VARIA HUKUM: Jurnal Forum Studi Hukum dan Kemasyarakatan is a periodical scientific journal published by the Law Studies Program, Faculty of Sharia and Law, State University of Sunan Gunung Djati, Bandung. The birth of the VARIA HUKUM journal is inseparable from the transformation of IAIN into UIN. This transformation has encouraged the delivery of faculties/general study programs and strengthened the existing faculties/religious studies programs. One of the general study programs is the law study program. The characteristics developed by the Legal Studies study program at UIN Sunan Gunung Djati Bandung are a legal, educational institution that can integrate the existence of sharia-based legal scholarship. This is a distinct colour in the world of higher legal education. The Journal of Varia Hukum is published every six months, in January and July. The review process in this journal employs a double-blind peer-review, which means that both the reviewer and author identities are concealed from the reviewers, and vice versa.

Abstract

Abstract: This study aims to examine and analyze the Pure Theory of Law developed by Hans Kelsen, focusing on both its strengths and weaknesses. Additionally, it assesses the extent to which this theory remains relevant and applicable in the context of contemporary law. The research employs a normative method with a conceptual approach to gain an in-depth understanding of the fundamental concepts within the Pure Theory of Law. This study is based on secondary data sourced from primary, secondary, and tertiary legal materials obtained through literature reviews and documentation. Data analysis is conducted using descriptive qualitative analysis. The findings indicate that Kelsen's theory provides a crucial foundation for the legal discipline, emphasizing that law should be understood as an autonomous normative system, independent of moral, social, and political values. However, in the face of ongoing social dynamics, such as globalization, digital technological advancements, and environmental crises, the Pure Theory of Law faces significant challenges due to its rigid and limited capacity to address the complexity of cross-border issues. While this theory remains vital as a basis for ensuring legal objectivity, its inability to accommodate social dynamics suggests that law requires a more flexible and adaptive approach.

Abstract

Abstract: Protection of customer personal data in the Indonesian banking sector is increasingly becoming a major concern with the rapid development of digital technology. The shift of banking transactions to digital platforms increases the risk of data leaks and the threat of cyber-attacks, requiring stricter regulations to safeguard sensitive customer information. This article evaluates the effectiveness of personal data protection regulations, including the implementation of the recently enacted Personal Data Protection Law, which in Indonesian, is named Undang-Undang Perlindungan Data Pribadi (UU PDP), as well as banks' responsibilities in maintaining the confidentiality and security of customer data. Using a normative juridical approach, this research assesses the policies and implementation of data protection by banks in Indonesia. The results of the analysis show that although many banks have taken proactive steps to protect customer data, there are still significant challenges in implementing regulations and increasing public awareness. Therefore, additional measures are needed to strengthen personal data protection and increase customer confidence in the banking system.

Abstract

Abstract The aim of this research is to analyze and discover war crimes and humanity that occurred in the armed conflict between Israel and Palestine, as well as analyze and discover the jurisdiction of the International Criminal Court which has issued arrest warrants for Benjamin Netanyahu and Yoav Gallant in this armed conflict. The method used in this research is a qualitative method with a normative juridical approach which examines research issues using various international legal instruments and doctrines from experts. The results of the analysis state that the war and humanitarian crimes that occurred in the Israeli and Palestinian conflict did not use and pay attention to restrictive legal instruments in international law, human rights principles, the ius cogen principle, and the Martens clause principle which prioritize the interests of peace, and prevent so that the conflict does not escalate further. The ICC as one of the institutions that has the authority to take action against perpetrators of international crimes has the opportunity to optimize its steps in making arrest warrants based on the 1998 Rome Statute, although it was found that the political element is still very strong considering that UN Security Council Resolutions are often "vetoed" by the United States which made effective steps towards the ICC facing obstacles, and solidarity from states party to the 1998 Rome Statute which was dichotomized by the refusal attitude of Hungary and Argentina, as well as the weak trend of international law as a law that has binding and coercive power against countries. Keywords: Jurisdiction, Arrest Warrant, International Criminal Court Abstrak Tujuan penelitian ini adalah untuk menganalisis dan menemukan kejahatan perang dan kemanusiaan yang terjadi dalam konflik bersenjata antara Israel dan Palestina, serta menganalisis dan menemukan yurisdiksi International Criminal Court yang telah membuat surat perintah penangkapan terhadap Benjamin Netanyahu dan Yoav Gallant dalam konflik bersenjata tersebut. Metode yang digunakan dalam penelitian ini adalah metode kualitatif dengan pendekatan yuridis normatif yang mengkaji isu penelitian menggunakan berbagai instrumen hukum internasional, dan doktrin-doktrin dari para ahli. Hasil analisis menyatakan bahwa kejahatan perang dan kemanusiaan yang terjadi dalam konflik Israel dan Palestina tidak menggunakan dan memperhatikan instrumen-instrumen hukum pembatasan dalam hukum internasional, prinsip hak asasi manusia, prinsip ius cogen, dan prinsip martens clause yang mengedepankan kepentingan-kepentingan perdamaian, dan mencegah agar eskalasi konflik tidak semakin meluas. ICC sebagai salah satu lembaga yang memiliki kewenangan untuk melakukan penindakan terhadap pelaku kejahatan internasional memiliki peluang untuk mengoptimalisasi langkahnya yang telah membuat surat perintah penangkapan berdasarkan Statuta Roma 1998, meskipun ditemukan bahwa unsur politis masih sangat kental mengingat Resolusi Dewan Keamanan PBB yang sering di “veto” oleh Amerika Serikat yang membuat langkah efektif ICC menghadapi hambatan, dan solidaritas dari negara pihak Statuta Roma 1998 yang terdikotomi oleh sikap menolak dari Hungaria dan Argentina, serta lemahnya tren hukum internasional sebagai hukum yang memiliki daya ikat dan daya paksa terhadap negara-negara. Abstract

Law enforcement is an effort to bring justice, benefits, and legal clarity into the real world, including in the context of traffic violations. One of the innovations implemented in traffic law enforcement is the electronic ticketing system (E-Tilang), which has been officially adopted in almost every major city. E-Tilang aims to provide a solution to issues such as congestion and uncertainty in traditional ticketing processes by utilizing information technology. This system allows officers to send ticketing data online, provide ticket payment notification numbers, and enable violators to pay fines without having to appear in court. However, the implementation of E-Tilang is not without various challenges, including legal, technological, and public acceptance issues. From the perspective of correctional institutions, the application of E-Tilang also relates to the rehabilitation aspect for traffic violators, which can influence approaches to punishment and reintegration of offenders into society. This article will discuss in detail the mechanism of law enforcement for traffic violations through the electronic ticketing system, as well as the challenges and efforts faced in this context, including obstacles in law enforcement, the readiness of law enforcement officers, and factors affecting the effectiveness of this system. It is hoped that through this discussion, solutions can be found to improve the quality of traffic law enforcement that is more efficient and just.

Abstract

Abstract: This research aims to explore the urgency and strategy of structuring the legal and human rights awareness curriculum through an anti-bullying dissemination study at the junior high school level. The formulation of the problem raised is how the urgency of developing a legal and human rights awareness curriculum and structuring efforts to increase students' understanding and awareness of legal and human rights issues, especially in the context of bullying prevention. The research method used an extension approach through stages that included needs assessment, interactive seminars, discussions, case simulations, and interpersonal skills training. The results showed that the implementation of a law and human rights-based curriculum had a significant impact in reducing cases of bullying, increasing empathy, and building a culture of respect for human rights in the educational environment. These findings emphasize the importance of integrating the values of law and human rights in the formal education system to create a young generation that is aware of the law, has character, and has a culture of peace.

Abstract

Abstract: The Family Hope Program (PKH) is a social protection program that provides cash assistance to low-income families who are designated as Beneficiary Families (KPM). PKH is a program targeting low-income families, with the primary focus on economically disadvantaged families. PKH is an initiative focused on the development and enhancement of human resources, with a particular emphasis on aspects of education, health, and social welfare. The purpose of this study was to determine the Implementation of the Family Hope Program Policy in Bojong Village, to find out the factors that hindered the Implementation of the Family Hope Program Policy in Bojong Village, to find out the efforts being made to overcome obstacles to the Implementation of the Family Hope Program Policy in Bojong Village—the third stage of payment and finally the commitment verification. The driving and inhibiting factors for PKH, which were implemented in Bojong Village, Bungbulang District, were that, although not fully implemented, the community acknowledged that this program had helped and provided relief to the community.

Abstract

Abstract: The use of absolute power of attorney (Kuasa Mutlak) in land Sale and Purchase Agreements (PPJB) still common in Indonesia, despite legal risks. Even after full payment, land ownership cannot be transferred without a Sale and Purchase Deed (AJB) and registration at the National Land Agency (BPN). While absolute power of attorney offers a quick solution, it violates contract principles and legal regulations, including the Minister of Home Affairs Instruction No. 14/1982. This study examines two key issues: (1) the legal consequences of absolute power of attorney in fully paid PPJBs, and (2) the mechanisms for protecting buyers in such cases. Through a normative analysis of court rulings and legal literature, the findings show that absolute power of attorney fails to secure buyer rights and often leads to disputes. To mitigate risks, stronger contractual clauses, stricter notarial oversight, and limited special power of attorney are proposed. The study recommends regulatory harmonization and public legal education to ensure safer and fairer land transactions.

Abstract

This article analyzes trends in sexual violence against women in Indonesia and West Java during 2020–2021, using structural and radical feminist theories from figures such as Sylvia Walby, Andrea Dworkin, bell hooks, Nancy Fraser, and Pierre Bourdieu. Data shows a significant increase in cases of sexual violence, including rape and harassment, dominated by perpetrators from the victim's immediate environment and exacerbated by the COVID-19 pandemic. The rape case in Cimahi is a concrete illustration of the failure of traditional protection systems for women. This research highlights the need for a multisectoral strategy and a collaborative governance model to address tradition-based violence that harms women. The West Java Provincial Government has begun implementing collaborative measures by involving service institutions, law enforcement officials, and civil society in providing protection and recovery for victims. This article recommends strengthening inclusive and gender-justice-based governance as key to preventing violence against women.

Abstract

This article highlights the need for reforming the regulation of compulsory licensing for non-pharmaceutical technologies in Indonesia by reviewing Law No. 13 of 2016 on Patents. This research employs a normative juridical approach, focusing on normative challenges and the rationale behind the urgency for reform. The findings indicate that current regulation remains limited to the pharmaceutical sector and lacks a clear operational definition of “public interest” in non-pharmaceutical contexts. Moreover, the absence of a Government Regulation outlining technical procedures, as well as the complexity of patent thickets in modern technologies, presents significant challenges. Such reform is essential to broaden access to strategic technologies, promote technology transfer, and reduce the dominance of foreign patents in key sectors of national development.

Abstract

The phenomenon of dupe culture—the trend of purchasing imitation products—has emerged as a growing consumer behaviour, particularly among younger, urban popular­tions seeking access to premium lifestyles at affordable prices. While economically viewed as a form of market inclusivity, this practice presents complex legal dilemmas, especially in the realm of Intellectual Property Rights (IPR) and trademark protection. This article critically examines how dupe culture operates within the blurred lines between inspired innovation and trademark infringement, and how Indonesian regulations respond to this challenge. Employing a normative and comparative legal approach, the study analyses regulatory gaps in trademark law and evaluates potential solutions, including ethical dupe certification, industry licensing collaborations, and consumer education. The findings suggest that an adaptive, participatory legal framework grounded in public literacy is essential to restructure duplicative practices in a way that safeguards creators' rights without stifling market dynamics. Consequently, dupe culture should not be viewed solely as a threat, but as an opportunity for IPR reform and the strengthening of the national creative industry ecosystem.
