Abstract

AbstrakPenelitian ini mengkaji teori kritis komunikasi sebagai pendekatan analitis yang berfungsi untuk mengkritisi struktur kekuasaan, ideologi, dan relasi sosial dalam praktik komunikasi. Tujuan utama penelitian ini adalah untuk mengungkap dinamika kekuasaan dominan, menganalisis representasi dan konstruksi realitas, serta mendorong kesadaran kritis dan transformasi sosial melalui komunikasi. Penelitian ini menggunakan desain penelitian kualitatif dengan metode studi pustaka (library research), yang mengandalkan analisis kritis terhadap literatur, buku, jurnal akademik, dan konten media yang relevan. Hasil penelitian menunjukkan bahwa teori kritis komunikasi berakar pada pemikiran Marxis, kritik budaya, poststrukturalis, dan perspektif feminis. Dalam kajian komunikasi, teori ini diterapkan untuk menganalisis konten media, iklan, propaganda, komunikasi politik, dan wacana antarbudaya. Temuan penelitian ini menegaskan bahwa teori kritis komunikasi memiliki peran penting dalam meningkatkan kesadaran kritis, mendekonstruksi ideologi dominan, dan mendukung perubahan sosial. Simpulan penelitian ini menegaskan relevansi teori kritis sebagai kerangka berpikir untuk melakukan perlawanan terhadap hegemoni dalam praktik komunikasi. Implikasi dari penelitian ini menunjukkan bahwa teori kritis komunikasi dapat digunakan sebagai alat strategis bagi pendidik, praktisi media, dan akademisi komunikasi untuk mendorong komunikasi yang emansipatoris dan mempromosikan keadilan sosial dalam kehidupan masyarakat kontemporer. Abstract This study examines critical communication theory as an analytical approach that critiques power structures, ideologies, and social relations within communication practices. The main objective of this research is to uncover the dynamics of dominant power, analyze the representation and construction of reality, and promote critical awareness and social transformation through communication. This study adopts a qualitative research design using library research (studi pustaka) as the primary method, relying on the critical analysis of literature, books, academic journals, and relevant media content. The research results show that critical communication theory is rooted in Marxist thought, cultural criticism, poststructuralism, and feminist perspectives. In communication studies, this theory is applied to analyze media content, advertising, propaganda, political communication, and intercultural discourse. The findings emphasize that critical communication theory plays a significant role in enhancing critical consciousness, deconstructing dominant ideologies, and supporting social change. The conclusion highlights the relevance of critical theory in providing a framework for resistance against hegemony in communication practices. The implication of this study suggests that critical communication theory can be used as a strategic tool for educators, media practitioners, and communication scholars to foster emancipatory communication and promote social justice in contemporary society. Abstract

Penelitian ini bertujuan untuk mengkaji implementasi pendidikan multikultural di SMP Swasta Muhammadiyah Kota Gunungsitoli dan dampaknya terhadap karakter siswa. Metode yang digunakan dalam penelitian ini adalah pendekatan kualitatif, di mana data dikumpulkan melalui wawancara dengan kepala sekolah, guru, dan siswa, serta observasi langsung terhadap kegiatan di sekolah. Hasil penelitian menunjukkan bahwa SMP Swasta Muhammadiyah Kota Gunungsitoli berhasil mengintegrasikan nilai-nilai multikultural ke dalam kurikulum, melaksanakan kegiatan ekstrakurikuler yang berfokus pada seni dan budaya, serta memberikan pelatihan kepada guru untuk meningkatkan pemahaman mereka tentang pentingnya keberagaman. Dampak positif dari praktik ini terlihat pada peningkatan empati, toleransi, dan sikap terbuka siswa terhadap perbedaan. Meskipun terdapat tantangan, seperti pengaruh stereotip dari masyarakat, komitmen sekolah dalam menciptakan lingkungan belajar yang inklusif tetap kuat. Penelitian ini merekomendasikan perlunya dukungan lebih lanjut dari orang tua dan masyarakat untuk memperkuat nilai-nilai multikultural dalam pendidikan. Kesimpulannya, internalisasi pendidikan multikultural di SMP Swasta Muhammadiyah Kota Gunungsitoli tidak hanya membentuk karakter siswa, tetapi juga berkontribusi pada terciptanya masyarakat yang harmonis dan berkeadilan. The research employed a qualitative approach, in which data were collected through interviews with the principal, teachers, and students, as well as direct observations of school activities. The findings reveal that Muhammadiyah Private Junior High School in Gunungsitoli has successfully integrated multicultural values into its curriculum, organized extracurricular activities centered on arts and culture, and provided teacher training to enhance their understanding of the importance of diversity. The positive impact of these practices is evident in the increased empathy, tolerance, and openness among students toward differences. Despite facing challenges such as societal stereotypes, the school’s commitment to fostering an inclusive learning environment remains strong. This study recommends further support from parents and the community to reinforce multicultural values in education. In conclusion, the internalization of multicultural education at Muhammadiyah Private Junior High School in Gunungsitoli not only shapes students’ character but also contributes to the development of a just and harmonious society. Abstract

Abstrak Penelitian ini bertujuan untuk menggali peran ilmu agama dalam mengamalkan Al-Qur'an di kalangan para penghafal Al-Qur'an di Rumah Tahfidz Kawan M77. Rumah tahfidz ini tidak hanya berfokus pada hafalan, tetapi juga pada pengimplementasian ajaran-ajaran Al-Qur'an dalam kehidupan sehari-hari. Penelitian ini menggunakan pendekatan kualitatif dengan teknik wawancara dan observasi untuk mengumpulkan data dari penghafal Al-Qur'an di Rumah Tahfidz Kawan M77. Hasil penelitian menunjukkan bahwa ilmu agama, seperti tafsir, fiqh, akhlak, dan hadits, menjadi fondasi utama dalam mengamalkan Al-Qur'an. Selain hafalan, para penghafal juga diberikan pembelajaran mengenai implementasi nilai-nilai Al-Qur'an dalam kehidupan mereka, dengan penekanan pada adab, akhlak, dan penguatan spiritual. Oleh karena itu, ilmu agama memegang peranan penting dalam membentuk individu yang tidak hanya hafal Al-Qur'an, tetapi juga dapat mengamalkan ajarannya dengan benar dalam kehidupan sehari-hari. Abstract This study aims to explore the role of religious knowledge in the practice of the Quran by the memorizers at Rumah Tahfidz Kawan M77. This tahfidz house plays an important role in shaping a generation that not only memorizes the Quran but also implements its teachings in everyday life. The research uses a qualitative approach with interview and observation techniques to gather data from the memorizers at Rumah Tahfidz Kawan M77. The results show that religious knowledge, including tafsir, fiqh, akhlak, and hadith, is a foundational element in practicing the Quran. The memorizers are not only focused on memorization, but also taught how to implement the values of the Quran in their lives, with an emphasis on manners, character, and spiritual reinforcement. Therefore, religious knowledge plays a significant role in shaping individuals who not only memorize the Quran but also practice its teachings correctly in their daily lives. Abstract

Abstrak Penelitian ini bertujuan menganalisis efektivitas penerapan metode kooperatif tipe Group Investigation dalam meningkatkan hasil belajar Pendidikan Agama Islam pada siswa kelas II MTs Uswatun Hasanah. Penelitian menggunakan pendekatan penelitian tindakan kelas dengan subjek sebanyak 39 siswa. Hasil penelitian menunjukkan adanya peningkatan signifikan dalam hasil belajar siswa setelah penerapan metode Group Investigation. Rata-rata nilai pre-test awal sebesar 36,63, dengan tidak ada siswa yang mencapai Kriteria Ketuntasan Minimal. Setelah siklus I dengan metode konvensional, 21,4% siswa mencapai Kriteria Ketuntasan Minimal, sedangkan pada siklus II setelah penerapan metode kooperatif tipe Group Investigation, persentase siswa yang mencapai Kriteria Ketuntasan Minimal meningkat menjadi 89,48%. Temuan ini menunjukkan bahwa metode kooperatif tipe Group Investigation efektif meningkatkan hasil belajar Pendidikan Agama Islam siswa. Oleh karena itu, metode ini direkomendasikan untuk digunakan dalam proses pembelajaran guna meningkatkan prestasi siswa. Abstract This study aims to analyze the effectiveness of the cooperative learning method, specifically the Group Investigation type, in improving learning outcomes in Islamic Religious Education for second-grade students at MTs Uswatun Hasanah. This research employed a classroom action research approach involving 39 students as subjects. The results showed a significant improvement in students' learning outcomes after applying the Group Investigation method. The initial pre-test average score was 36.63, with no students meeting the Minimum Mastery Criteria. After the first cycle using conventional methods, 21.4% of students met the Minimum Mastery Criteria, which increased to 89.48% after the second cycle using the Group Investigation cooperative method. These findings indicate that the Group Investigation cooperative learning method is effective in enhancing students' learning outcomes in Islamic Religious Education. Therefore, this method is recommended for use in the learning process to improve student achievement. Abstract

Abstrak Pemberlakuan Bea Perolehan Hak Atas Tanah dan Bangunan (BPHTB) terhadap hibah wasiat bertujuan mengoptimalkan pendapatan daerah sekaligus menjamin pengalihan hak milik yang terstruktur dan sah. Namun, dalam pelaksanaannya, terdapat berbagai tantangan terkait kepatuhan wajib pajak dan kepastian hukum. Penelitian ini menggunakan metode yuridis empiris dengan pendekatan observasional untuk mengkaji penerapan BPHTB pada hibah wasiat. Data primer dikumpulkan melalui pengamatan langsung dan dilengkapi bahan hukum sekunder untuk menganalisis konsistensi regulasi serta efektivitas penegakan. Tujuan penelitian adalah mengevaluasi efektivitas pengenaan BPHTB dan mengidentifikasi kendala pelaksanaannya. Hasil menunjukkan bahwa penegakan BPHTB belum efektif akibat kurangnya kesadaran masyarakat, mekanisme penegakan yang tidak konsisten, dan disparitas regional dalam penentuan pajak. Selain itu, inefisiensi birokrasi dan kompleksitas administrasi menurunkan kepatuhan wajib pajak. Dari perspektif kepastian hukum, ketidakkonsistenan peraturan pemerintah daerah dan tidak adanya ketentuan hukum seragam menimbulkan ambiguitas, berujung pada ketidakpastian bagi wajib pajak. Oleh karena itu, memperkuat kejelasan aturan dan memastikan penerapan yang seragam sangat penting untuk meningkatkan efektivitas BPHTB serta kepastian hukum dalam hibah wasiat.Kata Kunci: Bea Perolehan Hak Atas Tanah dan Bangunan (BPHTB), Hibah Wasiat, Pendapatan Daerah, Kepatuhan Wajib Pajak, Kepastian Hukum. Abstract The imposition of the Land and Building Acquisition Duty (BPHTB) on bequest grants aims to optimize regional revenue while ensuring a structured and lawful transfer of ownership rights. However, its implementation faces various challenges, particularly concerning taxpayer compliance and legal certainty. This study employs an empirical juridical method with an observational approach to examine the practical application of BPHTB on bequest grants. Primary data were collected through direct observation, complemented by secondary legal materials to analyze regulatory consistency and enforcement effectiveness. The research aims to evaluate the effectiveness of BPHTB imposition and identify obstacles hindering its implementation. Results indicate that BPHTB enforcement remains ineffective due to low public awareness, inconsistent enforcement mechanisms, and regional disparities in tax determination. Additionally, bureaucratic inefficiencies and administrative complexities reduce taxpayer compliance. From a legal certainty perspective, inconsistencies in regional government regulations and the absence of uniform legal provisions create ambiguity, leading to uncertainty among taxpayers. Strengthening regulatory clarity and ensuring uniform application are crucial to enhancing BPHTB effectiveness and legal certainty in bequest grants. Abstract

This study discusses the responsibility of the Ministry of Land Affairs in issuing Mortgage Rights for land certificates that are still subject to Land and Building Acquisition Fees. This study uses an empirical method. Data were obtained through analysis and primary data from interviews with the Land Office, creditors, and local governments, secondary data from laws and regulations, and tertiary data from literature and related legal documents. The results of the study indicate that verification of Land and Building Acquisition Fee payments before the issuance of Mortgage Right certificates is still not optimal due to the coordination agreement between the Land Office and local governments. In addition, a weak data integration system and low public awareness of the obligation to pay Land and Building Acquisition Fees also contribute to this problem. As a result, there is a risk for creditors in executing collateral and obstacles for debtors in the process of transferring land rights.

Abstract

The phrase “obligatory” in the government regulation regarding the Land Deed Official as the recipient of the protocol has significant legal implications in determining the nature of his/her obligations. The ratio legis of this phrase is important to assess whether the obligation is absolute or conditional, which affects legal certainty and uniformity of its application. This study uses a normative legal method, namely analyzing legal norms through the interpretation of relevant laws, regulations, and legal doctrines. This study relies on primary legal materials, including laws and government regulations; secondary legal materials, such as legal commentaries and scientific articles; and tertiary legal materials, including legal dictionaries and encyclopedias. Data collection was carried out through a literature study, which ensured a comprehensive examination of legal texts and academic discussions. This study aims to evaluate the extent to which the term “obligatory” imposes binding duties on the Land Deed Official in receiving and managing the protocol. The research findings indicate that the phrase “obligatory” reflects an imperative legal obligation based on the theory of legal positivism, which prioritizes compliance with written legal norms. However, from the perspective of the theory of legal certainty (Rechtszekerheid), the regulation is less clear in defining the procedural mechanism, resulting in inconsistent application among Land Deed Officials. This ambiguity poses challenges in enforcing uniform practices, potentially undermining the effectiveness of the regulation.

Abstract

Abstrak Pemungutan Pajak Perolehan Hak Atas Tanah dan Bangunan (BPHTB) pada tahap Perjanjian Pengikatan Jual Beli (PPJB) dalam transaksi properti di Indonesia menimbulkan ketidakpastian hukum dan dampak ekonomi yang signifikan. Ketidakpastian ini muncul karena PPJB merupakan perjanjian pendahuluan yang belum mengalihkan hak milik secara resmi, sehingga menimbulkan potensi pajak berganda dan beban finansial berlebih bagi pembeli. Penelitian ini bertujuan menganalisis kepastian hukum dan dampak ekonomi penerapan BPHTB pada tahap PPJB dengan menggunakan metode penelitian hukum empiris. Data dikumpulkan melalui wawancara dengan notaris, praktisi hukum, pejabat pajak, serta studi kasus transaksi properti terkait. Observasi lapangan juga dilakukan untuk meninjau perbedaan penafsiran dan penegakan peraturan BPHTB oleh pemerintah daerah. Hasil penelitian menunjukkan adanya ketidakpastian hukum dan persepsi ketidakadilan di kalangan pemangku kepentingan akibat penerapan BPHTB yang bervariasi antar daerah. Oleh karena itu, diperlukan standar kebijakan perpajakan yang jelas dan transparan agar BPHTB hanya dikenakan pada saat pengalihan hak milik yang sah secara hukum. Abstract The imposition of Land and Building Acquisition Duty (BPHTB) during the Sale and Purchase Binding Agreement (PPJB) stage in property transactions in Indonesia causes significant legal uncertainty and economic impact. This uncertainty arises because PPJB is a preliminary agreement that does not officially transfer ownership rights, leading to potential double taxation and excessive financial burden for buyers. This study aims to analyze the legal certainty and economic impact of BPHTB application at the PPJB stage using an empirical legal research method. Data were collected through interviews with notaries, legal practitioners, tax officials, and case studies of related property transactions. Field observations were also conducted to review differences in interpretation and enforcement of BPHTB regulations by regional governments. The findings reveal legal uncertainty and perceptions of injustice among stakeholders due to the varied application of BPHTB across regions. Therefore, a clear and transparent tax policy standard is needed to ensure BPHTB is only imposed upon legally valid ownership transfer. Abstract

Digital transformation has brought significant changes in various aspects of life, including in Islamic religious education in pesantren. As an educational institution that plays an important role in shaping the religious and cultural identity of Indonesian society, pesantren face challenges in adjusting to the development of information technology. This study aims to analyze the role of information technology in Islamic religious education in pesantren, including the challenges faced, strategies to overcome obstacles, and the impact on the learning process and pesantren culture. This research uses a qualitative method with a phenomenological approach. The research objects were Askhabul Kahfi and Roudlotul Muttaqin Islamic Boarding Schools in Semarang City. Data were collected through observations, interviews, and document studies, and analyzed using inductive and deductive approaches to find emerging patterns and meanings. Data validity was guaranteed through the triangulation method. The results show that pesantren have adopted information technology through the use of online platforms, learning applications, and digital resources to improve teaching effectiveness. However, the implementation of digital transformation is faced with infrastructure limitations, shifts in traditional pesantren culture, and curriculum adjustments. To overcome these challenges, it is necessary to increase the accessibility of technology, training for teachers and students, and the integration of Islamic values in the digital context. The impact can be seen in the changing roles of teachers and students as well as the shifting pesantren culture in religious learning. In conclusion, digital transformation makes a positive contribution to Islamic religious education in pesantren, although adaptation efforts are needed to remain in line with the traditional values upheld.

Abstract

This journal analyzes the procedural criminal law (KUHAP) in dealing with cybercrime within formal legal law. The analysis highlights the use of cloud storage as a media to store the proceeds of crime, in the form of data privacy. As a case study to show how cyber criminals commit cyber crimes by using computer networks, investigators still face difficulties in conducting searches and seizures to obtain evidence. The results of data theft crimes which are stored in cloud storage, make digital evidence difficult to be seized, nothing can be used as evidence. As a result, digital evidence from crimes remains accessible and can be reused in subsequent crime, while, hackers remain uncaptured. What strategies can the Indonesian government implement to overcome and prevent cyberbcrime attacks in the future? This requires reformulating legal provisions as amendments and improvements to Law Number 8 of 1981 concerning the Indonesian Criminal Procedure Code (KUHAP), with reference to the Budapest Convention. This research examines the main problem using a normative juridical approach, statutory approach, case approach, and comparative legal methods, combined with qualitative analysis approach. It philosophically examines the principle of legal certainty and analyzes legal theories of punishment and confiscation. Thus, a formal procedural legal system is applied to regulate the seizure and search of intangible electronic, enabling the electronic evidence stored in cloud to be seized or taken down from cyberspace, declared valid in court, fulfilling the principle of legal certainty to trace the footsteps of hackers across countries/internationally.
