Abstract

Education in Indonesia is undergoing significant transformation influenced by technological advances, policy changes, and the challenges of globalization. This article discusses the role of Total Quality Management (TQM) as a strategic approach to improving the quality of education, while also addressing the challenges faced by the national education sector. The purpose of this study is to explore the application of TQM in creating quality education through continuous improvement, stakeholder engagement, and strong leadership. This study uses a literature review method to analyze various relevant references. The results of the study indicate that TQM contributes to improving the quality of education through the integration of the principles of planning, implementation, evaluation, and continuous improvement. TQM also facilitates the active involvement of all stakeholders, including educators, students, and the community, to promote a culture of quality. In addition, the application of technology in education is recognized for its potential in improving the effectiveness of learning and administration. The successful implementation of TQM requires adequate infrastructure, continuous training for teachers, and policies that support educational equality and innovation. This implementation is expected to be able to create a globally competitive education system, producing innovative and highly competitive graduates.

Abstract

The Bukit Barisan Selatan National Park (TNBBS) in Tanggamus Regency has tourism potential that has not been optimally managed by the local government. This study aims to analyze the efforts of the local government in managing TNBBS as a tourist destination based on Tanggamus Regency Regional Regulation No. 6 of 2019 on Integrated Tourism Development, as well as to identify the natural resources that can be developed. This research employs the theories of authority and tourism, using an empirical juridical method with a descriptive-analytical approach. Primary and secondary data were collected through interviews, observations, and documentation, then analyzed descriptively using a qualitative approach. The results indicate that the Tanggamus Regency Government has made efforts to designate tourist destinations, coordinate development, and organize tourism education, training, and research. TNBBS has several tourism potentials, including Sukaraja Waterfall, Teluk Semaka, camping grounds, Tarsius and Rafflesia observation plots, and other biodiversity. However, these efforts remain suboptimal, particularly in tourism marketing, since the primary authority for managing TNBBS lies with the Bukit Barisan Selatan National Park Agency as a conservation area. The tourism potential in this region has met several strategic tourism area aspects outlined in Article 32 of Regional Regulation No. 6 of 2019. In conclusion, although the local government has carried out part of its authority, further optimization of tourism management and marketing is still needed. Therefore, the local government is expected to be more proactive in promoting tourism to enhance the attractiveness of TNBBS in the Tanggamus area.

Abstract

This research aims to analyze the function of law as a tool of social engineering in household waste management in Tanggamus Regency. The research method used is normative research with a legislative approach. The results of the study show that there are three regional regulations that serve as tools of social engineering in waste management in Tanggamus Regency. The law in waste management in Tanggamus Regency aims to address two main aspects: “waste handling” and the “obligations of traders and area managers.” Waste handling is organized on three scales: small, medium, and large. Meanwhile, the obligations of traders and area managers include the provision of facilities and infrastructure that cover waste sorting, collection, and processing at the regional scale.

Abstract

Transfer of land and building rights can be obtained through a legal act of sale and purchase that can be initiated by a PPJB made before a Notary so that the PPJB is essentially an authentic deed that has perfect evidentiary force. However, although the PPJB has often been used by the parties as the basis for the sale and purchase transaction, in practice it still often causes problems because one of them is proven to have committed a breach of contract in the implementation of the PPJB which can be seen in the case in Decision Number 45 / Pdt.G / 2023 / PN.Mdn. The formulation of the problem in this thesis is how is the legal basis for the use of PPJB in regulating the sale and purchase of land and buildings in Indonesia, how is the legal force of PPJB related to the breach of contract carried out by one of the parties in providing legal certainty for the parties, and how is the analysis of the judge's considerations and decisions in civil cases in Decision Number 45 / Pdt. G / 2023 / PN.Mdn. The method used in this research is a juridical-normative research method using primary data and secondary data with interview methods, a statutory regulatory approach, and a case approach, and in drawing conclusions, deductive reasoning is used, namely by thinking fundamentally about general matters and then drawing specific conclusions. The results of this thesis research are that the legal basis for the use of PPJB in regulating the sale and purchase of land and buildings in Indonesia is not contained in the Civil Code but comes from the customary law of Notaries/PPAT based on the principle of freedom of contract, its use is carried out in cases where the signing of the AJB cannot be done before the PPAT, the legal force of the PPJB related to default by one of the parties is if the PPJB is made before a Notary, then the PPJB has strong legal force so that if there is a condition of default because one of the parties does not fulfill its obligations in the PPJB, then the PPJB still has legal force to be implemented, and the considerations and decisions of the Panel of Judges in Decision Number 45/Pdt.G/2023/PN.Mdn which stated that the Defendant was in default in the implementation of the PPJB were appropriate because the considerations were in accordance with the provisions of laws and regulations and the theory of legal certainty so that the PPJB has binding legal force and has provided legal certainty.

Abstract

The influence of health policies on legal protection for medical personnel and patients is an important issue in efforts to improve the quality of health services. Clear and comprehensive policies are needed to regulate the rights and obligations of medical personnel and patients, as well as to reduce the risk of legal disputes. With good regulations, medical personnel can carry out their duties professionally and patients are protected from malpractice or medical negligence. In addition, specific policies regarding medical procedures, drug management, and health service standards provide clear guidance for medical personnel, thereby minimizing the potential for legal violations. Health policies must also ensure equitable access to health services for all levels of society, including vulnerable groups. Thus, effective health policies can guarantee adequate legal protection for medical personnel and patients and increase public trust in the health system.

Abstract

This article discusses the legal liability of hospitals in cases of medical malpractice based on Law No. 17 of 2023 concerning Health. This law provides a clear legal framework regarding the obligation of hospitals to ensure that all medical procedures performed are in accordance with applicable professional standards. In the event of malpractice, the hospital may be subject to civil liability to provide compensation to the victim as well as criminal liability if there is evidence of negligence or gross violations. In addition, Law No. 17 of 2023 emphasizes the patient's right to obtain safe and quality medical services, with a structured complaint and dispute resolution mechanism, as well as supervision and sanctions for violations. Thus, this law is designed to improve the quality of health services and strengthen patient protection from the risk of medical malpractice.

Abstract

The use of cloud services has become increasingly common in recent years, but this brings significant challenges related to data privacy and security. This paper examines the legal and regulatory perspectives on data privacy and security in cloud services. With regulations such as the General Data Protection Regulation (GDPR) in the European Union, strict standards have been set to protect personal data. The responsibility for ensuring data privacy and security must be shared between cloud service providers and users, with clear policies and contracts defining their respective responsibilities. Furthermore, as technology advances rapidly, regulations must continue to evolve to address new challenges and ensure adequate data protection. International collaboration and increased technological awareness among policymakers are also key factors in this effort.

Abstract

This study aims to analyze the determinants of QRIS adoption in Indonesia by integrating technological, psychological, and contextual perspectives. Using Structural Equation Modeling (SEM) on 320 user data, the study examined the influence of factors such as perceived ease of use (PEOU), user trust, promotion & education, and user satisfaction on QRIS adoption. The results show that user satisfaction and promotion-education have a significant effect on adoption, while ease of use only impacts satisfaction, not direct adoption. In contrast to classical theory, user trust is not significant in the Indonesian context, allegedly due to the dominance of financial incentive factors, government policies, and MSMEs' preference for practical benefits. These findings reinforce the relevance of Expectation-Confirmation Theory (ECT) and Diffusion of Innovation (DOI), while also highlighting the uniqueness of locality where targeted education and cashback programs are more effective than just system trust. The practical implications emphasize the need for an integrated strategy: economic benefit-based promotional campaigns, improved technical infrastructure to ensure the speed and security of transactions, and collaboration between regulators and service providers in expanding incentives for MSMEs. Further research is suggested to explore cultural factors (e.g., resistance to cashless transactions in rural areas) and qualitative approaches to understanding the perceptions of older generations. The study provides a holistic framework to accelerate the digital transformation of Indonesia's payments sector, prioritizing local context and real-world user experience.

Abstract

Financial Distress can be caused by a problematic economy in a company and cause economic instability in a company that can even lead to bankruptcy. This study aims to (1) determine the effect of liquidity, leverage, and profitability on financial distress (2) determine how profitability mediates the relationship between liquidity and leverage on financial distress. Research on all mining sector companies listed on the IDX for the 2017-2023 period. A population of 63 companies with a sample of 30 companies. The method used is purposive sampling. And the data analysis used is path analysis with SmartPLS 4.0 software. Based on the final results of this study, liquidity has a positive effect on financial distress, leverage does not affect financial distress, profitability has a positive effect on financial distress, liquidity does not affect profitability, leverage has a negative effect on profitability, then profitability is unable to mediate the effect of liquidity on financial distress, and profitability is able to mediate the effect of leverage on financial distress. The importance of financial distress analysis is to help management in making decisions to improve the company's financial situation faster before it gets worse, and so that external parties can invest in the company.

Abstract

This study examines the influence of Financial Literacy on Financial Inclusion by considering the role of Infrastructural Facility and Policy and Regulation as mediation variables. The study was conducted on MSMEs in the city of Pangkalpinang with 224 respondents, Data collection was carried out by distributing questionnaires online using Google Forms. The results of the analysis show that Financial Literacy has a significant effect on Financial Inclusion, both directly and through the Infrastructural Facility. On the other hand, mediation through Policy and Regulation is not significant, indicating that political regulation has not played an optimal role in increasing financial inclusion. These findings emphasize the importance of encouraging investment in strengthening infrastructure such as fintech networks and banking services in remote areas as an effective strategy in encouraging wider access to finance. In addition, regulations related to political and financial policies need to be evaluated to be more adaptive and effective in supporting people's financial literacy and access. More applicable financial education programs also need to be expanded through cooperation between the government, the private sector, and MSMEs to increase public understanding and participation in the formal financial system. Further research is suggested to explore additional factors and use a longitudinal approach to gain a more comprehensive understanding.
