Abstract

This study aims to analyze the sanctions imposed on perpetrators of child rape from the perspective of Islamic criminal law and to compare them with the provisions contained in Law Number 12 of 2022 concerning Sexual Violence Crimes. This research is motivated by the need to assess the extent to which the national legal system accommodates the principles of moral and spiritual justice emphasized in Islamic law. The methodology employed is normative legal research using a library research approach and a comparative case approach. The data sources consist of primary legal materials such as laws and court decisions, as well as secondary legal materials including literature on criminal law and both classical and contemporary fiqh texts. The findings reveal that Islamic criminal law provides a more comprehensive basis for imposing sanctions, as it emphasizes the protection of honor (al-‘irdh) and life (al-nafs), through the application of hudud or ta‘zir punishments to achieve substantive justice. Meanwhile, Law No. 12 of 2022 is more oriented toward procedural justice and victim protection. Therefore, integrating Islamic legal values is essential to strengthen both the effectiveness and moral dimensions of law enforcement against perpetrators of child rape.

Abstract

This study aims to analyze the forms of legal protection provided to Indonesian Migrant Workers who are victims of human trafficking in Wonosobo Regency and to examine the implementation of migrant worker protection regulations at both the national and regional levels. This article is categorized as normative juridical research combined with an empirical juridical approach. The research method involves a literature review of laws and regulations, legal literature, and scientific journals, as well as interviews with the Indonesian Migrant Workers Union (SBMI) Wonosobo Branch as the primary data source. The results indicate that legal protection for migrant workers in Wonosobo Regency has not been implemented optimally, as reflected in the high number of non-procedural departures and ongoing cases of human trafficking due to weak migration literacy, inadequate supervision, and insufficient policy integration

Abstract

This condition gives rise to various problems, particularly in resolving criminal conflicts involving vulnerable groups and local communities. This study aims to analyze the role of progressive law in resolving community criminal conflicts, as well as to identify the challenges and equitable legal solutions offered through this approach. The research employs a qualitative library-based methodology by analyzing scholarly literature, statutory regulations, and academic works relevant to progressive law and criminal conflict resolution. The findings indicate that progressive law is capable of providing more humane and contextual solutions through the application of restorative justice, penal mediation, and community-based approaches. Nevertheless, its implementation still faces structural, cultural, and institutional obstacles. Therefore, a paradigm shift in law enforcement and strengthened commitment from all stakeholders are required so that progressive law can function optimally in realizing sustainable justice.

Abstract

This study aims to examine the implementation of police discretion in handling sexual violence cases at Polrestabes Medan and to analyze its effectiveness from the perspectives of victim protection and restorative justice. This research employs an empirical legal research design with a qualitative approach, utilizing in-depth interviews, observation, and document analysis as data collection techniques. The findings indicate that police discretion plays a strategic role in preventing revictimization, facilitating victim recovery, and realizing a more humane and victim-centered form of justice. Nevertheless, its implementation remains constrained by normative inconsistencies, institutional limitations, and socio-cultural challenges, particularly regulatory disharmony and limited professional capacity. Therefore, strengthening regulatory frameworks and embedding victim-centered justice principles are essential to optimizing police discretion in addressing sexual violence cases.

Abstract

This study aims to analyze the implementation of smart contracts in digital business practices and to assess their legal certainty from a civil law perspective. This research employs a normative legal research method using statutory and conceptual approaches, focusing on the Indonesian Civil Code, the Law on Electronic Information and Transactions, and the Law on Financial Sector Development and Strengthening. The findings indicate that smart contracts can be legally recognized as valid agreements provided they fulfill the essential requirements of contract validity, namely consent, legal capacity, a specific object, and a lawful cause. However, the automated and code-based nature of smart contracts poses challenges in interpreting the parties’ intent, verifying legal capacity, and determining lawful cause. Therefore, stronger regulatory frameworks and hybrid contract models are necessary to ensure legal certainty for smart contracts in Indonesia.

Abstract

This study aims to examine the juridical application of Article 49 KUHP through an analysis of Decision Number 115/Pid.B/2021/PN Stb, with particular attention to the judicial assessment of the elements of self-defense. This research employs normative legal research (doctrinal legal research) using a qualitative approach, supported by the statute approach, case approach, and conceptual approach. The primary legal materials consist of statutory regulations and court decisions, while secondary materials include legal doctrines and scholarly publications in criminal law. The findings reveal that the court’s legal reasoning has not fully accommodated the principles of proportionality and contextual interpretation, resulting in an emphasis on formal legal requirements rather than the protective function of self-defense as a justification ground (rechtvaardigingsgrond). This study concludes that a more contextual and proportional interpretation of Article 49 KUHP is necessary to ensure legal certainty, justice, and legal utility in the application of self-defense provisions.

Abstract

This study aims to analyze the position, probative value, and relevance of testimonium de auditu within the framework of Islamic criminal law, while also examining it in comparison with positive criminal law. This research employs a qualitative library-based methodology using a normative juridical approach, enriched by conceptual and comparative approaches. Data are analyzed through content analysis and critical discourse analysis of fiqh jinayah literature, usul al-fiqh, and contemporary scholarly works. The findings indicate that testimonium de auditu does not possess the authority of a primary evidentiary instrument in Islamic criminal law; nevertheless, it may be conditionally accepted as supporting information through the concepts of istifadah and maslahah. These findings underscore the normative flexibility of Islamic criminal law in responding to the complexities of modern evidentiary practices while maintaining principles of prudence and substantive justice.

Abstract

This condition raises a critical issue regarding the conformity of imposed sanctions with the principles of justice embedded in fiqh jinayah. This study aims to analyze criminal sanctions for murder resulting from collective assault in Decision Number 101/Pid.B/2018/PN Bau from the perspective of Islamic criminal law. This research employs a library-based qualitative approach using normative juridical methods by examining court decisions, statutory regulations, and relevant fiqh jinayah literature. The findings indicate that the sanctions imposed in the decision formally comply with the provisions of Indonesian positive criminal law. Nevertheless, they have not fully reflected the principles of hifz al nafs (protection of life), proportionality, and public interest (maslahah) as emphasized in Islamic criminal law. Therefore, integrating the values of fiqh jinayah into judicial reasoning is essential to enrich criminal sentencing practices and to promote a more just and humane system of punishment.

Abstract

This study aims to analyze the concept of had punishment for perpetrators of group theft in Islamic law based on primary sources (the Quran, Hadith, and the opinions of jurists from various schools of law), to identify differences in scholarly views regarding the criminal liability of each member of the group, and to assess the relevance and challenges of its application within the context of contemporary law. This article constitutes library research employing a qualitative approach with a descriptive-analytical methodology. The findings indicate that there are significant differences among Islamic legal schools in determining the had punishment for group theft. Some scholars argue that the punishment of hand amputation applies to all group members if all are directly involved and the legal requirements are fulfilled. Others, however, distinguish between the principal offender (muqtarin) and accomplices, while also considering elements such as coercion or lack of knowledge. The study further reveals that, in the contemporary context, the enforcement of had punishment for group theft is often associated with the principles of syubhat (legal doubt), restorative approaches, and human rights protection, thereby necessitating adaptive ijtihad without neglecting the principles of justice and the objectives of Islamic law (maqashid al-shariah).

Abstract

This study aims to analyze and formulate a legal education–based drug abuse prevention model in Riwo Village, Dompu Regency, and to assess its implications for enhancing community legal awareness. This research employs field research with a qualitative socio-legal approach, utilizing in-depth interviews, observation, and document analysis. The findings indicate that a participatory and community-based legal education model effectively improves legal literacy, fosters internally driven legal compliance, and strengthens the role of local actors in drug abuse prevention. This model offers a more humanistic, contextual, and sustainable preventive approach for the development of village-level drug prevention policies.
