Abstract

Konsistensi penerapan prinsip syariah dalam lembaga keuangan syariah seperti BMT sangat krusial dalam membangun kepercayaan nasabah. Penerapan terhadap fatwa DSN-MUI, transparansi dalam pengelolaan dana, pemisahan dana usaha dan sosial, serta edukasi kepada nasabah menjadi kunci utama. Kepercayaan nasabah terbentuk dari keyakinan bahwa dana mereka aman, pengelolaan adil, produk halal, dan lembaga berkomitmen pada prinsip syariah. Semua elemen ini saling terkait dan membentuk fondasi kuat bagi keberlanjutan lembaga keuangan syariah. Untuk itu, tujuan peneliian ini adalah untuk mengetahui pengaruh konsistensi penerapan prinsip syariah terhadap tingkat kepercayaan nasabah di BMT NU Cabang Bungatan Kapubaten Situbondo. Metode yang di digunakan penelitian ini adalah kuantitatif dengan pendekatan explanatory research, dengan sampel sebanyak 100 responden. Sedangkan pengambilan sampel menggunakan assidental sampling. analisis data menggunakan path analisis dengan uji F dan uji t. Uji hipotesis dilakukan dengan bantuan software Statistical Package for the (SPSS) versi 24. Konsistensi penerapan prinsip syariah berpengaruh signifikan terhadap tingkat kepercayaan nasabah. Kata Kunci: Konsistensi Penerapan, Prinsip Syariah, Kepercayaan Nasabah, BMT NU .

Abstract

Pemikiran Fiqh kebangsaan bermakna penting dalam membangun dan mempertahankan eksistensi Negara Kesatuan Republik Indonesia (NKRI) yang majemuk. Dengan menggunakan nalar Islam Kebangsaan, riset ini menunjukkan bahwa pemikiran fiqh kebangsaan KH Abdul Qodir Syam memiliki kedudukan penting dalam upaya membangun dan mempertahkan paham fiqh kebangsaan masyarakat terutama warga NU, sehingga paham moderasi beragama mereka tertap terjaga dan kehidupannya tetap harmonis. Penerapan pemikiran fiqh kebangsaan KH Abdul Qodir Syam itu tidak hanya berpijak pada tataran pemahaman fiqh bayani, tetapi juga pemahaman fiqh irfani dan fiqh buryani, sehingga pemikiran fiqh kebangsaan KH Abdul Qodir Syam dapat diterima dan bermanfaat dalam mewujudkan kemaslahatan hidup masyarakat Bondowoso secara hakiki.

Abstract

The phenomenon of unclear ownership status of inherited items from Islamic boarding schools (pesantren) often leads to ownership conflicts, especially when the items are reclaimed after a long time. This study aims to analyze the legal status of ownership of inherited items from Islamic boarding schools (pesantren) in Al-Qur'aniyy, Gajah City, Central Lampung, from the perspective of Islamic economic law. This study uses a qualitative method with a normative approach, through observation, interviews, and documentation techniques. The results show that items left by students remain private property until a valid contract is made in the form of a gift or wadi'ah. However, in practice, many students do not explicitly convey their intention to own, so that the pillars of the contract, such as ijab and qabul, are not fulfilled. The implication of this ambiguity is the potential for violations of ownership rights and misuse of assets. Therefore, written administrative policies and education related to Islamic contracts are needed to ensure the clarity of the status of items and realize the principle of Hifzh al-Mal in the maqashid sharia. Abstract

The development of financial technology (fintech) has significantly transformed digital payment systems in Indonesia, including in the context of Islamic economics. This study aims to analyze the regulation of sharia-compliant digital payment systems in Indonesia from the perspective of Islamic economic law. A normative juridical method is used, analyzing laws, fatwas, and literature related to sharia-based digital financial transactions. The study recommends strengthening regulatory frameworks, enhancing public education, and fostering collaboration among authorities, industry players, and academics to ensure the inclusive and sharia-compliant development of digital payment systems. Abstract

The distribution of zakat fitrah in Ciptasari Village, Hamlet 5, Mesuji Raya District, OKI Regency is carried out every year before Eid al-Fitr. In the distribution of zakat, there is a discrepancy in the distribution of the amount of zakat which is only divided into 3 groups, namely the poor, amil and sabilillah, where the share of the poor is the least compared to the others even though the poor are the group that is most prioritized in the distribution of zakat. This type of research is field research and uses a qualitative approach method. The results of this study indicate that the practice of distributing zakat fitrah in Ciptasari Village, Hamlet 5 is not in accordance with the perspective of Imam Syafi'i where the distribution of fair and targeted zakat fitrah has not been achieved as stated in one of his books. The implication of this study is to highlight local zakat fitrah managers to be more selective and pay more attention to the conditions of the local community. Abstract

Sharia financial inclusion through the LASISMA scheme is an important instrument in expanding access to fair and sustainable financing for MSMEs. This study aims to evaluate the effectiveness of LASISMA financing in enhancing Islamic financial inclusion at BMT NU East Java, Jambesari Branch, with a focus on implementation strategies, challenges, and its impact on MSMEs. This research employs a qualitative method with a case study approach through interviews, observations, and documentation. The findings reveal that LASISMA proven to be effective in helping MSME actors access Islamic financing, grow their businesses, and build economic independence. However, there are still challenges such as limited funding, lack of human resources, and low Islamic financial literacy. LASISMA financing plays a significant role in promoting Islamic financial inclusion, but institutional strengthening and more intensive assistance are needed to ensure the program runs more optimally and sustainably. Abstract

Zakat plays a vital role in poverty alleviation and community welfare. Beyond consumptive uses, zakat can be productively channeled for mustahik business financing through qardh (interest-free loan) schemes, guided by DSN-MUI Fatwa No. 19/DSN-MUI/IV/2001. This literature review aims to examine how zakat funds can be utilized as business capital via qardh contracts. The study adopts a literature review method by examining relevant fatwas, books, and academic journals. The findings indicate that qardh provides equitable funding, prevents beneficiaries from exploitative financial systems, and fosters sustainable zakat distribution as returned funds can be re-utilized. The qardh contract also proves more effective than grants in fostering responsibility and entrepreneurship. However, implementation faces challenges like low repayment rates (only 20% on time), weak mustahik managerial capacity, and insufficient continuous supervision. Implications suggest the need for entrepreneurship training, intensive mentoring, and integrated monitoring. Strong collaboration among zakat institutions, government, and the community has the potential to make zakat utilization through qardh a strategic solution for sustainable economic empowerment of the Muslim community. Abstract

Bank interest legality is a contemporary dilemma in Islam. While classical riba is universally prohibited , bank interest is intensely debated regarding its classification as riba. The controversy intensified with MUI's 2003 fatwa prohibiting it, though some still consider it permissible. To comprehensively examine scholars' and Islamic organizations' views on bank interest law and its relation to riba. Research Method: This is a library research study using primary and secondary data, analyzed through reduction, presentation, and conclusion drawing. Findings: Significant differences in opinion exist. Gus Baha and Syekh Turaichan Kudus distinguish bank interest from riba and permit it, considering economic stability and currency devaluation. Yusuf Al-Qardhawi strictly prohibits bank interest, classifying it as riba and a cause of global crises. Mohammad Sayyid Thanthawi argues bank interest is not forbidden, differing from coercive pre-Islamic riba due to consent and information in current transactions. Abstract

This study aims to analyze the perspective of Sharia Economic Law on uncertainty in online transactions, particularly those related to the prohibition of gharar (uncertainty or excessive speculation). The phenomenon of online transactions is growing rapidly, but it often contains elements of uncertainty, both in terms of product specifications, payment systems, and delivery mechanisms. This study employs a library research method, analyzing various literary sources such as fiqh books, scientific journals, Islamic Economic Law textbooks, and official fatwas related to online transactions. The results indicate that the prohibition of gharar in online transactions is highly relevant to prevent trading practices that involve uncertainty. From the perspective of Islamic Economic Law, gharar is prohibited because it can harm one party and cause injustice. Therefore, online transactions must adhere to the principles of transparency (al-wuduh), clarity of contracts, and legal certainty, including in terms of product specifications, pricing, and delivery systems. This study recommends strengthening Sharia-based regulations in online transactions to prevent gharar practices and provide legal protection for consumers and businesses. Abstract

The development of the Islamic financial industry encourages microfinance institutions to continue to present innovative products, one of which is the Emas gold installment financing offered by KSPPS BMT NU East Java. This product is a sharia-based gold installment financing that aims to provide an alternative investment as well as a safe and affordable financing solution for the community. This study uses a qualitative approach with a descriptive method to examine how this product is implemented, including the contracts used and their advantages and challenges. The results of the study indicate that the implementation of contracts in Islamic Financial Institutions (LKS) in Indonesia has generally been carried out in accordance with sharia principles, but still faces significant challenges in terms of understanding and operational consistency. The main findings of this study highlight that the murabahah contract is most dominantly used because it is considered easier to implement and understand by customers and institutions. The main advantage of the implementation of the murabahah contract is to adjust to the financing needs of the community without violating the principle of the prohibition of usury. However, the most important challenge that must be understood in this context is the low level of sharia literacy among banking practitioners and customers, as well as the suboptimal internal supervision of sharia in maintaining the integrity of the contract.
