Abstract

The designation of Armed Criminal Groups as terrorists invites pros and cons, because some believe that implementing this status could lead to increased violence in Papua and innocent civilians could be affected, so the government is asked to take another approach. Separatist movements that develop into terrorists, however, cannot be justified because they can threaten the sovereignty and integrity of the Unitary State of the Republic of Indonesia. The implementation of the status of the Free Papua Organization as an Armed Criminal Group and then a terrorist is not without basis. This research is descriptive qualitative research, a type of research with the aim of describing phenomena or dynamics that occur using data collection methods in the form of interviews and observations. FKPT in carrying out counter-radicalism outreach certainly has big obstacles. Radicalism is difficult to detect because it is a latent danger that exists but is not visible. As long as there are still many in our society who don't know what radicalism is, they only have passionate religious zeal but lack sound and social reasoning, so during that time they will be indoctrinated by groups that are indicated by this radicalism. Apart from that, the obstacles faced by FKPT Papua not only occur outside the FKPT itself, but also within the FKPT internally. This can be seen from the top down way of working of FKPT Papua. Because the funding comes directly from BNPT, the only activities carried out are those determined by the Central BNPT. Thus, this means that the abilities of the FKPT management are not channeled properly in preventing counter-radicalism

Abstract

A country's concern for education is highly dependent on the progress of a country. then a country's indifference to education lies in the education of its decline or backwardness. In historical experience, no country has been able to achieve true progress except by improving education. Education is the key to the progress of a nation. There is no developed country that is not supported by strong education. Education must be made a field of excellence if it is to become a strong, advanced and internationally respected country. This is also the case with Sudan. The research method in this research is library research through collecting data from books and articles related to the Analysis of Islamic Education Policy in Sudan. The method of analysis used is descriptive analysis. Sudan is a Muslim-majority country that has often experienced several wars and conflicts, so that this country has lagged behind in various fields, including economic, social, political, especially in the field of education. Politically, this country has a different experience from other Muslim countries. Sudan, which was originally one country, is now divided into two countries, namely North Sudan and South Sudan. In the field of education, the country is experiencing a crisis that hinders education for most of these children. Schools across the country are often closed due to fighting and threats of violence, and hundreds of schools and other civilian assets are looted and destroyed. The language of instruction used at all levels is Arabic. In the field of formal education, the country has many renowned universities that are tens or even hundreds of years old. These universities include Khartoum University, Omdurman Islamic University, el-Nilein University, Khartoum International Arabic Language Institute, Al-Quran al-Karim University and the youngest, Africa International University. In the field of non-formal education, many scientific assemblies use the talaqqi system through masyakh. To finance education, apart from being obtained from state money, it is also obtained from the policy of the waqf system with the management of waqf called the Islamic Waqf Board which has been given broad authority to regulate and carry out all tasks related to waqf which greatly helps the process of waqf and the implementation of education in this country.

Abstract

The study under this thesis aims to describe the process and procedures of waqf of istibdâl asset practices based on the concept of waqf legislation, and the application of the maṣlaḥah principle in its implementation. The objects of waqf in this study are the waqf of land of Muhammadiyah Organization in Wonorejo Kaliwungu Kendal, the waqf of land of the Minan Nur Lakarsantri mosque in Surabaya and the waqf of land of the Daarul Ihsan mosque in Menteng Atas Setiabudi, South Jakarta. This is a qualitative research with a case study approach that describes social reality and empirical symptoms in the practice of istibdâl waqf. Primary data were obtained through documentary studies, observations, and interviews, while secondary data were collected through library material studies. The resulting data were then analyzed descriptively and qualitatively. The findings of the study are: first, the process and procedures for licensing of istibdâl waqf is more dominant and it emphasizes the administrative, verification and calculative aspects with the main orientation on calculating the material value of the exchanged assets and the legal status aspect of the replacement assets. There is no apparent elaboration of the level of urgency as a reason for istibdâl waqf and the fulfillment of the principle of maṣlaḥah, so that there seems to be a lack of synchronization between waqf legislation and its implementation. Second, the practice of istibdâl waqf is not always carried out for urgent reasons or maṣlaḥah ḍarūriyyāt, such as the waqf of land of the Muhammadiyah Organization in Wonorejo Village, Kaliwungu, Kendal, which was carried out because it was threatened by tidal water and was included in an industrial area, but also because of considerations of very urgent needs or maṣlaḥah ḥajiyāt to obtain ease of management that brings greater benefits such as the istibdâl waqf of the al-Huda prayer room in Lakarsantri Village, Surabaya, or for reasons of beauty and expansion of the use of waqf assets or maṣlaḥah taḥsīniyyāt such as the istibdâl waqf of land of the Daarul Ihsan prayer room in Menteng Atas Setiabudi, South Jakarta.

Abstract

This study aims to analyze the legal aspects of tax incentive policies for investors in the Special Economic Zone (SEZ) of North Sulawesi, Indonesia. Using a normative juridical approach combined with qualitative analysis, the research examines the harmonization of tax regulations between the central and local governments, the effectiveness of legal supervision in implementing tax incentives, and the legal implications of non-compliance with tax incentive regulations. The findings indicate that the implementation of tax incentives in the North Sulawesi SEZ has shown significant growth. Still, challenges remain in terms of regulatory harmonization, institutional capacity, and coordination among stakeholders. The analysis based on Fiscal Law Theory, Legal Certainty Theory, and Distributive Justice Theory highlights the importance of harmonizing regulations, simplifying administrative procedures, and strengthening institutional capacity to ensure the effectiveness and equity of the tax incentive policy. The study recommends strategic measures to enhance the performance of tax incentives in the North Sulawesi SEZ, including strengthening the regulatory aspect, developing institutional capacity, and optimizing coordination and supervision. These recommendations aim to contribute to the more effective and sustainable implementation of tax incentives to promote regional economic growth.
