Abstract

This research is conducted with the aim of analyzing the criminal liability of parents without custodial rights who abduct a child from the parent holding legal custody. The analysis considers whether the biological relationship between parents and children can eliminate criminal liability, as well as how the applicable legal provisions in Indonesia regulate such acts. This study employs a normative legal research method by examining primary and secondary legal materials, which are then systematically analyzed to obtain an understanding of the regulation and application of law regarding child abduction committed by parents without custodial rights. The results of the research indicate that although parents without custodial rights have a biological relationship with the child, if they abduct the child from the custodial parent, the perpetrators remain subject to criminal sanctions because their actions fulfill the elements of a criminal offense. This research also emphasizes the importance of ensuring the best interests of the child as well as legal certainty for parents who lawfully hold child custody.

Abstract

This study aims to analyze the implementation of social rehabilitation for drug abusers in the Class IIA Narcotics Correctional Institution, Bangli Regency. The research background stems from the need to understand how social rehabilitation is implemented within the correctional system, considering that drug abusers require not only legal guidance but also physical, mental, and social recovery to return to optimal functioning in society. This study employed an empirical research method with a qualitative approach. Data collection included field observations, interviews with correctional officers, addiction counselors, and inmates, and document analysis related to the implementation of the rehabilitation program. This research also focused on understanding how social rehabilitation is designed to support the recovery of drug abuse inmates and how it aligns with applicable regulations within the correctional system and drug prevention policies. The results of this analysis are expected to contribute to the development of social rehabilitation concepts and practices in correctional settings, as well as provide input for relevant parties in improving the quality of rehabilitation services for drug abusers.

Abstract

This study aims to comparatively analyze the normative construction, requirements for application, and implementation challenges of rechterlijk pardon in the Netherlands and Indonesia within the civil law system. The focus of the study is directed at comparing Article 9a of the Dutch Wetboek van Strafrecht and Article 54 paragraph (2) of Law Number 1 of 2023 on the Indonesian Criminal Code (KUHP), as well as identifying the objective parameters developed through the jurisprudence of the Hoge Raad. This article constitutes a qualitative library-based research. The methodology employed is normative juridical research with comparative, conceptual, and philosophical approaches. The findings indicate that the Netherlands has consistently implemented rechterlijk pardon through strict cumulative requirements and measurable objective parameters. In contrast, the regulation of judicial pardon under the 2023 Criminal Code remains general and ambiguous, and lacks technical guidelines, thereby potentially creating legal uncertainty and the risk of abuse of power.

Abstract

This study aims to analyze the patterns of handling online fraud crimes through digital evidence at the Surakarta Police and to assess their conformity from the perspectives of Indonesia’s positive law and Islamic criminal law. This research employs field research complemented by library research, using a qualitative approach with a juridical-empirical and normative-comparative method. The findings indicate that the use of digital evidence in investigative practices has largely complied with the Indonesian Criminal Procedure Code and the Electronic Information and Transactions Law, although it remains constrained by technical verification issues and the maintenance of the chain of custody. From the perspective of Islamic criminal law, digital evidence may be positioned as qarinah that possesses evidentiary value insofar as it fulfills the principles of al-bayyinah. This study demonstrates the normative convergence between positive law and Islamic law in strengthening a substantively just model of criminal proof in the digital era.

Abstract

This study aims to critically analyze judicial legal reasoning at various levels of adjudication, including district court, high court, cassation, and judicial review by the Supreme Court, in interpreting the legal protection of minority shareholders affected by share dilution. This research employs a normative legal method with a qualitative approach, relying on the analysis of court decisions, statutory regulations, and corporate law doctrines. The findings indicate that although Article 62 of the Indonesian Company Law constitutes an imperative norm oriented toward substantive protection, its application in the judicial review decision tends to be formalistic and disregards power imbalances inherent in corporate ownership structures. Such an approach ultimately weakens legal certainty and undermines minority investor protection within Indonesia’s corporate legal system.

Abstract

This study aims to examine the implementation of the death penalty in Indonesia and the time limit for carrying out executions under Law No. 1 of 2023, as well as to analyze the perspective of Islamic criminal law on the death penalty in Indonesia. This article constitutes qualitative library research. The methodology employed is a normative juridical study using conceptual and comparative approaches. The findings indicate that prior to the execution of the death penalty, several legal remedies are available in Indonesia, namely appeal, cassation, judicial review, and the submission of clemency to the President. Furthermore, the execution of the death penalty must be carried out within a maximum period of one year after the rejection of clemency. The study suggests the need for regulatory reform concerning the time limit for implementing the death penalty in Indonesia, including amendments to the Law on Clemency, considering that Islamic criminal law likewise does not stipulate a specific time limit for the execution of the death penalty, similar to the Indonesian criminal law system.

Abstract

This study aims to analyze the forms of legal protection for copyright in cover songs in the digital era based on Law Number 28 of 2014 on Copyright, as well as to assess the effectiveness of its implementation. This research employs normative legal research with a qualitative approach, using statutory, conceptual, and case approaches. The primary legal materials consist of copyright-related legislation, while secondary materials include legal literature and scholarly journals. The findings indicate that the Copyright Law has normatively provided protection through civil, criminal, and administrative mechanisms; however, its implementation remains constrained by structural, cultural, and technological challenges. Therefore, strengthening law enforcement, optimizing digital licensing systems, and enhancing the active role of digital platforms are essential to ensure fair and sustainable copyright protection.

Abstract

This research aims to analyze the legitimacy and position of the justice collaborator within the Indonesian criminal justice system and to assess its compatibility with the principles of Islamic criminal law. The method used in this research is a normative juridical approach with statutory and conceptual approaches. The research data were obtained through a literature study of primary legal materials in the form of legislation, the Supreme Court Circular Letter Number 4 of 2011, as well as Islamic legal sources such as the Qur’an, Hadith, and literature on fiqh jinayah. The results of the study indicate that the regulation of justice collaborators in Indonesian positive law provides legal protection and recognition in the form of sentence reductions for perpetrators who cooperate in revealing crimes. From the perspective of Islamic criminal law, this concept can, in principle, be accepted through the approach of tahfif al-‘uqubah (mitigation of punishment), taubat nasuha (sincere repentance), and considerations of public benefit (maslahah mursalah). This research finds a point of convergence between national law and Islamic law, particularly in efforts to realize substantive justice and the protection of public interests.

Abstract

This study aims to analyze the relevance of progressive legal theory in the reform of Indonesia’s criminal justice system from normative, philosophical, and legal policy perspectives. This research employs a qualitative library-based method using a juridical-normative and conceptual approach to examine progressive legal theory and its implications for criminal justice practices. The findings indicate that progressive legal theory has strong relevance as a framework for criminal justice reform, as it emphasizes substantive justice, contextual legal reasoning, and a human-centered orientation. Consequently, progressive legal theory offers a normative and philosophical foundation for promoting a more responsive, humane, and just criminal justice system in Indonesia.

Abstract

This study aims to analyze the implementation of qanun in regulating street vendors in Aceh by highlighting the gap between normative regulatory frameworks and their practical implementation, as well as the potential emergence of indirect criminalization of informal trading activities. This research constitutes field-based research employing a qualitative approach with a socio-legal (juridical-empirical) method. Primary data were obtained through interviews with officials of the Satuan Polisi Pamong Praja, the Department of Industry, Trade, and SMEs, street vendors, and community leaders in Lhokseumawe City and East Aceh Regency, complemented by field observations. Secondary data were derived from relevant qanun regulations as well as related academic literature. The findings indicate that although the Qanun of Lhokseumawe City No. 1 of 2014 and the Qanun of East Aceh Regency No. 11 of 2014 normatively regulate the management and empowerment of street vendors, their implementation continues to face several challenges, including limited business facilities, varying levels of vendor compliance, and inconsistencies in law enforcement. These conditions potentially give rise to indirect criminalization, whereby regulatory enforcement indirectly places street vendors in a vulnerable position to legal sanctions without the provision of adequate alternative trading spaces.
