Abstract

ABSTRACT Article 112 paragraph (1) and paragraph (2) Jo. Article 132 paragraph (1) of Law Number 35 of 2009 concerning Narcotics regulates the minimum criminal threat of 4 years and 5 years. The purpose of the study To analyze law enforcement against perpetrators of class I Narcotics crimes at the Rokan Hilir District Court based on the regulation; To analyze obstacles and efforts to overcome them. The research method is sociological legal research with a legislative, case and analytical approach; the research location is the Rokan Hilir District Court; population and samples from relevant sources; data sources are primary, secondary and tertiary; data collection techniques are observation, non-structural interviews and document/library studies; data analysis is qualitative with inductive conclusions. The results of the study are that law enforcement at the Rokan Hilir Court has not been implemented properly. The conclusion is First, law enforcement against perpetrators of Class I Narcotics crimes in the Court based on regulations has not been running well where judges impose sentences below the minimum threat provisions in the Article for perpetrators of methamphetamine narcotics crimes in 2022 and 2023. Second, obstacles come from legislative factors; law enforcement officers; and the community (defendants and mitigating witnesses). Efforts to overcome this are Legislative factors, namely the judge's decision provides justice, benefits and legal certainty for the wider community; apply the rules carefully and appropriately; judges apply them to defendants who meet the criteria in the Circular of the Supreme Court; The government amends Law Number 35 of 2009 concerning Narcotics because in certain circumstances it is no longer in accordance with the needs of law enforcement; Judges apply the law based on the substance of Law Number 35 of 2009 concerning Narcotics. Law enforcement factors, namely judges are more careful and do not have certain interests and are in accordance with the examination concept in implementing Letter A number 1 of the Supreme Court Circular Letter Number 02 of 2015; Public Prosecutors are more careful and thorough in preparing the indictment and avoiding certain interests and then taking legal action. Community factors, namely the defendant and mitigating sanctions tell the truth in court; the judge's consideration in imposing a light sentence is truly in accordance with the conditions of the defendant when examined in court; The defendant can present mitigating witnesses.Keywords: Methamphetamine, Judge's verdict, Rokan Hilir ABSTRAK Pasal 112 ayat (1) maupun ayat (2)  Jo. Kesimpulannya ialah Pertama, Penegakan hukum terhadap pelaku tindak pidana Narkotika Golongan I di Pengadilan tersebut berdasarkan regulasi belum berjalan dengan baik dimana hakim menjatuhkan pidana dibawah ketentuan ancaman minimum dalam Pasal tersebut bagi pelaku tindak pidana narkotika jenis shabu pada tahun 2022 dan 2023. Kedua, hambatan berasal dari faktor perundang-undangan; aparat penegak hukum; dan masyarakat (terdakwa dan saksi yang meringankan). Upaya mengatasinya ialah Faktor perundang-undangan, yaitu putusan hakim memberikan, keadilan, kemanfaatan dan kepastian hukum bagi masyarakat luas; menerapkan aturan tersebut dengan cermat dan tepat; hakim menerapkannya terhadap terdakwa yang memenuhi kriteria dalam Surat Edaran Mahkamah Agung tersebut; Pemerintah melakukan perubahan Undang–Undang Nomor 35 Tahun 2009 tentang Narkotika karena dalam keadaan tertentu tidak sesuai lagi dengan kebutuhan penegakan hukum; Hakim menerapkan hukum berlandaskan pada substani Undang-Undang Nomor 35 Tahun 2009 tentang Narkotika. Faktor aparat penegak hukum, yaitu hakim lebih cermat dan tidak punya kepentingan tertentu serta sesuai dengan konsep eksaminasi dalam menerapkan Huruf A angka 1 Surat Edaran Mahkamah Agung Nomor 02 Tahun 2015; Jaksa Penuntut Umum lebih cermat dan teliti menyusun surat dakwaan serta menghindari adanya kepentingan tertentu kemudian melakukan upaya hukum. Faktor masyarakat, yaitu terdakwa dan sanksi yang meringankan berkata jujur di persidangan; pertimbangan hakim dalam menjatuhkan vonis yang ringan memang benar-benar sesuai dengan kondisi-kondisi terdakwa saat dilakukan pemeriksaan di persidangan; Terdakwa dapat menghadirkan saksi yang meringankan.Kata Kunci: Metamfetamina, Putusan, Rokan Hilir

Abstract

ABSTRACT Article 80 paragraph (1) Jo. Paragraph (4) of Law Number 35 of 2014 concerning Amendments to Law Number 23 of 2002 concerning Child Protection Jo. Article 44 paragraph (1) of Law Number 23 of 2004 concerning the Elimination of Domestic Violence Jo. Article 351 paragraph (1) of the Criminal Code Jo. Article 356 paragraph (1) of the Criminal Code, regulates the prohibition and legal sanctions for parents who commit physical violence in the form of ordinary abuse against their children. The research method is sociological legal research, legislative and case approaches; research location Pekanbaru Police; population and samples from relevant sources; data sources are primary, secondary and tertiary; data collection techniques are observation, non-structural interviews and document studies; data analysis is qualitative; conclusion: inductive. The application of sanctions for perpetrators of physical violence against children committed by parents in the jurisdiction of the Pekanbaru Police based on the regulation has been implemented but the results have not been optimal in 2021 to 2023, as evidenced by several perpetrators not being prosecuted because there was peace between the perpetrators and victims. The obstacles are the law enforcement/government factor, the facility/facility factor and the community factor. Third, efforts to overcome these obstacles are Against the law enforcement/government factor, namely increasing the number of investigators; The police increase cooperation and coordination with the Pekanbaru City Social Service (child social workers); The police implement appropriate policies by prioritizing the interests of children (victims). Against the facility/facility factor, namely the local police increase the budget. Against the community factor, namely the victim is accompanied by a child social worker from the Pekanbaru City Social Service and involves the role of the victim's family who knows the condition of the victim and perpetrator in peace efforts; Investigators maximize separate examinations between the perpetrator and the victim; Investigators apply the right techniques in examining the perpetrator; during the examination the child is not confronted with his parents (perpetrators).Keywords: Abuse, Children, Pekanbaru

Abstract

ABSTRACT Article 30 paragraph (2) of Presidential Regulation Number 125 of 2016 concerning Handling of Refugees from Abroad regulates sanctions for special placement/isolation of refugees who violate accommodation regulations." The purpose of the study is to analyze law enforcement against refugees who violate the rules in Pekanbaru City based on Presidential Regulation Number 125 of 2016; To analyze the inhibiting factors; To analyze efforts to overcome the obstacles. The research method is sociological legal research, legislative and case approaches; the research location is the National Unity and Politics Agency of Pekanbaru City; population and samples from relevant sources; data sources are primary, secondary and tertiary; data collection techniques are observation, structured interviews and document/literature studies; data analysis is qualitative with inductive conclusion drawing. Law enforcement has not been implemented properly, especially from 2020 to 2024, as evidenced by the fact that special placement sanctions have not been applied to refugees who violate. Metode penelitiaan ialah penelitian hukum sosiologis, pendekatan perundang–undangan dan kasus; lokasi penelitian yaitu Badan Kesatuan Bangsa dan Politik Kota Pekanbaru; populasi dan sampel dari narasumber relevan; sumber data ialah primer, sekunder dan tersier; teknik pengumpulan data ialah observasi, wawancara terstruktur dan studi dokumen/kepustakaan; analisis data ialah kualitatif dengan penarikan  kesimpulan induktif. Penegkan hukumnya belum dilaksanakan dengan baik terutama tahun 2020 sampai 2024 dibuktikan terhadap para pengungsi yang melanggar, sanksi berupa penempatan secara khusus belum diterapka. Abstract

This study analyzes the procedures for designating a justice collaborator within Indonesia’s criminal justice system, using the case of *Sang District Court Decision No. 79/Pid.B/2024* involving convict Muhammad Ramdanu as a case study. The justice collaborator mechanism serves as a critical instrument to overcome evidentiary challenges in prosecuting organized crimes, particularly when conventional evidence is insufficient. The research employs a normative-juridical approach with qualitative analysis of legal frameworks, including Supreme Court Circular Letter (SEMA) No. 4 of 2011, Law No. 31 of 2014, LPSK Regulation No. 2 of 2020 (Witness and Victim Protection Agency), and Satjipto Rahardjo’s progressive legal theory. The findings reveal that the designation process for a justice collaborator involves a written application, verification of formal and material requirements, review by the LPSK, and recommendations for protective measures. Muhammad Ramdanu was deemed eligible as a justice collaborator due to his role as a non-principal perpetrator in the murders of Tuti Suhartini and Amalia Mustika Ratu, his significant informational contributions to uncovering the mastermind (Yosep Hidayah), and credible threats to his safety. This designation aligns with progressive legal principles that emphasize legal flexibility to achieve substantive justice. Implications include reduced sentencing and physical protection for justice collaborators. However, the study identifies regulatory gaps requiring clarification of "non-principal perpetrator" criteria and improved mitigation of retaliation risks. The findings recommend holistic policy integration between legal instruments and enforcement practices to ensure the efficacy of the justice collaborator mechanism without compromising fair trial principles and human rights.

Abstract

ABSTRACT Background: Article 15 paragraph (1) of Law Number 24 of 2011 concerning BPJS, regulates the obligation of employers to register themselves and their workers as BPJS Participants." Research objectives: To analyze the implementation of registration; To find inhibiting factors and efforts to overcome them. Research methods: sociological legal research; legislative and case approaches; research location: BPJS Pekanbaru Branch Office; population and samples from relevant sources; data sources: primary, secondary, tertiary; data collection techniques: observation, structured interviews, document/library study; data analysis: qualitative; conclusion: inductive.  Research results: the regulations have not been implemented well. Conclusion: First, the implementation of worker registration as BPJS Employment participants in private companies in Pekanbaru City has not yet been carried out in accordance with legal provisions in 2022 to 2024, where of the 13 companies and cooperatives there are still some workers whose employers have not registered as BPJS Employment participants. Metode penelitiaan: penelitian hukum sosiologis; pendekatan perundang–undangan dan kasus; lokasi penelitian: Kantor Cabang BPJS Pekanbaru; populasi dan sampel dari narasumber relevan; sumber data: primer, sekunder, tersier; teknik pengumpulan data: observasi, wawancara terstruktur, studi dokumen/kepustakaan; analisis data: kualitatif; kesimpulan:  induktif.  Hasil penelitian: regulasi itu belum diimplementasikan dengan baik. Kesimpulan: Pertama, Implementasi pendaftaran pekerja sebagai peserta BPJS Ketenagakerjaan pada perusahaan swasta di Kota Pekanbaru belum berjalan sesuai ketentuan hukum di tahun 2022 sampai 2024, dimana dari 13 perusahan dan koperasi masih ada sebagian pekerja yang belum didaftarkan pemberi kerjanya sebagai peserta BPJS Ketenagakerjaan. Abstract

Proposing the position of Constitutional judge from 3 (three) branches of power to guarantee the independence of the Constitutional Cout ar as  a Defender of Constitution On September 29 2022, the DPR RI proposed dismissing MK judge Aswanto in the middle of his term of office on the grounds that he often disappointed the DPR. Aswanto, who was elected by the DPR, was the subject of dismissal which raised questions regarding the independence and impartiality of the Constitutional Court (MK). This article aims to discuss how proposals for the dismissal of Constitutional Judges should be carried out in accordance with the mandate of Law Number 7 of 2020, and to emphasize that the Constitutional Court has no obligation to be responsible for the proposing institution. As a result, there is no place for the removal process of judges while they are still in tenure due to political considerations in implementing judicial policies.

Abstract

ABSTRACTArticle 74 paragraph (2) letter b of Law Number 22 of 2009 concerning Road Traffic and Transportation, regulates the deletion of registration and identification of motorized vehicles by the police if the motorized vehicle owner does not re-register at least 2 years after the validity period expires. Vehicle Registration.". The aim of the research is to analyze the implementation of its elimination; to analyze the factors that hinder its implementation; To analyze efforts to overcome obstacles. Research methods are sociological legal research, statutory and case approaches; the research location is the Riau Regional Police; population and sample of relevant sources; data sources are primary, secondary and tertiary; Data collection techniques are observation, structured interviews and document/library study; qualitative data analysis with conclusions: inductive.  The results of the research are that the implementation of the elimination has not been carried out by the Riau Regional Police Traffic Directorate Sub-Directorate for four-wheeled motorized vehicles from 2021 to 2023. Factors that hinder its implementation are legal/legislative factors, law enforcement/government factors, facilities/facilities factors. As well as community factors. Efforts to overcome these obstacles include changes to existing regulations; Pekanbaru City DPRD forms Regional Regulations; The Regional Police Traffic Directorate Sub-Directorate of Riau carries out the removal with full commitment and responsibility in accordance with legal provisions; The Regident Sub-Directorate of the Riau Police Traffic Directorate has back up data on the registration and identification of motorized vehicles that have been deleted; additional competent personnel specifically for registration and identification of motorized vehicles; Negotiating with local governments to sort out bleaching policies; collaborating with the regional government to create a special team to implement the deletion of registration and identification of motorized vehicles; carry out legal outreach to the community and stake holders; Increased cooperation and coordination to work in an integrated manner; there must be a special budget to meet facilities and equipment; making banners at motor vehicle registration and identification service centers; The community is cooperative;  collaborating with Pekanbaru City community leaders to approach the community;  the whitening policy remains in place so that people can complete tax payments that are in arrears; involving the Pekanbaru City community in sustainable Community Traffic Education activities.Keywords: Removal, Regident; Pekanbaru ABSTRAKPasal 74 ayat (2) huruf b Undang-Undang Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan, mengatur adnya Penghapusan registrasi dan identifikasi kendaraan bermotor oleh oleh kepolisian jika pemilik Kendaraan Bermotor tidak melakukan registrasi ulang sekurang-kurangnya 2 tahun setelah habis masa berlaku STNK.”. Tujuan penelitian ialah Untuk menganalisis implementasi penhapusannya; untuk menganalisis faktor yang menghampat implementasinya; Untuk menganalisis upaya mengatasi hambatannya Metode penelitiaan yaitu penelitian hukum sosiologis, pendekatan perundang–undangan dan kasus; lokasi penelitian yaitu Polda Riau; populasi dan sampel dari narasumber–narasumber relevan; sumber data ialah primer, sekunder dan tersier; teknik pengumpulan data ialah observasi, wawancara terstruktur dan studi dokumen/kepustakaan; analisis datanya kualitatif dengan kesimpulan: induktif.  Hasil penelitian yaitu Implementasi penghapusan tersebut belum dilaksanakan Subdit Regident Ditlantas Polda Riau terhadap kendaraan bermotor roda empat pada tahun 2021 sampai 2023. Faktor  yang menghambat dalam implementasinya ialah Faktor hukum/ perundang-undanganl, Faktor penegak hukum/pemerintah, Faktor sarana/fasilitas. Serta Faktor masyarakat. Upaya mengatasi hambatan tersebut ialah dilakukan perubahan terhadap regulasi yang ada; DPRD Kota Pekanbaru membentuk Peraturan Daerah; Subdit Regident Ditlantas Polda Riau umelaksanakan penghapusan dengan penuh komitmen dan tanggung jawab sesuai dengan ketentuan hukum; Subdit Regident Ditlantas Polda Riau memiliki bac up data terhadap registrasi dan identifikasi kendaraan bermotor yang telah dihapus; penambahan personil yang berkompeten khusus Registrasi dan Identifikasi kendaraan bermotor; Melakukan negosiasi dengan pemerintah daerah untuk pemilahan kebijakan pemutihan; menggandeng pemerintah daerah membuat tim khusus pelaksanaan penghapusan registrasi dan identifikasi kendaraan bermotor tersebut; melakukan sosialiasai hukum kepada masyarakat dan stake holder; Peningkatan kerjasama dan koordinasi supaya bekerja secara terpadu; harus ada anggaran khusus untuk memenuhi sarana dan fasilitas; membuat banner-banner di pusat-pusat pelayanan registrasi dan identifikasi kendaraan bermotor; Masyarakat bersikap koperatif;  menggandeng tokoh masyarakat Kota Pekanbaru untuk melakukan pendekatan kepada masyarakat;  kebijakan pemutihan  tetap ada supaya masyarakat bisa menyelesaikan pembayaran pajak yang sudah tertunggak; melibatkan masyarakat Kota Pekanbaru dalam kegiatan Pendidikan Masyarakat Lalu Lintas secara berkelanjutan.Kata Kunci: Penghapusan,  Regident, Pekanbaru

Abstract

In the era of globalization and rapid technological advancement, the labor market demands a workforce that possesses not only formal education but also skills that align with industry needs. Therefore, the government plays a role in enhancing workforce skills, one of which is through job training programs. This study discusses job training based on labor regulations in Indonesia and examines the role of job training in improving workforce skills to support the goals of workforce development in the country. The research employs a normative juridical method with a statute approach. The findings reveal that job training is regulated under several laws and regulations, including Law Number 13 of 2003 on Manpower, Government Regulation Number 31 of 2006 on the National Job Training System, and various Ministerial Regulations issued by the Ministry of Manpower. The role of job training programs provided by the government is a form of community empowerment, particularly for those classified as part of the labor force, to help them secure decent employment and reduce unemployment rates, thereby contributing to economic growth in Indonesia. This initiative also supports the achievement of Sustainable Development Goal number 8

Abstract

In the Palangkaraya Court Decision Number 119/Pdt.G/2020/PA.Plk there is a dynamic where the judge requires the ex-husband to provide child support as much as requested by the applicant without considering the income and financial strength of the ex-husband. So this study was conducted by analyzing the court's decision in the Theory of hifdz nafs in Maqashid Syariah and the theory of Judicial Activism. This study uses a qualitative method with a research location which is a Library study. The results of this study indicate that the Decision made by the judge at the Palangkaraya Religious Court is stated in the purpose of maintaining the soul which is implemented in the provision of food, drink, clothing and also Education. Meanwhile, the Judge's Decision is at the level of hajiyat (secondary) not dharuriy (primary). Therefore, in the theory of Judicial Activism, judges at the Palangkaraya Religious Court should reinterpret and formulate decisions that accommodate peace between two people who have separated, by applying the Interpretive Fidelity dimension to obtain substantive justice.Keywords: Livelihood, Hifdz Nafs, Judicial Activism.
