Abstract

This study explores the challenges posed by legal uncertainty in corporate law and environmental regulations that affect sustainable business practices in Indonesia. As the country seeks to balance economic growth with environmental protection, the absence of clear guidelines for environmental, social, and governance (ESG) practices makes it difficult for businesses to adopt sustainable operations. Key issues contributing to this legal uncertainty include conflicting regulations, frequent changes to laws, and inconsistent enforcement, all of which can undermine business confidence and hinder innovation. The Omnibus Law, introduced in 2020 to simplify investment processes, has raised concerns about weakening environmental protections, complicating compliance for businesses. Using a normative research approach, this study reviews existing literature to identify and analyze the connections between various legal frameworks. The findings suggest that creating a Comprehensive Legal Framework for Sustainability, establishing a Regulatory Oversight Body, and improving stakeholder engagement are crucial steps to reduce legal uncertainty and encourage sustainable practices. By aligning environmental regulations with industrial policies, Indonesia can create a more stable legal environment that supports sustainable development.

Abstract

This study seeks to find the concept of Nusantara Aesthetics in Javanese traditional houses, its correlation with the value of the Javanese people. The research is positioned in a critical thinking system, using the semiotic critical theory of visual communication. The location of the research is in Java. The study uses qualitative methods and interpretive analysis techniques that use a qualitative approach. Broadly speaking, the findings in the study are that the concept of Nusantara Aesthetics found in Javanese Traditional Houses is realized to maintain harmony. Harmony in social life can be achieved with the pillars including attitudes: aruh, gupuh, lungguh, and suruh. Aruh is a grapyak or friendly attitude to maintain safety and harmony with the environment. The representation of the attitude of the Aruh is that the Javanese traditional house has a Regol which is located at the front as a barrier with a road in the form of a small open house. Gupuh is an age-age attitude, Javanese people respect guests with an age-age attitude when they come out of the house to welcome guests in masks. The mask of the front building in the configuration of the Javanese house as a face, making the shade house a representation of the value of shade in accepting the presence of people. Lungguh is sitting, Javanese people receive guests to talk about something by sitting, therefore the house has a pendapa in the form of a spacious open house, a representation of a loose heart/freely accepting the presence of people.

Abstract

This study aims to examine the effect of human resource development (HRD), work culture, and motivation on employee performance at the Secretariat General (Setjen) of the DPR RI, with job satisfaction as an intervening variable. The methodology used in this research is quantitative, involving 95 respondents consisting of all State Civil Apparatus (ASN) functional officials under the guidance of the Secretariat General of the DPR RI in 2022. This research applies a saturated sample technique, where the entire population is used as a sample. For data analysis, the Structural Equation Modeling (SEM) method was used. The results showed that HR development had no effect on employee performance, and no effect on job satisfaction. On the other hand, work culture also has no direct effect on performance, but has a positive and significant effect on job satisfaction. Motivation is proven to have a positive and significant impact on employee performance, although it has no effect on job satisfaction. In addition, job satisfaction is shown to have a positive and significant influence on performance. An important finding of this study is that HR development does not affect employee performance, even with job satisfaction as a mediator. In contrast, work culture shows a positive and significant influence on employee performance when job satisfaction is used as a mediator, while motivation does not show the same effect. This study is the first of its kind conducted at the Secretariat General of the House of Representatives and the results may serve as an impetus for researchers to provide further analysis to improve employee performance.

Abstract

Citizen culture and Bhinneka Tunggal Ika are a set of ideas or concepts that contain positive values and become the identity of a nation. However, with globalization, people's lifestyles have shifted to modern lifestyles, because it is one of the crucial problems that makes people no longer preserve citizen culture and the values contained in the motto Bhinneka Tunggal Ika as a national identity. This study aims to analyze the contribution of the Mapalus tradition of house building to strengthen citizen culture and Bhinneka Tunggal Ika in Tobatu Dua Tengah village. This study is an ethnographic study with a qualitative approach. The research data collection technique uses in-depth interview techniques, observation, and documentation. The results of the study indicate that the implementation of the Mapalus tradition of house building can strengthen citizen culture in terms of language, knowledge, kinship and social organization, and art. These findings are in line with Hall's theory, that cultural identity comes from ancestral heritage, has certain elements and values that strengthen the cultural identity of a region. Mapalus house construction also provides reinforcement of bhinneka tunggal ika in the aspect of strengthening social solidarity, resource sharing, collective problem solving, uniting various social groups, non-formalistic principles, convergent, pluralistic and multicultural, and the spirit of mutual cooperation. This finding is in line with Robert's theory that high social connectedness, achieved through joint activities, can increase trust and cooperation between community members.

Abstract

This study examines the effects of tax understanding and taxpayer morality on tax compliance moderated by tax awareness. Tax compliance is very important to ensure that the government obtains sufficient state revenue. Factors that influence compliance, such as tax understanding, taxpayer morality, and tax compliance have been widely conducted, but research influenced by tax awareness as a moderator variable has not been widely conducted. Tax understanding can help taxpayers fulfill their obligations, while taxpayer morality is related to ethical beliefs that drive compliance. Tax awareness involves individuals' recognition of their tax responsibilities. This quantitative study used a survey approach, collecting data through questionnaires from 103 corporate taxpayers in a shipping service company in Jakarta. Data were analyzed using the Partial Least Squares (PLS) method. Tax understanding has a positive impact on tax compliance, while taxpayer morality has no significant effect. Tax awareness weakens the relationship between tax understanding and compliance but does not significantly moderate the impact of taxpayer morality on compliance. In addition, tax awareness negatively affects compliance, because taxpayers who are more aware can be critical of the tax system. As a result of this study, taxpayers with better tax understanding are more compliant. Taxpayer morality alone is not enough to drive compliance, with factors such as understanding and awareness playing a more dominant role. While tax awareness moderates the effect of tax understanding on compliance, it does not moderate the effect of taxpayer morality. High awareness can lead to greater criticism of the tax system, reducing compliance.

Abstract

The study of administrative and financial law in Indonesia has rapidly evolved, driven by the democratization process and the government's focus on financial governance. Administrative law regulates the relationship between the government and citizens, overseeing decision-making and the implementation of government functions, while financial law manages state finances, including taxes and budgets, adapting to societal and technological changes. Both branches impose responsibilities: administrative duties involve public service and governance, whereas financial responsibilities focus on managing state finances and ensuring legal certainty, with an emphasis on integrity and accountability. However, challenges persist, such as decision-making failures, procedural violations, corruption, bureaucratic delays, and inadequate public services in administrative law, alongside issues like poor budget planning and mismanagement in financial law. This study employs normative and empirical legal analyses to examine these challenges and their implications for contemporary governance, aiming to enhance understanding of both branches of law, analyze their impact on government actions, improve oversight of state finances, and bolster accountability for efficient financial management, ultimately benefiting the public.

Abstract

The position of the Prosecutor's Office of the Republic of Indonesia has not been explicitly regulated in the 1945 Constitution of the Republic of Indonesia, resulting in inconsistencies related to the independence of the Prosecutor's Office of the Republic of Indonesia, which in existence the Prosecutor's Office of the Republic of Indonesia is positioned to be part of the Judicial Power as well as part of the government (executive) institution. This has an impact on the weak position of the Prosecutor's Office of the Republic of Indonesia in carrying out its function as a prosecution institution in Indonesia. The purpose of this study is to find out the legal certainty of the constitutional regulation of the independence of the Attorney General's Office of the Republic of Indonesia in Indonesia. In the research, the type of research used is a type of research with normative legal research methods. The conclusion in this study is that the independence of the Prosecutor's Office is needed for the benefit of law enforcement by being honest, fair, responsible, and transparent by upholding the principle of fair trial in the principle of equality before the law. Thus, this must be carried out because the prosecutor's institution is a determining factor in the sub-system of legal structure in criminal law enforcement. On the other hand, the constitutional reconstruction of the position of the Attorney General of the Republic of Indonesia should be important, considering that until now the arrangements related to the position of the Attorney General of the Republic of Indonesia have not been implicitly regulated. This has an impact on the independence of the Prosecutor's Office of the Republic of Indonesia which until now is still positioned as part of the judicial power as well as part of the government (executive) institution on the other hand. The constitutional reconstruction of the position of the Attorney General of the Republic of Indonesia can refer to the Constitution of Myanmar and Laos, which in its constitution formulates the regulation of the position, war/function, appointment and removal of the Attorney General in their respective constitutions.

Abstract

The development of social media has become part of everyday life, making it easier for individuals to express opinions, share information, and interact more widely and quickly. However, this convenience also creates legal challenges, one of which is the increase in defamation cases in the digital realm. Defamation on social media is a criminal offense that can harm individuals and institutions, but proving it is not easy. This research aims to analyze the legal aspects related to proof in the criminal act of defamation on social media. The research method used is normative research with data collection through literature study. The collected data is then analyzed with the stages of data filtering, data presentation, and conclusion drawing. The results show that evidence in the crime of defamation on social media refers to Article 27 paragraph (3) of the ITE Law as well as Articles 310 and 311 of the Criminal Code, with evidence regulated in Article 184 of the Criminal Procedure Code, including witness testimony, experts, letters, instructions, and testimony of the defendant. Digital forensics has an important role in ensuring the validity of electronic evidence, such as recorded conversations, screenshots, or metadata, to reveal the perpetrator's digital footprint and ensure data integrity. In addition, prosecutors must prove the element of intent (mens rea) to ensure that the posts were intended to defame and not merely criticize or a legitimate form of freedom of speech.

Abstract

The socio-economic dynamics of Indonesian communities, especially in traditional institutions like Pondok Buntet Pesantren, are undergoing significant transformations due to the increasing integration of modern technologies and ideas. Pondok Buntet Pesantren, the oldest Islamic educational institution in Indonesia, plays a central role in shaping the local community's social and economic interactions. This research aims to analyze the socio-economic dynamics in Pondok Buntet Pesantren using Auguste Comte’s social evolution theory, which includes the theological, metaphysical, and positivist stages. The study uses qualitative methods with case study design, collecting data through interviews, observations, and document studies. The findings show that the community is transitioning from a religious value-based society to a more modern, technology-integrated one, with innovations such as QRIS being adopted in economic transactions. The Pesantren functions as an agent of social change, blending traditional values with modern technology and educational practices. This study contributes to understanding how Comte’s theory can be applied in socio-economic transformations, demonstrating how communities can integrate modernity without losing cultural identity. The research provides implications for developing community-based empowerment programs that promote economic transformation while preserving traditional values, although further studies with broader scope and quantitative methods are recommended.
