Focus and Scope MARCAPADA: Jurnal Kebijakan Pertanahan is a scientific journal that focuses on agrarian-land issues, spatial planning, land management, problems that arise as the causes of a land policy. All terminology refers to the keyword "Policy" which intersects with Agrarian-Land. Land policy issues are built with multidisciplinary analysis, as they relate to scientific disciplines: Spatial, Social-humanities, and Technology. Technically, the Marcapada journal will contain research articles, brief policy studies, and broad land policy thinking. Abstract

The development of a complete city/regency is a strategic agenda of the Ministry of ATR/BPN to realize legal certainty over land. Malang City has achieved Complete City status, but the implementation of the Complete Village development in Sukun District still faces various obstacles. This issue is important to study because success at the village level is a benchmark for the quality of national land policy implementation. This study aims to analyze the implementation, problems, and strategies for accelerating the development of Complete Villages after the declaration of Complete City 2024. The study used a descriptive qualitative method with data collection techniques through structured interviews, field observations, and document reviews. Data were analyzed descriptively using the Miles and Huberman model with the application of three analytical tools: the 5M management approach (man, money, material, machine, method) to assess internal factors, Rumelt's Evaluation Theory to measure consistency, suitability, excellence, and feasibility of strategies, and SWOT Analysis to formulate adaptive strategies. The results indicate that the development of Complete Villages in Sukun District follows four main stages according to the 2022 PTSL Technical Guidelines and has fulfilled the 5M elements. However, Rumelt's evaluation identified technical and non-technical constraints, such as limited technological infrastructure, human resource capacity, and inter-agency coordination. The SWOT analysis recommended strategies such as strengthening institutional vision, improving cross-sectoral coordination, collaborating with third parties, and utilizing digital technology, particularly Artificial Intelligence (AI), to accelerate the sustainable implementation of the Complete Village.

Abstract

The electronic certificate policy was expected to be a step towards improving the quality of land services. However, the policy, initially formulated in the Regulation of the Minister of ATR/BPN No. 1 of 2021 concerning Electronic Certificates, was postponed due to content that raised public concerns, particularly regarding the regulation of analog certificate withdrawals. The Denpasar City Land Office became the first implementer of the electronic certificate policy in Indonesia following the enactment of Regulation No. 3 of the Minister of ATR/BPN in 2023. The purpose of this study was to analyze how the electronic land certificate policy was implemented at the Denpasar City Land Office using George C. Edward III's theory, which focuses on aspects of communication, resources, disposition, and organizational structure using qualitative research methods. Based on the research results, it was determined that the successful implementation of the electronic land certificate policy at the Denpasar City Land Office was inseparable from the commitment of the leadership and all staff, in addition to effective communication, adequate resources, and a positive attitude among implementers. However, it is necessary to update the Standard Operating Procedures to adapt to existing electronic land services.

Abstract

The Special Region of Yogyakarta is an area that has a Special Law governing land affairs. Village Common Land is distributed across various regions, making it crucial to understand its ownership and management system, particularly in Yogyakarta. This study aims to explore the duality of the status of Village Common Land and its management for increasing local revenue in the village. This research uses a descriptive qualitative method with a descriptive approach. The findings indicate the presence of dual ownership status of Village Common Land. The management system includes subjects and objects, licensing, protection of Village Common Land, management of Village Common Land used for public facilities, business premises, and educational institutions, along with a profit-sharing system. There is potential for contributions from the management of Village Common Land, which can be used for development. In conclusion, the management of Village Common Land for the improvement of Village Own-Source Revenue (PAD) is effective, and it is recommended that the government further optimize the management of Village Common Land, while the community should utilize Village Common Land in accordance with existing regulations.

Abstract

Forests in Indonesia are a vital ecosystem, covering 64% of the country’s total land area, according to data from the Ministry of Environment and Forestry (LHK) released in 2020. Forests serve not only as a source of livelihood but also as a place for meeting the needs of communities, including customary law community (MHA) that have long controlled and utilized forest land prior to the establishment of the nation. One example of a land control conflict in forest areas by MHA occurs in Nagari Simpang Utara. The MHA, led by Datuk Putiah, claims the forest area as ulayat land under Minangkabau customary law. The government, through the Ministry of LHK, has designated this area as state forest land according to Law No. 41 of 1999 on Forestry, reinforced by Minister of Forestry Decree No. 35/Menhut-11/2013. This study aims to identify the dynamics of land control by MHA and find conflict resolution solutions in accordance with applicable regulations. The research method used is qualitative with a descriptive approach. The findings indicate that the recognition and existence of MHA often conflict with government policies, causing friction between indigenous communities and state authorities. In this regard, conflict resolution efforts must consider both sides to achieve a fair and sustainable solution.

Abstract

Agrarian conflict is a prevalent issue within the land sector. One such conflict in Indonesia occurs in Sumberklampok Village, Gerokgak Subdistrict, Buleleng Regency, Bali Province. This study aims to analyze the chronology of the conflict, the efforts to manage and resolve agrarian disputes, and the process of land redistribution. The research employs a qualitative methodology with a descriptive approach and analysis. Data were collected through observation, interviews, and document reviews. The findings reveal that the conflict stemmed from the community's control over land previously classified under HGU (Right to Cultivate) Certificates No. 1, 2, and 3 in Sumberklampok Village, alongside the Bali Provincial Government's claim over the land classified under HGU Certificates No. 2 and 3. The resolution process was supported by various stakeholders, culminating in the issuance of a Joint Agreement Letter (SKB) that facilitated land redistribution as part of an agrarian reform program. The Joint Agreement Letter (SKB) was followed by the distribution of 1,613 land certificates to the community, serving as legal proof of ownership and providing legal certainty over their land rights.

Abstract

The conversion of agricultural land to non-agricultural use in Kembaran District, prompted by the development of Purwokerto, has resulted in multiple environmental impacts. This study seeks to analyze land changes and their effects on environmental quality from 2016 to 2022, employing a mixed-methods approach that integrates both quantitative and qualitative data within a spatial framework. The analysis identifies six categories of land use changes. Mixed Gardens are transformed into Rare Villages (1,954 ha) and Rare Housing (0.156 ha); Irrigated Rice Fields are converted into Small Industries (5,838 ha), Road Networks (0.270 ha), Rare Villages (3,374 ha), and Sparse Housing (2,642 ha). The alterations impact the quality of the residential environment, categorized into good (131,758 ha), medium (311,003 ha), and poor (310,903 ha) classifications. High-quality settlements exhibit low to medium density, abundant shade trees, and significant distance from pollution sources. In contrast, the medium category is characterized by medium density and a moderate presence of shade trees. Poor-quality settlements exhibit high density, a scarcity of shade trees, and closeness to pollution sources. The findings indicate that agricultural land conversion diminishes productive land and exacerbates environmental quality, particularly in densely populated areas with limited vegetation and proximity to pollution sources.

Abstract

This paper aims to examine the contribution of agrarian reform in addressing the gerontocracy of agriculture in rural areas. The research specifically focuses on examining how the post-agrarian reform program in Gunung Kukusan hamlet has shifted land ownership and control from the older to the younger generation, and how agrarian reform has influenced changes in land management control. The research was conducted using a qualitative approach. Data collection techniques included in-depth interviews, observation, and documentation. Data analysis was carried out qualitatively by categorizing and visualizing the data. The research results clearly demonstrate the issue of agricultural gerontocracy, particularly the tendency to view agricultural activities as a secondary profession. Agrarian reform through asset restructuring and access restructuring does not bring about changes in land control, ownership, and management. Land certification serves as a confirmation of ownership rather than a direct transfer of ownership. The practice of land grabbing shows that management control is entirely in the hands of landowners, most of whom belong to the older generation. The youth lack the authority to make changes to the generations-old coconut farming practices. This situation underscores the need for agrarian reform policies that accommodate the issue of youth landlessness.
