Abstract

Traditional knowledge is part of society that is passed down from generation to generation and needs to be protected by law. There is potential for economic benefits resulting from the use of traditional knowledge by developed countries through biopiracy or misappropriation. This article aims to examine the legal protection for people who possess traditional knowledge from acts of biopiracy or misappropriation under the Patent Law (UU Patent). The research method in writing is normative research with a statutory approach. The results of the study reveal that the legal protection of traditional knowledge is regulated in Article 26 of Law no. 13 of 2016 concerning Patents, namely if the invention relates to and/or originates from genetic resources and/or traditional knowledge, it must clearly and correctly state the origin of the genetic resources and/or traditional knowledge in the description. This is done so that genetic resources and/or traditional knowledge are not recognized by other countries and in order to support Access Benefit Sharing (ABS). The distribution of results and/or access to the use of genetic resources and/or traditional knowledge is carried out in accordance with the laws and regulations and international agreements in the field of genetic resources and traditional knowledge.Keywords: Benefit Sharing; Patent; Traditional Knowledge

Abstract

As a corrective step, it is appropriate that government administration issues be returned to their khitah. Regarding government administration, this needs to be implemented in the Job Creation Act. The goal is to create a bureaucratic culture that is fast, responsive, and responsible. The research method used in this article is normative with a statutory approach. This study seeks to reveal the impact of the omnibus law, whether it is in line with what is stipulated in the Government Administration Act. The results of the research article reveal that; First, the discretionary space of government officials must be limited on conditions that are in line with the provisions of the legislation. Second, the implementation of positive fictitious decisions must still involve the State Administrative Court.Keywords: Government Administration; Omnibus Law; Job Creation Law

Abstract

This study aims to determine the implementation of customary inheritance law and the process of settlement of inheritance disputes based on customary inheritance law applicable in Sikka Regency. This study uses a qualitative approach with measuring instruments for data collection using structured, semi-structured, and observational interviews. The sampling technique used in this research is snowball sampling. The source of the data used is primary data from interviews with 10 informants who are elders and administrators of village traditional institutions in several villages in Sikka district. The results of this study reveal that the description or condition of the implementation of customary inheritance law in the patrilineal kinship system in Sikka Regency in the distribution of land inheritance is given full power to sons so that the amount of distribution is different from that of girls, while the dispute resolution process is based on negotiations after there is no settlement, then by means of deliberation to reconcile the disputing parties by the Village Customary Institution and the Village Government.Keywords: The Existence of Customary Inheritance; Customary Inheritance Law; Patrilineal System

Abstract

This study intends to determine the legal protection of copyright as licenses for broadcast copyrighted world cup works. Specifically, this study investigates the legal protection criteria for licenses registered with the Directorate General for Intellectual Property Rights. In addition, it attempts to examine instances of court decisions relating to copyright licensing issues. This study employs normative research and literature in accordance with a statutory methodology. As described in Article 83, paragraph 1, of the Copyright Law No. 28 of 2014, copyright certainty is established if the copyright has been registered with the Directorate General for Intellectual Property Rights. In order for the license agreement to have legal repercussions for third parties, it must be registered, but in practice it cannot be executed because there are no penalties for third parties that break the license. Similarly, in the instance of copyright infringement, the Judicial Review decision No. 43 PK/Pdt.Sus-HKI/2017 is one of them. FIFA recognized PT Inter Sports Marketing as the exclusive licensee for the 2014 World Cup in Brazil, as the company had registered. Due to violations by a Semarang hotel, the verdict did not reflect the losses sustained. It seemed as though the registration had been in vain since it lacked sufficient legal clarity.

Abstract

Diversion is a sort of alternative dispute resolution that diverts child cases away from the conventional legal system and toward more informal means of conflict settlement. Children who are threatened with incarceration for a term of less than seven (seven) years and who have not committed a crime may be eligible for a diversion mediation process under Article 7 paragraph (2) of Law Number 11 of 2012 concerning the Juvenile Criminal Justice System. This process may be applied to cases in which the child is not guilty of a crime. The structure for diverting cases that is included in the Supreme Court Regulation represents an expansion of the legal meaning. Nevertheless, the Supreme Court Regulation in this instance needs to be in compliance with the provisions of the law that is already in place. In this study, a qualitative research method was combined with an approach based on literature and legislation. According to the findings of the study, developments regarding diversion regulations are contained in Supreme Court Regulation Number 4 of 2014 concerning Guidelines for the Implementation of Diversion in the Juvenile Criminal Justice System. As a result, this supreme court regulation permits diversion in terms of criminal acts that are punishable by imprisonment of 7 years or more in the form of a subsidiary.

Abstract

Already in 2014, restorative justice as a distinct approach within the general criminal justice system had been used as the basis to treat child victims and offenders (the child protection Act of 2014).  Nonetheless it is worth noticing that long before the promulgation of this Act, restorative justice has been used and is embedded in the living law of the Indonesian indigenous populations. This paper, using a descriptive analytical method, shall elaborate upon those traditional values found in the living law of the indigenous populations which resembles or reflects a restorative justice approach. The State of Indonesia as an archipelago with thousands of ethnic groups with a variety of different cultural customs in indigenous groups and local wisdom makes the State of Indonesia famous as a country rich in ethnicisity. The existence of indigenous community in various laws and regulations including the Constitution recognizes the existence of indigenous community and even the constitution mandates separate regulations in the form of laws to protect the existence of them and their customary rights

Abstract

The power that is held by human rights might be described as fundamental or basic in nature. People are able to more readily violate the rights of others since many people still do not understand how violation cases work. As a result, there are cases of violations that occur at the present time. A qualitative research method that takes an approach based on statutory regulation is the one that was used for this study. According to the findings presented in the conclusion, the protection and maintenance of human rights within the national institutional framework are established in institutions such as the National Women's Commission (Komnas Perempuan), the National Commission on Human Rights (Komnas HAM), and the Commission on Truth and Reconciliation. These institutions include the Indonesian Child Protection Commission (KPAI), the National Commission on Human Rights (Komnas HAM), and the Commission on Truth and Reconciliation (TRC). Despite this, the KKR was dissolved because it was seen to be incapable of performing its duties in an adequate manner.

Abstract

Tulisan ini akan membahas kontradiksi antara dua putusan Mahkamah Konstitusi yakni putusan nomor 77/PUU-IX/2011 dan putusan nomor 43/PUU-XI/2013 terkait status kekayaan pada BUMN yang berasal dari modal negara. Pada putusan pertama, Mahkamah Konstitusi telah memisahkan piutang Bank BUMN dari piutang negara karena kekayaan BUMN dianggap sebagai kekayaan perseroan. Anehnya, pada putusan yang berbeda Mahkamah Konstitusi berpendapat bahwa kekayaan BUMN tidak dapat dikatakan kekayaan perseroan melainkan termasuk kekayaan negara.  Tulisan ini disusun berdasarkan penelitian yuridis normatif yang menjadikan peraturan perundang-undangan sebagai sumber hukum primer dan kepustakaan sebagai bahan sekunder. Tulisan ini menemukan bahwa dikeluarkannya Putusan Mahkamah Konstitusi Nomor 77/PUU-IX/2011 menyebabkan Bank BUMN dapat mengurus sendiri piutang yang dimilikinya. Adapun Putusan Mahkamah Konstitusi Nomor 48/PUU-XI/2013 tidak memberikan implikasi terhadap pengurusan piutang Bank BUMN yang telah diserahkan oleh PUPN kepada Bank BUMN untuk diselesaikan berdasarkan hukum perseroan.

Abstract

Numerous parents utilize or even manipulate their children for their own profit. Typically, their treatment is motivated by money or economic issues. Numerous individuals immerse themselves in the demands of their existence without thinking about what they require and require. In this study, a qualitative descriptive methodology was employed. Based on the findings of this study, it was determined that there was a legal void in the implementation of criminal acts against offenders of economic exploitation of children. Even though the child's status in the eyes of the law has been accorded special protection, as stipulated in Law No. 23 of 2002 on Child Protection, this protection is not absolute. Children entitled to parental protection, affection, and supervision are educated and cared for in accordance with their rights as children so that there are no growth phase deviations. As an institution that concentrates on incidents of violence against children, the National Human Rights Commission can also demonstrate that numerous acts of violence have been committed against Indonesian children.
