Abstract

The Law on Dependent Rights provides convenience and certainty for Holders of Dependent Rights to carry out execution through public auctions. The execution of the right of dependency can be carried out in two ways, namely the Execution Parate based on Article 6 of the Law on the Rights of Dependency, or through the FiatĀ  of the District Court Execution based on Article 14 paragraphs (2) and (3) of the Law on the Rights of Dependency. In this writing, the main focus is to analyze the lawsuit against the defendant who is considered an unlawful act in the execution of the right of dependency through the implementation of an auction. This paper is expected to provide a comprehensive overview of the legal consequences arising from the existence of a civil lawsuit against the auction of the execution of the Right of Dependency and whether it is possible to conduct an auction without a court determination. The research used the doctrinal research method with the type of research used by the author based on its nature as an explanatory research, using case data in the Supreme Court Decision Number 3600 K/Pdt/2020 associated with principles, legal norms and laws and regulations. Lawsuits and fights create legal uncertainty for the Holder of Dependent Rights, auction buyers and other parties related to the execution of Dependent Rights.

Abstract

This study investigates the presence and significance of the Pasai tombstone typology in the Great Mosque of Demak, highlighting its archaeological significance as evidence of historical collaboration between Pasay and Demak in the 16th century to resist Portuguese colonization and establish the city of Jakarta. From all areas studied, 13 tombstones were found with the characteristics of the typology. The existence of this headstone in the cemetery area of the Demak Grand Mosque shows the connection between Demak Raden Trenggono and Pasais Fatahillah Against the Portuguese and the establishment of Jakarta is indeed an alliance between the two groups. This research explores the cultural and religious impact of the Wali Songo's religious and cultural teachings during the period of resistance against colonization, particularly in relation to their influence on the socio-political landscape of Java. In addition, oral histories and local narratives are collected that may shed light on the perceptions and legacies of Wali songo in the context of the resistance against Portuguese colonialism. This work enhances our understanding of regional interactions and cultural exchanges during a critical period in Southeast Asian history.

Abstract

This research aims to determine the provincial priorities for the development of the mosque-based ZISWAF ecosystem by Bank Syariah Indonesia (BSI). This study employs a descriptive qualitative approach, focusing on texts, expressions, and behaviors of resource persons to explore the potential of mosques and the potential for economic and financial empowerment of the people. The study uses a structured interview method to identify key areas on the islands of Java and Sumatra, specifically highlighting East Java, West Java, Jakarta, Aceh, and South Java, as well as additional regions like East Kalimantan, South Sulawesi, and Bali. The results of the study also show that there are differences, advantages, and disadvantages of UPZ and MPZ both in terms of legality, institutional, work patterns, operations, sustainability, and fund distribution flows. There are four clusters of challenges faced by Bank BSI in efforts to develop the mosque and mosque ecosystem in Indonesia, namely, the human resources of amil and nazhir mosques, worshippers and residents around mosques (government regulations and budgets), and the legality of mosque LPZs (local government budgets). The study also shows that there is a significant difference in the quality of mosque management based on dimensions, variables, and indicators on the existing mosque index. It is hoped that the use of this instrument can make it easier for Bank FSI to develop a mosque and its ecosystem for the progress and welfare of people and the nation.

Abstract

Health is a fundamental aspect of human life, and the right to choose health care facilities, including vaccination, is crucial to the enforcement of human rights. In the digital age, the role of Artificial Intelligence (AI) in optimizing health services, particularly in vaccination distribution and monitoring, has become significant. AI systems can enhance transparency, accuracy, and accessibility in providing health care, but they also raise questions about accountability and ethical concerns. This study examines the state's responsibility in regulating the use of AI for the protection of patients' rights, focusing on AI's role in ensuring safe, licensed vaccines for children and equitable access to healthcare facilities. The study also analyses how AI could improve the state's efforts in fulfilling its human rights obligations by making healthcare more efficient and inclusive. A normative juridical method is employed, using a statutory and analytical approach, to explore the legal frameworks governing AI in health care and the state's responsibility. The findings reveal gaps in current legal protections against the use of unlicensed vaccines, and the unequal access to AI-supported health services for vulnerable groups, such as children. While AI can help identify and distribute vaccines more effectively, the state has yet to fully implement regulations that guarantee fairness and safety in AI-driven health services. The integration of AI into healthcare poses both opportunities and challenges, and the state must strengthen its accountability mechanisms to ensure AI supports human rights, especially children's right to access safe and reliable vaccinations.

Abstract

Investigating common crimes in Indonesia often faces challenges in proving them. DNA testing is internationally recognized as an accurate method of proof. However, its implementation in Indonesia is still hampered by limited health facilities and human resources, especially experts such as forensic scientists and law enforcement officials who are skilled in the use of forensic technology and analysis. With technological advancements, especially artificial intelligence, there is potential to improve the effectiveness of DNA testing in investigations. The purpose of this study is to evaluate the challenges in implementing artificial intelligence-based DNA tests in the investigation of common crimes in Indonesia and to identify strategic measures to overcome these barriers while maximizing the potential of this technology in law enforcement. The research method used is normative juridical, using a legal approach and an analytical approach. The findings of the study suggest that while artificial intelligence-based DNA testing has the potential to improve the effectiveness of investigations, significant challenges remain, including inadequate infrastructure, a lack of understanding among law enforcement officials, and the need for specialized training for forensic personnel. Furthermore, although Article 75 letter l of Law Number 35 of 2009 regulates the use of DNA tests, more detailed regulations are needed for the application of artificial intelligence in forensic analysis and evidence collection. AI-based DNA tests can improve the accuracy and efficiency of criminal investigations in Indonesia. Regulatory reform and collaboration between governments, educational institutions, and the private sector are needed to address the challenges and develop guidelines for their use.

Abstract

The distribution of land inheritance often poses challenges, particularly within the context of customary law that varies by region. The role of notaries, recognized legally to draft authentic deeds in accordance with Article 16, Paragraph (1), letters a and b of Law No. 2 of 2014 on Amendments to Law No. 30 of 2004 on Notary Positions, is crucial in providing legal certainty and preventing disputes among heirs. In this era of technological advancement, artificial intelligence (AI) can assist notaries in expediting and simplifying the resolution of land inheritance issues more efficiently while adhering to applicable customary law provisions. The purpose of this research is to analyse the role of notaries in the resolution of land inheritance distribution under customary law and to explore the potential utilization of artificial intelligence in assisting this process. The research method used is normative juridical, using a statutory approach and an analytical approach. The research shows that artificial intelligence (AI) can assist notaries in document verification, heir identification, and the application of complex customary law. AI accelerates the process and reduces the potential for disputes, but it requires regulatory adjustments and increased technological literacy among notaries and the public. Artificial intelligence (AI) has significant potential to optimize the role of notaries in resolving land inheritance under customary law by accelerating processes, improving accuracy, and ensuring fairness. However, the successful implementation of AI requires clear regulations and collaboration between the government, legal institutions, and customary communities.

Abstract

Children with special needs are vulnerable in rural areas to nutrition problems, including stunting, due to limited access to health services and minimal nutrition knowledge. Article 11 of Law No. 17 of 2023 on Health emphasizes the responsibility of the Central and Local Governments to provide access to healthcare facilities and health education. In this case, the utilization of artificial intelligence (AI) can help monitor, diagnose, and intervene more effectively against stunting through accurate data analysis and timely recommendations. The objective of this study is to analyse the legal challenges related to child nutritional health, especially stunting in children with special needs in rural areas, and explore the potential of utilizing AI in addressing this issue. The research method used is normative juridical, using a statutory approach and an analytical approach. The results show that children with special needs in rural areas face various challenges in accessing health services and nutritional information. Limited access, lack of community knowledge about the importance of nutrition, and lack of effective intervention programs are the main obstacles. On the other hand, the use of AI can help in early detection and treatment of stunting through health data analysis, and provide appropriate intervention recommendations. The use of artificial intelligence has great potential in improving the effectiveness of child nutrition health programs and reducing stunting cases among children with special needs in rural areas. Collaboration between the government, health institutions, and technology is needed to implement this solution effectively and sustainably.
