Abstract

Karyawan yang turnover karena stres kerja meningkat dari kondisi sebelum pandemi dan saat pandemi terjadi. Kesusahan beradaptasi karyawan merupakan faktor utama dari tingginya turnover. Keadaan ketika terjadi pandemi beban kerja bertambah mengakibatkan kelelahan fisik karena kekurangan karyawan, hal ini menimbulkan peningkatan stres kerja. Untuk menjaga kondisi karyawan perlu diberikan intervensi berupa pelatihan self efficacy untuk meningkatkan resilinsi pada karyawan. Tujuan penelitian ini untuk mengetahui efektifitas pengaruh pelatihan self efficacy terhadap peningkatan kemampuan resiliensi karyawan dan melihat adanya perubahan sebelum dan sesudah diberikan pelatihan self efficacy pada karyawan perusahaan x di surabaya. Penelitian ini menggunakan metode ekperimen one group dengan menguji pretest- posttest satu kelompok ekperimen. Subjek penelitian berjumlah 11 peserta yang menjadi kelompok ekperimen. Teknik pengambilan sampel dalam penelitian ini menggunakan teknik total sampling. Hasil penelitian ini menunjukkan ada perbedaan tingkat resiliensi yang disignifikan pada saat pretest dan posttest. Berdasarkan hasil analisis setiap aspek resiliensi diketahui bahwa peningkatan tertinggi ada pada self efficacy dengan rata-rata 4,54 sedangkan peningkatan rata- rata paling rendah adalah regulasi emosi 1,09. Kesimpulan dari penelitian ini menunjukkan Ha diterima, menyatakan bahwa terdapat pengaruh pelatihan self efficacy terhadap peningkatan resiliensi karyawan perusahaan x di Surabaya.

Abstract

A state agency that has a good work culture can be seen and observed by the people who receive public services. This can also be seen at the South Medan Samsat Integrated Service Unit (UPT) Office. UPT Samsat South Medan is a representative of a Government Institution which is engaged in providing services to the public, namely in the form of motor vehicle ownership management services to the public. The public's views on the quality of service at the South Medan SAMSAT UPT Office vary, but in general the quality of the service provided is quite satisfactory to the public.

Abstract

This research explores the social construction within the "Friends with Benefits" (FWB) relationships among young people in the city of Manado. Employing a qualitative method involving in-depth interviews and participatory observation, the study reveals that the FWB concept extends beyond the physical dimension, encompassing emotional and social aspects. Young individuals in FWB relationships in Manado tend to construct the meaning and boundaries of these relationships in alignment with local cultural values. Within the dynamics of FWB, adjustments and reinterpretations of existing social norms are evident, creating a space acceptable within society. The ambiguity in FWB relationship boundaries highlights the ongoing process of social construction, reflecting the dynamics of modern young interpersonal relationships. These findings provide profound insights into the complexity of social constructions in FWB within the local cultural context, emphasizing the importance of understanding shifts in norms and values in interpersonal relationships.

Abstract

This research aims to describe the form of dysphemism in the Kiky Kompleks Podcast Episode Pengakuan Kaesang Soal Dinasti Politik through the study of the theory of Wijana & Rohmadi. The research method uses a qualitative descriptive with data collection of SBLC techniques and recorded techniques. The data in this study used data in the form of discourse manipulation in the Kiky Kompleks Podcast of Pengakuan Kaesang Soal Dinasti Politik that has elements of the theory of Wijana and Rohmadi and the theories of Firmansyah, Ristiyani, and Roysa. The object of the study is Kiky Saputri, Pak RT, House Assistant, and resource person (Kaesang Pangarep). Based on data analysis, the researchers found that dysphemism in the Kiky Kompleks Podcast of Pengakuan Kaesang Soal Dinasti Politik has three forms: namely rudeness or swearing in the form of words, rudeness or swearing in the form of phrases, and rudeness or insults in the form of clauses.

Abstract

This research aims to determine the application of material criminal law to narcotics crimes in the case of Decision Number 156/PID.SUS/2023/PN.STB. And to find out the judge's legal considerations in imposing criminal sanctions on perpetrators of narcotics crimes in decision No156/PID.SUS/2023/PN.STB. The research used to answer the two things above is literature research on decisions and the author took data obtained from court decisions at the Stabat District Court. The results of this research indicate that the application of material criminal law to narcotics crimes in the judge's decision in case no. 2207/PID.SUS/2022/PN.MDN. In accordance with the law, in this case it is regulated in Law number 35 of 2009 concerning narcotics offenses in handing down criminal sentences, the judge has given considerations in accordance with the facts and those revealed in court, both in terms of material criminal and formal criminal considerations. Penelitian ini bertujuan untuk mengetahui penerapan hukum pidana materil terhadap tindak pidana narkotika dalam perkara Putusan Nomor 156/PID.SUS/2023/PN.STB. Dan untuk mengetahui pertimbangan hukum hakim dalam menjatuhkan sanksi pidana terhadap pelaku tindak pidana narkotika dalam putusan No156/PID.SUS/2023/PN.STB. Penelitian yang digunakan untuk menjawab dua hal diatas adalah penelitian kepustakaan keputusan dan Penulis mengambil data yang diperoleh dari putusan pengadilan di Pengadilan Negeri Stabat. Dari hasil penelitian ini menunjukkan bahwa penerapan hukum pidana materil terhadap tindak pidana narkotika dalam putusan hakim dalam perkara No. 2207/PID.SUS/2022/PN.MDN. Telah sesuai dengan perundangundangan dalam hal ini diatur dalam Undang-undang nomor 35 tahun 2009 tentang tindak narkotika dalam menjatuhkan vonis pidana hakim telah memberikan pertimbangan-pertimbangan sesuai dengan fakta dan terungkap dipersidangan baik itu dari pertimbangan segi pidana materil maupun dari pidana formil.

Abstract

One of the problems that often arises in employment relations is the problem of layoffs, where workers are always the weak party when faced with employers who are parties who have strength, as parties who are always considered weak, it is not uncommon for workers to always experience injustice when faced with company interests. The purpose of this study is to determine the obligations of Sari Mutiara Medan General Hospital (Defendant) towards the rights of workers / SUTRISNI (Plaintiff) based on a work mutation letter dated June 14, 2018 Number: 837 / I.2 / RSU-SM / VI / 2018 without clear procedural and legal basis and does not pay attention to objectivity / fulfill a sense of justice and know the legal consequences of the decision Number 272 / Pdt.Sus-PHI / 2021 / PN.Mdn concerning termination of employment of the parties (Employers and Workers). The type of research used in this study uses normative juridical research methods. The problem approach used in this study includes the legal approach and the case approach. The results of the study show that layoffs are employment relationships due to certain things that result in the end of rights and obligations between workers and companies. This can happen due to resignation, dismissal by the company or expiration of the contract. In the world of work, especially for workers, it cannot be separated from the word layoff and can come at any time. But companies laying off workers must have their own reasons, therefore the Manpower Law was created. And more precisely in Article 150 – Article 172, it is regulated about the reasons for layoffs. In Decision Number 272 / Pdt.Sus-PHI / 2018 / Pn.Mdn that I took, contains a case about "Claims against companies that have laid off 1 worker / worker". Salah satu permasalahan yang sering muncul dalam hubungan kerja adalah permasalahan PHK, dimana tenaga kerja selalu menjadi pihak yang lemah apabila dihadapkan pada pemberi kerja yang merupakan pihak yang memiliki kekuatan, sebagai pihak yang selalu dianggap lemah tidak jarang para tenaga kerja selalu mengalami ketidakadilan apabila berhadapan dengan kepentingan perusahaan. Adapun tujuan dari penelitian ini yaitu untuk mengetahui kewajiban Rumah Sakit Umum Sari Mutiara Medan (Tergugat) terhadap hak-hak pekerja / SUTRISNI (Penggugat) berdasarkan surat mutasi kerja tertanggal 14 Juni 2018 Nomor: 837/I.2/RSU-SM/VI/2018 tanpa prosedural dan dasar hukum yang jelas serta tidak memperhatikan objektifitas / memenuhi rasa keadilan serta mengetahui akibat hukum dari putusan Nomor 272/Pdt.Sus-PHI/2021/PN.Mdn tentang pemutusan hubungan kerja terhadap para pihak (Pengusaha dan Pekerja). Jenis penelitian yang digunakan dalam penelitian ini menggunakan metode penelitian yuridis normatif. Pendekatan masalah yang digunakan dalam penelitian ini meliputi pendekatan undang-undang dan pendekatan kasus. Hasil penelitian mnunjukkan bahwa PHK adalah hubungan kerja karena suatu hal tertentu yang mengakibatkan berakhirnya hak dan kewajiban antara pekerja dan perusahaan. Hal ini dapat terjadi karena pengunduran diri, pemberhentian oleh perusahaan atau habis kontrak. Dalam dunia kerja, terutama bagi para tenaga kerja tidak bisa terlepas dari kata PHK dan bisa sewaktu-waktu datang kapan saja. Tetapi perusahaan melakukan PHK kepada para tenaga kerja pasti memiliki alasan tersendiri, oleh karena itu diciptakanlah UU Ketenagakerjaan. Dan lebih tepatnya didalam Pasal 150 – Pasal 172 tersebut, diatur tentang alasan dilakukannya PHK. Didalam Putusan Nomor 272/Pdt.Sus-PHI/2018/Pn.Mdn yang saya ambil, berisi kasus tentang “Tuntutan terhadap perusahaan yang telah melakukan PHK terhadap 1 tenaga kerja/buruh”.

Abstract

The Internet of Things (Internet of Things ), also known as the connectivity of various physical objects to the internet for autonomous data exchange, has become an integral part of human life. Its impact extends beyond the conventional use of smartphones for social media, influencing diverse aspect of daily activities. This research focuses on exploring the extent to which women in the city of Manado engage with Internet of Things . Employing a descriptive qualitative approach, with theory of utilization and using phenomenological methods, the study utilizes a Combination Purposive sampling technique based on the analysis of individuals actively involved in various activity (Patton, 2002). Both secondary and primary data sources are employed with the researcher serving as the primary instrument. Initially, ten informants were selected, but to enhance information gathering, an online platform survey was distributed, resulting in responses from twenty one informants. The study reveals that women in Manado extensively leverage Internet of Things technology, particularly through Internet of Things – based application on smartphones, while also utilizing devices in their artificial environments due to their availability.

Abstract

The main problem at the BKPP (Regional Personnel Board) of North Minahasa Regency is the low motivation of employees, influenced by factors such as delayed payment of allowances, political speculation in job promotions, unclean working conditions, and suboptimal implementation of training knowledge. The impact is evident in low work discipline, high levels of absenteeism, and strategic performance targets that have not been achieved. Solutions are needed to improve work motivation and address inhibiting factors to enhance public service effectiveness. This research aims to, first, assess the impact of compensation on the work motivation of Civil Servants at the BKPP of North Minahasa Regency in the context of public service. Second, identify the influence of promotions on employee motivation within the institution. Third, evaluate the relationship between the work environment and the work motivation of Civil Servants at the BKPP of North Minahasa Regency in the implementation of public services. Fourth, determine to what extent human resource development affects the work motivation of employees in the context of public service in the institution. The research method employed is explanatory with a quantitative approach, and data collection is done using questionnaires. The research sample involves 100 Civil Servants selected purposively. Data analysis is performed using SPSS to test validity, reliability, and hypotheses. The research results are expected to provide a better understanding of the factors influencing employee work motivation in the institution. The t-test analysis results show that the variables of compensation (X1), job promotion (X2), and the work environment (X3) significantly influence the work motivation (Y) of Civil Servants at the BKPP of North Minahasa Regency, with respective t-values of 2.389 (sig. 0.019), 2.270 (sig. 0.025), and 2.137 (sig. 0.035). However, the human resource development variable (X4) does not have a significant impact on work motivation, with a t-value of 0.494 (sig. 0.622). These results indicate that compensation, job promotion, and the work environment have a positive impact on work motivation, while human resource development does not significantly influence the work motivation of Civil Servants in the institution.

Abstract

Cases of women who become pregnant out of wedlock and their children certainly have various impacts resulting in abortion. The Criminal Code prohibits abortion, but Law no. 36 of 2009 concerning Health allows abortion but by providing the conditions contained in Article 76 of the Health Law. If the abortion does not comply with the requirements in Article 76 of the Health Law, then the child rape victim who undergoes an abortion may be subject to a crime under Article 194 of the Health Law. This research focuses on legal protection for children who are pregnant out of wedlock and undergo abortions. This research discusses Decision Number: Number 5/Pid.SusAnak/2018/PN.Mbn. In this case, it was stated that the child defendant had an abortion under the influence of coercion from her biological mother. Victims have the right to receive protection both materially and psychologically in the form of providing victims' rights during the case resolution process in accordance with the provisions contained in Article 7a of Law Number 31 of 2014 concerning Amendments to Law Number 13 of 2006 concerning Protection of Witnesses and Victims ( LPSK Law). Based on the provisions contained in the LPSK Law, victims of criminal acts are entitled to receive restitution in the form of: a. compensation for loss of wealth or income; b. compensation for losses incurred as a result of suffering directly related to criminal acts; and/or c. reimbursement for medical and/or psychological care. However, in this decision the victim has not received his rights

Abstract

The relationship between doctor and patient is a relationship based on the law. Practically, both doctor and patient have the same potential to experience loss or disadvantages due to one of the parties violate the obligations and rights. Treatment of disease that involves two parties – the health service provider and the patient – should be protected by law. It is to embody the highest degree of health for the community in order to achieve a strong, healthy, and productive nation. The aim of this writing is to know all matters concerning the state regulation of relationship between doctor and patient, including each party’s obligations and rights as well as legal protection for both doctor and patient. Method of this writing is qualitative descriptive by collecting data and information based on health laws in Indonesia, as well as literature research. Other source of data and information are from relevant writing such as scientific journal, thesis, books and other electronic media.
