Abstract

It is an agreement of the ummah, that what Allah revealed in the Al-Qur'an and also what was conveyed by the Messenger of Allah in the Hadith are the basic sources of Islamic law. The two sources, of which there is an order (Amr), this Amr has various meanings such as obligatory, mustahab and others. In this study, the researcher attempted to describe the views of the scholars of jurisprudence in understanding the meaning of amar and its implications for one of the Islamic laws, and here the researcher took one case, namely the practice of worship during the Covid-19 Pandemic. Although most of the Ulama proposing fiqh are of the view that amr basically has a mandatory meaning unless there is a qarinah, in practice there are differences between them. In this study, the researcher used an analytic descriptive method in which after the researcher described the views of the Ulama with regard to the meaning of amr, the designation of the meaning of amar and the legal implications of practicing worship during the Covid-19 Pandemic, considering that at this time there were differences in worship practices that had never happened before Furthermore, the researcher provides some analysis of what the researchers understand based on the views of scholars and experts in this matter.

Abstract

True North true north is any point on the earth to the North pole, this is because the North and South poles point precisely to the earth's axis of rotation. Therefore true north is North based on the earth's axis not North based on the earth's magnetism. So the difference is true North shows the true north direction of the earth while magnetic North is the North direction of the magnetic compass needle. Magnetic north does not coincide with Earth's true north. To find out the true North of the earth using a compass, you need to know the magnetic declination first. To know the magnetic declination can be done through a magnetic declination calculator such as WMM (world magnetic model) which can be downloaded through the crowdmag application playstore. In determining the direction of the Qibla it is required to determine the True North point of the earth.

Abstract

The problem of inheritance that is often a problem in society is when a deceased leaves only daughters so that the father's brother gets the inheritance because there is no barrier to inheritance. In general, the deceased's wife and daughter are not willing to leave the inherited property due to the role of the father's biological brother as long as the deceased (father) does not play a maximum role as guardian. However, if the biological uncle's share is not given, it is feared that there will be damage to the family relationship between the biological uncle and the deceased daughter. So later, in Binjai City, the biological uncle was still given the inheritance, but only part of the actual portion. This study analyzes the practice of inheritance settlement between uncles and daughters in the Binjai City community and the legal arguments of religious leaders who play a role in it. The research method used is field-qualitative with a normative approach and legal sociology. This research found that in solving the distribution of inheritance between daughters when dealing with paternal brothers in Binjai City, there are generally two ways of settlement, namely: First, the clergy want to remain consistent in applying the provisions of inheritance law by traditional fiqh, namely the father's biological brother gets the share of the heir when dealing with an only daughter. Second, scholars try to update the meaning of Islamic inheritance law by placing the position that a daughter can wear the hijab from her father's brotherMasalah waris yang kerap menjadi persoalan di tengah masyarakat adalah ketika mayit hanya meninggalkan anak perempuan, sehingga saudara laki-laki dari pihak ayah mendapatkan harta warisan disebabkan tidak terdapat penghalang waris. umumnya pihak isteri si mayit dan anak perempuannya tidak rela harta warisan keluar dari rumah disebabkan peran saudara laki-laki kandung pihak ayah selama si mayit (ayah) tidak berperan maksimal sebagai wali.

Abstract

The purpose of this study is to find out the Values of Islamic Religious Education in the Tradition of Wages of the Village Community of Kampung Pajak, North Labuhanbatu Regency which is still often carried out by the people of Kampung Pajak. This study uses a descriptive qualitative research method with a phenomenological research approach, where researchers collect data with data collection techniques through interviews, observations and documentation. The results of this study show that the process of implementing the wage tradition carried out by the people of Kampung Pajak Village is by first preparing dishes that will be paid, such as white rice with boiled eggs or white rice with chicken, fish, goats and buffalo and then arranged on plates, tampas or halls. The wages dish is adjusted to what causes a person in wages and the ability of the party who pays the wages. After that, the family gives words of advice to the person who is paid in turn, the first person to convey the words of wages is the father and mother of the person who is paid, then followed by the rest of the family. The tradition of these wages is very good to be implemented because there are Islamic Religious Education values such as the value of faith and morals. The value of faith education contained in the tradition of wages can be seen from the community's belief and compassion towards Allah with the expression of gratitude contained in the advice conveyed, they are grateful for the blessings that Allah gives them, so they carry out the tradition of wages as a form of their gratitude. In addition, there are also worship values such as inviting goodness when conveying the words of wages by the person who pays them. The moral value is also found in the tradition of wages, the value of moral education contained in the tradition of these wages is very good, such as morality to Allah is proven by supplications and requests through prayers, besides that there is a moral value when the community connects the relationship relationship, they gather, meet and strengthen the relationship relationship, this is clearly seen when the tradition of wages takes place.

Abstract

This study examines the disparity in court rulings concerning the status of confiscated assets in online trading crime cases. The Banten High Court Decision No. 117/Pid.Sus/2022/PT BTN ordered the return of assets to victims, whereas the Bandung High Court Decision No. 1/Pid.Sus/2023/PT BDG ruled that such assets be confiscated for the state. This divergence generates legal uncertainty and raises fundamental questions of justice. The research aims to critically assess the extent to which these rulings are consistent with the objectives of maqāṣid al-sharīʿah, particularly the principle of ḥifẓ al-māl (protection of property). A normative legal approach is employed, drawing on statutory analysis, judicial decisions, and comparative perspectives. The findings indicate that the Banten ruling more closely reflects ḥifẓ al-māl by safeguarding victims’ property rights, while the Bandung ruling risks undermining justice, as the state did not directly incur losses. Beyond highlighting this jurisprudential inconsistency, the study underscores the urgency of harmonizing regulatory frameworks so that the principle of ḥifẓ al-māl can be systematically integrated into Indonesian criminal justice practice, thereby advancing substantive justice and strengthening public trust in the law.

Abstract

The shifting role of wives as primary breadwinners within families has become increasingly evident, yet this reality remains insufficiently recognized in the division of joint property upon divorce. Article 97 of the Compilation of Islamic Law (KHI), which mandates equal division, often fails to reflect actual economic contributions, particularly when the wife plays a dominant financial role. Addressing this gap, this normative legal research adopts a qualitative approach through a literature study, utilizing primary legal sources (court decisions, the Marriage Law, KHI, the Qur’an, Hadith, and fiqh principles) and secondary sources (fiqh texts, legal theories, and academic journals). The findings from the Religious Court Decision of Indramayu No. 2388/Pdt.G/2023/PA.Im show that the judges took a progressive stance by allocating 60% of the joint property to the wife and 40% to the husband, though the proportion still falls short of representing the wife’s significant economic contribution as she worked in Hong Kong and financed most of the home construction. From an Islamic legal perspective, justice implies proportionality rather than mere equality, aligning with the concept of syirkah (partnership) and the principles of maqāṣid al-syarī‘ah, which emphasize the protection of property and women’s rights. This study contributes to the reinterpretation of Article 97 of the KHI to be more responsive to contemporary social realities and calls for progressive ijtihād among judges to realize substantive justice in the division of joint property.
