Abstract

This research aims to analyse the concept of the rule of law in the 1945 Constitution of the Republic of Indonesia (UUD 1945) and evaluate the extent to which the principle of the rule of law is implemented in Indonesia's constitutional structure. Using a normative juridical approach and a positivistic paradigm, this research finds that the implementation of the principle of the rule of law in Indonesia still faces significant challenges, including inharmonious regulations, corruption, and limited independence of the judiciary. This research provides recommendations for improvements to the legal system and government institutions to reflect the principle of the rule of law that is more consistent with constitutional values, which is expected to strengthen fair and transparent legal governance in Indonesia.

Abstract

The transformation of Indonesia's governance system through decentralization has granted extensive authority to local governments to manage administrative affairs based on their unique potentials and needs. The principle of decentralization aims to accelerate development and enhance community welfare through improved public services. However, the implementation of this principle faces numerous challenges, including regional development disparities, abuse of power, and suboptimal budget management. This study employs a juridical-normative approach to analyze the effectiveness of decentralization in regional autonomy, focusing on supervision, budget allocation, and the administrative capacity of local governments. The findings reveal that while decentralization has the potential to accelerate development, fiscal imbalances and weak supervision remain significant obstacles. Consequently, reforms in oversight systems and more transparent budget management, alongside enhanced local government capacity, are necessary to maximize the benefits of decentralization. The study recommends strengthening supervision, improving central-local coordination, and adjusting budget allocations to reduce regional development disparities. These measures are expected to help achieve the goals of decentralization in fostering equitable development and enhancing community welfare.

Abstract

This research aims to analyse the legal protection of the first wife's rights in the division of joint property in polygamous marriages in Indonesia. Through a normative juridical approach, this research examines the legal provisions governing the division of joint property as well as the challenges in practice. The results show that despite clear arrangements in the Marriage Law and the Compilation of Islamic Law, in practice injustice often occurs to the first wife, both from formal legal aspects and socio-psychological factors. Therefore, legal policy reform and strengthening of legal protection mechanisms are needed to ensure justice for the first wife in the division of joint property in polygamous marriages.

Abstract

This research aims to review and analyse the legal protection provided to notaries in disputes over default of land sale and purchase agreement (PPJB) in Indonesia. The main focus of this research is to identify the extent to which existing legal provisions, both in Law Number 2 Year 2014 on the Notary Position (UUJN) and in the Criminal Code (KUHP), can protect notaries from the legal consequences that may arise in cases of default. Through a normative legal approach, this study finds that although UUJN authorises notaries to draft valid authentic deeds, legal protection for notaries in the context of default disputes is still limited. Therefore, this study recommends the strengthening of more comprehensive regulations and clearer legal protection mechanisms for notaries, in order to provide legal certainty in carrying out their professional duties. This research is expected to contribute to the understanding of the rights and obligations of notaries and strengthen the integrity of the land law system in Indonesia.

Abstract

This study investigates the implementation of the Village Fund Allocation policy in Sansarino Village, Ampana City District, Tojo Una-Una Regency. Utilizing a qualitative descriptive approach, this research identifies factors influencing the policy’s effectiveness, including standards, resources, communication, and the socio-economic environment. Data were collected through purposive sampling, involving key informants such as village officials and community members. The analysis applies Van Meter and Van Horn’s policy implementation model. Results indicate significant challenges, including resource inadequacies, lack of coordination, and discrepancies between policy objectives and community needs. Recommendations include enhancing human resources, fostering collaboration among stakeholders, and ensuring better alignment between policy goals and local contexts. This study contributes to the discourse on public policy implementation in rural settings.

Abstract

This study examines t,he implementation of the Corporate Social Responsibility (CSR) program by PTPN I Regional 7, specifically the Micro and Small Business Funding Program (PUMK), in the Southern Sumatra region. Using a descriptive qualitative approach, the research explores the program's impact on micro, small, and medium enterprises (MSMEs) and local economic development. Data collection involved interviews, document analysis, and stakeholder observations, including beneficiaries and company representatives. The findings reveal that the PUMK program has successfully increased access to capital, provided training, and created job opportunities, particularly in Lampung, South Sumatra, and Bengkulu. However, implementation in South Sumatra lags behind other regions due to challenges such as limited information dissemination and low managerial capacity among MSME actors. Strategic collaboration with Bank Rakyat Indonesia (BRI) has significantly improved program reach and impact. Despite these successes, further evaluation and efforts are necessary to address existing challenges and optimize the program’s effectiveness. Enhancing digital access, increasing loan ceilings, and integrating environmental sustainability are recommended to ensure broader and more sustainable impacts.

Abstract

This study examines the impact of fraud findings in procurement processes and the level of auditor experience on audit results, using a case study of Company X. Company X experienced significant financial performance changes in the form of increases, followed by fraud incidents during the audit period. The research employs a qualitative approach with data collected through interviews and examination of audit evidence. The findings indicate that significant fraud findings and the level of auditor experience critically influence the audit results and the opinion issued. The study emphasizes the importance of thorough and careful risk assessment and the need for auditors to adjust their audit strategies in response to new evidence, including fraud findings. Additionally, the research highlights the necessity for robust internal controls and the auditor's role in ensuring the accuracy and reliability of financial statements. The results suggest that when significant fraud is detected, auditors must reassess risks, adjust audit procedures, and issue an appropriate opinion that reflects the true state of the financial statements.

Abstract

This research arises from the rapid introduction of electric vehicles (EVs) in response to sustainability concerns. Many studies have analyzed the switching intention mechanism from the utilitarian perspective. However, fewer studies address EV adoption from a psychological standpoint. Using the Value Belief Norm framework, this study investigates the psychological values influencing an individual's intention to switch from conventional to electric vehicles driven by their norms. This research uses a quantitative approach, using a survey method. Using convenience sampling, we gathered 294 usable responses. Data was analyzed using the Partial Least Squares Structural Equation Model (PLS-SEM). The results show that individuals with a New Environmental Paradigm (NEP) will be more aware of environmental problems. NEP, as a customer value, drives individuals’ belief that there is an ecological problem. NEP also drives self-efficacy in understanding environmental issues. Data support that problem awareness and self-efficacy will form personal norms that, in turn, will create the intention to switch to electric vehicles. This research provides theoretical implications by highlighting individuals' switching intentions to use electric vehicles, reflecting social transformation and commitment to sustainable practices. The value-belief-norm (VBN) Theory suggests that individual, exceptionally altruistic values play a significant role in pro-environmental behaviors such as using electric vehicles.

Abstract

The objective of this. Research determines the influence between customer satisfaction and service quality, as well as the likelihood of customers making repeat purchases at the Honda Motor TDM Natar dealership. Maintaining high service standards and ensuring customer satisfaction are essential for client retention and encouraging repeat business in the competitive automotive industry. Although previous studies have examined the link between these two factors, this research focuses specifically on Honda Motor dealers in Natar, an area that has not been previously studied. The analysis utilizes SPSS version 30 software to perform a multiple linear regression analysis, employing non-probability sampling methods, particularly purposive sampling. An aggregate of 87 customers of the Honda Motor TDM Natar dealership were surveyed using questionnaires to gather data. The results determine the influence customer satisfaction and service quality.

Abstract

This research aims to analyze the legal certainty of electronic land certificates in land registration in Indonesia, with a normative approach through literature studies that analyze various related laws and regulations. Electronic land certificates are expected to provide convenience and transparency in the land registration process. However, the implementation of this system faces challenges, especially related to the validity of electronic documents, the misuse of multiple certificates, and the role of notaries in the installation of mortgage rights. This study found that despite efforts to strengthen legal certainty through regulations related to electronic land registration, implementation and law enforcement issues still need to be improved. Therefore, it is necessary to strengthen regulations, increase public understanding, and stricter supervision of the implementation of electronic land registration in Indonesia.
