Abstract

Permasalahannya adalah bagaimana wewenang dan tanggung jawab penyidik dalam penetapan tersangka dan bagaimanakah kekuatan mengikat putusan Praperadilan. Sebagai tujuan adalah Untuk mengetahui dan menganalisis wewenang  dan tanggung jawab penyidik dalam penetapan  tersangka  dan untuk mengetahui dan menganalisis kekuatan  mengikat Putusan praperadilan. Metode penelitian yang digunakan adalah yuridis normative didukung oleh pendekatan yuridis empiris dan sosiological yuris prudence. Dari hasil penelitian diperoleh kesimpulan, Pengajuan Permohonan Praperadilan adalah hal yang biasa dalam membangun sinergitas dan mekanisme saling kontrol antara Kepolisian, Kejaksaan dan Tersangka  (melalui Kuasa Hukumnya)  atau pihak ketiga lainnya. Dalam negara hukum yang senantiasa harus menjunjung tinggi penegakkan supremasi hukum, sangat diperlukan suatu lembaga kontrol yang independen yaitu Pengadilan dengan lembaga Praperadilannya. Salah satu tugasnya mengamati/mencermati (memeriksa, mengadili dan memutuskan) perkara yang diajukan ke Pengadilan yang mempersoalkan tentang  sah tidaknya  penangkapan, penahanan, sah tidaknya penggeledahan, penyitaan, atau sah tidaknya penghentian penyidikan atau sah tidaknya penetapan tersangka,  atau sah tidaknya alasan penghentian penuntutan suatu perkara pidana baik itu dilakukan secara resmi dengan mengeluarkan  Surat Pemberitahuan Penghentian Penyidikan (SP3) maupun tindakan tidak meneruskan proses perkara dengan alasan tidak cukup bukti yang biasanya diberitahukan  kepada pihak yang berkepentingan melalui Surat Pemberitahuan Perkembangan Hasil Penyidikan (SP2HP) maupun penghentian secara diam-diam dengan alasan belum cukup bukti. penetapan tersangka sebagai objek gugatan Praperadilan merupakan upaya hukum pertama dan terakhir di pengadilan negeri ( final and binding) terhadap kekeliruan penetapan seseorang sebagai tersangka, apabila upaya hukum ini dilanggar akan muncul konsekwensi-konsekwensi hukum terhadap penyidik.

Abstract

Development of technology, communications and the internet make people life easier and faster. Online systems provide changes to buy foods & goods, reserve online transportation even to get consultation with doctor. This research aims to examine the legal aspects of online consultation between doctor and patient or users, about the limitations that can be given in the consultation. The method used is the normative juridical method, using secondary data in the form of books, journals, articles and related regulations and data analysis techniques used are qualitative descriptive. The results of the study: (1). People can consult & communicate with doctors through the online medium by providing true information about their disease history, use of certain drugs and doctors would give the opinions according to the patient's information and the code of ethics; (2). The consultation of doctors through online media obeyed to the Law on Technology & Information, the Health Act, the Medical Practice Act, Consumer Protection Act.Key words: doctor, online consultation, patient, law on techology and informationKey words: doctor, online consultation, patient, law on techology and information

Abstract

The process of land acquisition for development for wide-ranging public interest is always carried out with the stages as stipulated in Law Number 2 Year 2012 and its implementing regulations. However, other things with the procurement of small-scale land that can be done by way of sale and purchase, exchange or other means agreed by both parties without going through the stages set forth in the laws and regulations implementation. Article 121 of Presidential Regulation No. 148 of 2015 in paragraph (3) states that small-scale land procurement can be carried out without location determination. In the absence of a location stipulation in small-scale land acquisition resulted in agencies requiring land can not consign or take care of damages in court because one of the conditions set forth in Supreme Court Regulation No. 3 of 2016 to do consignment or nursing in court requires determination location set by governor or mayor / regent

Abstract

ABSTRAK Permasalahan yang diteliti adalah yaitu bagaimana upaya dari Kejaksaan Negeri Donggala untuk menyelesaikan secara optimal tunggakan pembayaran uang pengganti dalam Undang-Undang Nomor 3 tahun 1971 tentang Tindak Pidana Korupsi. Tujuan penulisan ini adalah untuk mendeskripsikan hambatan-hambatan dalam upaya penyelesaian tunggakan pembayaran uang pengganti oleh terpidana tindak pidana korupsi yang telah meninggal dunia serta penelitian ini juga bertujuan untuk mengkaji dan untuk mengetahui dasar hukum dalam pelaksanaan eksekusi dalam Undang-Undang Nomor 3 tahun 1971 tentang Tindak Pidana Korupsi. Metode yang digunakan dalam penelitian hukum yuridis empiris dengan menggunakan sumber data primer dan sekunder dengan teknik studi dokumen, penelitian lapangan serta sumber bacaan yang berkaitan dengan permasalahan yang ada. Berdasarkan hasil penelitian maka dapat disimpulkan bahwa upaya yang dilakukan Kejaksaan Negeri Donggala sehubungan dengan adanya putusan Nomor : 252/PID.B/2003/PN.PALU telah dilakukan dengan langkah-langkah sebagai berikut: Pertama: melalui jalur Non Litigasi yaitu melakukan negosiasi terhadap Ahli Waris dari Terpidana, Kedua: melakukan upaya pemutihan atau penghapusan atas tunggakan pembayaran uang pengganti dalam putusan Nomor : 252/PID.B/2003/PN.PALU dan Ketiga: melalui jalur Litigasi yakni dengan melalukan gugatan perdata kepada Ahli Waris dari Terpidana. Adapun saran yang direkomendasikan oleh penulis, pidana tambahan pembayaran uang pengganti dalam Undang-Undang Nomor 3 tahun 1971 tentang Tindak Pidana Korupsi terdapat kekosongan pengaturan (Regelsvacuum) sehingga diperlukan pengaturan atau aturan yang jelas dalam hal eksekusi pembayaran uang pengganti dalam Undang-Undang Nomor 3 tahun 1971 tentang Tindak Pidana Korupsi kepada Negara. Kata Kunci : Uang Pengganti, Kerugian Negara dan Tindak Pidana Korupsi.

Abstract

Kemajuan teknologi, komunikasi dan internet sekarang ini membuat kegiatan masyarakat menjadi lebih mudah dan cepat. Sistem Online memberikan perubahan dalam membeli barang, memesan transportasi, makanan hingga konsultasi dokter juga dilakukan secara online. Penelitian ini bertujuan untuk mengkaji aspek hukum konsultasi dokter melalui media online di Indonesia, dan batasan dalam konsultasi tersebut. Metode yang digunakan adalah metode yuridis normatif, menggunakan data sekunder berupa buku, artikel dan perundang-undangan yang terkait, teknik analisis data yang digunakan adalah deskriptif kualitatif. Hasil penelitian adalah (1). Masyarakat berkonsultasi dengan dokter melalui media online dengan memberikan keterangan yang sebenarnya mengenai riwayat penyakit penggunaan obat tertentu dan dokter memberikan pendapat sesuai keterangan tersebut & kode etik praktik kedokteran; (2). Konsultasi dokter melalui media online tunduk pada UU Teknologi & Informasi, UU  Kesehatan, UU Praktik Kedokteran, UU Perlindungan Konsumen.

Abstract

The auction is a sale of general public goods by an oral and / or written bid that increases or decreases to achieve the highest price, preceded by the effort of collecting prospective buyers/auctions led by auction officials. The transfer of rights through auction can only be registered if it is proved by auction quotation quotes made by the auction official and at the auction of the object of mortgage, it is very necessary a certificate issued by the National Land Agency (BPN) in which the auction object is based on a written request from the Head of the Auction Office. The certificate in question is the Land Registration Certificate (SKPT). Land Registration Certificate is very important in the auction process of Mortgage Rights because it is a much needed requirement. In the certificate of registration the land explains the physical data and juridical data as well as the identity of the object of Mortgage Rights that will be in the auction and also to know the last condition of the status of the land. Function of Land Registration Certificate as the latest source of information on the right to land or Property Owned Up Unit Flats to be auctioned. Auction conducted without a Certificate of Land Registration then the auction is invalid and legally flawed, and the result is null and void. Because auction officials are prohibited from auctioning the object of Mortgage Rights if not equipped with Land Registration Certificate (SKPT).

Abstract

The research problem was the legal consideration of judge in decide verdictforconvict based on court decisionnumber: 84/Pid-Sus/2017/PN. Donggala andlegal consequences of the conviction decision number: 84/Pid-Sus/2017/Donggala wereimposed on convicted person The objective of this research is to find out and to analyze the legal consideration of judge in decide verdictforconvict based on court decision number:84/Pid-Sus/2017/PN. Donggala and to find out and analyze the legal consequences of conviction decision imposed on convicted person. The research used normative research method and qualitative research type. The result of the research show that the consideration of judge in imposeconviction decision is based onverification in a case carried out by a claimant based on proven legal facts. Based on thedefendantstatements, witness statements and evidence, existing legal facts have proven to be legitimate and convincing guilty of committing a criminal act "Criminal Agreement without the Right to Submit Narcotics Group I in accordance with consideration of juridical and non-juridical and legal consequence with the verdict conviction of the defendant in a narcotics crime, namely: conviction and fines on the defendant and reduced punishment while serving detentionand confiscation of evidence. The prosecutor and defendantmay submit an appeal attempt strengthened by the decision. It is recommended for the panel of judges to impose a punishment onthe defendant must have confidence that the defendant is legally and convincingly committing a crime based on the evidence that follow the justice process, prioritizing the instrumentsand systemof evidence or facts revealed at the justice impose maximum criminal sanctions on the defendant as a deterrent effect.

Abstract

How is the action of immigration toward the wrong offender using the residence permit for foreign people in the area of Imigration Office Class IA Palu. The purpose of reseach to know an of thed to analyze the supervision of residence permit for foreign people in the area of Imigration Office Class IA Palu. To know and to analyze the action of immigration toward the wrong offender using the residence permit for foreign people in the area of Imigration Office  class IA Palu. The result of the research showed that the supervision implementation   of residence permit for foreign people in the area of immigration office class I A Palu has been done   of legal regulation. The supervision of resident permit for foreign people is done in administrative way since the foreign people for the Visa to visit and come to Indonesia through international airport and field supervision to evaluate the valid residence permit of the foreign people. The action administrative immigration is appropriate to be used, because tells act is more affectife than projustitia action incase of an other problem, it will projustitia action.

Abstract

Penelitian ini mengangkat tentang Kedudukan Presiden Dalam Mengesahkan Rancangan Undang-Undang Yang Telah Disetujui Bersama Menjadi Undang-Undang Berdasarkan UUD RI 1945. Terkait rapat pembahasan rancangan undang-undang yang dilaksanakan oleh Dewan Perwakilan Rakyat (DPR) dan pemerintah (Presiden) terdapat beberapa Rancangan undang-undang yang tidak mendapat pengesahan oleh Presiden Megawati Soekarno Putri pada masa kepemimpinannya sehingga melahirkan beberapa undang-undang tanpa pengesahan Presiden meskipun rancangan undang-undang itu telah mendapat persetujuan bersama. Hal ini yang melatar belakangi penambahan ayat pada Pasal 20 ayat (5) UUD 1945 yang berbunyi “Dalam hal pengesahan rancangan undang-undang yang telah disetujui bersama tersebut tidak disahkan oleh Presiden dalam waktu tiga puluh hari semenjak rancangan undang-undang tersebut disetujui, rancangan undang-undang tersebut sah menjadi undang-undang dan wajib diundangkan”. Hal ini menjadi menarik bagi penulis untuk mengkaji dan mencari tahu apa kedudukan Presiden dalam hal mengesahkan serta implikasi hukum terhadap kedudukan Presiden ketika tidak mengesahkan rancangan undang-undang yang telah disetujui bersama menjadi undang-undang?Dengan metode penelitian hukum normatif dan pendekatan historis, konseptual serta perundang-undangan penelitian ini berhasil membuktikan bahwa kedudukan Presiden dalam mengesahkan rancangan undang-undang menjadi undang-undang ialah sebagi Kepala Negara. Hal ini merupakan simbol dan tidak terdapat implikasi hukum terhadap kedudukan Presiden ketika tidak mengesahkan rancangan undang-undang yang telah disetujui bersama menjadi undang-undang berdasarkan pada Pasal 20 ayat (5) UUD 1945. Namun secara etika ketatanegaraan ini mempengaruhi kepercayaan masyarakat dan konsistensi yang sebelumnya telah menyetujui bersama (Presiden dan DPR) tetapi diakhir tidak mengesahkan.

Abstract

Forest destruction in Indonesia is threatened by severe sanctions in criminal law, because it is a forestry crime regulated on Article 12, 14, 15, 16, 17, 19-28 in Law number 18 of 2013 that concerning prevention and eradication of forest destruction. The legal instrument is expected to sanction to prevent and combat forest destruction in Indonesia. But the fact shows that the deforestation rate in the last five years forest destruction in Indonesia has reached 2.83 million ha per year. In Central Sulawesi of 2014, forest damage caused by fires was 70.73 ha. The consequence would certainly be the problem of how the role of enforcement of sanctions in criminal law to perpetrators of forest destruction.The research methods were statute approach and conceptual approach with normative legal type research and the source of legal materials were primary, secondary and tertiary, which is supported by sociological juridical research, and content analysis.The results of this research show the criminal sanction system adopted in the law on the prevention and eradication of forest destruction is a cumulative system, with the threat of maximum and minimum penalties. The threat of punishment (sanctions) is quite severe, but it is very dependent on the integrity of law enforcement in implementing criminal sanctions against perpetrators of forest destruction, because there is still a tendency for the weak enforcement of witnesses (punishments) to perpetrators of forest destruction.Enforcement of criminal law witnesses in terms of forest destruction is still strongly influenced by several factors that are closely related to the factors of effectiveness of law enforcement such as: Law, Implementing Law, Facilities and Community Legal Awareness/Culture. Other factors that influence the enforcement of legal sanctions are still weak coordination between law enforcers (Police, Prosecutors and Courts) so that it is very vulnerable to creating conflicts of interest. This is one of the obstacles in the enforcement of criminal acts in the forestry sector. And the influence on application of criminal sanctions to perpetrators of forest destruction because they are still oriented to the principle of ultimum remedium which should use primum remedium (as the main way) because the act of forest destruction is an act that can directly or indirectly endanger the humans lives.
