Muqaranah adalah jurnal yang diterbitkan oleh Prodi Perbandingan Mazhab Universitas Islam Negeri Raden Fatah Palembang dengan ISSN 2809-3658 dan E-ISSN 2809-4832. Muqaranah terbit dua kali dalam setahun yaitu pada  Juni dan Desember. Jurnal ini menerbitkan konsep dan makalah penelitian terkini tentang perbandingan mazhab dan hukum. Abstract

People who have limitations such as weakness of mind must be under guardianship in doing everything, including carrying out transactional activities. Because, without guardianship it is feared that it will have a bad impact on both himself and others. Therefore, researchers conducted research with the aim of examining the legality of buying and selling transactions carried out by people who have mental limitations. This research specifically examines the judge's decision on related cases. The study will focus on the views of scholars. This study uses a normative and comparative juridical approach with library research methods. The results of the study show that there are differences of opinion regarding the legality of transactions carried out by people with mental disabilities. There are those who think it is legal and there are also those who think it is illegal. People who have mental limitations must involve their guardians if they want to make buying and selling transactions, this is based on the concept of al-hajr. This is intended so that the transaction does not cause harm to both himself and others.

Abstract

This is research on the prohibition of Menstruating Women Staying in the Mosque according to Imam al-Shafi'i and Imam Ahmad bin Hanbal. In Indonesia, the presence of menstruating women in mosques is still considered prohibited, because the Indonesian Muslim community generally adheres to the Shafi'i school of thought. However, this opinion began to be sued because it was considered to discriminate against women because it prohibited them from being involved in activities at the mosque. On the other hand, there is the view of Imam Ahmad who does not question the presence of menstruating women in the mosque. This study aims to compare the opinions of the two Imams to find which one is more appropriate to the times and not discriminatory. This research is library research that relies on data sources from written data, both in the form of books and journal articles. This study uses a comparative qualitative approach. The results of the study show that according to Imam Ahmad, there is no strong argument that prohibits menstruating women from entering and staying at the mosque. The hadith which prohibits menstruating women from entering and staying in the mosque is a daif hadith because there are majhul narrators. Meanwhile, Imam al-Shafii took an attitude of ihtiyath by continuing to practice the hadiths above, so that only menstruating women were allowed to pass inside the mosque, without stopping and remaining silent.

Abstract

The obligation to care for children does not end even if the parents are divorced. However, there is often a struggle over child custody, even having to involve a court to resolve it. One of them was the hadhanah case at PTA Palembang with decision Number: 005/Pdt.G/2018/PTA.plg. which will be the focus of this study. The purpose of this study is to examine the judge's decision in terms of Law Number 17 of 2016 and Islamic Law, so that a comparison between the two can be known. This research is a normative juridical research. The approach method is comparative. The data analysis technique that the writer uses is a qualitative descriptive analysis technique. In decision Number: 005/Pdt.G/2018/PTA.plg. Child custody is handed over to anyone because the lawsuit contains a formal defect so that the lawsuit cannot be accepted. According to Islamic law, hadhanah rights as stated in decision Number: 005/Pdt.G/2018/PTA.plg. handed over to the mother, but Law Number 17 of 2016 does not question this. This law stipulates that children must be cared for by their own parents, unless there are other justified reasons.

Abstract

Salah satu bagian dari pertukaran atau ekonomi adalah kolaborasi pembagian keuntungan. Dalam kenyataan kehidupan individu, banyak individu yang beragama Islam mengadakan partisipasi bagi hasil dalam berbagai bidang ekonomi dan pertukaran sebagai pekerjaan atau bisnis mereka, kenyataan ini dapat dilihat dalam budidaya padi. Untuk melakukan bisnis ladang pedesaan, ada banyak partisipasi antara pemilik ladang dan individu yang memiliki apa yang diperlukan dan kesiapan untuk mengolah. Karena terkadang pemilik tanah tidak dapat menggerogoti tanah miliknya sendiri, bertentangan dengan norma ada buruh yang memiliki kemampuan bercocok tanam namun tidak memiliki tanah tersebut. Isu yang diangkat dalam perbincangan ini adalah bagaimana cara melakukan bagi hasil sawah di Kota Cahaya Maju, Kelurahan Lemrub, Aturan Ogan Komering Ilir. Bagaimana survei regulasi Islam dan aturan baku tentang pelaksanaan pengambilan manfaat sawah di Kota Cahaya Maju, Kecamatan Lemrub, Rezim Ogan Komering Ilir. Dari hasil percakapan tersebut, diduga pelaksanaan pengambilan manfaat di kota Cahaya Maju Kecamatan Lemembu Peraturan Ogan Komering Ilir merupakan kesepahaman yang dilakukan secara lisan (tidak tersusun) dan pembagian manfaat dilakukan dengan pemahaman terhadap dua orang pemain/maro (secara adil) tanpa mempengaruhi orang ketiga, sedangkan eksekusi dilakukan setelah menuai dan jika terjadi kemalangan, kemalangan itu akan ditanggung oleh pemilik tanah dan penggarap. Tindakan pembagian hasil sawah di kota Cahaya Maju, Kecamatan Lemembu, Kabupaten Ogan Komering Ilir, sudah sesuai dengan aturan Islam (by contract) namun ada kelemahan yang tidak melibatkan pengamat dalam pemahaman, dan dalam Dilihat dari peraturan baku penataan di kota Cahaya Maju dilengkapi dengan kecenderungan yang sudah ada sejak lama.

Abstract

This article discusses the uniqueness of manhaj ijtihad al-fuqaha' al-sab'ah and its influence on Imam Malik's thuruq al-istinbath. Al-fuqaha' al-sab'ah are seven scholars of the tabi'in period who are even considered the pioneers of the Ahlu Hadith Madrasa. However, it turns out that their manhaj ijtihad is somewhat different from most ahl al hadith scholars. How is the uniqueness of manhaj ijtihad al-fuqaha' al-sab'ah, and its influence on Imam Malik's thuruq al-istinbath becomes a research question in this paper. The results showed that al-fuqaha' al-sab'ah still does not leave the characteristics of the ahl al-hadith scholars who adhere to the zahir al-Qur'an, the Sunnah of the Prophet, qaulu companions, and ijma' ahl Medina. When they don't find answers to problems, they use ra'yu. The use of ra'yu is accompanied by the use of the ijtihad method commonly used by ahl al-ra'yi scholars. This is where the "uniqueness" of al-fuqaha' al-sab'ah lies. Several methods of ijtihad used by al-Fuqaha' al-Sab'ah such as prioritizing zahir al-Qur'an, amal ahlu medina, ijma' madinah scholars, and prioritizing qaulu shohabi over ijma' and qiyas apparently were adopted by Imam Malik as part of his thuruq al-istinbath. Abstract

Theoretical studies of waqf have often featured the opinions of scholars from Sunni schools, such as the Hanafi, Shafi'i, Maliki, and Hanbali schools. While the opinions of other schools of waqf, such as the Zahiri school, which was promoted by Ibn Hazm in al-Muhalla, are rarely studied. The purpose of this study is to find out the provisions of waqf in Kitab al-Muhalla and their relevance to the provisions of waqf in Indonesia. To achieve this goal, the author uses normative legal research that focuses on one book of the Zahiri School. The primary source is Kitab al-Muhalla, while the secondary source is the book or article relevant to this study. The results showed that the discussion of waqf in Kitab al-Muhalla only presents general views on waqf theory such as definitions, waqf objects, waqf ownership, expert waqf and ta'bid requirements on waqf. While specific studies on nazhir (waqf management), waqf management, waqf dispute resolution are not highlighted. Some waqf theories in Kitab al-Muhalla are relevant to waqf provisions in Indonesia, including ownership of waqf property, and expert waqf. While other provisions are not relevant to be applied in Indonesia. This phenomenon is natural, considering that the Zahiri school only sees zahir nash in studying waqf. Meanwhile, waqf studies today focus more on the ijtihadi approach.

Abstract

Congregational prayers in Islam have added value. Likewise praying in the mosque has additional appreciation from Allah Subhanahu wa Ta'ala. Especially if the prayers are performed in congregation and carried out in the mosque. But in daily reality there are those who judge that congregational prayers performed at the mosque by women are not a good deed. Therefore, this article discusses the issue of how the law holds congregational prayers for women in mosques according to the perspective of madhhab scholars. The purpose of this study was to examine the legal basis for congregational prayers at the mosque for women based on the opinion of the Islamic scholars. This research is a literature research by examining the treasures of the book referred to by the school's scholars. From searching this article, it was found that the opinion of madhhab scholars absolutely prohibits (forbids) women from participating in congregational prayers at the mosque.

Abstract

This paper explaines the necessity to maintain the sustainability of the benefits of waqf objects, especially waqf for health facilities through istibdal waqf after the Covid-19 pandemic. When the pandemic hit the country, many people were infected by the corona virus outbreak, thus inspiring several Islamic philanthropic institutions to participate in easing the burden on the society and government by raising waqf funds directed at the procurement of medical devices. After Covid-19 hit, even in some regions, there were calls to lift the "pandemic" condition to endemic, then medical devices derived from waqf became no longer used. This makes several institutions, namely Dompet Dhuafa and the Qur'an Waqf Board, think hard about how to utilize the waqf of health facilities so that they continue to benefit the community. The research problem in this paper is how istibdal waqf is a solution to maintain the sustainability of the utilization of waqf objects in the post-COVID-19 period. This type of research is Islamic legal research with qualitative methods. Data were obtained through interviews and documentation and analyzed inductively. The results showed that Dompet Dhuafa and the Qur'an Waqf Board in maintaining the sustainability of the benefits of waqf objects donated several waqf medical devices to several health facilities. Even though giving waqf objects is not allowed by scholars. The solution that DD and BWA can do is to conduct istibdal waqf, so that waqf objects can still be used mauquf 'alaih and are in line with the opinion of the sunny mazhab scholars and positive law in Indonesia.

Abstract

Recently there has been frequent violence against children which of course violates children's rights. Various types of violations against violence against children seem to assume that children do not have rights to be protected. The main problem of this research is how to study Islamic law and positive law against sanctions on juvenile crimes that result in serious injuries in Decision Number: 1961/Pid.Sus/2016/PN .Plg. The purpose of this research is to examine the sanctions for perpetrators of crimes against children both in terms of Islamic law and positive law. The type of research used is literature (library research) which is analyzed using descriptive analysis techniques. The approach method is comparative, namely comparing Islamic law and positive law regarding sanctions for perpetrators of child crimes. The results of this study reveal that the judge's considerations in convicting criminals against perpetrators of violence against children who cause serious injuries in Decision Number: 1961/Pid.Sus/2016/PN .Plg. That is, the judge has first considered the facts at trial. In Islamic criminal law, criminal acts are punished with ta'zir, that is, in accordance with the actions and the decision is left to the ruler's policy or law. The difference between the two laws is that the witness imposed on the perpetrators of abuse according to law number 13 of 2014 is in the form of imprisonment, whereas in Islamic law it is in the form of qishas, diyat and ta'zir punishments.

Abstract

The many problems of sharia economic disputes have not all been resolved because the judges who resolve the problems of sharia economic disputes are not special judges who are capable and certified in handling sharia economic disputes. For this reason, this thesis was created to answer this problem, consisting of two problem formulations, namely: What are the Procedures for Settlement of Sharia Economic Disputes in View of Supreme Court Regulation Number 14 of 2016 and Islamic Law? The type of approach method used is qualitative method or literature study whose research uses written data such as books, journals, papers, as well as decisions of the Supreme Court and laws, or from document to document related to this research. From the results of this study it can be concluded that in the settlement of Islamic economic disputes in terms of Perma No. 14 of 2016 it is carried out in two ways, namely simple lawsuits and ordinary lawsuits while in Islam it is carried out by means of peace, arbitration, Al-Qadha.
