Abstract

Jurnal ini bertujuan menjelaskan tentang tafsir mubadalah dalamhal poligami. Data utama terdiri dari buku Faqihuddin Abdul Kadir berjudul Qira’ah Mubadalah, buku-buku berkaitan dengan poligami, karya ilmiah berupa tesis, jurnal, artikel, skripsi, dan bahan pendukung lainnya. Hasil dari artikel ini bahwa mubadalah memiliki pandangan terkait poligami, bahwa pandangan mubadalah terkait poligami ialah: (1) Poligami bukanlah solusi dalam relasi pasangan suami istri, melainkan problem yang akan sering mendatangkan kemudharatan. Perempuan mempunyai hak mutlak untuk menolak poligami dengan alasan menghindari dari kerusakan dan mudharat yang akan terjadi pada dirinya atau keluarganya. (2) Perempuan tidak berhak melarang suaminya untuk berpoligami akan tetapi dia mempunyai hak cerai jika dia tidak terima untuk dipoligami, untuk kehidupan yang layak dan bahagia.

Abstract

When there is a default committed by the customer, the Islamic Bank can carry out parate execution of the object of mortgage rights used as collateral by the customer through the auction system. The customer often fights against the execution by submitting a fight against execution to the Religious Court, but the contract between the customer and the Islamic Bank which includes a dispute resolution clause through BASYARNAS raises legal certainty issues. The purpose of this research is to find out the authority of the Religious Court in adjudicating cases of resistance to execution even though there is a dispute resolution clause through BASYARNAS in the Deed of Financing Agreement. The method used in this research is a descriptive qualitative method with a conceptual approach and normative approach. Based on the results of the study, it shows that the Religious Court is still authorized to examine, hear and decide disputes against the execution of mortgage rights with a contract containing a dispute resolution clause through BASYARNAS, although article 3 and article 11 of Law Number 30 of 1999 concerning Arbitration and Alternative Dispute Resolution limit the authority of the Religious Court but BASYARNAS as an arbitration institution does not have the authority to resolve disputes against execution, so that the Religious Court, which has free authority and may not refuse to examine, hear and decide a case because the legal basis for the authority of the dispute is unclear as stipulated in Article 10 of Law Number 48 of 2009 concerning Judicial Power, is still authorized to examine, hear and decide cases.

Abstract

The study aims to identify waqf issues in Lampung and South Sumatra Provinces and explore potential solutions to develop a national waqf ecosystem that is more responsive to the development of time. This research employed empirical juridical research. The primary data was gathered through observations, interviews, and documentation with waqif (donors), nadzir (the administrators of Waqf), public figures, academics, and BWI (Indonesian Waqf Institution) of Lampung and South Sumatra. The secondary data were gathered from books, laws and regulations, judicial decisions, scientific journals, and websites. This study discovered that the challenges of Waqf in Lampung and South Sumatra Provinces comprised aspects of management and supervision, a lack of socialization and literacy, waqf fraud, and insufficient nadzir (donors) resources for creating profitable Waqf and waqf digitization. The solution is to enhance the national waqf ecosystem by reforming waqf laws to strengthen waqif, nadzir, and BWI. With the renewal of waqf law, a positive ecosystem will emerge, reducing waqf disputes and improving people's well-being.

Abstract

This study examines the governance design of the Nusantara Capital Authority (Otorita Ibu Kota Nusantara), as established in Law No. 21 of 2023 amending Law No. 3 of 2023 concerning the Capital City of the State. The objective of this research is to assess whether the governance design of the Nusantara Capital Authority aligns with the principles of regional autonomy and to propose a future governance concept for the Nusantara Capital Authority. This research adopts a normative juridical approach, using statutory and conceptual methods, and utilizes secondary data consisting of primary, secondary, and tertiary legal materials. The findings indicate that the governance structure established under the IKN Law does not conform to the principle of regional autonomy, and as such, the Nusantara Capital Authority cannot be classified as a special regional government. The Nusantara Capital Authority does not possess the independent authority to manage its governmental affairs, as in the case of autonomous regions. Based on these findings, the author proposes a governance design for the Nusantara Capital Authority as an administrative area with the status of a Special Zone, which would exercise authority in the preparation, development, and relocation of the Capital City. Therefore, the recent amendments to the IKN Law have not altered the governance design of the Nusantara Capital Authority, which continues to maintain its status as a special region, despite not being in line with the principle of regional autonomy. Penelitian ini mengkaji desain tata kelola Otorita Ibu Kota Nusantara (Otorita Ibu Kota Nusantara), sebagaimana ditetapkan dalam UU No. 21 Tahun 2023 yang mengubah UU No. 3 Tahun 2023 tentang Ibu Kota Negara. Tujuan dari penelitian ini adalah untuk menilai apakah desain tata kelola Otorita Ibu Kota Nusantara telah sesuai dengan prinsip-prinsip otonomi daerah dan untuk mengusulkan konsep tata kelola Otorita Ibu Kota Nusantara di masa depan. Penelitian ini menggunakan pendekatan yuridis normatif, dengan menggunakan metode perundang-undangan dan konseptual, serta menggunakan data sekunder yang terdiri dari bahan hukum primer, sekunder, dan tersier. Hasil penelitian menunjukkan bahwa struktur pemerintahan yang dibentuk berdasarkan UU IKN tidak sesuai dengan prinsip otonomi daerah, sehingga Otoritas Jasa Keuangan tidak dapat diklasifikasikan sebagai pemerintah daerah khusus. Otoritas Modal Nusantara tidak memiliki kewenangan yang mandiri untuk mengelola urusan pemerintahannya, seperti halnya daerah otonom. Berdasarkan temuan ini, penulis mengusulkan desain tata kelola Otoritas Ibu Kota Nusantara sebagai wilayah administratif berstatus Kawasan Khusus, yang akan menjalankan kewenangan dalam penyiapan, pembangunan, dan pemindahan Ibu Kota. Oleh karena itu, amandemen UU IKN yang dilakukan baru-baru ini tidak mengubah desain tata kelola Otoritas Ibu Kota Nusantara, yang tetap mempertahankan statusnya sebagai kawasan khusus, meskipun tidak sejalan dengan prinsip otonomi daerah.

Abstract

This study aims to provide a constitutional critique of the implementation of qanun in Aceh from the perspectives of the constitution and gender. During its formulation process, the community expressed a desire for Sharia values to be incorporated into the qanun governing the lives of Acehnese people. However, its implementation has the potential to restrict women's rights. This study also seeks to contribute to the reformulation of laws that are fair for all. A qualitative approach is employed in this study, with data collected from library research to analyze constitutional and gender critiques of the implementation of Aceh's qanun. From a constitutional perspective, the study finds that the implementation of Aceh's qanun is not entirely aligned with the national constitution, human rights, and the principles of a unitary state. Although Aceh has special autonomy to implement Islamic law, its enforcement must not contradict the principles of equality before the law, freedom of religion, and the protection of human rights. From a gender perspective, while the qanun aims to uphold Islamic values and establish a well-ordered social structure, its implementation often fails to align with gender justice principles, as it restricts women's rights. To achieve justice for all members of society, it is essential to reassess the application of Aceh’s qanun and ensure women's participation in the decision-making process, so that the resulting policies genuinely reflect the needs and rights of all citizens.

Abstract

This study aims to analyze the legal basis for the judge's considerations in deciding the case 1145/Pdt.G/2012/PA JS according to the Law and then will be analyzed using Islamic law against the judge's considerations in deciding the case 1145/Pdt.G/2012/PA JS. This study is a type of library research, this study is descriptive analytical, the primary data in this study is Law Number 1 of 1974 concerning marriage and the Compilation of Islamic Law. Using the Maslahah Mursalah Theory, data analysis in this study uses deductive thinking techniques, then the author makes data analysis with qualitative analysis. The results of the study are that the judge's considerations in deciding the case 1145/Pdt, G/2012/PA JS are Law Number 1 of 1974 Article 41 letter (c) which reads: the consequences of a marriage breaking up due to divorce are that the court can require the ex-husband to provide living expenses and/or determine an obligation for the ex-wife. The regulation in Article 149 letter (b) of the KHI only mentions the obligation of the ex-husband to provide iddah, kiswah, mut'ah and hadanah costs for his children after a divorce due to talak. Textually, divorce in the Article contains the meaning of divorce in general, so it can be interpreted that the religious court has the right to require the ex-husband to provide living costs and determine an obligation for the ex-wife due to divorce due to talak or due to a lawsuit. The analysis of Islamic law on the provision of living costs according to maslahah al-mursalah is to provide iddah, kiswah, and mut'ah living costs according to his ability as long as the wife who filed for a lawsuit divorce is not nusyuz, then as long as she has the right to receive living costs as a consolation and guarantor of her life for her own benefit so as to lighten the burden of her life. This aims to maintain the soul (al-nafs) of the ex-wife so that she gets benefit and aims to reject harm. This is in accordance with the theory of maslahah murlah, namely creating good benefits in social life, the household and even after divorce and rejecting all harm which ultimately makes the order damaged so that someone is harmed.

Abstract

This article examines family conflicts and their resolution based on the local wisdom of Lampung customs, including Pepadun and Saibatin. Because every household is always faced with conflicts, whether mild, moderate or severe, which can lead to household breakdown and social harmonization. Communities that still apply customary values in conflict resolution include Tanggamus and Way Kanan districts. The method used is qualitative, the type of research includes field research conducted in the indigenous Lampung Saibatin community in Tanggamus and Pepadun in Way Kanan. The approach used is ethnography and mubādalah approach. Primary data sources were obtained from Lampung traditional leaders in the two regions. This research found that conflict resolution is based on local wisdom by upholding the philosophy of life piil pesenggiri which priorities deliberation mechanisms, extended family support and conflict resolution offers. Lampung traditional local wisdom is in line with the principle of mubādalah because it provides guidance for family members in carrying out their roles by cooperating with each other, respecting each other and sharing roles for the welfare of the family that contributes to household harmony and divorce prevention.

Abstract

An agreement is a deal made between somebody or some person with somebody or other people to do a deed certain. If this observed, that the agreement made by the two parties will basically give rise to a right on the one hand, and an obligation on the other. This is closely related to the existing legal aspect. So that is in law if something deed has influence or consequence which related to a law called with deed law (including agreement). Abstract

The Formation of Regional Regulations in Indonesia, including in Lampung Province, is an integral part of the government's efforts to regulate community life effectively and efficiently. Islamic legal values have become an important factor influencing the formation of regional regulations (Perda). Lampung Province, one of Indonesia's regions rich in cultural and religious diversity, demonstrates significant adoption of Islamic legal aspects in various local regulations. This research is a normative legal study based on literature with a legislative approach and legal interpretation analysis. The data analysis method used is content analysis. The results show that Islamic law significantly influences the formation of regional regulations in Lampung Province. This is reflected in several regional regulations that adopt Islamic law principles in various aspects of community life. The internalization of Islamic legal values in these regional regulations is concrete evidence of the adaptation and harmonization between Islamic law and the national legal context in Indonesia. This research implies the importance of considering religious aspects in formulating regional legal policies to achieve social justice and harmony among communities with various backgrounds and beliefs.
