Abstract

Kedudukan Lembaga Negara yang dibentuk Undang-Undang merupakan lembaga Negara pendukung yang menjalankan tugasnya berdasarkan Undang-Undang, namun dalam sengketa kewenangan lembaga Negara, lembaga Negara tersebut dibatasi oleh Undang-Undang Dasar khususnya Pasal 24 C. Terkait legal standing lembaga Negara yang dibentuk Undang-Undang dapat bersengketa dengan lembaga Negara lainnya sepanjang subjectum litis dan objectum litis memiliki nilai kepentingan konstitusionalnya. Adapun kedudukan Peraturan Mahkamah Konstitusi Nomor 8/PMK/2006 sebagai tindak lanjut dari Hukum Acara sengketa kewenangan lembaga Negara yang diatur dalam Undang-Undang Nomor 24 Tahun 2003, namun terkait sengketa kewenangan lembaga Negara, lembaga yang dibentuk Undang-Undang masih dibatasi berdasarkan lembaga Negara yang dapat beracara hanya lembaga Negara yang kewenangannya dibentuk oleh Undang-Undang Dasar Negara Kesatuan Republik Indonesia Tahun 1945

Abstract

Recognition of the traditional rights of the community, such as the implementation of traditional and cultural life which differs from one region to another, is the glue of the Unitary State of the Republic of Indonesia. One of them is the customs and culture that exist in society in Aceh, namely Langgeh Rights. Langgeh rights are former rights, namely the right of one person is more important than others, to get the opportunity to buy the neighbor's land at the same price. Langgeh rights can be given to the closest person to the seller, namely, relatives of the seller, other members of customary law, or neighbors whose land is directly sold with the land to be sold. Langgeh rights aim to prevent the land from being purchased by foreigners from outside the customary law community. In practice, the settlement of disputes over the rights of langgeh (syuf'ah) in Aceh almost entirely cannot be resolved through the Syari'ah Court, but will be resolved in the gampong customary court, this is because the Acehnese are a society that upholds the Shari'ah who expect peace. They do not expect mutual hostility, so the outcome of the customary justice process is peace.

Abstract

Covid-19 has greatly affected several sectors, one of which is the economy andhealth in every country, as well as the Indonesian state which has experienced atremendous impact since the beginning of the Corona Virus in early March 2020,so the government has set a policy of credit relaxation for MSME actors who haveloan funds. which makes the bank experiencing problems with bad loans or NonPerforming Loans (NPL) so that it affects the level of bank liquidity which causesbetween debtors and creditors to experience instability. 8 of 1999 concerningProtection of debtors and efforts to settle bad loans.

Abstract

ABSTRAK Ketentuan Presiden harus meminta Pertimbangan DPR dalam hal pemberian peniadaan proses hukum (Amnesti) dan pengampunan tuntutan hukum (Abolisi) perlu untuk dipertimbangkan kembali, hal ini di dasari dengan landasan pemikiran bahwa DPR sebagai lembaga Politik tentu saja paradigma yang dibangun adalah paradigma politik, padahal pada konsepnya proses pemberian amnesti dan abolisi adalah masuk dalam ranah state policy of law.. Tujuan penelitian ini adalah untuk mengetahui dan menganalisis tentang pelaksanaan pemberian Amnesti dan Abolisi sebelum  amandemen dan sesudah amandemen UUD 1945, dan  menganalisis konsep pelaksanaan pemberian Amnesti dan Abolisi yang ideal dalam kerangka penguatan UUD 1945. Penelitian ini menggunakan jenis Penelitian normatif. Penelitian ini mengunakan pendekatan, pendekatan undang-undang (statue approach), pendekatan sejarah (historical approach), dan pendekatan konseptual (conceptual approach). Hasil Penelitian ini menunjukan Bahwa aktulialisasi pemberian amnesti dan abolisi sebelum  amandemen dan sesudah amandemen UUD 1945 terdapat perbedaan, yaitu berubahnya ketentuan pasal 14 UUD 1945. Rancangan awal dari pasal 14 UUD 1945 hanya terdapat dalam satu pasal saja dan tidak diturunkan kedalam dua ayat seperti saat ini, dimana antara Grasi, Reabilitasi, Amnesti, dan Abolisi tergabung dalam satu pasal yang sama dan core konsultasi Presiden dalam memberikan keputusan Amnesti, dan Abolisi adalah ke Mahkamah Agung, sedangkan setelah amandemen terhadap UUD 1945 core konsultasi  Presiden dalam memberikan keputusan Amnesti, dan Abolisi adalah ke DPR. Bahwa konsep pelaksanaan pemberian amnesti dan abolisi yang ideal dalam kerangka penguatan UUD 1945 adalah dengan melakukan amandemen terhadap pasal 14 UUD 1945 melalui amandemen ke-lima dengan mengembalikan kedudukan Mahkamah Agung sebagai core pemberi “pertimbangan” kepada Presiden, hal ini untuk membangun keseimbangan (equilibrium) antara putusan politik dan hukum. Selanjutnya, merumuskan ketentuan turunan dari amanat pasal 14 UUD 1945  ini tersebut ke dalam satu undang-undang.

Abstract

Penelitian ini mengkaji tentang analisis pertimbangan hakim tentang talak yang di jatuhkan satu  tetapi di hitung tiga sekaligus  oleh Hakim di Mahkamah Syariyah dalam putusan nomor 28/PDT.6/2017/MS LSM. Tujuan penelitian adalah untuk mengetahui pertimbangan Hakim Mahkamah Syar’iyah dalam menjatuhkan talak satu, terhadap talak yang di ucapkan tiga oleh suami di luar Mahkamah Syar’iyah dan untuk mengetahui dampak yang terjadi di masyarakat. Metode Penelitian ini merupakan metode penelitian yuridis empiris (sosiologis) dengan pendekatan kualitatif Hasil penelitian menunjukkan bahwa Pertimbangan Hakim Mahkamah Syar’iyah dalam menjatuhkan talak satu, terhadap talak yang di ucapkan tiga oleh suami di luar Mahkamah Syar’iyah mengacu pada Undang-Undang Perkawinan Tahun 1974 sesuai dengan asas mempersukar perceraian. Dampak yang terjadi di masyarakat terhadap penjatuhan ikrar talak Satu oleh Hakim Mahkamah Syar’iyah terhadap talak yang di ucapkan tiga yang dilakukan di luar Mahkamah Syar’iyah diantaranya menjadi permasalahan yang rumit di tengah masyarakat yang mayoritas beragama Islam dan bermazhab Syafi’i karena talak yang diucap tiga sekaligus di anggap sah dan putusan ikrar talak satu oleh Mahkamah Syar’iyah tidak diakui dalam masyarakat serta menimbulkan efek bagi keluarga yang menerima putusan tersebut.

Abstract

Evidence is the most important thing in the process of proof in a criminal court. Some cases, such as cases of assault, rape / immoral to murder Visum et Repertum have absolute power in proof, because Visum et Repertum is examined not only on the outside of the victim but on the inside of the victim. Therefore, the results of the Visum et Repertum are used as authentic evidence in seeking actual material truths. The research method, this research uses normative juridical, with a conceptual approach, namely analyzing legal materials from a knowledge and practical point of view, where the result is that the strength of the results of Visum et Repertum can be used as absolute evidence in proving in the legal court process in order to uphold the truth and the fairest.

Abstract

 Women are creatures that almost all of their bodies are naked. Aurat must be covered. Covering the genitals is called clothing. This study looks at the provisions of clothing according to fiqh and Aceh qanuns. The research method is qualitative by tracing the fiqh literature and the text of the 2002 Aceh qanun. The results show that sharia does not limit the model and type of clothing to cover the genitals, but limits the conditions that must be met, as well as in the qanun. There is a correlation between fiqh and qanun for the implementation of Islamic law in the fields of faith and worship.

Abstract

Technological developments cause various developments in people's lives, one of which is in terms of lending and borrowing money. Currently, information technology-based lending and borrowing services are available based on agreements. In its implementation, it is possible for the parties not to carry out things in accordance with the agreement, causing a dispute. The purpose of this research is to study further in relation to the regulation of information technology-based lending and borrowing dispute settlements based on the provisions of laws and regulations in Indonesia and how the dispute resolution mechanism is. The research method used is the normative juridical method. The results of the study show that the regulation of technology-based lending and borrowing dispute resolution is not regulated in detail in the specific regulations, namely the Financial Services Authority Regulation Number 77/PJOK.01/2016 concerning Technology-Based Money-Lending and Borrowing Services and Bank Indonesia Regulation No.19/12/ PBI/2017 concerning the Implementation of Financial Technology. So, to determine what dispute resolution mechanisms can be done, it can refer to the legal umbrella for electronic transactions, namely Law Number 11 of 2008 concerning Information and Electronic Transactions as amended by Law Number 19 of 2016 (UU ITE). According to the Information and Electronic Transactions Law, electronic transaction dispute resolution mechanisms can be resolved through civil lawsuits, arbitration and other dispute resolution institutions.

Abstract

The arrangement on victims in the Kuhap is only stipulated in Article 98 to Article 101, the articles relate to the right of victims in demanding compensation. The mechanism taken is the merger of lawsuit cases in exchange for criminal cases. The purpose of this study is to explain the underlying importance of legal protection against victims of fraud crimes and forms of legal protection for victims of fraud crimes in the provisions of the Kuhap and RKUHAP. The research methods used in this study are: Normative type of juridical research. With a legal approach, and a conceptual approach. The victim is a party who is harmed in the occurrence of a crime so that it must get attention and service in providing protection against it. The importance of protection to create a just and peaceful society without any crime or violence. Article 133 RKUHAP is regulated on compensation for victims who state if the defendant is criminally convicted and there are victims who suffer material losses. For law enforcement officials to pay attention and prioritize justice in providing protection to victims because victims have suffered losses and mental disorders and the rule of law that has been made must be carried out and given in accordance with what has been determined.

Abstract

Restorative justice is a development of the purpose of prosecution in general that focuses on criminal acts that occur. As the purpose of the prosecution in general, that focus on retaliation for actions carried out with the aim of providing a deterrent effect for the perpetrator. Meanwhile, the purpose of prosecution based on restorative justice is to emphasize the fulfillment of the rights of each party involved with criminal acts that occur, especially realizing a sense of justice in society. In this case, the existence of restorative justice is as a concept of recovery of the parties involved to return to the original condition or resemble the original situation before the occurrence of criminal acts in society. The concept of restorative justice directly involves the perpetrator, victim, and community in accommodating the needs of the relevant parties. The policy of the State Police of the Republic of Indonesia, in general, has fulfilled the concept of restorative justice as a whole, which focuses on restoring the rights of the relevant parties in realizing a harmonious community life as usual. Similarly, with the customary judiciary found in Aceh with the existence of Qanun Aceh has also accommodated the overall concept of restorative justice to the settlement of criminal cases in the community.
