Abstract

The child is the future in the family and the heir to the family even if the child is an illegitimate child because the child born should have his rights protected in the position of inheritance. What if the heir leaves an illegitimate child who will become the sole heir of Employment BPJS who will have a lot of interference from other parties if the illegitimate child has no position. So the purpose of this research is for illegitimate children to get rights and positions in inheritance. The research method uses normative laws and empirical (sociological) laws. Article 43 paragraph 1 of the Marriage Law states that a child born out of wedlock only has a civil relationship with his mother and his mother's family. In order for children out of wedlock to receive recognition from their father according to the Constitutional Court Decision No.46/PUU-VIII/2010 if it can be proven by a DNA test then the child is his child so that the child has the opportunity to obtain a birth certificate with father and mother name so that children out of wedlock have the right to inherit BPJS Employment.

Abstract

Penelitian ini bertujuan untuk menganalisis kedudukan hukum, bentuk dan batasan pertanggungjawaban Notaris, serta penerapan prinsip etika jabatan terhadap akta yang dibuat melalui platform daring dalam perspektif hukum positif di Indonesia. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan kasus. Data penelitian bersumber dari bahan hukum primer seperti Kitab Undang-Undang Hukum Perdata (KUHPerdata) dan Undang-Undang Nomor 2 Tahun 2014 tentang Jabatan Notaris (UUJN), serta bahan hukum sekunder berupa literatur dan pendapat para ahli hukum. Hasil penelitian menunjukkan bahwa akta yang dibuat secara daring belum memiliki kedudukan sebagai akta otentik karena tidak memenuhi unsur formil kehadiran para pihak di hadapan Notaris sebagaimana disyaratkan oleh hukum positif. Tanggung jawab Notaris atas akta daring dibatasi pada kewenangan dan kehati-hatian dalam pelaksanaan jabatan, termasuk perlindungan terhadap data elektronik. Sementara itu, penerapan prinsip etika jabatan menjadi aspek penting dalam menjaga integritas profesi di era digital. Oleh karena itu, diperlukan pembaruan regulasi dan kode etik profesi agar praktik kenotariatan daring dapat dilaksanakan secara sah, etis, dan berkeadilan

Abstract

Penelitian ini bertujuan untuk menganalisis kekuatan eksekutorial akta grosse notaris dalam penyelesaian sengketa perjanjian kredit antara bank dan nasabah. Akta grosse merupakan akta autentik yang memiliki kekuatan eksekutorial setara dengan putusan pengadilan yang telah berkekuatan hukum tetap. Namun, dalam praktiknya, pelaksanaan eksekusi atas akta grosse seringkali menimbulkan perdebatan hukum, terutama terkait validitas perjanjian pokok, pelaksanaan klausula wanprestasi, serta kewenangan pengadilan dalam menilai keabsahan akta tersebut. Metode penelitian yang digunakan adalah yuridis normatif, dengan pendekatan perundang-undangan, konseptual, dan kasus (case approach). Data diperoleh melalui studi kepustakaan, analisis terhadap putusan pengadilan, serta wawancara dengan notaris dan praktisi perbankan. Hasil penelitian menunjukkan bahwa kekuatan eksekutorial akta grosse hanya berlaku apabila akta tersebut memuat perikatan yang nyata dan tidak bersifat fiktif, serta dibuat oleh pejabat umum yang berwenang sesuai ketentuan Pasal 224 HIR dan UU Jabatan Notaris. Dalam praktik, hambatan muncul karena beberapa grosse tidak memenuhi syarat formil, seperti tidak adanya perjanjian pokok yang sah atau adanya pelanggaran asas kehati-hatian dalam pemberian kredit. Kesimpulannya, akta grosse notaris memiliki kekuatan hukum mengikat dan memaksa (executorial power) selama dibuat sesuai ketentuan hukum dan tidak bertentangan dengan asas keadilan serta perlindungan hukum bagi debitur. Implikasi penelitian ini menegaskan pentingnya peran notaris sebagai pejabat publik dalam menjamin kepastian hukum serta integritas perjanjian kredit.

Abstract

This research focuses on examining the legal and normative aspects of the standard clause regulations and institutions that play a role in legal protection in e-commerce services in Indonesia, such as the Ministry of Communication and Information, BPSK, BPKN, and LPKSM. Using a statutory approach and a conceptual approach to comprehensively analyze legal issues. The principle of balance demands equality of position between the parties in the agreement, both in the implementation of rights and obligations. However, in reality, equality between the rights and obligations of the parties in the terms of e-commerce services has not been achieved, as seen from the aspects of the formulation and implementation of the agreement which still tend to be one-sided. Consumers have a weak position because in e-commerce agreements generally take the form of electronic contracts (click-wrap agreements), where consumer flexibility is limited to the option of "agree" or "disagree". Therefore, the guarantee of legal protection is a crucial aspect. So, in this case consumers are protected by Law No. 8 of 1999 on Consumer Protection (UUPK), Law No. 11 of 2008 as amended by Law No. 1 of 2024 on Information and Electronic Transactions (ITE Law), Government Regulation Number 80 of 2019 concerning Trading Through Electronic Systems (PMSE), and also Government Regulation No. 71 of 2019 on Implementation of Electronic Systems and Transactions (PP PSTE).

Abstract

This study aims to examine and reconstruct law enforcement against revenge porn as a form of cyber harassment from the perspective of victim-oriented restorative justice. The core issue arises from the reality of conventional law enforcement in Indonesia, which remains trapped in the lens of public morality and a rigid retributive paradigm—thereby ignoring elements of lack of consent, psychological suffering, and frequently triggering secondary victimization through victim blaming. To address these problems, this research employs a normative-empirical juridical method (socio-legal research) utilizing statute, conceptual, and socio-legal approaches, supported by the analysis of primary, secondary, tertiary legal materials, and court jurisprudence based on feminist legal theory, contextual integrity, and restorative justice. The findings indicate that the current positive law enforcement construction in Indonesia remains partial and vulnerable to conservative moral biases, thus necessitating more progressive normative harmonization. Furthermore, the urgency of reconstructing law enforcement through a victim-oriented restorative justice perspective is imperative to shift the punishment orientation toward psychological recovery, the protection of bodily autonomy and digital privacy, and the institutionalization of rapid and comprehensive digital footprint removal mechanisms.

Abstract

This study aims to analyze the urgency of legal accountability for business crimes in the practice of financial statement manipulation and the abuse of corporate authority, as well as to examine the challenges of law enforcement and prevention efforts within the corporate sphere. The research method employed is normative legal research using statutory and conceptual approaches through library research on various primary, secondary, and tertiary legal sources. The findings indicate that financial statement, manipulation and abuse of corporate authority constitute forms of business crimes that not only violate criminal law norms, but also contradict the principles of fiduciary duty and Good Corporate Governance. From the perspective of criminal law, such actions may be classified as fraud, embezzlement, and deceptive practices, while from the perspective of corporate law they create civil and administrative liabilities for corporate organs. Law enforcement against business crimes still faces several obstacles, including the complexity of corporate structures, weak internal supervision, limited capacity of law enforcement officers, and difficulties in proving criminal intent. Therefore, strengthening supervision systems, optimizing internal audits, protecting whistleblowers, and implementing the principles of transparency, accountability, and integrity are necessary to prevent business crimes and to create a healthy and fair business environment.

Abstract

This study aims to analyze the legal protection of investors in debt-collateral disputes, examine the legal considerations of judges in assessing the validity and binding force of agreements, and identify the implications of decisions on strategic investment policies in Indonesia. The research method used is normative legal research with a legislative approach and a case approach, especially through the analysis of the Supreme Court Decision Number 2511 K/Pdt/2025. The results of the study show that legal protection for investors in debt-collateral disputes is still dominated by the principle of legal certainty through the application of the principle of pacta sunt servanda. The judge considered that the debt settlement agreement that had met the legal requirements was still binding on the parties, including the new management, despite the change in the company's structure. The judge's legal considerations also emphasized that corporate responsibility remains attached to the legal entity, so that the company's obligations are not erased due to the change of management. The implications of this ruling show that although legal certainty is guaranteed, protection for investors is still not optimal, especially in the context of corporate takeovers. Therefore, it is necessary to strengthen regulations and apply the principle of prudence in investment activities to create a balance between legal certainty and investor protection.

Abstract

The annulment of contractual deeds in investment relationships gives rise to complex legal consequences, particularly concerning the legal liability of the parties and the fulfillment of rights and obligations previously agreed upon. In practice, investment disputes often arise due to the failure to meet the legal requirements of a valid agreement, defects of consent, or violations of legal provisions that result in a contract being declared null and void or voidable. Such circumstances create legal uncertainty and may cause losses to the parties bound by the contractual relationship. This research aims to analyze the forms and legal grounds of liability in investment disputes arising from the annulment of contractual deeds, as well as to examine their impact on the fulfillment of the rights and obligations of the parties within contractual relationships. The study employs a normative legal research method using statutory, conceptual, and case approaches by examining contract law, investment law, and relevant court decisions. The findings indicate that the annulment of contractual deeds in investment disputes results in legal liability in the form of restoring the parties to their original position (restitutio in integrum), compensation for losses, and the possible emergence of liability based on unlawful acts. The annulment of a contract also affects the termination of contractual rights and obligations, thereby necessitating clear legal regulation regarding the legal consequences of contract annulment to ensure legal certainty and justice for the parties. Therefore, this research emphasizes the importance of prudence in the drafting of investment agreements and the strengthening of the role of law in providing protection and legal certainty in contractual relationships.

Abstract

The development of technology-based funding services has transformed legal relationships in the financial services sector and increased the need for legal certainty, governance, risk management, and consumer protection. In the Islamic finance context, the complexity is heightened because providers must comply not only with positive law but also with Sharia principles. This study examines the adequacy of Indonesia's regulatory framework for Sharia fintech following Law Number 4 of 2023 on Financial Sector Development and Strengthening as amended by Law Number 4 of 2026, Financial Services Authority Regulation Number 40 of 2024 on Information Technology-Based Joint Funding Services, Financial Services Authority Regulation Number 22 of 2023 on Consumer and Public Protection in the Financial Services Sector, and Financial Services Authority Circular Letter Number 19/SEOJK.06/2025. This normative legal research employs statutory, conceptual, and comparative approaches. The study finds that the legal problem is no longer appropriately framed as the absence of regulation, but as the integration of positive law, Sharia standards, Sharia supervisory governance, risk management, consumer protection, dispute resolution, and enforcement. POJK 40/2024 strengthens the LPBBTI framework, including provisions on Sharia business units, Sharia Supervisory Boards, governance, and risk mitigation. SEOJK 19/2025 further operationalizes Sharia compliance through references to fatwas and/or Sharia Supervisory Board opinions and periodic evaluation. Nevertheless, the functional relationship between fatwas, DPS, Sharia risk management, consumer protection, and enforcement still require strengthening. This study proposes a Sharia compliance chain as a model for strengthening regulatory governance of Sharia fintech in Indonesia.
