Abstract

The Indonesian Constitution stipulates in Article 28H paragraph (1) as follows: “everyone has the right to live in physical and spiritual prosperity, to live and to have a good and healthy environment, and to have the right to health services”. The principle of a prosperous life as the right of every person is further regulated in Article 9 paragraph (2) of Law Number 39 of 1999 which stipulates as follows ” everyone has the right to live in peaceful, safe, peace, happy, physical and spiritual prosperity. One aspect of supporting a prosperous life is food. Food is one of the basic human needs that must be met in order to live a prosperous life. The Indonesian state and nation really understand the urgency of food in human life so that they can live in prosperity. Based on the idea of the urgency of food in a prosperous human life, Indonesia stipulates Law No. 18 of 2002 on Food. The Indonesian state is determined to achieve the ideals of "food sovereignty" as an ideal condition that is expected to support the welfare of the Indonesian nation. The Indonesian people are determined to be sovereign in the food sector in the sense of having the ability to determine food policies that guarantee the right to food so that the Indonesian people can live in prosperity. However, in reality, the world is experiencing a food crisis at this time. The reality of the food crisis that is hitting the world at this time is one of the agendas promoted by President Joko Widodo, who serves as the G-20 Presidency, as one of the main agendas of the G-20 meeting in the months ahead. Can President Joko Widodo as the G-20 Presidency garner the agreement of G-20 countries to cooperate and work together to overcome the world food crisis as one of the main agendas of the G-20 meeting? This research uses juridical-normative research methods and other research methods that are deemed necessary and can support the success of the research. According to the author, as the G-20 Presidency, President Joko Widodo will be able to forge an agreement with G-20 member countries to work together and work together to overcome the world food crisis that is happening at this time. The reason is that all G-20 member countries and all countries in the world will be affected by the global food crisis in due time, so if they do not want to be affected by the global food crisis, all G-20 member countries and the other countries on the surface of the earth must work together to tackle the global food crisis. All G-20 member countries are advised to take concrete steps to overcome the food crisis in their respective countries as has been done by Indonesia as stated in President Joko Widodo's program.

Abstract

This study aims to determine and analyze the implementation of prisoner coaching. This research uses normative and empirical research. Normative and empirical variety research is used in this study. Normative research examines laws, ideas, and conceptions related to the problem being investigated. The field as the primary data source includes findings from interviews and observations. Which is supported by a statutory approach and an analytical approach. The results of the study indicate that the implementation of coaching has not been effective, when viewed from the understanding of the existing guidance in the detention center, there are still obstacles in the implementation of coaching, the number of inmates who are not following the capacity (over-capacity), lack of facilities and infrastructure for coaching and health services.

Abstract

Usually in a village there is only one leader. However, this does not apply in Bali, namely the Kutuh Traditional Village. Kutuh Village is led by 2 people with different functions and jobs. Between the two by calling, its leadership duality, not dualism. Leadership that is mutually beneficial and supports each other, strives together to build Kutuh village towards an advanced village. This empirical research has been ongoing since 2021 and has interviewed village officials, the indigenous people of Kutuh-Bali Village aim to find out how the synergy between the Head of the Service Village and the Head of the Traditional Village of Kutuh Village in making their village advanced by optimizing the Village Fund and even getting the title as an anti-corruption village. corruption and the richest village in Indonesia. This study draws the conclusion that the duality of leadership is harmoniously intertwined between the village head of the "perbekel" service and the traditional village head "Bendese Adat" who is worried about the trihita karana philosophy which is Balinese local wisdom. Synergy is seen at the intersection in the management of village funds. The Village Service in carrying out activities relies on customary law called written awig-awig. These intersections have an impact on the decision-making process, implementation and direct supervision by indigenous peoples in the management of village funds. So that the existence of indigenous peoples is still strongly maintained and duality continues and is proven to work in harmony according to their respective duties because their manners are the same. Thus, the existence of indigenous peoples or pakreman together with the official village both play an important role in the current framework of constitutional life, in order to realize the welfare of the community.

Abstract

Mutilation is an act that causes the victim to die by taking the life and then dismembering the victim's body. This mutilation has the aim of eliminating traces of the murder. The Criminal Code Articles 338 and 340 serve as the basis for imposing sentences for the perpetrators of the crime of mutilation, but these two articles do not regulate and explain in detail about mutilation. Because there is no regulation that specifically regulates mutilation killings, the perpetrators of mutilation are subject to the same articles as those of ordinary murder and premeditated murder. Therefore, the problem that will be discussed in this paper is how the crime of murder by mutilation is in criminal law in Indonesia. The research method used is a normative juridical method using a statutory approach and a case approach. The results of the research obtained are that the crime of murder by mutilation gets special arrangements in the legislation so that there are special differences for the perpetrators so that they can provide protection and a sense of security to the community.

Abstract

Social media, also known as social networks, is part of new media. It's clear that the interactive content in new media is very high. Social media, quoted from Wikipedia, is defined as an online media, where users can easily participate, share, and create content including blogs, social networks, wikis, forums, and virtual worlds. Blogs, social networks, and wikis are the most common forms of social media used by people around the world. Social media has a significant influence on societal changes regarding their personalities. The purpose of this research is to determine the implementation of Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Electronic Information and Transactions, the application of sanctions for social media users who harm others. This research study is normative juridical in nature as the main approach, considering that the discussion is based on legislation and legal principles applicable to issues of information technology crimes. The juridical approach is intended to conduct an assessment of the legal field, especially criminal law. Most social media users who intend to harm others in their use of social media will be ensnared by Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 on Electronic Information and Transactions (ITE Law), whether intentional or unintentional. The law should provide protection to internet users by thinking positively, having good intentions, and taking decisive action against cybercrime perpetrators. However, the legal system has not yet addressed all computer crimes through the Internet. The ITE Law is expected to provide guidelines in restricting the use of social media for the public.Top of Form

Abstract

The process of shifting the criminal justice system's case resolution process for offenses involving minor sexual assault to an outside location is known as diversion. One kind of diversion is returning money to victims of child sexual abuse; nevertheless, diversion and restitution are typically used less frequently in the criminal justice system. For this study, the following question was posed: Does law enforcement adhere to the juvenile criminal justice system when it comes to enforcing diversion and providing compensation for offenses involving sexual abuse of children? The study's technique is juridical-normative and follows the law. The study's findings show that law enforcement officers at all levels still stray from advised procedures even in the face of attempts to implement diversion within the criminal justice system. In order to make diversion mandatory during police investigations, public prosecutors' prosecutions, and judicial panel trials, rules and regulations that offer legal certainty are required.

Abstract

Intellectual Property Rights in the form of geographical indications play a role in optimizing products with local regional wisdom, so that these products have economic value that can help the local communities. One of them is through Geographical Indication-based Agrotourism. However, the realization of a geographical indication application is complicated, takes a long time and is expensive. Good planning and management programs are also needed after obtaining geographical indications. This research aims to explore geographical indication policies in Indonesia, as well as elaborating on the potential of geographical indications as a key instrument in developing agricultural tourism areas. This research uses a normative approach with analytical descriptive. The data source used is secondary data consisting of primary legal materials in the form of Law Number 20 of 2016 concerning Trademarks and Geographical Indications and secondary legal materials. This research provides an overview of the history of geographical indication regulations in Indonesia. The geographical indication policy is expected to provide legal protection for products with reputation, quality and special characteristics due to geographical factors in the region of origin. To realize geographical indication-based agrotourism, awareness is needed from all parties, both the government and the community protecting geographical indications. Good governance and careful planning need to be prioritized. It is necessary to strengthen the environment, social and culture in society to build tourism-friendly areas.   Hak Kekayaan Intelektual berupa indikasi geografis berperan dalam optimalisasi produk dengan kearifan lokal daerah sehingga memiliki nilai ekonomi yang dapat memajukan kesejahteraan masyarakat setempat. Salah satunya melalui Agrowisata berbasis Indikasi Geografis. Namun realiasasi permohonan indikasi geografis ini rumit, membutuhkan waktu lama, dan mahal. Perencanaan dan program pengelolaan yang baik juga diperlukan pasca perolehan indikasi geografis. Penelitian ini bertujuan untuk menggali terkait kebijakan indikasi geografis di Indonesia, serta mengelaborasi potensi indikasi geografis sebagai instrumen kunci dalam pengembangan kawasan wisata pertanian. Penelitian ini menggunakan pendekatan normatif yang bersifat deskriptif analitis. Sumber data yang digunakan adalah data sekunder yang terdiri dari bahan hukum primer berupa Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis dan bahan hukum sekunder. Penelitian ini memberikan gambaran mengenai historis pengaturan indikasi geografis di Indonesia. Kebijakan indikasi geografis diharapkan dapat memberikan pelindungan hukum terhadap produk dengan reputasi, kualitas dan karakteristik khusus karena faktor geografis daerah asal. Untuk mewujudkannya agrowisata berbasis indikasi geografis perlu kesadaran dari semua pihak baik pemerintah maupun masyarakat pelindung indikasi geografis. Tata kelola yang baik serta perencanaan dari hulu hingga hilir yang matang perlu di prioritaskan. Abstract

Norma Pasal 462 UU No 7 Tahun 2017 menegaskan bahwa KPU tidak memiliki alasan untuk menolak putusan Bawaslu yang menjadi kewenangan Bawaslu, namun sebenarnya keputusan dan rekomendasi Bawaslu tidak sera-merta dilaksanakan KPU, karena adanya Perbedaan tafsir hukum atas UU No 7 Tahun 2017 tentang Pemilu dan dengan alasan kepentingan hukum yang lebih luas. Terdapat perbedaan/disparitas antara keputusan Bawaslu dengan pelaksanaan keputusan Bawaslu yang menjadi kewenangan KPU pada tataran praktik, sehingga sanksi administratif yang bersifat reparatoir tidak dapat dilaksanakan. Hal ini dapat mempengaruhi kualitas penegakan keadilan pemilu. Tujuan dari penelitian ini untuk menganalisis kedudukan dan kewenangan Bawaslu di Kota Bekasi dalam penanganan pelanggaran administrasi Pemilu dan menganalisis penanganan pelanggaran administrasi Pemilu terkait dengan penegakan keadilan Pemilu, sehingga dapat dijadikan sebagai solusi untuk meningkatkan efektifitas dan kualitas penanganan pelanggaran. Penelitian ini didasarkan pada beberapa teori, diantaranya: teori demokrasi yang menjelaskan bagaimana Pemilu merupakan bentuk kedaulatan rakyat, teori keadilan Pemilu, dan teori kewenangan. Hasil penelitian menyimpulkan bahwa sebanyak dua putusan pelanggaran penyelenggaraan Pemilu di Kota Bekasi hasil dari proses penanganan pelanggaran administrasi Pemilu. Sejatinya sanksi yang dijatuhkan bersifat reparatoir yakni mengembalikan kondisi semula sebelum terjadi pelanggaran. Namun, karena eksekutor pelaksana putusan tersebut ada pada kewenangan KPU, maka keputusan Bawaslu belum efektif ditindaklanjuti.

Abstract

Disinformation has become a threat to public security and order. Disinformation is a strategy to obscure information by spreading information that is deliberately false and false. Whatever the purpose of disinformation, the public will be the victims. Given its status as a threat, it requires appropriate policing measures to prevent the spread of disinformation. To counter disinformation, it is necessary to develop strategies by empowering communities to counteract disinformation when it occurs. By using the literature review method, this research will show some community empowerment policies that can be done to prevent the spread of disinformation.
