Abstract

General Background Hadhanah in Islamic family law traditionally regulates child care based on biological parental responsibility, particularly after divorce, with an emphasis on welfare and protection. Specific Background Contemporary social conditions show increasing reliance on child social welfare institutions, such as the Putri ‘Aisyiyah Sumbersari Jember institution, which implement structured, value-based child care integrating religious, social, and developmental dimensions. Knowledge Gap Classical fiqh and the Compilation of Islamic Law primarily frame hadhanah as an individual parental right, leaving limited conceptual clarity regarding institutional caregiving practices. Aims This study aims to reconceptualize hadhanah within institutional child care practices by integrating Islamic law, Kuhn’s paradigm shift theory, and modern social welfare perspectives. Results The findings indicate a shift from individual to collective guardianship, where institutions function as subjects of hadhanah oriented toward the best interests of the child, encompassing holistic protection including physical, psychological, social, and spiritual needs. Institutional practices demonstrate alignment with maqāṣid syariah and child protection principles, emphasizing structured, professional, and child-centered care. Novelty This study introduces hadhanah as a form of collective institutional responsibility (hadhanah jama’iyah), redefining caregiving beyond lineage-based relations into social-professional frameworks. Implications The reconceptualization bridges classical Islamic jurisprudence, national legal frameworks, and contemporary child welfare practices, providing a more adaptive and contextually relevant model for Islamic family law and institutional child care systems. Highlights: Institutional caregiving replaces lineage-based custody with collective responsibility frameworks. Holistic protection integrates spiritual, psychological, educational, and social dimensions of care. Child-centered orientation prioritizes long-term development and rights fulfillment. Keywords: Reconceptualization, Hadhanah, Child Social Welfare Institutions

Abstract

General Background: Women’s participation in public economic activities has increased alongside evolving gender roles in Indonesian society, yet normative legal frameworks emphasize balanced rights and obligations within households. Specific Background: Female agricultural laborers in Ramban Kulon Village simultaneously engage in income-generating activities and domestic responsibilities, reflecting a complex interaction between socio-legal norms and rural realities. Knowledge Gap: Despite formal recognition of gender equality in Islamic family law and national legislation, discrepancies persist in the practical division of household roles, particularly in agrarian communities. Aims: This study aims to analyze the forms of problems experienced by female agricultural laborers and identify the social and economic factors contributing to these challenges. Results: Findings reveal excessive double workloads, limited recovery time, and unequal domestic role distribution, driven by patriarchal norms and unstable household income. Women’s economic participation does not alter domestic responsibilities, resulting in sustained role conflict and structural burden. Novelty: This study highlights the interaction between socio-cultural structures and economic necessity in shaping persistent dual role conditions among rural women within a socio-legal framework. Implications: The findings underscore the need for gender-responsive policies and community-based interventions addressing structural inequality and promoting equitable role distribution in rural households. Highlights: Simultaneous domestic and agricultural responsibilities create continuous physical and emotional strain. Patriarchal cultural norms maintain unequal household task allocation despite income contribution. Seasonal and unstable earnings drive women’s labor participation without shifting family role structures. Keywords: Women's Dual Roles, Farm Laborers, Family Problems

Abstract

General Background: Artistic imagery is a central element of rhetoric that translates abstract thought into perceptible expression within Arabic literary tradition. Specific Background: In Nahj al-Balagha, the wisdom of Imam Ali (peace be upon him) presents a distinctive rhetorical model grounded in figurative and sensory representation. Knowledge Gap: Despite previous rhetorical studies, limited research has examined the aesthetic structure and integrated functions of artistic imagery in his aphoristic rulings through a focused descriptive-analytical approach. Aims: This study analyzes the composition, types, and aesthetic, semantic, and persuasive roles of artistic imagery in Imam Ali’s wisdom. Results: The analysis shows that simile, metaphor, metonymy, allegory, and sensory, mental, and kinetic imagery embody moral and philosophical meanings in concrete forms, creating a unified expressive system that combines beauty, intellectual depth, and value-oriented guidance. Novelty: The study demonstrates that artistic imagery constitutes the structural core of Imam Ali’s rhetoric through an organic unity between form and ethical content. Implications: The findings position Nahj al-Balagha as a complex literary and rhetorical model for aesthetic and critical studies in Arabic and Islamic literature. Highlights • Identifies sensory and cognitive figurations as structural components of aphoristic discourse.• Demonstrates integration of moral philosophy with figurative composition.• Establishes proverbial sayings as a comprehensive rhetorical system. Abstract

General Background The digital economy has transformed traditional sources of market power from capital and market share toward data control as a strategic asset. Specific Background Consumer data has evolved into a central mechanism enabling digital enterprises to build competitive advantages, reinforce dominant positions, and create structural entry barriers through algorithm-driven feedback systems. Knowledge Gap Indonesian competition law, particularly Law No. 5 of 1999, does not explicitly regulate data dominance and remains rooted in a pre-digital paradigm focused on price and market share indicators. Aims This study analyzes how data dominance can be conceptualized as market power within Indonesian competition law and examines its legal implications for enforcement. Results The findings demonstrate that large-scale data control may generate anti-competitive practices, including barriers to entry, ecosystem dependency, and algorithm-based exclusivity, which are not adequately captured by conventional price-based analysis. Novelty This study provides a normative construction that interprets data dominance as a functional form of dominant position within existing legal frameworks without requiring immediate legislative amendment. Implications The study highlights the necessity of interpretative approaches and strengthened institutional capacity to ensure fair competition, while also emphasizing the need for adaptive enforcement mechanisms aligned with digital market structures. Highlights: Large-scale information control creates structural barriers that limit new entrants in digital markets. Algorithm-based feedback mechanisms reinforce ecosystem dependency and concentration of economic control. Existing legal provisions can be reinterpreted to address emerging competition issues without explicit regulatory reform. Keywords: Data Dominance, Market Power, Indonesian Competition Law.

Abstract

General Background: Firm value reflects investor perception of performance and prospects, while banking stability is closely linked to financial and sustainability practices. Specific Background: Environmental, Social, and Governance (ESG) disclosure and Net Interest Margin (NIM) are considered key indicators in assessing sustainability and financial performance in the banking sector. Knowledge Gap: Prior studies show inconsistent findings on ESG–firm value relationships, with limited focus on banking using NIM and the moderating role of firm size over a long observation period. Aims: This study analyzes the relationship between ESG disclosure and NIM on firm value, with firm size as a moderating variable in Indonesian listed banks during 2013–2024. Results: The findings reveal that ESG disclosure and NIM simultaneously relate to firm value with limited contribution, ESG shows a negative relationship, NIM is not significant, and firm size does not moderate these relationships. Novelty: This study integrates ESG and NIM within the banking context using firm size moderation and a relatively long observation period. Implications: The results indicate that sustainability practices in Indonesian banking have not been fully valued by the market, highlighting the need to improve transparency and integration of sustainability with financial performance to strengthen investor confidence and firm value. Highlights• ESG disclosure shows a negative association with market valuation• Net interest margin does not relate significantly to market assessment• Company scale fails to strengthen sustainability and financial linkages KeywordsESG Disclosure; Net Interest Margin; Firm Value; Firm Size; Banking Sector
