Abstract

This research aims to analyze the level of sharia compliance at KSPPS BMT Guna Lestari. The main focus of this research is to identify factors that influence sharia compliance and the role of the Sharia Supervisory Board (DPS) in maintaining operational integrity in accordance with sharia principles. The method used is a qualitative approach with case studies, where data is collected through semi-structured interviews, observation and documentation. The research results show that sharia compliance at KSPPS BMT Guna Lestari is influenced by the availability of DPS resources, reporting and coordination systems, as well as the culture of sharia compliance within the organization. DPS plays a significant role, although challenges such as limited resources and lack of employee technical understanding regarding sharia still exist. This research suggests the need for better resource allocation for DPS as well as more in-depth training for employees to improve sharia compliance.

Abstract

This study aims to analyze the impact of grounding system improvements on crossarm voltage and the potential occurrence of back flashover in power transmission networks. Initially, the grounding resistance reached 33.2 Ω, exceeding the IEEE Std 80-2000 standard, with lightning current assumed between 20 kA and 80 kA. Simulation results show that crossarm voltage without considering the corona effect reached 1493.715 kV, while with the corona effect, it reached 1533.7 kV, both exceeding the flashover voltage threshold of 1440.439 kV. After improvements were made by extending the grounding electrode, the resistance decreased to 7.489 Ω (simulated) and 5.20 Ω (measured in the field). The crossarm voltage without corona effect dropped to 1438.829 kV and 1433.947 kV, approaching or below the flashover voltage limit. However, crossarm voltage with the corona effect remained above the threshold at 1508.4 kV and 1505.9 kV. These results indicate that while grounding improvements effectively reduce back flashover risk, the corona effect remains a factor that must be further mitigated to achieve optimal protection.  Gateway have a positive and significant influence on SMEs' performance.

Abstract

The aim of this research is to analyze the legal provisions for legal protection of the rights of creditors holding mortgage rights over land which is the object of land acquisition for public purposes whose funds have been entrusted to the court. This research uses normative legal research methods with a statutory approach. The research data consists of primary, secondary and tertiary legal materials which were collected using library study techniques and analyzed using qualitative normative data analysis methods. The results of the research and discussion are, the legal position of Mortgage Rights where land is the object of land acquisition as well as legal protection for creditors in land procurement regulations where legal certainty has not been achieved, because there is a legal vacuum that regulates how creditors obtain compensation funds, so it is necessary to add provisions to be able to exercise the right of claim in changes to land procurement regulations so that creditors/banks are involved in the land procurement stages and it is necessary to regulate how the creditor can obtain all or part of the compensation received by the giver of the Mortgage Rights for the repayment of his receivables if the object of the Mortgage Rights is revoked. public interest.

Abstract

The aim of this research is to determine the ownership status of inherited assets that are still being rented by third parties, the distribution of inherited assets that are still being rented by third parties whose lease terms have not yet ended, and to analyze the judge's considerations in the Supreme Court Decision Number 1935 K/PDT/2023. The method used in this writing is a normative juridical research method, namely a method that refers to legal norms carried out by means of literature study. This research has a descriptive nature, and the data is analyzed qualitatively and conclusions are drawn deductively. The research results found that the ownership status of inherited assets that are still rented by third parties remains jointly owned by the heirs, without changing the ownership status of the inherited objects. Distribution of inherited assets in this condition can be done in several ways, such as selling the inherited object along with the rental rights, waiting for the lease period to end before dividing, or dividing the rental proceeds proportionally between the heirs. This is in line with the Supreme Court decision Number 1935 K/PDT/2023, where the judge emphasized the principle of justice in the distribution of inheritance by giving equal rights to all legal heirs, including ordering the disputed object to be vacated for sale and the proceeds of the sale to be divided equally among all heir. This decision strengthens the understanding that the heirs' rights to inherited assets are still recognized and protected, even though the objects of inheritance are being rented by a third party.

Abstract

This research examines the 2 to 1 inheritance distribution system from a maqasid sharia perspective, with a focus on justice and prosperity in family inheritance. The distribution of inheritance in Islamic law, especially which stipulates that men have twice the rights compared to women, often triggers controversy regarding gender issues. Through a library research approach, this research analyzes how the principles of maqasid sharia—protection of the soul, mind, and offspring—can be integrated to formulate a fairer and more sustainable distribution system. Research finds that understanding inheritance law, social norms, economic conditions and education have a significant influence on the implementation of this system. In addition, challenges in upholding justice and adapting inheritance provisions to the modern context are also identified. Thus, this research provides recommendations for more inclusive inheritance law reform, ensuring that the principles of maqasid sharia are applied to achieve wider benefits, for the welfare of all family members, especially women.

Abstract

In ancient times, the Jahiliyah Arab community believed in the month of Safar as a month that brought bad luck. But not all people believe in this. Because there are so many traditions that are often carried out by many groups to welcome the month of Safar, one of them is to do Betanding for newborn babies. The purpose of this study is to find out how the cultural development contained in the Batanding tradition is in the Banjar community who live in Sangasanga District. The factors that underlie some Banjar people believe in and carry out certain practices in the month of Safar based on information from the books of previous scholars submitted by religious leaders so that a process of suggestion and imitation of behavior occurs (modelling). This tradition has been passed down from generation to generation until now. The motivation and goal is to gain safety and avoid bad luck.

Abstract

The system of evidence in civil cases only needs to be realized by the judge in the form of formal truth. However, Decision Number: 850/Pdt.G/2023/PA.Smd The Panel of Judges has put aside the principle of formal evidence and used a material evidence system to find the truth in the inheritance case. The aim of this research is to understand the concept of proof in civil cases in Indonesia and analyze the proof system in Decision Number: 850/Pdt.G/2023/PA.Smd. This research is normative research with a statutory and conceptual approach. The results of the study show that inheritance cases are one of the civil cases, where the evidentiary system achieves formal truth. Decision Number: 850/Pdt.G/2023/PA.Smd provides the view that although inheritance is one of the civil cases, it is not necessarily rigid to the civil law evidentiary system which seeks formal truth, but depends on the circumstances and position of the case which requires proof others in seeking the truth of a dispute, one of which is through the testimony of witnesses who are decisive in the judge a quo's considerations.
