Abstract

Abstract In the perspective of law, violations committed by someone the rights of others, can cause offense. In the case of an alleged violation of law has occurred, it is consistent with the mandate of Pancasila as the state that is the source of all sources of law, the right of a person suspected of committing an offense or the suspect must be protected, respected and fulfilled. Associated with respect for the rights of suspects or prisoners, it is necessary to put forward opinions expressed by Mardjono Reksodiputro that the primary purpose of law enforcement is the due process of law (due process of law), which includes the rights of suspects, defendants and prisoners protected and considered as part of the rights of citizens (civil rights), and because it's part of human rights. relating to arrest and detention, the Book of the Law of Criminal Procedure (Criminal Code) has set regulations on the arrest and detention, regulated in Article 16 and Article 31 of the Book of the Law of Criminal Procedure (Criminal Code). Abstract

Existence of Indigenous Institutions in the Regulation of the Minister of Interior No. 3 of 1997 as follows: Accommodating and channeling public opinion to the government and resolve disputes relating to customary law, Customs and habits of society in order to enrich the local culture and empower the community in supporting the implementation of the government, implementation of development and social development; create a democratic and harmonious relationship and objective between the Head of Indigenous / Stakeholder Indigenous Peoples or the Oldest and Leader / Indigenous leaders with government officials in the region. Abstract

Tulisan ini membahas Analisis Yuridis Rehabilitasi Terhadap Korban Tindak Pidana Perkosaan Di Dalam Hukum Positif Indonesia  dan Konsepsi Pengaturan Mengenai Ganti Kerugian Terhadap Korban Tindak Pidana Perkosaan. Hal ini dikarenakan  hampir setiap hari media menyuguhkan berita perkosaan, yang memprihatinkan bahkan menyayat hati. Di samping modus kejahatannya yang semakin tidak berperikemanusiaan. Betapa sangat menyedihkan, banyak korban perkosaan yang mengalami trauma kejiwaan yang berat. Tidak sedikit diantara para korban harus hidup dalam keputusasaan dan penderitaan batin yang mendalam. Dapatlah dibayangkan penderitaan yang dialami oleh korban yang mengalami perkosaan. Ia tidak saja akan mengalami penderitaan secara fisik, seperti luka, cacat, atau kehilangan selaput dara, tetapi lebih dalam lagi, ia akan mengalami penderitaan psikis berupa rasa rendah diri, ketakutan, kecemasan, dan trauma, yang apabila tidak berhasil dipulihkan, akan ditanggung oleh korban perkosaan tersebut seumur hidupnya.  Mengingat demikian seriusnya dampak dari perkosaan terhadap kondisi fisik dan psikis korban, dapatlah difahami manakala di dalam perundang-undangan pidana Indonesia, Kata Kunci : Rehabilitasi, Ganti Rugi, Korban Perkosaan

Abstract

AbstractUntuk menentukan apakah pelaku tindak pidana  tersebut  terganggu jiwanya  atau gila  bukanlah kewenangan penegak hukum (Polisi/Penyidik, Jaksa Penuntut Umum  dan Hakim), namun yang paling berwenang adalah  Psikiater. Apabila  dari hasil pemeriksaan Dokter  Psikiater ternyata pelaku kejahatan tersebut mengalami kejiwaan atau  terganggu kesehatan hal ini tentunya  akan mempengaruhi kemampuannya  dalam  mempertanggungjawabkan atas tindak pidana yang dilakukan. Abstract

Indonesia sebagai negara yang pernah dijajah oleh Belanda sudah tentu akan mendapatkan pengaruh dalam berbagai macam sendi kehidupan bermasyarakat berbangsa dan bernegara termasuk juga dalam sistem hukumnya, Belanda sebagai negara yang menganut Civil Law System memberikan pengaruh yang besar terhadap sistem hukum yang berlaku di Indonesia, salah satu asas hukum yang sangat berpengaruh tersebut adalah asas legalitas, asas legalitas  ini sangat mempengaruhi cara berfikir penegak hukum di Indonesia  yang memiliki implikasi yang luas terhadap penegakan hukum dan keadilan. Abstract

Abstract

Abstract Lahirnya UUPPLH 2009 bukan saja sebagai refisi terhadap UU LH sebelumnya (UU No. 23 Tahun 1997) yang dinilai tidak lagi relevan dengan realitas yang ada, melainkan juga diamanahkan oleh TAP MPR No. XI Tahun 2001. Abstract

Pokok permasalahan dalam penelitian ini: Pertama, Bagaimana pengaturan pemberian Bantuan Hukum di bidang kenotariataan secara cuma-cuma terhadap orang yang tidak mampu dan Kedua: Apa akibat hukum terhadap notaris yang menolak memberikan Bantuan Hukum di bidang kenotariatan kepada orang yang tidak mampu. Penelitian ini merupakan penelitian yuridis-normatif yang mendasarkan sumber datanya pada bahan hukum, baik primer, sekunder maupun tersier. Kesimpulan yang diperoleh dari penelitian ini, Pertama, Ketidakadaan aturan mengenai tata cara dan syarat pemberian bantuan hukum di bidang kenotariatan secara cuma-cuma terhadap orang yang tidak mampu membuat notaris selaku pihak yang memberikan bantuan hukum menjadi dilematis karena terjebak diantara aturan minimum honorarium yang datur oleh Ikatan Notaris Indonesia dan juga perintah undang-undang untuk memberikan bantuan hukum secara cuma-Cuma. Kedua, Akibat hukum terhadap notaris yang menolak memberikan jasa bantuan hukum di bidang kenotariatan kepada orang yang tidak mampu adalah 1) teguran lisan; 2) terguran tertulis; 3) pemberhentian sementara; 4) pemberhentian dengan hormat; atau 5) pemberhentian dengan tidak hormat. Kata kunci :    Bantuan Hukum Cuma-cuma, Kenotariatan, Orang Yang Tidak Mampu

Abstract

AbstrakPolicy Strategy of Land and Building Tax OfVillageand City (PBB-P2) after diversion from Central Government to Jambi City Government start from 1st of January 2014 is still face obstacles. PBB-P2 target on 2014 is Rp. 12.000.000.000,- and in realization only Rp. 8.723.143.203,- . So it makes writer interest to doing the thesis research with title Policy Strategy Of Land And Building Tax Of Village And City To Increase Own Source Revenue Of Jambi City On Land And Building Tax Division In The Local Revenue Department Of Jambi City In Jambi Province. This research aim for knowing and analizing the obstacles tha found in implementation PBB-P2 policy and perfect the strategy which has done by Local Revenue Department of Jamby City to be a right strategy.This research method is combining the descriptive and qualitative, the source data through interviews, observation and review of literatures. The data analysis using SWOT and Litmus Test for determine strategic issues as the right in PBB-P2 policy to increase own-source revenue of Jambi City in the Local Revenue Department of Jambi City in Jambi Province.         This result showed PBB-P2 policy strategy that has been implemented by Local Revenue Department of Jambi City is not work like the planning and still have some obstacles that need improvement right strategies to increase own-source revenue of Jambi City. To resolve some obstacles in Government of Jambi City should be need more participation from kelurahan as the service center of PBB-P2 and also using online payment system by Local Revenue Department of Jambi City. Keywords : Policy Strategy, Land and Building Tax, Jambi City
