Abstract

Abstrak Penelitian ini mengkaji implikasi hukum dari Pasal 78 Peraturan Pemerintah Nomor 39 Tahun 2023, khususnya terkait ketidakjelasan batas waktu pembayaran ganti rugi dalam pengadaan tanah untuk kepentingan umum. Ketentuan tersebut memungkinkan penundaan tanpa batas waktu yang jelas, sehingga menimbulkan ketidakpastian hukum dan mengancam hak konstitusional pemilik tanah. Tujuan penelitian ini adalah untuk menganalisis dampak normatif dari kekaburan tersebut serta merumuskan formulasi pengaturan yang lebih pasti secara hukum dan adil secara prosedural. Dengan menggunakan pendekatan yuridis normatif, penelitian ini mengacu pada teori keadilan Aristoteles, konsep kepastian hukum Gustav Radbruch, dan prinsip penafsiran peraturan perundang-undangan. Temuan menunjukkan bahwa frasa “hal tertentu” dalam ayat (6) dan (7) membuka celah interpretasi, memungkinkan penyalahgunaan diskresi, serta berpotensi memicu ketidakpercayaan publik dan konflik sosial. Oleh karena itu, studi ini merekomendasikan revisi pengaturan dengan menetapkan batas maksimal penundaan, pemberian sanksi atas keterlambatan, dan penguatan prinsip transparansi. Kebaruan penelitian ini terletak pada fokus terhadap norma waktu sebagai elemen penting dalam perlindungan hukum, yang selama ini kurang mendapat perhatian dalam literatur pengadaan tanah. Temuan ini menjadi semakin relevan di tengah maraknya sengketa ganti rugi yang terus berulang dan merugikan pemilik tanah di berbagai wilayah Indonesia. Keywords: Pengadaan Tanah, Ganti Rugi, Kepastian Hukum, Keadilan, Peraturan Pemerintah Abstract This study examines the legal implications of Article 78 of Government Regulation No. 39 of 2023, particularly the ambiguity surrounding the time limit for compensation payments in land acquisition for public interest. The provision allows for postponement without a clear temporal boundary, leading to legal uncertainty and undermining the constitutional rights of landowners. The objective of this research is to analyze the normative consequences of such ambiguity and propose a more legally certain and procedurally fair regulatory formulation. Using a normative legal approach, the study applies Aristotle’s theory of justice, Gustav Radbruch’s concept of legal certainty, and principles of statutory interpretation. The findings indicate that the undefined phrase “certain conditions” in paragraphs (6) and (7) creates interpretive gaps, enables discretionary abuse, and risks triggering public distrust and social conflict. Therefore, the study recommends revising the regulation to establish a clear maximum postponement period, impose delay penalties, and reinforce transparency standards. The novelty of this research lies in its focus on temporal norms as a crucial component of legal protection, an area largely overlooked in existing land acquisition literature. These insights are particularly urgent amid recurring compensation disputes that continue to affect landowners across Indonesia. Abstract

Penelitian ini mengkaji perbedaan pengaturan jangka waktu pemberian Hak Guna Usaha (HGU) antara Undang-Undang Pokok Agraria (UUPA) dan peraturan turunan dari UU Cipta Kerja, yaitu Peraturan Pemerintah Nomor 18 Tahun 2021. Dalam UUPA, tidak terdapat ketentuan mengenai jangka waktu pembaruan HGU, hanya mengatur perpanjangan hak tanpa klausula pembaruan setelah masa berlaku berakhir. Sebaliknya, UU Cipta Kerja dan PP 18 Tahun 2021 memberikan pengaturan jangka waktu yang berbeda, tanpa merujuk pada UUPA dan tanpa kejelasan pelaksanaan aturan tersebut, sehingga menimbulkan ketidakpastian hukum. Tujuan penelitian adalah menganalisis kebijakan penggunaan jangka waktu pembaruan HGU yang diberikan pemerintah. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual. Hasil penelitian menunjukkan bahwa kebijakan baru memberikan jangka waktu perpanjangan dan pembaruan HGU hingga 95 tahun. Kebijakan ini berpotensi mengabaikan prinsip fungsi sosial tanah dan lebih mengutamakan investasi jangka panjang dibandingkan redistribusi tanah untuk keadilan agraria. Kata Kunci: Hak Guna Usaha, Jangka Waktu, Kebijakan, Agraria, Investasi Abstract This study examines the differences in the regulation of land use rights (Hak Guna Usaha, HGU) renewal periods between the Basic Agrarian Law (UUPA) and the derivative regulation from the Job Creation Law, namely Government Regulation No. 18 of 2021. The UUPA does not regulate the renewal period for HGU, only the extension of rights without clauses on renewal after the expiration period. Conversely, the Job Creation Law and PP 18 of 2021 regulate the renewal period differently, without referencing UUPA and lacking clarity on implementation, thus creating legal uncertainty. The study aims to analyze government policy regarding the renewal period of HGU rights. The method used is normative legal research with statutory and conceptual approaches. The results reveal that the new policy grants renewal and extension of HGU rights for up to 95 years. This policy potentially neglects the social function of land and tends to prioritize long-term investment interests over land redistribution for agrarian justice. Abstract

Penelitian ini bertujuan untuk meningkatkan kemampuan menghafal Al-Qur’an pada siswa MTs Al- Munawwarah Binjai Utara melalui penerapan metode hafalan berbasis Repetisi. Metode ini berfokus pada pengulangan ayat secara sistematis untuk memperkuat daya ingat dan konsistensi hafalan. Penelitian ini menggunakan pendekatan Penelitian Tindakan Kelas (PTK) yang terdiri dari beberapa siklus, mencakup tahap perencanaan, tindakan, observasi, dan refleksi. Data dikumpulkan melalui wawancara, observasi, dan tes hafalan. Hasil penelitian menunjukkan bahwa metode Repetisi secara signifikan meningkatkan jumlah dan kualitas hafalan siswa, serta meningkatkan motivasi mereka dalam menghafal Al-Qur’an. Dengan strategi pengulangan yang sistematis, siswa lebih mudah mempertahankan hafalannya dalam jangka panjang. Oleh karena itu, metode ini direkomendasikan sebagai strategi efektif dalam pembelajaran Tahfidz di lingkungan madrasah.

Abstract

Data management and registration services are important components in supporting hospital information systems. Trans Medic application-based online registration is a web-based system that allows simultaneous use by multiple users. This study aims to evaluate the use of the Trans Medic online application in the outpatient registration process at Royal Prima Medan General Hospital. This research used a qualitative approach with a case study design. The informants in the study totaled ten people, consisting of one official staff, four registration officers, and five patients. Data were collected through in-depth interviews and analyzed using the stages of data reduction, data presentation, and conclusion drawing. The results showed that the obstacles faced in using the application were network disruptions and application errors that caused inability to access by patients and officers. Nevertheless, the human resources who manage the application are considered adequate and have the required knowledge and skills. This application provides significant benefits in the form of ease of registration for patients and work efficiency for officers. In addition, Standard Operating Procedures (SPO) related to the use of the application are available and running effectively.

Abstract

communication between local and immigrant students at the Faculty of Social Sciences, State Islamic University of North Sumatra. Using the theory of intercultural communication and the concept of culture shock from Oberg, this study applies a qualitative ethnographic approach with a constructivist paradigm. Data were collected through in-depth interviews, participant observation, and documentation, and validated using source triangulation. The results of the study indicate that local students have difficulty understanding the accent and regional terms of immigrant students, while immigrant students face discomfort in communicating and feelings of inferiority in initial interactions. Through involvement in campus organizations and academic activities, immigrant students successfully adapt, while local students show an attitude of openness to cultural diversity. The conclusion of the study confirms that cross-cultural interactions on campus show developments towards more inclusive social relations, although institutional efforts are still needed to systematically strengthen cross-cultural programs in order to optimize the social integration of students from various backgrounds.

Abstract

This study aims to analyze the tourism communication strategy implemented by the Langkat Regency Tourism Office in increasing tourist interest. Langkat Regency has great natural and cultural potential, but has not been fully optimized through an effective and adaptive communication strategy to global trends. This study uses a qualitative approach with an explanatory research type, through observation techniques, in-depth interviews, and documentation. The results of the study show that the communication strategies used include the use of social media, the involvement of micro-influencers, strengthening locality-based destination narratives, developing a community-based creative economy, and cross-actor collaboration. This strategy has been able to build a positive destination image and strengthen tourists' emotional involvement in Langkat, especially through a digital approach and experience-based promotion. However, the study also found challenges such as inadequate infrastructure, low quality of service, and lack of integration between online promotion and the reality of services in the field. Referring to the Marketing Mix 7P theory, Langkat's communication strategy has not fully touched all aspects of the marketing mix in a balanced manner. Therefore, a more integrated and sustainability-based strategic approach is needed to build an inclusive, adaptive, and long-term oriented tourism communication system. This study is expected to be a reference in designing effective tourism communication policies for areas with similar characteristics and challenges. Langkat Communication has not fully touched all aspects of the marketing mix in a balanced manner. Therefore, a more integrated and sustainability-based strategic approach is needed to build an inclusive tourism communication system.

Abstract

Abstract Penalty clauses in civil contracts serve as a preventive mechanism against breach of contract and as a legal protection tool for the aggrieved party. However, the Indonesian Civil Code (KUHPerdata) does not explicitly regulate such clauses, resulting in legal uncertainty and inconsistent judicial practices. This study aims to comparatively analyze the regulation and implementation of penalty clauses in Indonesia, the United Kingdom (via the concept of liquidated damages), and Germany (through Strafklauseln). Employing normative, conceptual, case study, and comparative approaches, the findings reveal that Indonesia’s legal framework remains weak and heavily reliant on judicial discretion, in contrast to the more structured and proportionate approaches found in the UK and Germany. The study recommends a reformulation of Indonesia’s legal framework governing penalty clauses to strengthen legal certainty and ensure substantive justice. The novelty of this research lies in its cross-system legal analysis and emphasis on the need for contractual justice reform in Indonesian civil law. Abstract

Abstrak Tujuan dari kajian penelitian ini adalah mendeskripsikan praktik tahsin al-Qur’an pada program pendidikan agama Islam Universitas Terbuka serta menganalisis capaian hasil belajar mahasiswa untuk mengetahui efektivitasnya. Mixed methods desain eksplanatori sekuensial adalah pendekatan yang diterapkan dalam penelitian ini. Data kuantitatif diperoleh melalui dokumentasi nilai dari 2.264 mahasiswa, sedangkan kualitatif diperoleh melalui observasi, wawancara semi struktur dan analisis dokumen. Hasil penelitian menunjukkan bahwa pendekatan sinkronus melalui daring tatap maya (virtual) yang dilaksanakan secara langsung (real-time) memberikan interaksi langsung, koreksi bacaan serta pemberian umpan balik yang efektif dalam pembelajaran praktik tahsin al-Qur’an diPAI UT. Sementara itu, pendekatan asinkronus memberikan keluasan waktu belajar mahasiswa baik mengakses materi ataupun Latihan mandiri sehingga tercipta kemandirian yang terarah. Pendekatan sinkronus dan asinkronus dalam pembelajaran Tahsin di Universitas Terbuka membentuk model blended learning daring yang dinilai cocok dalam upaya meningkatkan kompetensi membaca al-Qur’an di kalangan mahasiswa. Dilihat dari capaian nilai dimana lebih dari 75% mahasiswa mendapatkan nilai baik hingga baik sekali. Dalam pembelajaran praktik tahsin al-Qur’an di PAI UT berbasis keterampilan atau praktik, penggunaan pendekatan sinkronus dan asinkronus adalah kesatuan yang membentuk keterpaduan dalam pembelajaran sehingga tidak dapat dipisahkan satu per satu. Kata Kunci: Sinkronus, Asinkronus, Tahsin al-Qur’an, Universitas Terbuka Abstract This study aims to describe the practice of Qur’anic tahsin (refinement of recitation) within the Islamic Religious Education program at Universitas Terbuka and analyze student learning outcomes to assess its effectiveness. A sequential explanatory mixed methods design was employed. Quantitative data were collected from the academic records of 2,264 students, while qualitative data were obtained through observation, semi-structured interviews, and document analysis. The findings indicate that synchronous learning through real-time virtual sessions (e.g., Zoom, Microsoft Teams) offers direct interaction, effective correction, and timely feedback in tahsin instruction. Meanwhile, asynchronous learning facilitates flexibility and autonomous learning, enabling students to access content and engage in self-practice at their own pace. The integration of synchronous and asynchronous modes forms a blended learning model that proves effective for enhancing Qur’anic reading proficiency. Over 75% of students achieved commendable academic performance. In skill-based learning contexts like tahsin, the combination of both methods constitutes an inseparable instructional unity. Abstract

Abstrak Penelitian ini bertujuan untuk menganalisis penyebab tidak terpenuhinya kewajiban pengembang perumahan dalam penyediaan Prasarana, Sarana, dan Utilitas (PSU), serta implikasi hukum yang timbul akibat tidak terpenuhinya kewajiban tersebut. Fokus utama penelitian ini adalah pada pengambil-alihan secara sepihak PSU oleh Pemerintah Daerah di Perumahan Makarya Binangun, Kabupaten Sidoarjo. Penelitian ini menggunakan metode yuridis-empiris dengan pendekatan yuridis-sosiologis dan yuridis-antropologis. Teknik pengumpulan data dilakukan melalui wawancara dengan berbagai pihak terkait, seperti Dinas Perumahan, Pemerintah Desa, dan warga perumahan, serta analisis dokumen hukum. Hasil penelitian menunjukkan bahwa pengembang perumahan tidak memenuhi kewajibannya, sehingga Pemerintah Daerah melakukan pengambil-alihan PSU secara sepihak. Proses pengambil-alihan ini terhambat oleh ketidaktahuan keberadaan dokumen penting dan ketidakteraturan status hukum lahan PSU. Penelitian ini menyarankan kebijakan baru yang lebih efektif untuk mempercepat proses pengambil-alihan PSU, termasuk penerbitan sertifikat pengganti dan verifikasi lapangan yang lebih transparan. Abstract This study aims to analyze the causes of developers’ failure to fulfill their obligations in providing Infrastructure, Facilities, and Utilities (PSU) and the legal implications arising from this non-compliance. The primary focus of this research is the unilateral takeover of PSU by the local government in Makarya Binangun Housing, Sidoarjo. This research employs a juridical-empirical method with juridical-sociological and juridical-anthropological approaches. Data collection techniques include interviews with various relevant parties, such as the Housing Department, Village Government, and residents, as well as the analysis of legal documents. The findings indicate that the housing developer failed to meet its obligations, prompting the local government to take unilateral action to acquire the PSU. However, this process was hindered by the lack of essential documentation and irregular legal status of the PSU land. This study suggests the implementation of more effective policies to expedite the PSU takeover process, including the issuance of replacement certificates and a more transparent field verification process. Abstract

This study explores the effectiveness of clinical supervision in enhancing teaching quality and teacher professionalism in secondary religious schools. Clinical supervision is viewed as a collaborative and reflective approach that offers teachers an opportunity to develop pedagogical competencies through structured guidance and constructive feedback. Employing a qualitative approach with a case study design, this research involved direct observation, in-depth interviews, and document analysis of supervision activities within the school. Findings indicate that clinical supervision not only improves teaching skills but also encourages teachers to be more reflective in their practice, fostering a dynamic and adaptive learning environment. The collaborative nature of this supervision allows teachers to receive constructive and solution-oriented feedback, driving innovation in teaching methods and building confidence. Additionally, challenges such as limited time and resources were identified, which can be mitigated through strategic planning and enhanced management support. This study concludes that clinical supervision is an effective tool for improving teaching quality and teacher professionalism, with broader applicability in strengthening teaching practices across diverse educational contexts. These findings are expected to underpin educational policy development that emphasises continuous support and professional development for teachers.
