Abstract

Peraturan Menteri Perhubungan No. 27 Tahun 2018 tentang Alat Penerangan Jalan Umum. Lampu penerangan jalan umum sangat diperlukan untuk keamanan dan kenyamanan pengguna jalan dan kelancaran dalam mobilitas perekonomian suatu daerah khususnya di Simpang Kanan Kabupaten Aceh Singkil, pelaksanaan tugas dari PJU dilimpahkan kepada Dinas Lingkungan Hidup (DLH) dan berkerja sama dengan Perusahaan Listrik Negara (PLN) Kabupaten Aceh Singkil. PJU merupakan salah satu pelayanan pemerintah daerah yang digunakan untuk kepentingan umum dan digunakan untuk penerangan jalan dimalam hari, namun di Kecamatan Simpang Kanan lampu PJU tidak berjalan sebagaimana mestinya. Lampu penerangan jalan banyak yang padam dan belum diperbaiki tentu hal tersebut membuat pengguna jalan merasa tidak nyaman bahkan keamanannya terasa terancam. Penelitian ini bertujuan untuk mengetahui bagaimana peran pemerintah daerah dalam penerangan lampu jalan di Kecamatan Simpang Kanan Kabupaten Aceh Singkil serta mengetahui apa hambatan dan upaya pemerintah daerah dalam penerangan lampu jalan di Simpang Kanan Kabupaten Aceh Singkil. Penelitian ini menggunakan jenis penelitian empiris dengan pendekatan penelitian yuridis empiris. Sifat penelitian deskriptif, bentuk penelitian yaitu diagnostik, dan lokasi penelitian di kecamatan Simpang Kanan kabupaten Aceh Singkil. Dan sumber data yang di gunakan sumber data primer, sekunder, dan data tersier. Teknik pengumpulan data berdasarkan teknik penelitian lapangan. Alat pengumpulan data berupa wawancara dan pengamatan. Berdasarkan hasil penelitian diketahui bahwa pemerintah daerah sangat berperan penting dalam penggerak berjalannya suatu kegiatan pembangunan, tugas dan wewenang pemerintah daerah dalam penyelenggaraan PJU yaitu mengontrol, memelihara dan mengelola, agar PJU dapat berfungsi dengan baik dan permasalahan tentang padamnya PJU di Simpang Kanan secara garis besar disebabkan karena anggaran tidak memadai, kurangnya sumber daya manusia, faktor alam, fasilitas tidak memadai sehingga hal tersebut membuat penerangan jalan tidak berjalan maksimal. Untuk itu diperlukan suatu upaya untuk meminimalisir semua hambatan yang ada agar PJU berjalan sebagaimana mestinya. Saran untuk pemerintah daerah yaitu harus lebih memperhatikan kebutuhan masyarakat dan membuat Qanun khusus terkait penyelenggaraan PJU serta lebih aktif dalam menjalankan tugas dan kewajiban yang telah diamanahkan.

Abstract

Pukat harimau merupakan alat penangkap ikan yang menggunakan jaring-jaring, penggunaan pukat harimau ini merupakan tindakan yang dilarang oleh pemerintah. Dampak buruk penggunaan pukat harimau akan menyebabkan kerusakan sumber daya alam seperti rusaknya terumbu karang, mengancam kepunahan ikan di laut serta merugikan nelayan tradisional. Meskipun larangan penggunaan pukat harimau telah dilarang, namun para nelayan hingga saat ini masih menggunakan pukat harimau dalam menangkap ikan di laut, para nelayan sering mengabaikan peraturan hukum yang ada di Indonesia ini, padahal telah disebutkan dalam pasal 85 jo pasal 9 Undang-Undang Republik Indonesia Nomor 45 Tahun 2009 tentang perubahan atas Undang-undang Republik Indonesia Nomor 31 Tahun 2004 tentang Perikanan bahwa menangkap ikan dengan menggunakan pukat harimau merupakan perbuatan tindak pidana. Penelitian ini akan membahas pokok masalah bagaimanakah penegakan hukum terhadap larangan penggunaan pukat harimau, bagaimanakah hambatan dalam penegakan hukum terhadap larangan penggunaan pukat harimau, dan bagaimanakah upaya dalam penegakan hukum terhadap larangan penggunaan pukat harimau, khususnya larangan penggunaan pukat harimau yang terjadi di perairan Gampong Pusong Kecamatan Banda Sakti Kota Lhokseumawe. Penelitian ini menggunakan metode penelitian dengan pendekatan yuridis sosiologis. Data diperoleh melalui kegiatan penelitian kepustakaan (library research) dan penelitian lapangan (field research). Analisis dilakukan dengan cara deskriptif (descriptif analysis). Hasil penelitian ini menjelaskan bahwa penegakan hukum terhadap larangan penggunaan pukat harimau yang terjadi di wilayah perairan Kota Lhokseumawe dilakukan secara represif yaitu hanya melakukan penyidikan dan belum pernah diselesaikan sampai ke pengadilan. Sedangakan secara preventif dilakukan dengan melakukan patroli dan pembinaan. Hambatan yang dihadapi petugas Polair yaitu diakibatkan karena kurangnya kerjasama antar pihak yang berwenang dalam mencegah dan memberantas penggunaan pukat harimau serta kurangnya partisipasi dari masyarakat setempat. Upaya yang dilakukan oleh petugas Polair agar masyarakat tidak menggunakan pukat harimau dalam menangkap ikan di laut yaitu dengan melakukan pengawasan lebih baik dan petugas berusaha menjalin hubungan baik dengan masyarakat di wilayah perairan Gampong Pusong Kecamatan Banda Sakti Kota Lhokseumawe. Diharapkan agar penegak hukum bekerjasama dengan masyarakat pesisir pantai serta berkoordinasi dengan baik dengan pihak-pihak terkait. Selain itu, pemerintah harus segera merealisasikan pemberian jaring pukat yang ramah lingkungan sebagai pengganti pukat harimau agar tindak pidana penggunaan pukat harimau dapat dicegah dan tidak ada pihak yang merasa dirugikan.

Abstract

Abstrak The Gayo tribe community is prohibited from carrying out exogamous marriages for several reasons, one of which is that they consider one clan / split to be one offspring. The Gayo tribe community still maintains this custom and cannot be violated, if the Gayo people marry into one clan / split or one village with girls in the village then this is considered a disgrace and will have a direct impact on being ostracized by the community in that village. Communities who carry out exogamous marriages will be subject to customary sanctions in the form of farak (exile) which is decided by customary deliberations conducted by Sarak Opat (customary institution). But in reality, there are still Gayo people in urban and rural areas who carry out exogamous marriages. This study aims to determine and explain the Exogamy Marriage Exogamy of the Gayo Tribe between urban and rural areas in Central Aceh Regency, to find out and explain the legal consequences of exogamous marriages in urban and rural areas for the Gayo tribe in Central Aceh District and efforts to resolve customary sanctions given to people who carry out exogamous marriages in Central Aceh District. This study uses a qualitative method with an empirical juridical approach. Data obtained through library research (library research) and supported by field research (field research). Data analysis was carried out descriptively (descriptive analysis). Based on the results of the research, it is known that exogamous marriage in urban communities has maintained the prohibition of marrying one clan / split until now, while in rural communities the prohibition of marrying among tribes is not really cared about because there has been a shift in customs in the countryside. So that the customs in the Gayo Tribe, not all people of Central Aceh District comply with the customary prohibition of exogamous marriage. The leniency of customs in several places, especially in Linge District, is because the majority of pentani communities from outside the region who carry out exogamous marriages due to ignorance of local customary rules. It is recommended for the community to continue to maintain the customs in the Gayo Tribe. Gayo and Reje Adat Majlis so that they can provide guidance to all rural communities so that they understand and know the local customs rules because the Gayo Tribe customs are the norms (rules) for all people in Central Aceh Regency that must be obeyed. Abstract

The Law Number 22 of 2009 on Traffic and Transportation has given juridical regulation to traffic order. Numerous traffic accidents in the area of police station of Lhokseumawe city from 2016 to 2018 occurred due to the negligence of driver that cause casualties even death. The study aimed to describe the criminal act of traffic accident fatality and the causes in the area of Police Station of Lhokseumawe. The study also attempted to examine the efforts of the traffic police of police station in Lhokseumawe to manage the criminal act of traffic accident fatality and the obstacles. This study used qualitative methods with sociological juridical approach. Data obtained through library research and field research. Data analysis was conducted by using descriptive analysis. Based on the results, it can be concluded that the criminal act of traffic accident fatality in the area of police station in Lhokseumawe is caused by negligence (culpa) of driver and noncompliance with the traffic laws. Majority of the accident is caused by one vehicle overtaking another vehicle. While the efforts to manage violations of traffic law was carried out preventively and repressively by the police station of Lhokseumawe. However, it might not be able to eliminate the violation directly but it can give a warning to the traffic violator. To present an intact image of law to the public, it is suggested that the traffic police of Lhokseumawe city to handle traffic accidents using the strategy of single site (fixing sharp bend), mass action plans (coating the road surface), route action plans (improving traffic signs facilities), and area wide schemes (reducing vehicle speed on specific location), as well as improvements in the internal of police station in Lhokseumawe city. Abstract

Penelitian ini bertujuan untuk memberikan pemahaman kepada masyarakat Kota Lhokseumawe tentang pertanggungjawaban pidana dan sistem pembuktian atas perbuatan mengambil barang milik korban kecelakaan lalu lintas, serta menelaah terkait upaya pencegahan atas tindak pidana tersebut. Kota Lhokseumawe yang merupakan jalan lintas penghubung antar kota memiliki angka kecelakaan lalu lintas yang tinggi sehingga harus diwaspadai oleh masyarakat, karena perbuatan mengambil barang milik korban kecelakaan lalu lintas bisa terjadi kapan dan dimana saja. Metode yang digunakan adalah yuridis empiris dengan pendekatan kualitatif dan sifat penelitiannya deskriptif dengan lokasi penelitian di Kota Lhokseumawe. Hasil penelitian menyebutkan bahwa tindak pidana ini termasuk kedalam pencurian ringan yang diatur dalam Pasal 362 KUHP dengan tanggungjawab ganti ruginya adalah restitusi. Sistem pembuktian yang digunakan adalah pembuktian undang-undang secara negatif dan sesuai dengan undang-undang yang berlaku. Adapun upaya pencegahannya dengan mengurangi jumlah kecelakaan lalu lintas, memberikan laporan atas tindak pidana tersebut sehingga pelaku dapat dihukum dan memperhatikan keselamatan harta dan jiwa ketika berkendara. Abstract

Undang-undang Nomor 33 Tahun 2014 tentang Jaminan Produk Halal, telah memberi perlindungan hukum kepada konsumen tentang ketidakpastian dalam mengkonsmsi makanan dan minuman yang baik dan halal untuk digunakan sesuai dengan kewajiban islam. Di Indonesia yang berwenang mengeluarkan sertifikat halal adalah MUI, namun untuk wilayah aceh yang berwenang mpu melalui LPPOM MPU Aceh, keberadaan LPPOM MPU Aceh menjawab kebutuhan masyarakat untuk mendapatkan makanan dan minuman yang halal untuk dikonsumsi. Tetapi diluaran masih banyak rumah makan yang belum memiliki sertifikat halal. Penelitian ini bertujuan untuk mengetahui tanggung jawab pelaku usaha yang belum memiliki sertifikat halal, cara MPU mengawasi rumah makan belum bersertifikat halal dan hambatan-hambatan pelaku usaha rumah makan dalam mendaftarkan sertifikasi halal. Metode penelitian ini menggunakan metode penelitian yuridis empiris dengan pendekatan kepustakaan dan penelitian lapangan. Penelitian kepustakaan guna memperoleh data sekunder bersifat teoritis, sedangkan penelitian lapangan guna memperoleh data primer melalui wawancara dengan informan dan responden. Berdasarkan hasil penelitian pelaku usaha rumah makan bertanggung jawab atas makanan dan minuman yang dijual tersebut halal, tetapi tidak memahami sertifikat halal sesuai dengan ketentuan undang-undang. Cara MPU mengawasi rumah makan yang belum bersertifikat halal yaitu dengan cara membentuk tim terpadu, tim ini nanti akan memeriksa usaha para pelaku usaha secara berkala. Hambatan pelaku usaha dalam mendaftarkan sertifikat halal yaitu karena kurangnya pemahaman mengenai sertifikat halal, proses yang lama dan harga yang mahal. Disarankan untuk MPU lebih tegas lagi dalam menindak rumah-rumah makan yang belum melakukan sertifikasi halal. Karena tidak adanya sanksi pelaku usaha menghiraukan ketentuan membuat sertifikat halal sesuai peraturan yang berlaku.

Abstract

Traffic accident victims have the right to get protection as stated in Law Number 22 of 2009 Article 241 concerning Road Traffic and Transportation, which states that "Every traffic accident victim has the right to prioritize first aid and treatment at the nearest hospital in accordance with provisions of laws and regulations. That the problem in this study is what are the factors for the occurrence of traffic accident victims caused by livestock and how are efforts to protect victims of traffic accidents caused by livestock. This study aims to determine the factors of the occurrence of victims of traffic accidents caused by livestock and to determine the protection efforts against victims of traffic accidents caused by livestock. The benefit of this research is to be able to contribute ideas to law students, especially in the field of Criminal Law, especially regarding all aspects related to traffic accident regulations caused by livestock.The method that the researcher uses is the empirical juridical method with qualitative analysis. The data were obtained through library research activities and field research. Data analysis was carried out from the beginning and continued throughout the research process, including collecting data, reducing or shrinking data, analyzing data and drawing conclusions. Based on the results of the research that became a factor in traffic accidents, namely the human factor itself, both from the driver who was careless or negligent so that his attention was not focused when driving, and also because the speed of the vehicle was too high so that the vehicle could not be controlled, and from livestock owners who not watching and letting his cattle roam the highway. And the protection efforts given to victims because no livestock owners were found, namely from the police who provided direct handling at the scene, and from the hospital providing care to victims borne by BPJS. It is hoped that the regional government of Pidie Regency will immediately review the Pidie Regency Qanun concerning Control of Livestock Maintenance in Pidie Regency Number 7 of 2012 with stricter sanctions and fines, so that there is a deterrent effect for livestock owners who let their livestock roam freely on the road.

Abstract

Abstrac The settlement of disputes related to reservoir land management rights located in Tring Gadeng District involved the communities of Gampong Meunasah Dee and Gampong Pulo fighting each other for management rights to reservoir land, giving rise to disputes that must be resolved based on customary settlements in Aceh. This is in accordance with Aceh Qanun Number 9 of 2008 concerning the Guidance of Indigenous Life and Customs. In this qanun, it has been explained that each customary dispute resolution in Aceh must first be resolved with existing regulations, both at the village level and at the city level. The research method in this thesis uses empirical juridical research with the type of qualitative research, and the nature of the research is descriptive analysis. The research location is located in Tring Gadeng District, Pidie Jaya, the population used is related to efforts to resolve disputes over land management rights between gampongs traditionally in Tring Gadeng district, Pidie Jaya. The results showed that the settlement of disputes over the customary management rights of inter-gampong reservoirs in Tring Gadeng District, Pidie Jaya was carried out by customary deliberation (mediation) which was resolved by the two gampong officials, Mukim Peuduk Tunong, Camat Tring Gadeng and supervised by the Tring Gadeng Police Chief. The obstacle experienced in this research is that the Gampong Pulo community complicates the dispute resolution process so that it becomes complicated, and the dispute resolution process is slow. Efforts to resolve these obstacles are carried out by peaceful deliberation and approaches to parties who insist on demanding reservoir land management rights. The conclusion in this study is that dispute resolution between gampongs is resolved by customary deliberation (mediation) by carrying out the stages of meetings and approaching parties who demand management rights. courts, and the community must also always be able to accept dispute resolution by customary deliberation according to the decision of the Mukim, Camat and Kapolsek Tring Gadeng as parties participating in the dispute resolution process. Abstract

This study aims to determine the implementation of public services to increase public trust in the Simpang Mamplam District office, Bireuen Regency. One of the government organizations that carry out general government duties is the sub-district government. A sub-district is a government organization formed in a regency/municipal area led by a sub-district head. That the problem in this research is how the implementation of public services to increase public trust and what are the obstacles and efforts made by the employees of the Simpang Mamplam District office, Bireuen Regency. The method used is the empirical juridical method with qualitative analysis, with the research location at the Simpang Mamplam District office, Bireuen Regency. Based on the results of the study, it is known that in the implementation of public services to increase public trust in the Simpang Mamplam District office, Bireuen Regency, the following are: service requirements have been carried out by placing announcements about technical requirements near the service counter; ease in managing and fulfilling service requirements that sub-district employees have provided clarity of information so that it has made it easier for the community to service; clarity of flow in service procedures that sub-district employees have interacted directly with the community related to service flow; service completion time that the community as the recipient of the document has obtained time certainty with the rule of 14 working days; details of the cost of free administration services are not charged any fees.
