Abstract

Laws are guidelines and rules related to the concept of social life and will always be in accordance with the conditions of society. Law is a demand to be able to provide justice, meaning that law is always faced with the question of whether the law can achieve justice. Related to this legal concept, legal politics is defined as activities that determine patterns and ways of forming laws, overseeing the operation of laws, and updating laws for the purposes of the State. Therefore, law is a determinant of politics, and is also related to democracy in the sense that political activities are regulated and must comply with legal rules. Law is viewed from the perspective of das sollen (necessity), viewing that law must be guided by the relationships between members of society. Meanwhile, those who view it from the point of view of das sein (reality), empiricists see that law is greatly influenced by politics, not only in the process of making it, but also in its empirical realities. So that law is influenced by politics and even today, legal autonomy in Indonesia is often intervened by politics, not only in terms of its creation, but also in its implementation, both in terms of law enforcement. This research aims to find out what is the impact of legal political developments on law enforcement in Indonesia? How does legal politics exist in law enforcement in Indonesia? The method used in research is normative juridical.

Abstract

This paper aims to analyze the implementation of Ministerial Instruction No. 1 of 2023 concerning Halal Certification of Products and Canteens within the Ministry of Religious Affairs Work Unit, a case study of the policy of the Rector of State Islamic Religious Universities Se – North Sumatra. The research method used is empirical law research by looking at and observing the rules related to the implementation of the acceleration of canteen halal certification in the PTKIN campus environment throughout North Sumatra. The results showed that the rector's policy related to the Instruction of the Minister of Religious Affairs which appealed to coordinate the acceleration of halal certification of products and canteens in the campus environment until now has not been circulated The Rector's Certificate about every canteen business actor is required to have Halal Certification because this regulation is still relatively new, therefore the Rector still uses the old rules / policies by selling halal products in accordance with the agreed contract together with canteen business actors. It is hoped that the Rector's policy will not only become a legal instrument, but also as a guide and spur to carry out the instruction of the Minister of Religious Affairs No. 1 of 2023 effectively and ensure that Islamic values ​​are well maintained in the campus environment.

Abstract

The Village Consultative Body (BPD) is an institution that carries out village government functions whose members are representatives of the village population based on regional representation and are determined democratically. In the village government system, village government will run effectively if the elements or institutions administering village government can run well. The Village Consultative Body (BPD) is an institution that embodies democracy in the administration of village government. BPD members are representatives of the population of the village concerned based on regional representation. In general, those selected to be members of the BPD consist of the chairman of the Rukun Warga, traditional leaders, professional groups, religious leaders and other figures or community leaders. It can be concluded that the function of the Village Consultative Body (BPD) is to discuss and approve Draft Village Regulations, accommodate community aspirations, and supervise the performance of the Village Head. Based on the research results, it shows that the function in making regulations is more implemented and realized, which is different from the function in accommodating community aspirations and supervising the performance of the Village Head, which has not been optimal in its implementation due to the lack of understanding of BPD members regarding their duties and functions based on applicable regulations.

Abstract

Villages as the main milestone in the development of the State have the right of origin and traditional rights in regulating and managing the interests of local communities and play a role in realizing the ideals of independence based on the 1945 Constitution of the Republic of Indonesia, although Village Regulations are not explicitly explained in the hierarchy of legislation in Indonesia. Villages in their governance and development arrangements are regulated in Law No. 6 of 2014. This research is a descriptive qualitative research with the type of research used is Field Research. The results of this study are the implementation of the formation of village regulations in Pakkat Hauagong Village, Humbang Hasundutan Regency still has many shortcomings in the formation process. In the formation of village regulations in Pakkat Hauagong Village, there are still many inhibiting factors such as people who are still unfamiliar with village regulations, lack of cooperation between the Village Head and the Village Consultative Body (BPD) and Pakkat Hauagong Village as a village where the majority of Batak Toba people are still more dominant in using customary law than village regulations in solving problems.

Abstract

This study endeavors to explore the intricate connection between Human Resource Management (HRM) practices and Organizational Resilience, with a specific emphasis on dimensions such as leadership, innovation, employee performance, and system satisfaction. Employing a literature review methodology, a comprehensive understanding framework was constructed by examining insights from various prominent studies available in Scopus, ScienceDirect, and ResearchGate journals. The outcomes underscore the pivotal role of HRM in confronting unparalleled challenges, especially during crises like the COVID-19 pandemic. Notably, it was discovered that the quality of systems, information, and services significantly influences user satisfaction within e-learning systems. Furthermore, the characteristics of boards, including board size, the proportion of independent commissioners, and board meeting frequency, exhibit an impact on CSR disclosure in the mining industry. The findings also illuminate the intricate nature of digital HRM transformation, emphasizing the necessity for a holistic approach that encompasses process reengineering, competency development, and organizational culture change. Practical implications emanating from the research involve refining marketing and service strategies based on factors that influence customer satisfaction. In the context of bolstering global competitiveness, the study highlights the pivotal role of knowledge management, emphasizing the imperative to concentrate on knowledge management strategies amidst intensifying global competition. Consequently, this research contributes profound insights, theoretical advancements, and invaluable practical recommendations for prospective research endeavors and HRM practitioners.

Abstract

Law Number 16 of 2019 Amendments to Law Number 1 of 1974 concerning Marriage increases the minimum age for marriage for both men and women to 19 years. This is not just equalizing the minimum age for men and women, but there are government legal policies to improve the quality of Indonesian marriages. The age limit for marriage for citizens is in principle intended to ensure that couples who are getting married are expected to have maturity of thought, mental maturity and adequate physical strength. The legal politics of marriage dispensation in Indonesia are related to Marriage Law. Marriage dispensation is regulated in the law because the minimum age limit for marriage has been changed to 19 years for both sexes. Marriage dispensation legal policies are influenced by philosophical and sociological considerations such as justice, benefit, expediency and legal certainty. PERMA Number 5 of 2019 provides guidelines and standards for judges in considering and determining dispensational marriages and paying attention to the best interests of children. However, clearer clarification is needed from the State regarding the emergency situation that allows marriage dispensations and stricter procedures for marriage dispensation to prevent premature marriage.

Abstract

This research aims to determine regional financial independence and a comparison of regional financial independence in the 5 parent Regency Governments and 5 expansion Regency/Cities in Aceh Province in 2015-2020. The data analysis methods used are Descriptive Statistical Tests and Comparative Tests. The results of the research show that: the regional financial independence of North Aceh Regency in 2015, 2017 and 2019-2020 is included in the instructive relationship pattern, while in 2016 and 2018 it is included in the instructive relationship pattern. consultative relationship. Lhokseumawe City, South Aceh Regency, Aceh Singkil Regency, Bener Meriah Regency, East Aceh Regency and Pidie Jaya Regency from 2015-2020 are included in the instructive relationship pattern. The level of regional financial independence in Central Aceh Regency from 2015-2018 and 2020 is included in the consultative relationship pattern. Langsa City from 2015-2017 and 2019 is included in the instructive relationship pattern. Meanwhile, in 2018 and 2020 it is included in the consultative relationship pattern. The level of regional financial independence of Pidie Regency from 2015-2017 and 2019-2020 is included in the instructive relationship pattern and in 2018 it is included in the consultative relationship pattern. Comparison of the regional financial independence of North Aceh Regency and Lhokseumawe City, there is no significant difference. There is no significant difference in the comparison of regional financial independence for the 2015-2020 period between South Aceh Regency and Aceh Singkil Regency. There is a significant difference in the comparison of regional financial independence between Central Aceh Regency and Bener Meriah Regency for the 2015-2020 period. There is a significant difference in the comparison of regional financial independence in East Aceh Regency and Langsa City for the 2015-2020 period. There is no significant difference in the comparison of regional financial independence for the 2015-2020 period between Pidie Regency and Pidie Jaya Regency.

Abstract

The purpose of this research is to examine the influence of high-performance work systems and servant leadership on organizational performance through the mediating role of employee engagement at Bank Indonesia Lhokseumawe Representative Office. The data in this research were 133 employees who responded to the questionnaire distributed via Google Forms. The data analysis tool uses Structural Equation Modeling (SEM) which is operated with Amos. The research results found that High-Performance Work Systems (HPWS) and Servant Leadership have a significant effect on employee engagement and employee performance. Employee engagement also significantly improves employee performance. In testing the mediating effect of employee engagement, it became a partial mediating variable between High-Performance Work Systems (HPWS) and Servant Leadership on the performance of Bank Indonesia Aceh Representative employees. It is hoped that the results of this research will provide an important contribution to stakeholders in developing employee development strategies as an important resource for every organization.

Abstract

This research aims to find out how service quality influences consumer satisfaction at the Ganda Bakery in Pematangsiantar. The consumer satisfaction indicators used consist of fulfilling consumer expectations, attitude or desire to use the product, recommending to other parties, service quality, loyalty, good reputation, location. then the indicators of reliability used consist of compliance with promises, responsibility, good impression, punctuality, appropriate information. The indicators of responsiveness used consist of fast service, helping consumers, responsive handling of responses. Indicators of assurance consist of communication, credibility, security, competence. Indicators of empathy consist of access, communication, ability to understand customers. Furthermore, indicators of physical evidence consist of the latest or newest equipment, attractive physical facilities, neat appearance and appropriate physical facilities. Where all these variables will be used using the Likert scale. The data used in this study is primary data obtained by distributing questionnaires to 130 consumers who buy at Ganda Bakery in Pematangsiantar. The data analysis technique used in this study is multiple linear regression analysis using the help of SPSS software version 25. The results showed that reliability, responsiveness, assurance, emphaty and physical evidence partially had a positive and significant effect on the consumer satisfaction at the Ganda Bakery in Pematangsiantar.
