Abstract

Tindak pidana illegal logging merupakan ancaman serius terhadap keberlanjutan ekosistem hutan di Indonesia, yang memiliki peran penting dalam menjaga keseimbangan lingkungan dan kehidupan manusia. Penelitian ini bertujuan untuk menganalisis secara yuridis penerapan sanksi pidana terhadap illegal logging berdasarkan peraturan perundang-undangan yang berlaku, serta efektivitasnya dalam melindungi ekosistem hutan. Metode penelitian yang digunakan adalah hukum normatif dengan pendekatan konseptual, undang-undangan, dan kasus. Hasil penelitian menunjukkan bahwa peraturan perundang-undangan tentang illegal logging (terutama UU No. 18 Tahun 2013 jo UU No. 6 Tahun 2023 dan UU No. 41 Tahun 1999) telah mengatur sanksi pidana yang cukup tegas, meliputi penjara dan denda. Namun, dalam praktik penerapannya masih terdapat kendala, seperti lemahnya penegakan hukum, peran pelaku intelektual yang jarang dipidana, dan masalah pengelolaan barang bukti. Dengan demikian, dapat disimpulkan bahwa efektivitas sanksi pidana dalam rangka perlindungan ekosistem hutan belum optimal akibat berbagai hambatan struktural dan prosedural dalam penegakan hukum. Disarankan untuk memperkuat koordinasi antar instansi penegak hukum, meningkatkan kapasitas sumber daya manusia, dan menciptakan kebijakan yang lebih komprehensif guna meningkatkan efektivitas sanksi pidana dalam perlindungan ekosistem hutan.

Abstract

This case study aims to analyze the initial screening findings of a preschool child suspected of having special needs, forming the basis for targeted intervention recommendations. Using a qualitative approach with a single-case study design, the main analysis unit was Subject S-1 (male, 2 years and 5 months), with primary data derived from screening documents. Data were analyzed descriptively through reduction, comparative data presentation, and verification against child development norms for ages 2–3 years and Global Developmental Delay (GDD) criteria. The screening results indicated a strong cognitive impairment associated with GDD (IDAI, 2023). The deviations were identified across multiple domains: (1) Cognitive/Receptive (difficulty understanding simple instructions), (2) Fine Motor (inconsistent/stiff muscle tone and inability to pinch), (3) Expressive Language (limited verbal communication), and (4) Social-Emotional (isolated behavior and lack of affective response during physical interactions). Oral sensory difficulties (difficulty chewing) further reinforced the multidimensional nature of the delay. These findings confirm significant developmental red flags. Immediate recommendations include referral for clinical assessment/diagnosis by professionals (psychologists or pediatric specialists). This diagnosis is critical for determining the etiology and formulating a multidisciplinary intervention program (speech therapy and occupational therapy) to take advantage of the subject’s brain plasticity during early childhood (WHO/UNICEF, 2020) and optimize developmental potential.

Abstract

This study analyzes abuse of authority by State Civil Apparatus (ASN) in sexual violence crimes, focusing on the case of Nunukan District Court Decision Number 265/Pid.Sus/2024/PN Nnk. The purpose of this study is to identify the forms of abuse of authority by ASN, examine the perpetrator's criminal liability, and evaluate the judge's considerations in constructing abuse of office as an aggravating element of criminal punishment according to Law Number 12 of 2022 concerning Sexual Violence Crimes (TPKS Law). The method used is normative juridical with a statutory and case approach. The data used includes related laws, government regulations, as well as previous literature and research. The results of the study indicate that the ASN in this case has abused his position for personal gain, fulfilling the elements of Article 6 letter c of the TPKS Law and Article 52 of the Criminal Code. However, the judge has not fully considered abuse of office as an aggravating factor, resulting in a lighter sentence than the prosecutor's demands. This research emphasizes the need to strengthen laws governing sanctions for civil servants who commit acts of sexual violence, both criminal and administrative, including dishonorable discharge, to ensure accountability and protection of victims.

Abstract

This research is motivated by the importance of innovation and entrepreneurial orientation in improving the competitiveness and marketing performance of MSMEs in the era of global competition. The purpose of this study is to analyze the influence of innovation strategy and entrepreneurial orientation on the competitive advantage and marketing performance of MSMEs in Pangkep Regency. This study uses a quantitative approach with an explanatory method to explain the causal relationship between variables. Data were collected through a Likert-scale questionnaire from 92 MSME owner respondents selected using a non-probability sampling technique, namely accidental/convenience sampling. Data analysis was carried out using Structural Equation Modeling Partial Least Squares (SEM-PLS) in SmartPLS. The results showed that innovation strategy significantly influenced competitive advantage (t = 2.009; p = 0.045), while entrepreneurial orientation significantly influenced marketing performance (t = 2.793; p = 0.005), and competitive advantage significantly influenced marketing performance (t = 5.752; p = 0.000). Furthermore, competitive advantage served as a mediating variable, strengthening the influence of innovation strategy (t = 2.693; p = 0.007) and entrepreneurial orientation on marketing performance (t = 2.352; p = 0.019). This finding confirms that competitive advantage is a key factor in improving the marketing performance of MSMEs in Pangkep Regency.

Abstract

Eskalasi kejahatan siber berbasis Artificial Intelligence (AI) telah mendisrupsi tatanan hukum pidana nasional serta menciptakan disparitas tajam antara akselerasi teknologi dengan rigiditas regulasi. Paradigma hukum pidana Indonesia yang masih antroposentris gagal menjangkau entitas algoritma otonom sehingga memicu kekosongan norma (vacuum of norm) yang serius dan melahirkan impunitas struktural. Penelitian ini bertujuan untuk mendekonstruksi hambatan yuridis akibat karakteristik AI dan memformulasikan reformasi kebijakan pidana yang adaptif. Dengan menggunakan metode penelitian yuridis-normatif melalui pendekatan perundang-undangan, konseptual, dan perbandingan hukum, studi ini menemukan bahwa karakteristik Black Box dan otonomi AI secara fundamental memutus rantai kausalitas serta mengaburkan unsur kesalahan (mens rea) konvensional. Oleh karena itu, pendekatan positivisme yang kaku harus ditinggalkan demi Hukum Progresif. Penelitian ini merekomendasikan pergeseran paradigma menuju doktrin Strict Liability atau pertanggungjawaban mutlak bagi pengembang AI risiko tinggi dan mendesak penerbitan Peraturan Mahkamah Agung sebagai instrumen taktis untuk mengisi kekosongan hukum guna menjamin keadilan substantif.

Abstract

Penelitian ini bertujuan merumuskan Perencanaan Strategis Sistem Informasi dan Teknologi Informasi (SI/TI) yang selaras dengan strategi bisnis CV Anugerah Jaya, sebuah perusahaan distribusi bahan bakery. Masalah utama terletak pada implementasi SI/TI yang parsial dan tidak terintegrasi, menyebabkan inefisiensi operasional, seperti verifikasi stok manual dan kesulitan signifikan dalam pengelolaan piutang dari 600 pelanggan aktif dengan Terms of Payment (TOP) 1 bulan. Metodologi Ward dan Peppard digunakan dalam penelitian ini, didukung oleh serangkaian alat analisis komplementer (MOST, PEST, SWOT, Value Chain, CSF, dan McFarlan Strategic Grid). Hasilnya adalah dokumen blueprint strategis komprehensif yang mencakup Strategi Bisnis SI, Strategi TI, dan Strategi Manajemen SI/TI. Keluaran utamanya berupa Portofolio Aplikasi Masa Depan, yakni Sistem Manajemen Inventori Real-Time dan Modul Manajemen Piutang Otomatis, yang esensial untuk meningkatkan efisiensi operasional, mengurangi risiko finansial, dan memperkuat daya saing jangka panjang perusahaan.

Abstract

Postoperative nausea and vomiting (PONV) is one of the most common postoperative complications and may reduce patient comfort, prolong hospital stay, and lead to further complications. Ondansetron and dexamethasone are widely used antiemetic agents for PONV prophylaxis; however, the comparative effectiveness of both drugs as monotherapy remains inconsistent across studies. This systematic review aimed to compare the effect of dexamethasone versus ondansetron on the incidence of PONV in patients undergoing elective surgery. This study was conducted according to the PRISMA 2020 guidelines. Literature was searched through multiple electronic databases. Eligible studies were randomized or quasi-randomized controlled trials involving adult patients undergoing elective surgery who received dexamethasone or ondansetron as PONV prophylaxis. Study selection was performed systematically, and five studies met the inclusion criteria for qualitative analysis. The findings demonstrated that dexamethasone and ondansetron showed relatively comparable effectiveness as monotherapy in reducing the incidence of PONV within the first 24 hours after surgery. However, several studies indicated that the combination of dexamethasone and ondansetron provided superior antiemetic efficacy compared with monotherapy. Dexamethasone and ondansetron are equally effective as monotherapy for PONV prophylaxis in elective surgical patients. In patients at high risk of PONV, the combination of both agents is more strongly recommended.

Abstract

Penelitian ini mengkaji kepastian hukum atas hak kepemilikan tanah warga negara Indonesia (WNI) dalam perkawinan campuran dengan warga negara asing (WNA) setelah terjadinya pembatalan perjanjian perkawinan. Kajian ini dilatarbelakangi oleh meningkatnya jumlah perkawinan campuran di Indonesia, khususnya di Bali sebagai wilayah dengan intensitas interaksi internasional yang tinggi. Kondisi tersebut memunculkan problematika hukum yang kompleks, terutama terkait kepemilikan hak atas tanah, mengingat hukum agraria nasional secara tegas membatasi kepemilikan tanah hanya bagi WNI. Permasalahan muncul ketika harta yang diperoleh selama perkawinan berada dalam rezim harta bersama, sehingga berpotensi bertentangan dengan prinsip kewarganegaraan dalam hukum agraria. Fokus penelitian ini adalah menganalisis implikasi hukum pembatalan perjanjian pranikah atau pascanikah terhadap status kepemilikan tanah yang diperoleh selama perkawinan. Pembatalan perjanjian tersebut berakibat pada berlakunya sistem harta bersama, yang berpotensi menimbulkan anggapan adanya penguasaan tidak langsung oleh pasangan WNA. Penelitian ini menggunakan metode hukum normatif-empiris dengan memadukan analisis peraturan perundang-undangan, putusan pengadilan, dan data empiris melalui wawancara dengan praktisi hukum. Temuan penelitian menunjukkan bahwa pembatalan perjanjian perkawinan menimbulkan kerentanan hukum bagi WNI, baik berupa ketidakpastian hak, potensi sengketa, maupun risiko pemaksaan pengalihan hak. Oleh karena itu, penelitian ini menekankan pentingnya penguatan peran notaris, standardisasi klausul perjanjian, kejelasan dokumen bilingual, serta mekanisme verifikasi yang ketat guna menjamin kepastian hukum, perlindungan hak milik WNI, keadilan, dan kedaulatan hukum nasional.

Abstract

The guarantee of the political rights of the State Civil Apparatus (ASN) in the 1945 Constitution is further regulated in Law Number 20 of 2023 concerning the State Civil Apparatus (ASN) and various derivative regulations. This research aims to answer a fundamental question: how are the constitutional rights of the State Civil Apparatus (ASN) regulated in Indonesian politics, and what is their neutrality concerning the potential conflict between the constitutional guarantees of political rights in the 1945 Constitution and the restrictions on political activities imposed on the State Civil Apparatus (ASN) by legislation. This study employs a descriptive-normative method, utilizing both legislative and conceptual approaches. The findings indicate that the lack of synchronization between regulations and the unclear boundaries between active and passive political activities have generated normative tensions. These tensions arise between the constitutional rights of the State Civil Apparatus (ASN) and their obligation to maintain bureaucratic neutrality. Overly broad restrictions may violate the principle of proportionality and create legal uncertainty for the State Civil Apparatus (ASN). Additionally, this situation allows for varying interpretations among different agencies, leading to inconsistencies in the application of the principle of neutrality in practice. Consequently, it may undermine the political rights of the State Civil Apparatus (ASN) as citizens.

Abstract

The increasing volume of transactions in coffee shop businesses requires a structured and informative sales data management system. Sales data that are not managed through a well-designed system may lead to recording errors, delays in reporting, and limited information to support managerial decision-making. This study aims to conceptually design a coffee shop sales information system by utilizing sales transaction data as the basis for system requirements analysis. The research method employed is systems analysis and design using the Unified Modeling Language (UML) approach. The design process includes actor identification, functional requirements analysis, use case modeling and scenarios, activity diagrams, sequence diagrams, and class diagrams, complemented by conceptual user interface (UI/UX) design and data normalization. The results of this study produce a conceptual design of a sales information system that can serve as a blueprint for future system development
