Abstract

The Standard Inpatient Class (KRIS) policy introduced by BPJS Kesehatan aims to enhance equitable healthcare quality by standardizing hospital inpatient facilities in Indonesia. However, its implementation has raised concerns due to its significant impact on hospital bed availability, particularly in facilities with limited capacity, leading to challenges in service accessibility and quality. This study aims to examine the implications of the KRIS policy on bed capacity and healthcare service standards, as well as the obstacles faced by hospitals in maintaining service quality for BPJS participants. Employing a normative juridical method, the research systematically analyzes legal materials, including Presidential Regulation Number 59 of 2024, alongside relevant secondary literature. The findings reveal that the policy, while intended to improve service equity, has resulted in a notable decline in bed capacity, increased waiting times, and heightened workloads for medical personnel, particularly in resource-constrained hospitals. Hospitals in remote areas face additional challenges in meeting infrastructure requirements due to budget limitations. The study concludes that balancing the policy's quality standards with resource availability remains a critical issue, necessitating sustainable financial strategies, capacity-building programs, and innovative resource management solutions to ensure equitable healthcare access for all BPJS participants. Future research should focus on comparative assessments, patient satisfaction, and alternative strategies to optimize policy outcomes.

Abstract

Artificial intelligence (AI) has emerged as a promising technology in the field of healthcare, enabling the development of innovative solutions that enhance the quality and efficiency of medical services. The application of AI in the management of patient data has facilitated the acceleration, optimization, and precision of this process, which can subsequently improve the quality of healthcare services. This study aims to analyse the legal challenges that arise with the use of digital technology and artificial intelligence in patient data management, and to identify relevant legal solutions to overcome these problems. The study employs library research techniques, analysing statutory provisions and drawing on both written and unwritten positive law to examine legal issues. The results show that the integration of AI and digital technology in healthcare has yielded significant advantages, including enhanced efficiency, precision in diagnosis, and the harnessing of big data for patient care. However, a number of significant challenges remain, particularly with regard to the safeguarding of personal data. The formulation of an ethical framework for the utilisation of AI, the establishment of rigorous safety standards and the continuation of research in this domain are vital to enhance the advantages and mitigate the risks associated with the deployment of AI. It is imperative that health institutions and AI developers implement robust cybersecurity standards and periodic assessments for potential system vulnerabilities.

Abstract

In the digital era, intellectual property rights (IPR) face unprecedented challenges due to rapid technological advancements and the global accessibility of digital content. This study examines the impact of digital developments on copyright infringement in Indonesia, a diverse and pluralistic society, and analyzes effective legal approaches for copyright protection within its unique socio-cultural context. Employing a normative-juridical approach, the research explores existing legal frameworks, including Indonesia’s Copyright Law and the Electronic Information and Transaction Law, to assess their capacity to address issues related to digital copyright infringement and the role of artificial intelligence (AI) in both enforcing and infringing copyright. By analyzing relevant statutes and applying a conceptual approach, the study evaluates the extent to which current legal mechanisms support creators' rights while balancing cultural values. The findings reveal that Indonesia’s legal framework requires adaptive and culturally relevant modifications to effectively protect copyright in a digitally connected, multicultural society. This research contributes to the discourse on digital copyright law, emphasizing the need for flexible regulations and collaborative efforts among government, communities, and stakeholders to foster compliance and awareness. Future research is recommended to focus on adaptive regulatory models that integrate technology with IPR protection and explore international cooperation to address the global challenges of digital copyright.

Abstract

The Indonesian National Armed Forces (TNI) are frequently exposed to the risk of physical and mental injuries that may result in disability. The integration of artificial intelligence (AI) into integrated rehabilitation programs has the potential to expedite the recovery process, enhance diagnostic precision, and facilitate more tailored and efficacious care. This study aims to examine the role of Integrated Rehabilitation at the Rehabilitation Center of the Ministry of Defense of the Republic of Indonesia in improving the quality of life for Indonesian national army soldiers with disabilities. The research employs a normative juridical research method to systematically investigate the legal framework underpinning rehabilitation programs for soldiers and explores the potential integration of AI into these processes. The results show that the integrated rehabilitation services at Pusrehab Kemhan can improve the operational efficiency of the rehabilitation centre. The incorporation of AI in rehabilitation processes serves a crucial purpose in the context of improving the effectiveness of rehabilitation services for people with disabilities, especially for TNI soldiers. Despite challenges related to patient data privacy and security, the potential of AI is enormous.

Abstract

Hospitals often encounter financial difficulties when non-BPJS patients evade payment due to financial incapacity, with some institutions unfairly shifting the financial burden onto doctors. This situation raises serious legal, ethical, and employment concerns, especially in light of Law No. 17 of 2023 on Health, which mandates institutional responsibility for patient management. Meanwhile, Artificial Intelligence (AI) offers promising solutions for predicting and mitigating financial risks by identifying high-risk patients, though it introduces new challenges regarding data privacy, accountability, and liability. This study aims to explore the legal protections available to doctors when patients abscond without paying, and to propose a legal framework for integrating AI in healthcare to prevent such incidents. Using a normative legal approach, the research analyzes key provisions of Law No. 17/2023, employment regulations, and relevant case studies involving financial disputes between doctors and hospitals. The results show that imposing financial liability on doctors not only breaches employment principles but also contradicts healthcare regulations. Furthermore, AI can improve financial risk management by helping hospitals predict and prevent non-payment cases, though its implementation requires clear legal guidelines to avoid unintended consequences for medical staff. In conclusion, hospitals must bear financial responsibility for unpaid patient bills to protect doctors' legal rights. Additionally, a comprehensive regulatory framework for AI is essential to ensure that the technology is implemented fairly, safeguarding both healthcare professionals and patient interests.

Abstract

The aim of this study is to investigate the effect of the use of the alphabet mystery box media on early reading skills in early childhood. A literature review was conducted using Google Scholar, Google Search, and ResearchGate. A total of 13 peer-reviewed publications, dated between 2015 and 2024, were included in the review, covering studies in both English and Indonesian. The data analysis utilized content analysis to examine findings related to the Alphabet Mystery Box media and its influence on early childhood reading skills, contextualized within relevant theories and previous research. The results of the study show that the ability to read early through the using of alphabet box media for early childhood has a significant impact on early literacy skills. The use of "magic box" learning media can improve children's cognitive and language skills, including recognizing numbers, alphabets, and colors. This article aims to optimize the reading ability of children aged 0-6 years, which is considered a critical developmental period. This research could assess how integrating traditional and digital media impacts engagement and the effectiveness of early reading instruction.

Abstract

Personal data have become a critical issue in the era of global connectivity, where the use of mobile devices such as smartphones and tablets connected to the internet has created an increasingly complex communication network. In recent years, there has been a significant increase in cases of personal data abuse in the banking sector, especially concerning fraudulent loan applications. This study aims to identify the factors that create a legal vacuum in the protection of victims of data abuse. This research adopts a normative legal methodology aimed at examining various legal regulations in Indonesia related to personal data protection. The findings can serve as a foundation for further research aiming at developing comprehensive legal solutions and enhancing victim support mechanisms.

Abstract

This research discusses the legal consequences that arise for licensees when the owner of Intellectual Property Rights (IPR) experiences bankruptcy. The background of this research is the legal uncertainty regarding the fate of licenses granted by an IPR owner declared bankrupt, considering that the assets of the owner, including IPR, become part of the bankruptcy estate. The research method used is normative legal research, with a legislative approach and analysis of relevant court decisions. This research also uses secondary data in the form of related legal literature. The findings indicate that the bankruptcy of the IPR owner can potentially affect the rights and obligations of the licensee, especially concerning the continuity of the granted license. In some cases, the curator handling the bankruptcy estate has the authority to decide to continue or terminate the license agreement. However, legal protection for the licensee depends on the content of the license agreement and applicable legal provisions. Thus, the licensee is at risk of losing their licensing rights if there is no clear provision in the agreement or adequate legal protection from the law. This research recommends clearer regulations to protect licensees in situations where the owner of IPR experiences bankruptcy.

Abstract

This study examines the impact of the elimination of the investigation stage in the Draft Criminal Procedure Code (RUU KUHAP) on the dynamics of criminal law enforcement in Indonesia. The study utilizes various data sources, including legislative texts, government regulations, judicial decisions, and academic literature related to the topic, in order to understand the legal foundation governing the issue. The author analyzed the data through a qualitative approach, employing comparative legal analysis to evaluate the implications of various legal provisions, exploring their effectiveness and relevance in law enforcement practice. Furthermore, the author engaged in thematic analysis to explore the broader impacts of these reforms on legal practice and the enforcement of the criminal law, assessing the effectiveness and relevant of the existing legal framework in light of the proposed reforms. The results demonstrate that the abolition of the investigator position in the draft criminal procedure code has significant implications for the criminal procedural law system in Indonesia, paving the way for further discussions on improving criminal procedure and enhancing the effectiveness of law enforcement. This research could contribute to refining the legal framework and operational practices in Indonesia to ensure a balance between effective crime control and the protection of civil liberties.

Abstract

The rise of app-based transportation services has led to a shift in lifestyle from conventional to online, from shopping needs to public transportation orders and various other services. The study aimed to explore the legal uncertainty that currently exists in the regulation of apps-based transport services, as well as the barriers and efforts to create legal certainty in this context. This study analyzed the data through a qualitative approach, employing a combination of legal analysis and comparative methods. The results show that the lack of clear regulations regarding the use of two-wheeled vehicles as public transport creates significant weaknesses within the industry. The lack of fair competition principles in Indonesia is an important concern in the context of transportation regulation. This work provides valuable insights for policymakers, regulators, and stakeholders involved in the transportation sector, suggesting pathways for improving regulatory clarity and effectiveness. By analyzing these areas, future research could contribute valuable insights to aid policymakers in creating a more coherent, effective, and responsive regulatory environment that supports the sustainable growth of the app based transportation sector while ensuring the safety and protection of all parties involved. This research could include comparative analyses of successful regulatory models from other jurisdictions that have effectively harmonized their regulations while fostering innovation and consumer protection.
