Abstract

The preparation of tax regulations, including regional taxes such as Land and Building Rights Acquisition Fee (BPHTB), must consider conceptual suitability. BPHTB is a tax on the transfer of ownership rights to land and/or buildings. However, there is a conceptual error in determining when BPHTB is due in Law Number 1 of 2022 concerning Central and Regional Financial Relations (HKPD Law). This determination is inconsistent with the concept of tax on transfer of ownership. In addition, there are differences between the provisions in the HKPD Law and its implementing regulations, which exacerbates conceptual problems. This research uses qualitative methods with literature studies to analyze these errors, including potential legislative errors related to the regulations when BPHTB is owed. The research results show that determining the signing of the Sale and Purchase Agreement (PPJB) as the time when the BPHTB is due is a conceptual error. In addition, there is a risk of inconsistent application of the law due to legislative errors, especially in cases of land and/or building sale and purchase transactions that are canceled and returned to the seller due to default. This error creates legal uncertainty and needs to be corrected to comply with applicable taxation concepts.

Abstract

Humanitarian Intervention is a phenomenon that emerged in the modern era as a result of extreme historical experiences that have caused a horrifying number of casualties. Humanitarian Intervention represents the application of international law aimed at protecting civilians from excessive violations of human rights. Several instances of this phenomenon are reflected in three major conflicts: Kosovo, Libya, and Syria. Using qualitative research methods and literature review as data sources, this article seeks to highlight a comparison of these three cases regarding the effectiveness of Humanitarian Intervention implementation. It was found that in the cases of Kosovo and Libya, both demonstrated significant and organized international support through NATO. Conversely, Humanitarian Intervention failed to be effectively implemented in Syria due to geopolitical factors and the lack of international consensus.

This research shows that the Contextual Teaching and Learning (CTL) learning model has a positive impact in increasing students' interest and learning outcomes in the Sociology subject in Phase E. CTL allows teachers to connect academic concepts with real life situations, thereby creating a more relevant and relevant learning experience. meaningful for students. This method has proven effective in increasing student engagement and deepening their understanding of the subject matter. However, implementing CTL requires adequate training for teachers to be able to create a learning environment that is inspiring and meets students' needs. Apart from that, developing contextual and relevant teaching materials is an important aspect to support learning that is adaptive to students' needs. This research also opens up opportunities to apply CTL to various subjects and different grade levels, as well as exploring the best strategies to optimize learning outcomes. With these findings, the research makes a practical contribution to teachers and schools, helping to create more innovative and responsive learning approaches. Furthermore, this research also provides a scientific basis for developing curriculum and educational policies that support the wider implementation of contextual learning in the future. This shows that the application of CTL not only supports the achievement of academic goals, but also equips students with critical thinking abilities and relevant life skills.

Abstract

Trust is a crucial element in the audit process that impacts the quality and success of audits. This study explores the application of social penetration theory as a strategy to build trust between auditors and auditees. The theory illustrates that interpersonal relationships develop through openness and information exchange. In the audit context, increased openness facilitates more effective communication, accelerates data collection, and reduces conflicts. The findings indicate that strong trust enhances transparency and audit quality. Competent and ethical auditors gain trust more easily, while respected auditees are more cooperative. The study recommends training in interpersonal skills for auditors and regular assessments of trust relationships. Implementing this approach will strengthen the audit process and enhance organizational accountability.

Abstract

Settlement of disputes over the election of village heads is the attributive authority of district/city regional heads based on Article 37 Paragraph (6) of Law Number 6 of 2014 concerning Villages, which states "in the event of a dispute over the results of the village head election, the regent/mayor shall resolve the dispute within the time period specified in referred to in paragraph (5)", in conjunction with Article 53 paragraph (1) South Buton Regent Regulation Number 23 of 2017 concerning Election of Village Heads which reads "In the event of a dispute over the results of the Village Head election, the Regent is obliged to resolve the dispute within a period of time. 30 (thirty) days”. However, the resolution of the dispute by the Regent still left a dispute, and resulted in a lawsuit at the State Administrative Court, this was because the nature of the Regent's decision could still be challenged (Beschikking). This research aims to determine the implementation of the South Buton Regent's Regulation Number 23 of 2017 concerning the Election of Village Heads in Resolving disputes over Simultaneous Village Election results in South Buton Regency. This research method is a normative juridical method, by conducting a review of library data or library research (Library Research). The model used is collecting legal materials and conducting analysis. The results of this research are that the Regulations for Settlement of Village Head Election Disputes in South Buton Regent Regulation Number 23 of 2017 concerning Village Head Elections are not regulated implicitly so that changes or separate arrangements need to be made as well as transferring authority in resolving Village Head Election Disputes in accordance with the division of power of an institution.

Abstract

Medical disputes in Indonesia often face challenges such as lengthy litigation processes, high costs, and low satisfaction among the parties involved. In this context, Alternative Dispute Resolution (ADR), particularly mediation and arbitration, offers a more efficient solution. Mediation has been regulated under Law No. 30 of 1999 on Arbitration and Alternative Dispute Resolution as well as Supreme Court Regulation (Perma) No. 1 of 2016. However, arbitration mechanisms still lack a specific legal framework, even though Law No. 17 of 2023 on Health emphasizes the importance of swift and fair dispute resolution in healthcare services. Unlike litigation, arbitration allows for final, expedited, and binding resolutions. Countries such as the United States, the United Kingdom, and Taiwan have successfully implemented arbitration in medical disputes. Taiwan, for instance, has specific regulations that facilitate medical arbitration processes, providing legal certainty for patients and healthcare providers. Indonesia can learn from these international experiences. By clarifying arbitration regulations in the healthcare sector, the government can strengthen a dispute resolution system that is responsive to societal needs. This enhancement can be achieved through the training of professional arbitrators and promoting the use of ADR, ensuring that medical disputes are resolved more fairly, quickly, and cost-effectively.

Abstract

Work-family conflict is a common issue faced by employees across various sectors, which can significantly impact their performance. This conflict arises when the demands of work and family collide, creating tension and stress that affect psychological well-being and productivity. Therefore, it is crucial to understand the relationship between work-family conflict and its effects on employee performance, as well as explore ways to manage and mitigate this conflict. This study aims to analyze the influence of work conflict and family conflict on employee performance by referring to relevant theories and previous research, and to provide recommendations for organizations in managing this conflict. This research utilizes a literature review method by examining relevant national and international journals and previous studies from the past five years. Data was collected through content analysis of articles discussing work-family conflict and its impact on performance, as well as policies to reduce its negative effects. The findings show that work-family conflict significantly affects employee performance by increasing stress, fatigue, and reducing productivity. Theories such as Role Theory and Conservation of Resources Theory explain how conflicts between work and family roles deplete individual resources, leading to decreased performance. Additionally, policies supporting work-life balance, such as flexible working hours, social support, and wellness programs, have been proven to effectively mitigate the negative impact of this conflict.
