Abstract

One of the potential Regional Taxes to increase Local Revenue in Pelalawan Regency is the Parking Tax. Parking Tax is a tax on the operation of a parking space outside a body of a road, whether provided in connection with the principal of the business or that is provided as a business, including the provision of motorized vehicle day care. This research aims to explain the law enforcement of the implementation of the Parking Tax in Pelalawan Regency based on Pelalawan District Regulation Number 1 of 2011 concerning Regional Taxes. The method used in this research is socio-legal research. Parking Tax Implementation in Pelalawan Regency has not run optimally because in 2017 it is known that the Ramayana Pangkalan Kerinci and Kerinci Business Center do not deposit Parking Taxes. The efforts made by the Pelalawan Regency Financial and Asset Management Agency to maximize Local Tax revenue are forming a Regional Tax Control and Billing Task Force. Article 130 of Pelalawan District Regulation Number 1 of 2011 concerning Regional Taxes stipulates that a sanction of 400% (four hundred percent) of the principal tax payable will be imposed if any taxpayer who deliberately does not deposit the collected tax will cause losses on regional finance.

Abstract

Drugs are pharmaceutical preparations that are much needed during the pandemic, such as today. There are so many pharmaceutical preparations circulating through internet-based media, which are not in accordance with applicable regulations so that they have big potential to cause bad impacts. There are various obstacles faced by the government in carrying out supervision of pharmaceutical preparations through the Food and Drug Supervisory Agency, especially related to online drug buying and selling activities. Some of these obstacles include good access to Indonesia's territory, the low level of public knowledge about drugs, low cross-sectoral supervision, and weak legislation. These weaknesses then become a gap for business actors to conduct online buying and selling transactions without complying with applicable regulations. Thus, further supervision is needed by the Food and Drug Supervisory Agency as a form of responsibility and the realization of legal certainty in order to improve justice and public safety as consumers.

Abstract

The existence of Kampar Regency Regional Regulation No. 09 of 2008 concerning General Mining Management demonstrates the local government's desire to improve people's lives while also preserving the environment. However, there are still issues with implementing this regional rule, such as the fact that there are still miners from the neighboring community who do not have licences to carry out the present mining activities. The goal of this study was to see how the Kampar Regency Regulation No. 9 of 2008 on General Mining Processing was implemented, particularly in the categorization of excavated mining material type c. The Civil Service Police Unit of Kampar Regency was used as the research venue for sociological legal research. Primary, secondary, and tertiary data were used, and 9 persons were allocated to responders who clearly understood the situation. The authors utilize observation, structured interview and documentation study. Data analysis was carried out using qualitative legal methods, which entails describing and describing the data obtained based on supporting theories in order to be able to make a conclusion that ranges from broad to particular. According to the findings of the study, quarry miners in Kampar Regency were subjected to both preventive and repressive law enforcement in order to comply with regional laws. The presence of traditional miners in the local community, who are hereditary, is an impediment. The lack of public knowledge and government socialization has resulted in a lack of enforcement of these regional rules.

Abstract

Kabupaten Pelalawan Propinsi Riau memilik wilayah perkebunan yang cukup luas. Selain kepemilikan perkebunan yang dimiliki masyarakat, juga terdapat perkebunan milik perusahaan. Kasus kebakaran lahan perkebunan di Indonesia menjadi hal yang menarik diperbincangkan. Hasil observasi diperoleh informasi bahwa apabila terjadi kebakaran dilahan perkebunan milik perusahaan, hanya pelaku pembakaran saja yang menjadi sorotan, namun untuk pemilik perusahaan yang secara jelas memiliki kawasan dan bertanggung jawab terhadap area perkebunannya terkesan tidak terlibat. Penelitian bertujuan untuk melihat pertanggungjawaban hukum terhadap kebakaran lahan perkebunan milik perusahaan di kabupaten pelalawan Berdasarkan Undang-Undang Nomor 18 Tahun 2004 Tentang Perkebunan. Penelitian dilakukan berjenis sosiologis dengan pendekatan kualitatif yang melibatkan responden dari pihak Pemerintah Daerah, Polres, Badan Pertanahan Nasional dan beberapa responden yang terkait. Hasil penelitian terlihat bahwa pertanggungjawaban hukum terhadap kebakaran lahan kebun milik perusahaan di Kabupaten Pelalawan berdasarkan Undang-Undang Nomor 18 Tahun 2004 tentang Perkebunan adalah belum terlaksana.

Abstract

Penyelesaian perkara pencurian ringan berdasarkan Surat Kapolri No.Pol/B/3022/XXI/2009/SDEOPS tentang penanganan kasus melalui ADR dijadikan alternatif penyelesaian perkara. Di Kabupaten Rokan Hilir, dalam wilayah hukumnya dalam beberapa perkara diselesaikan dengan mengunakan penyelesaian perkara pencurian dengan menggunakan ADR. Dalam prosesnya, muncul permasalahan-permasalahan dalam melaksanakan penanganan penyelesaian perkara tersebut. Penelitian ini bertujuan untuk melihat pelaksanaan dispute resolution terhadap perkara pencurian di Kabupaten Rokan Hilir. Penelitian berjenis kualitatif dengan melakukan pendekatan penelitian hukum sosiologis. Sampel ditetapkan sebanyak 10 responden menggunakan tehknik purposive random sampling. Data yang digunakan adalah data primer, sekunder dan tersier. Teknik pengumpulan data melalui observasi dan wawancara terstruktur dan non struktur dan ditambah dengan melakukan kajian kepustakaan. Hasil penelitian mengungkapkan bahwa implementasi kebijakan dispute resolution terhadap perkara pencurian di Kabupaten Rokan Hilir masih belum berjalan secara optimal, beberapa hambatan ditemukan dalam pelaksanaan dispute resolution yang dilakukan.

Abstract

This research aims to understand the correlation between ASN and Regional Head Election (Pilkada) as election for choose leader by democratic based on principle of direct, general, free, confidential, honest and fair which submitted by party political or combined party political. About implementation, right choose of Civil Servant or abbreviated with ASN prohibited to declare openly to public to invite choose one of candidate so that tend becomes form "campaign" or endorsement. However thus, level violation to implementation Pilkada simultaneously which ruled by government. This research used Socio Legal Research on phenomenon law which there is in public election and approach problem used a case approach. The conclusion show that the implementation of the banning the ASN in Bengkalis on Regional Head Candidates 2020 not yet done with good. Because still many found ASN which no neutral. It is caused the existence connection family Among ASN with candidate regional head, ambition of career position, no clear dan nothing strictly rules, weakness enforcement law.

Abstract

Based on Article 169 paragraph (1) of Law Number 22 of 2009 concerning Road Traffic and Transportation, it is stipulated that drivers and/or public goods transportation companies must comply with provisions regarding loading procedures, carrying capacity, vehicle dimensions, and road class. This research aims to explain law enforcement against violations of goods transportation vehicles in Pekanbaru City based on Law Number 22 of 2009 concerning Road Traffic and Transportation. The method used in this research is socio-legal research. The results showed that law enforcement against violations of goods transportation vehicles in Pekanbaru City hasn’t been optimal. Barriers from the side of law enforcement officials are the lack of cross-sectoral coordination between the Pekanbaru City Transportation Service and Pekanbaru Police Traffic, most of the freight vehicles passing through Pekanbaru City from night to early morning, and the lightness of criminal sanctions as regulated in Law Number 22 of 2009 concerning Road Traffic and Transportation. Efforts that can be made by the Pekanbaru City Transportation Service are to collaborate with the Pekanbaru Traffic Police, increase supervision of goods transportation vehicles, and propose that Law Number 22 of 2009 concerning Road Traffic and Transportation be revised.Keywords: Goods Transport Vehicle; Violation; Law Enforcement AbstrakBerdasarkan Pasal 169 ayat (1) Undang-Undang Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan diatur bahwa pengemudi dan/atau perusahaan angkutan umum barang wajib mematuhi ketentuan mengenai tata cara pemuatan, daya angkut, dimensi kendaraan, dan kelas jalan. Penelitian ini bertujuan untuk menjelaskan penegakan hukum terhadap pelanggaran kendaraan angkutan barang di Kota Pekanbaru berdasarkan Undang-Undang Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan. Metode yang digunakan dalam penelitian ini adalah penelitian hukum sosiologis. Hasil penelitian menjelaskan bahwa penegakan hukum terhadap pelanggaran kendaraan angkutan barang di Kota Pekanbaru belum berjalan optimal. Hambatan dari sisi aparatur penegak hukum adalah kurangnya koordinasi lintas sektoral antara Dinas Perhubungan Kota Pekanbaru dengan Satlantas Polresta Pekanbaru, kendaraan angkutan barang sebagian besar melintas di Kota Pekanbaru dari malam hingga dini hari, serta ringannya sanksi pidana yang diatur dalam Undang-Undang Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan. Upaya yang dapat dilakukan oleh Dinas Perhubungan Kota adalah menjalin kerja sama dengan Satlantas Polresta Pekanbaru, meningkatkan pengawasan terhadap kendaraan angkutan barang, serta mengusulkan agar Undang-Undang Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan direvisi.Kata kunci: Kendaraan Angkutan Barang; Pelanggaran; Penegakan Hukum

Abstract

Meskipun pemerintah telah memberlakukan Undang-Undang Nomor 41 Tahun 199 tentang Kehutanan, namun kenyataannya masih terjadi kebakaran hutan di Provinsi Riau sejak Januari hingga Maret 2019 seluas 1.178 hektar. Hal ini disebabkan masyarakat belum memahami aturan dan sanksi yang berlaku. Metode pengabdian kepada masyarakat ini dalam bentuk ceramah. Sebelum dan sesudah penyuluhan, peserta diminta mengisi kuesioner pre-test dan post-test. Berdasarkan hasil kegiatan tampak bahwa meningkat pemahaman masyarakat mengenai larangan membakar hutan. Hal ini terlihat dari hasil penilaian kuesioner dan tanggapan peserta. Peserta telah memahami pengertian hutan larangan membakar hutan, penyebab kebakaran hutan, sanksi pidana dan denda bagi pelaku pembakaran hutan, dan sebagainya. Kegiatan seperti ini perlu dilakukan secara rutin agar masyarakat lebih memahami ketentuan Undang-Undang Kehutanan.

Abstract

Article 3 letter a Government Regulation Number 24 of 1997 concerning Land Registration says to provide legal certainty and legal protection to rights holders of land parcels, apartment units and other registered rights so that they can easily prove themselves as holders of the rights concerned. . However, in the course of time, the existence of this Registration Regulation is considered to have not been optimal because there are several obstacles including limited funds and personnel so that control of land is largely not supported by adequate evidence. In addition, this Government Regulation is not sufficient to provide the possibility for the implementation of land registration in a short time and with satisfactory results. The type of research used in the writing of this research is Normative legal research, which discusses the legal certainty of land title certificates in Indonesian land law. From the results of the research, it can be concluded that the legal certainty of land title certificates is not in accordance with legal certainty regarding the object of land rights, the subject of land rights and regarding certainty over land and with this state guarantee given to the owner or certificate holder it can be given because the land is already registered. in the state land administration system. Ideally, land ownership in order to have appropriate legal certainty is protection for land rights holders which are legally formal rights for every Indonesian citizen, however actions to take action against any party who occupies land by certain parties illegally must be carried out with care. -be careful not to cause social conflict or conflict between citizens and the government.
