Abstract

This study examines the relationship between brand differentiation strategies, technological innovation in digital marketplaces, and trademark protection under Indonesia’s Law No. 20 of 2016. Using a qualitative empirical–juridical approach, the research draws on semi-structured interviews with intellectual property officials, business actors, and marketplace stakeholders, complemented by document analysis and case studies. The findings indicate that global market competition and digitalisation encourage firms to strengthen brand differentiation through digital ecosystems, data-driven marketing, and platform technologies such as AI and blockchain. However, regulatory fragmentation, cross-border enforcement challenges, and limited intellectual property awareness among MSMEs hinder effective trademark protection. The study contributes to the literature by highlighting the emerging implications of immersive technologies (VR, AR, XR, and metaverse environments) for trademark protection and proposing an adaptive regulatory framework that integrates state regulation, platform governance, and business innovation.

Abstract

Abstract

Islamic microfinance has strategic potential as a productive investment instrument in empowering Micro, Small, and Medium Enterprises (MSMEs), but a comprehensive synthesis of this position is still absent from the literature. This research aims to map research trends, synthesize models and mechanisms that have proven to be effective, and formulate a future research agenda in the field of Islamic microfinance and MSME empowerment. The method used is Systematic Literature Review (SLR) with the PRISMA 2020 protocol, covering a systematic search on four databases (Scopus, Web of Science, Google Scholar, DOAJ) for the period 2015–2025. Of the 847 articles identified, 65 articles met the inclusion criteria and were synthesized using bibliometric analysis (VOSviewer) and thematic synthesis (framework analysis). The results show a significant increase in publication productivity since 2019, with Indonesia and Malaysia as the dominant contributors. Four Islamic microfinance models were identified as effective: the Sharia Graduation Model, Integrated Zakat-Microfinance, Productive Waqf, and Sharia Fintech, with the first two models having the strongest evidence base. Five priority research agendas were formulated, including standardization of productive investment indicators, longitudinal studies, integration of sharia fintech, synergy of zakat-state budget, and comparative studies across OIC countries. This research contributes by introducing a new framing of Islamic microfinance as a productive investment instrument, filling a conceptual gap that has not been answered in the Islamic economic literature

Abstract

This conceptual study explores the fundamental role of Islamic ethical principles in shaping regulatory frameworks for fintech systems in Muslim-majority societies. Although there is an increasing body of research on Islamic fintech, it primarily focuses on Shariah-compliant products, consumer behavior, and technological advancements. There is limited investigation into how Islamic moral values are integrated at the regulatory level. To address this gap, the study proposes a normative-empirical framework that places Islamic ethics (such as justice, transparency, the prohibition of riba and gharar, and the promotion of social welfare) at the core of fintech governance design and legitimacy. By combining Islamic ethical thought with modern regulatory theory, the paper presents a new perspective that aligns faith-based values with international regulatory standards. Theoretical implications include a new understanding of regulatory legitimacy grounded in Islamic Ethical Principles, while practical outcomes point to the creation of ethically-based fintech policies. The study also suggests directions for future empirical research, such as examining stakeholder perspectives, developing ethical value indices, and assessing the mediating role of regulatory awareness.

Abstract

CSR in the conventional perspective is disclosed using the Global Reporting Initiative (GRI) index, while CSR disclosure in the Islamic perspective uses Islamic Social Reporting. This study aims to analyze the disclosure of the ISR Index at Indonesian Sharia Commercial Banks for the period 2019-2023. The method used in this study is comparative qualitative with content analysis based on the concept of Shariah Enterprise Theory (SET). Based on the results of the study, overall, when viewed from the Islamic Social Reporting (ISR) Index, the level of disclosure carried out by each Islamic bank varies, indicating the company's ability to provide the best performance for the community. At Bank Syariah Indonesia, ISR disclosure has increased significantly since 2021, with an average ISR value of 92% in 2023, indicating highly informative disclosure. Bank Aceh Syariah remained stable at around 73–89%, which is typical for smaller regional banks with concise sustainability reports. Bank Muamalat scored lower, between 72–85%, but showed consistent and fairly comprehensive ISR disclosure. The corporate governance theme tends to have the highest score, while the environmental theme has the lowest score among the three banks, although it continues to improve every year. Disclosure scores are classified into the following categories: Very Informative (81-100).

Abstract

This study aims to examine the effect of gold prices, income, and Islamic financial behavior on public interest in investing in gold jewelry in Ujung Negeri Hulu Village, Bintang Bayu District, Serdang Bedagai Regency. This research uses a quantitative approach with a population of 485 people and a sample of 83 respondents selected using purposive sampling. Data were collected through questionnaires and analyzed using multiple linear regression with SPSS. The results show that partially, gold prices, income, and Islamic financial behavior have a positive and significant effect on investment interest. Simultaneously, these variables also have a significant effect on investment interest. The coefficient of determination (R²) is 0.589, indicating that 58.9% of the variation in investment interest can be explained by the independent variables, while 41.1% is influenced by other factors outside the model. This study contributes to the literature by integrating economic and Islamic behavioral factors in explaining investment interest in rural communities.

Abstract

This study examines the effect of sharia capital market education and investment accessibility on students’ investment intentions. While prior studies have predominantly focused on financial literacy and general investment intention, limited research integrates structured educational interventions with accessibility factors within the sharia investment context. This study adopts a quantitative approach using primary data collected from students at Universitas Islam Negeri Sumatera Utara. Data were analyzed using Partial Least Squares Structural Equation Modeling (PLS-SEM) with SmartPLS 4.0. The results indicate that participation in sharia capital market education significantly influences investment intention (t = 10.266; p < 0.001). Investment accessibility, represented by the ease of account opening, also shows a significant positive effect (t = 3.525; p < 0.001). The model explains 89.2% of the variance in investment intention (R² = 0.892). This study contributes to the literature by integrating educational intervention and accessibility within the framework of the Theory of Planned Behavior and behavioral finance. The findings highlight that structured education combined with accessible investment platforms plays a critical role in shaping students’ intention to invest in sharia financial instruments.

Abstract

Abstract

This study examines how fatwa acquires legal authority in Islamic financial regulation within pluralistic legal systems. Using a PRISMA-based systematic literature review and reflexive thematic analysis, it analyzes the transformation of fatwa into formal regulatory frameworks. Drawing on legal pluralism and legal legitimacy theories, the study argues that Islamic financial regulation operates within a hybrid legal structure where state law, Sharia principles, and global standards interact dynamically. The findings identify a dominant pattern in the literature: fatwa consistently functions as an epistemic authority, institutionalized through Sharia governance mechanisms and translated into binding regulatory norms. Through processes of interpretation, institutional mediation, and regulatory codification, fatwa evolves from a non-binding religious opinion into legally recognized norms, conceptualized here as an epistemic-legal transformation. This transformation is mediated by governance structures that bridge religious knowledge and formal legal systems. The study further demonstrates that legal legitimacy in Islamic finance is a hybrid construct integrating formal, social, and epistemic dimensions. By advancing the concept of hybrid legal legitimacy and the framework of epistemic-legal transformation, this study contributes to legal theory by incorporating epistemic authority into the analysis of law in pluralistic systems. Practically, the findings suggest that policymakers and regulators should strengthen institutional mechanisms that integrate fatwa into formal regulation to enhance legal certainty, consistency, and public trust in Islamic financial systems.
