dari pandangan ekonom syariah terkait hukum transaksi jual beli emas secara tidak tunai dapat dibagi menjadi tiga, yaitu: 1) mutlak boleh, berdasarkan Fatwa DSN MUI, 2) boleh dengan syarat, dibagi dua: a) boleh tidak tunai dari segi pembayaran dan penyerahan barang dengan syarat emas diketahui jelas 4 kriteria, b) boleh tidak tunai dari segi penyerahan saja dengan syarat dapat diserah terimakan secara langsung atau diwakilkan, dan 3) mutlak haram, berdasarkan jelas dan tegasnya hadits yang melarang.

Abstract

The importance of Sharia Compliance in the Sharia financial industry, with a focus on BMT Al Hikmah Semesta. Sharia Compliance supervision management at BMT is considered crucial to ensure compliance with sharia principles, where the Sharia Supervisory Board (DPS) plays an important role in overseeing this compliance. The strategy implemented by BMT Al Hikmah Semesta includes implementing a digital attendance system and establishing a Sharia Compliance Division. Although this article provides a valuable contribution to the understanding of Sharia compliance monitoring activities in the field of Sharia finance, there are several limitations in the research that need to be taken into account, such as weaknesses in the corporate governance of Islamic financial institutions that may affect the performance of these institutions. In this context, the Sharia Supervisory Board (DPS) at BMT Al Hikmah Semesta has an important role in enforcing sharia compliance, by providing fatwas, and recommendations regarding new products and services, as well as carrying out routine monitoring of operational activities. Management needs to increase support for DPS performance and provide education to employees to strengthen the culture of sharia compliance at BMT, so that it can increase effectiveness, maintain quality and increase members' trust in the sharia financial industry.

Abstract

This study aims to determine how the risk perception factor and the risk attitude factor change the Intentional Behavior and Actual Behavior of consumers so that they do panic buying during the COVID-19 pandemic in Indonesia, especially in Maluku. The approach used is qualitative research with the type of case study. Data was collected by interview and observation, with data analysis techniques of data reduction, data display, and verification. S-O-R and TPB are used to see consumer panic buying behavior during a pandemic. The results of the study show that there are stimuli that influence behavior, including: Stimulus of familiarity, controllability, and information/risk exposure. These stimuli form Risk Perception and then become Risk Attitude.

Abstract

Fatwas issued by DSN-MUI are generally related to sharia banking products and contracts. However, these fatwas cannot be immediately applied in sharia banking operations because they are not part of the legal and regulatory hierarchy. Fatwas NO: 78/DSN-MUI/IX/2010 specifically regulates sharia principles in the mechanisms and instruments of the interbank money market. The formulation of the problem in this research is how is the DSN-MUI fatwas NO: 78/DSN-MUI/IX/2010 reviewed from the perspective of maslahah mursalah? This research uses a library method, with a descriptive approach that prioritizes in-depth analysis of various available sources and data. The results of this study indicate that in the DSN-MUI fatwas NO: 78/DSN-MUI/IX/2010, there are 13 provisions that regulate the interbank money market mechanism based on sharia principles. This is in line with the qualification of maslahah ad-Dharuriyah, namely the benefits related to the basic needs of humans both in the world and the hereafter, and humans cannot survive without wealth/property which is the main element in human life. There are 5 benefits, namely: Hifz ad-Din (preserving the religion), Hifz an-Nafs (preserving the soul), Hifz al-'Aql (preserving the intellect), Hifz an-Nasl (preserving of offspring), Hifz al-Mal (preserving the property), these basic needs are considered non-negotiable and must be prioritized to ensure a just, balanced, and prosperous society.
