Abstract

This research examines the indifferent behavior of users of priority seats on the Electric Commuter Train in Jakarta. This deviant behavior occurs during the commuting hours, both in the morning and evening. This research was examined using qualitative research methodology and a case study approach. In this study, it was found that KRL passengers choose to ride the KRL so they can sit and rest during the journey on the KRL. The irony is that on every seat occupied in the KRL, there is an appeal to give up their seat for those who are classified as priority. Meanwhile, those who have already gotten a seat choose to be indifferent, either by sleeping or covering their ears with headphones while watching their phones or playing games during the journey. With that behavior, they hope not to have to bother giving up their seats to priority users during the journey. Our analysis of that behavior concluded that it is not in line with the ethical system that applies in the KRL. This occurs due to the low legal awareness of KRL users regarding the applicable norms. Likewise, the background of religious, social, and moral education plays an important role in the existence of such indifferent behavior. The existence of such indifferent behavior falls into the category of a modern humanitarian problem that is highly capitalistic. Degrading the value of humans in Islam as khalifatullah, because they are unable to make Allah the primary object of worship in every activity, especially by giving priority to those who are more deserving.

Abstract

This article critically analyzes Islamic family law reforms with a focus on the legal corpus and its classification. The main aim of this research is to explore the reasons behind efforts to reform Islamic family law and to identify gaps that exist in the legal context. The core issues examined include the differences between traditional Islamic family law and current reform efforts, as well as the relevance and social implications of these changes in an increasingly modern society. The research methodology used includes analysis of legal documents, comparative studies between Islamic family law systems in various countries, and a review of the views of experts and relevant stakeholders. The findings of this research highlight the complexity in implementing Islamic family law reform, both in terms of theory and practice. The conclusion of this article emphasizes the importance of a holistic and inclusive approach in designing Islamic family law reform that can accommodate various views and social and legal needs in modern society.

Abstract

The revitalization of customary law is an effort to integrate traditional values with modernity in sustainable environmental management. Customary law plays a crucial role in maintaining ecosystem balance and ensuring the sustainability of natural resources through principles rooted in local wisdom. However, exploitative economic development and growth-oriented policies often overlook its significance. This study analyzes the challenges, causes, and solutions in revitalizing customary law to create synergy between tradition and modernity. A qualitative approach is employed through in-depth interviews, field observations, and focus group discussions (FGDs) to assess its effectiveness in environmental conservation. The findings indicate that the revitalization of customary law can enhance the effectiveness of natural resource management, strengthen the rights of Indigenous communities, and mitigate conflicts between economic and environmental interests. Integrating customary law into national and international policies, raising public awareness, and fostering cross-sector collaboration are strategic steps to optimize its role in maintaining ecological and economic balance.

Abstract

This study examines the governance design of the Nusantara Capital Authority (Otorita Ibu Kota Nusantara), as established in Law No. 21 of 2023 amending Law No. 3 of 2023 concerning the Capital City of the State. The objective of this research is to assess whether the governance design of the Nusantara Capital Authority aligns with the principles of regional autonomy and to propose a future governance concept for the Nusantara Capital Authority. This research adopts a normative juridical approach, using statutory and conceptual methods, and utilizes secondary data consisting of primary, secondary, and tertiary legal materials. The findings indicate that the governance structure established under the IKN Law does not conform to the principle of regional autonomy, and as such, the Nusantara Capital Authority cannot be classified as a special regional government. The Nusantara Capital Authority does not possess the independent authority to manage its governmental affairs, as in the case of autonomous regions. Based on these findings, the author proposes a governance design for the Nusantara Capital Authority as an administrative area with the status of a Special Zone, which would exercise authority in the preparation, development, and relocation of the Capital City. Therefore, the recent amendments to the IKN Law have not altered the governance design of the Nusantara Capital Authority, which continues to maintain its status as a special region, despite not being in line with the principle of regional autonomy. Penelitian ini mengkaji desain tata kelola Otorita Ibu Kota Nusantara (Otorita Ibu Kota Nusantara), sebagaimana ditetapkan dalam UU No. 21 Tahun 2023 yang mengubah UU No. 3 Tahun 2023 tentang Ibu Kota Negara. Tujuan dari penelitian ini adalah untuk menilai apakah desain tata kelola Otorita Ibu Kota Nusantara telah sesuai dengan prinsip-prinsip otonomi daerah dan untuk mengusulkan konsep tata kelola Otorita Ibu Kota Nusantara di masa depan. Penelitian ini menggunakan pendekatan yuridis normatif, dengan menggunakan metode perundang-undangan dan konseptual, serta menggunakan data sekunder yang terdiri dari bahan hukum primer, sekunder, dan tersier. Hasil penelitian menunjukkan bahwa struktur pemerintahan yang dibentuk berdasarkan UU IKN tidak sesuai dengan prinsip otonomi daerah, sehingga Otoritas Jasa Keuangan tidak dapat diklasifikasikan sebagai pemerintah daerah khusus. Otoritas Modal Nusantara tidak memiliki kewenangan yang mandiri untuk mengelola urusan pemerintahannya, seperti halnya daerah otonom. Berdasarkan temuan ini, penulis mengusulkan desain tata kelola Otoritas Ibu Kota Nusantara sebagai wilayah administratif berstatus Kawasan Khusus, yang akan menjalankan kewenangan dalam penyiapan, pembangunan, dan pemindahan Ibu Kota. Oleh karena itu, amandemen UU IKN yang dilakukan baru-baru ini tidak mengubah desain tata kelola Otoritas Ibu Kota Nusantara, yang tetap mempertahankan statusnya sebagai kawasan khusus, meskipun tidak sejalan dengan prinsip otonomi daerah.

Abstract

Kompilasi Hukum Islam (KHI) merupakan pembaruan fiqih yang dimulai 23 tahun lalu, dengan norma-norma yang lebih progresif dibandingkan dengan fiqih klasik. Salah satu contohnya adalah Pasal 173 tentang Penghalang Warisan, yang mencakup percobaan pembunuhan, penganiayaan berat, dan fitnah ahli waris—norma yang tidak ditemukan dalam literatur fikih klasik. Artikel ini bertujuan untuk menganalisis tanggapan ulama dayah di Aceh terhadap perluasan norma fikih dalam KHI, terutama dalam hal penghalang warisan. Penelitian ini menggunakan metode kualitatif melalui wawancara dan studi dokumentasi. Hasil penelitian menunjukkan bahwa ulama dayah di Aceh memiliki pandangan yang beragam. Beberapa mendukung peran pemerintah dalam memperluas norma hukum selama tidak bertentangan dengan syariat, sedangkan lainnya lebih konservatif, mempertahankan kesetiaan pada fikih klasik. Beberapa ulama menggunakan qiyas untuk menyesuaikan hukum dengan zaman, sementara kelompok konservatif-modernis berupaya menyeimbangkan tradisi dengan tuntutan modernitas. Ulama tradisionalis menolak perluasan hukum yang dianggap bertentangan dengan mazhab. Kesimpulannya, meskipun ada perbedaan, mereka sepakat bahwa perluasan norma harus mematuhi prinsip-prinsip syariah dan mempertimbangkan relevansi dengan zaman.

Abstract

Eating and drinking are routine human activities, thus requiring various regulations related to these problems. Allah commands us to eat halal (halalan) and good (thayyiban) food so as not to harm our bodies. Aceh has issued a special regulation to provide protection to the public regarding the products consumed, namely Qanun Number 8 of 2016 concerning the Halal Product Guarantee System, known as Qanun SJPH. This paper wants to find a clear picture of the arrangement and supervision of halal products in Aceh from the Perspective of Qanun Number 8 of 2016 concerning the Halal Product Guarantee System. This research is a qualitative research with a normative juridical approach. All data that has been collected was analyzed using the content analysis method. The result of the research is that the SJPH Qanun has provided a clear description of the guarantee of halal products in Aceh. This regulation of SJPH is a form of responsibility of the Government of Aceh in providing legal protection for Muslims in particular and all Acehnese people in general, regardless of religious origin and certain groups. The main regulatory object is related to halal products, besides that it is also important related to products that meet hygienic standards. Halal product guarantees are regulated in qanuns with a very systematic system of arrangement, supervision and implementation of arrangement and supervision of product distribution in Aceh. The substance of the qanun is very comprehensive regarding guarantees for halal products in the aspects of production, distribution and consumption. Qanun regulates from arrangement, supervision to the provisions of 'uqubat for perpetrators of violations. Arrangement of halal products is carried out starting from raw materials to marketing of halal products, namely products that are labeled halal and/or have received halal certificates from authorized institutions. Furthermore, supervision is carried out from the origin of raw materials, production processes and production facilities on processed animal and/or vegetable products, medicines and cosmetics. The implementation of arrangement and supervision of halal products is the responsibility of LPPOM MPU Aceh and LPPOM can involve an integrated team from cross-agency related to SJPH.

Abstract

This article delves into and elucidates the framework of Qodri Azizy's Islamic legal thought as a prominent Muslim intellectual in Indonesia. His contemplations on eclecticism are deemed crucial in the context of national legal development, emerging from specific situations and contexts. The analysis employs normative and hermeneutical approaches, encompassing significant works such as "Ikhtilaf in Islamic Law" and "Reformasi Bermazhab". The idea of eclecticism in Islamic law is understood through Fazlur Rahman's hermeneutics of the double movement. Qodri's thoughts are influenced by his educational environment in the United States, particularly regarding the concepts of ikhtilaf, madhhab, and talfiq. His critique of scholars who neglect the historical understanding of Islamic law results in a perception of legal opinions as unalterable dogma. Qodri asserts that legal opinions from past scholars result from a dialectical process and interaction of ideas, emphasizing their relative nature. In the modern context, Qodri's views remain relevant as he underscores that legal truth is relative, and a process of mutual enrichment (eclecticism) occurs, where seemingly strong opinions are supported by weaker ones.
