Abstract

Indonesia kaya dengan kemajemukan yang mewujudkan pluralisme Indonesia. Perbedaan keyakinan beragama menjadikan berbeda tata cara pelaksanaan perkawinan dan pencatatannya. Keabsahan perkawinan diukur berdasarkan hukum agama dan dilakukan pencatatannya. Beberapa warga masyarakat tetap melangsungkan perkawinan meskipun berbeda keimanan. Namun ada keraguan mencatatkan perkawinan beda agama tersebut. Keraguan terselesaikan dengan Pasal 35 UU Administrasi Kependudukan. Pernikahan yang tidak seiman diajukan permohonan pada pengadilan untuk mendapatkan dasar pencatatan perkawinan. Diterbitkannya SEMA No. 2 Tahun 2023 menjadikan kembali pada kebuntuan pencatatan perkawinan beda agama. Untuk itu perlu didalami apakah pluralisme Indonesia membenarkan berlangsungnya perkawinan beda agama, adakah pengaturan larangan perkawinan beda agama dalam UUPerkawinan. Pembahasan dilakukan dengan penelitian doktrinal melalui bahan hukum dengan melakukan kajian atas pluralisme agama dan juga ketentuan mengenai larangan perkawinan. Perolehan hasil penelitian bahwa pluralisme tidak membenarkan adanya perkawinan beda agama. Terdapat larangan perkawinan beda agama yang terkandung di Pasal 8 huruf (f) UU No. 1 Tahun 1974 tentang Perkawinan. Pelaksanaan perkawinan bagian dari ibadah yang harus tunduk pada tuntutan hukum agama. Hal ini bersesuaian dengan Pasal 2 ayat (1) UUPerkawinan. Tidaklah dibenarkan perkawinan beda agama. Pernikahan di luar hukum agama tidaklah dapat dilakukan pencatatan untuk mendapatkan akibat hukumnya secara hukum postif. Pasangan yang berbeda keyakinan dan bermaksud melangsungkan perkawinan haruslah mengorbankan keyakinan beragamanya dengan migrasi pada keyakinan beragama penyelenggaraan perkawinan agar menjadi seiman. Adalah salah langkah dan keliru mengambil jalan melangsungkan perkawinan berbeda agama dalam lingkup pluralisme Indonesia yang religius. Pencatatan perkawinan seharusnya ditujukan bagi perkawinan yang sah.

Abstract

The development of human life always produces new things, for Muslims these new things require legal clarity. Many of the legal needs of Muslims are not listed directly in the main sources of law, namely the Quran and hadith, so ijtihad is required to complete them. There are several ijtihad methods that can be used and known by the majority of scholars and one of them is maslahah mursalah. This article will discuss the legal basis of maslahah, various types of maslahah, the views of scholars who are pros and cons to maslahah mursalah, and the hujjah of maslahah mursalah. Maslahah mursalah as a method of law-making is widely used to produce legal products related to human benefits

Abstract

Barang bukti, yang didapatkan melalui proses penyitaan, merupakan hal yang fundamental dalam proses persidangan pidana. Namun, KUHAP belum mengatur secara spesifik tentang kedudukan barang bukti yang tidak dihadirkan dan langkah-langkah untuk mengatasi hal tersebut, padahal terhadapnya telah disita oleh penyidik. Berdasarkan penelitian hukum doktrinal ini, ditemukan bahwa Pasal 28G ayat (1) UUD RI 1945 menjamin perlindungan hukum atas harta benda, yang jika dijadikan barang bukti harus melalui penetapan penyitaan dari KPN. Terhadap barang bukti yang tidak dihadirkan, penafsiran Pasal 46 ayat (2) KUHAP menunjukkan bahwa barang bukti harus dikembalikan kepada pihak tersita, namun hal ini bertentangan dengan Pasal 181 ayat (1) KUHAP. Tindakan yang tepat adalah tidak mempertimbangkan barang bukti tersebut sesuai SK KMA No. 359 Tahun 2022, yang juga diikuti oleh beberapa putusan pengadilan. Untuk menjamin keberadaan barang bukti, melalui reformasi KUHAP nantinya, KPN harus diberi kewenangan aktif untuk memeriksa barang bukti sebelum mengeluarkan penetapan penyitaan, dan hakim harus lebih proaktif dalam persidangan, terutama dalam mengingatkan penuntut umum akan kewajibannya menghadirkan barang bukti.

Abstract

The legal framework must adapt to technological advances and environmental sustainability demands during the Society 5.0 era. This research looks at how to use the green constitution to deal with the challenges and opportunities offered by Society 5.0. The purpose of this study is to see how a green constitution can be incorporated into the legal system to ensure a balance between technological advancement and environmental protection and to see how it can impact legal policies and practices in different countries. This research uses a thorough normative analysis method of the latest literature that discusses the green constitution, environmental law, and Society 5.0. The study also includes a comparative analysis of the implementation of green constitutions in several international jurisdictions. Furthermore, the data collected from this literature research is analyzed to find relevant trends, problems, and innovative solutions. This research shows that incorporating a green constitution into the legal framework of Society 5.0 can encourage sustainable technological advancement and improve environmental protection. The study also shows that policymaking that incorporates green principles in law can improve regulatory efficiency and drive the achievement of broader sustainability goals.

nowadays marine pollution become a serious problem in the  word, especially in Indonesia including in Sukabumi that known for itas beautifull beaches such as Pelabuhan Ratu, geopark ciletuh, ujung genteng, etc. marine  marine scientists have found hamrful impact of marine pollution by plastic waste to the marine environment, ecosystem and human. there-quarter of all marine pollution in marine environment is plasctic. the situation become worse whe it come micro plastic woman have essential role to preseve the marine environment because woman have close relation to the environment

Abstract

The suspicion in cases of medical malpractice in is only slightly raised, meanwhile, there are actions by the health profession by doctors as medical personnel which have the potential to be a malpractice that can be reported by the public, but are not resolved legally because the community only has limited knowledge of science medical and because there is no form of specific legal regulations governing malpractice in Indonesia so that the occurrence of these malpractices can cause legal problems. This study aims to determine criminal liability for medical malpractice acts committed by doctors to patients in anticipating and dealing with medical malpractice problems in criminal cases. The research method used in this study is doctrinal, where the author collects material from the literature, both hardcopy and softcopy, which is related to the title of this research by using an analysis of the research object. Criminal malpractice occurs when a patient dies or is disabled and/or seriously injured as a result of actions taken by health workers who are careless or less careful in making efforts to treat patients who die or are disabled and are criminally liable as a result of medical malpractice acts committed. doctors on patients can be accounted for under Article 359 and Article 360 of the Criminal Code. In this case the health law is considered insufficient and does not clearly regulate the crime of medical malpractice. So it is necessary to regulate the crime of medical malpractice by giving birth to a new health law, namely by explicitly regulating criminal liability for medical malpractice acts by doctors against patients in Indonesia

Abstract

Cyberbullying in social media until now is a problem that has not been appropriately resolved. The presence of social media certainly has consequences in human life, including shaping cyberbullying behaviour itself. Cyberbullying is an aggressive behaviour that is carried out deliberately and repeatedly by individuals and groups using telecommunication media to harm others emotionally and psychologically so that it has an impact on the lives of individuals as victims of cyberbullying. Therefore, this study seeks to explore how to describe the dangers of bullying for students who become victims of cyberbullying. This research uses a qualitative phenomenological approach. The subjects of this study are three students who are active on social media networks and have been victims of cyberbullying. Purposive sampling techniques are used to find research subjects. Data results are analyzed using phenomenological analysis. Research shows that three of the victims have been victims of cyberbullying. Besides that, sequentially, the psychological dynamics of the third subject start with the Subject's family state, the Subject, the personality of the Subject, the Subject's daily activities, cyberbullying, the dangers of cyberbullying, and the preventive efforts of cyberbullying.

Abstract

This study has the purpose of examining and analyzing mediation efforts in resolving land ownership disputes at the Bekasi City Land Office. In addition, it also analyzes the legal protection for parties to land disputes based on the Regulation of the Minister of Agrarian Affairs and Spatial Planning Number 11 of 2016. The research method used is normative juridical research method. The normative juridical research method is a legal analysis based on legal norms, principles, and doctrines. The results showed that the application of mediation in land ownership disputes at the Bekasi City Land Office has not been effective enough. In 2017-2020, the Bekasi City Land Office was only able to resolve disputes through mediation with a limited number of cases. This is due to external and internal obstacles experienced by the section for controlling and handling land disputes. In addition, legal protection in resolving land disputes at the Bekasi City Land Office is actually not enough to provide legal protection, because the results of the mediation carried out are still not optimal. Internal and external obstacles experienced, causing repressive legal protection has not been fulfilled for the parties to the dispute.

Abstract

Brimob is a special top of Indonesian National Police Force, Brimob was trained to face special crimes using guns and other special weapon to face crimes using force. All politics is a struggle for power is violence. The reemergence in the early 1980s of terrorism motivated by a religions imperative and state-sponsored terrorist set in motion perfound changes in the nature, motivations and capabilitis of terrorist that are still unfolding. Torture is used as a strategic component of state security system to achieve board political ends thorugh the victimizaztion of individuals which serves pain of suffering, wether physical of metal, is intentionally inflicted : ‘many person, of course, harbor all sorts of radical and extreme belifts and opinion, and many of them belong to radical or even illegal of proscribed political organization. However, if they do not use violence in the pursuance of their beliefs, they cannot be considered terrorist. The willful application of force in such a way that is intentionally injurious to the person or group against whom it applied. Injury is under stood to include psychological as well as physical harm. Police use arms to protect himself and the people.

Abstract

The purpose of this study was to provide an overview of the actions of the defendant already fulfilling the elements of Article 351 paragraph (3) of the Criminal Code in the Supreme Court Decision No. 1043 K / PID / 2016 and to illustrate the basic consideration of the judge in imposing a verdict on a criminal offense charged with Article 351 paragraph (3) of the Criminal Code in the Supreme Court decision No. 1043 K / PID / 2016. The method used in this study is normative law research. Data collection methods in this study were carried out with literature study, which is a method of collecting data by searching and reviewing library materials (literature, research results, scientific magazines, scientific bulletins, scientific journals). Data collection techniques using qualitative analysis methods. The conclusion in this study is the application of material criminal law by the Panel of Judges of the Supreme Court in the case of Number 1043 K / PID / 2016 which corrected the decision of the Banjarmasin High Court Number 59 / PID / 2016 / PT.BJM, dated 13 July 2016 which strengthened the Kotabaru District Court Decision Number 64 / Pid.B/2016/PN. Ktb, dated April 27, 2016 stating that the defendant Nanang Ramli bin (late) Syamsudin was proven legally and convincingly guilty of committing a criminal act of maltreatment which resulted in the death of the victim Jumadi alias jumai bin yahya ( alm) as stipulated in Article 351 paragraph (3) the Penal Code (hereinafter referred to as the Criminal Code) is correct, it is in accordance with the Public Prosecutor's Subsidies indictment, and has been based on the facts of the trial, the evidence presented The Public Prosecutor is in the form of witness statements, evidence, post mortem, and statements of the defendant. The Panel of Judges of the Kotabaru District Court in its consideration there are still some shortcomings, especially in its subjective considerations, namely on consideration of things that are burdensome and matters that alleviate the defendant.
