Abstract

Over-reliance on Constitutional Court Decision No. 138/PUU-VII/2009 as the primary benchmark for Government Regulations in Lieu of Law has led to overlooking other final and binding decisions from 2003-2023 that also established issuance criteria. This research analyzes the legitimacy and formation criteria for these regulations, examining multiple Constitutional Court decisions from 2003-2023. Using a juridical-normative and case-law approach, this study finds the Constitutional Court has established multiple material and formal criteria for the issuance and substantive content of Government Regulations in Lieu of Law. These criteria mandate such regulations as a last resort for compelling urgencies, adhering to legal certainty and constitutional principles. Presidential subjectivity in issuing Government Regulations in Lieu of Law is thereby limited by these Constitutional Court-established criteria. Differing criteria across Constitutional Court decisions are construed as jurisprudential refinement and adaptation to evolving state governance needs, complementing previous rulings.

Abstract

Abstract

Abstract

Public participation is recognized as a fundamental pillar of procedural environmental rights under both national and international legal frameworks. Nevertheless, the protection of public participation rights in Indonesia has experienced significant shifts following the enactment of regulations potentially diminishing public involvement in environmental governance. This article aims to map and critically analyze the evolving regulatory dynamics and the Constitutional Court’s jurisprudence concerning public participation in environmental matters. Employing normative legal research with statutory and case-law approaches, this study identifies a normative regression in the substantive value of public participation, particularly after the enactment of Law No. 11 of 2020 on Job Creation. However, through its constitutional review function, the Constitutional Court has consistently underscored the government’s obligation to ensure meaningful participation, emphasizing that public involvement should not be reduced to merely a procedural formality. Nevertheless, the Court remains substantially constrained by judicial formalities, potentially limiting civil society’s capacity to advocate effectively for sustainable and equitable environmental participation.

Abstract

The constitutional concept of ‘state control’ mandates that drinking water be provided by the State. However, the State’s limited capacity has created a service gap filled by a plurality of non-state actors, including communities and private companies. Due to restrictive laws, these actors are forced to operate through regulatory loopholes—such as ‘own-use’ schemes, partnership models, and community-based systems. This situation results in normative incoherence, weak state oversight, and undermines consumer protection. This paper argues that the effective solution is not to prohibit non-state participation but to establish a legal framework that explicitly recognizes and governs this plurality of providers, thereby ensuring legal certainty and upholding the universal right to water

Abstract

The oversight and enforcement of the code of ethics for constitutional judges have evolved throughout history, culminating in the recent establishment of the Honorary Council of the Constitutional Court (MKMK) as a permanent body. However, significant weaknesses persist. These include structural dependencies, such as its reliance on administrative staff seconded from the Constitutional Court and its institutional positioning within the Court’s framework. This research employs a normative juridical method, utilizing statutory, regulatory, and contextual approaches. The findings indicate that the legal policy governing the supervision and enforcement of ethics for constitutional judges has undergone three distinct phases of change. While the MKMK is now institutionally permanent, it faces several challenges related to its independence, its limited and passive authority, a membership recruitment process that does not adhere to a merit system, and its dependence on seconded human resources. Therefore, to fortify the ethical oversight mechanism for constitutional judges, this research proposes a two-pronged approach. First, it is necessary to reconstruct the MKMK’s position as a truly independent supervisory and enforcement body by separating it institutionally from the Constitutional Court and strengthening its authority. Second, the authority of the Judicial Commission (KY) should be restored, allowing it to function as the primary ethical oversight institution for all state officials exercising judicial power, including constitutional judges.

Abstract

Abstract
