Abstract

Abstrak Notaris memiliki kewajiban menyelenggarakan protokol yang diawasi oleh Majelis Pengawas Daerah (MPD). Di era digital dan cybernotary, mekanisme pengawasan manual dinilai tidak lagi memadai dalam menjawab tuntutan efisiensi, transparansi, dan akuntabilitas. Meski telah ada inisiatif sistem berbasis teknologi seperti SIEMON, belum tersedia regulasi yang secara khusus mengatur mekanisme pengawasan protokol notaris melalui sistem digital. Kekosongan hukum ini berpotensi menimbulkan ketidakpastian hukum dan melemahkan fungsi pengawasan. Penelitian ini bertujuan menganalisis urgensi pengaturan pengawasan digital oleh MPD dalam menghadapi perkembangan cybernotary. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual. Analisis dilakukan melalui teori konvergensi hukum dan teknologi, teori hukum progresif, teori kepastian hukum, serta teori kewenangan untuk memahami kelemahan regulasi yang ada dan merumuskan arah pengaturan ideal. Hasil penelitian menunjukkan bahwa sistem pengawasan manual tidak lagi relevan dengan perkembangan masyarakat digital dan kebutuhan layanan hukum modern. Regulasi baru diperlukan untuk memastikan kepastian hukum, integritas jabatan notaris, serta perlindungan hukum bagi masyarakat. Dari aspek filosofis, yuridis, dan sosiologis, pengaturan ini mendesak untuk diwujudkan sebagai dasar hukum yang adaptif terhadap transformasi teknologi, sekaligus menjamin profesionalisme notaris sebagai officium nobile. Abstract Notaries are obliged to manage protocols under the supervision of the Regional Supervisory Council (MPD). In the digital and cybernotary era, conventional manual supervision mechanisms are no longer adequate to address the demands for efficiency, transparency, and accountability. Although initiatives such as SIEMON have been introduced, there is still no specific regulation governing technology-based supervision of notarial protocols. This legal vacuum may result in uncertainty and weaken supervisory functions. This study aims to analyze the urgency of regulating digital supervision by MPD in response to the development of cybernotary practices. The research employs normative legal methods using statutory and conceptual approaches. The analysis applies the theory of law and technology convergence, progressive law theory, legal certainty theory, and authority theory to examine current regulatory shortcomings and formulate the direction of ideal regulation. The findings reveal that manual supervision is no longer relevant to the dynamics of a digital society and the needs of modern legal services. New regulations are required to ensure legal certainty, uphold the integrity of the notary office, and protect public interests. Philosophical, juridical, and sociological considerations highlight the urgency of establishing adaptive regulations that align with technological transformation while ensuring the professionalism of notaries as officium nobile. Abstract

Abstrak Fenomena perdagangan anak di Kota Medan menunjukkan peningkatan signifikan baik dari segi kuantitas maupun modus operandi, yang kini bergeser dari pola individual ke bentuk kelompok terorganisasi berbasis digital. Penelitian ini bertujuan untuk menganalisis efektivitas strategi kepolisian dalam mencegah perdagangan anak, dengan fokus pada transformasi tren kejahatan, kapasitas institusional, inisiatif pencegahan, kolaborasi masyarakat, serta kerangka kebijakan dan hukum. Metode penelitian menggunakan pendekatan kualitatif normatif-empiris, dengan unit analisis pada institusi Kepolisian Kota Medan. Data dikumpulkan melalui wawancara mendalam, observasi lapangan, dan analisis dokumen hukum serta laporan kelembagaan. Hasil penelitian menunjukkan adanya tren peningkatan kasus perdagangan anak yang signifikan, disertai pergeseran modus operandi ke platform digital. Kepolisian telah mengembangkan strategi pencegahan melalui sosialisasi masyarakat dan kerja sama dengan sekolah serta LSM, namun efektivitasnya terhambat oleh keterbatasan sumber daya manusia, dana, dan keahlian siber. Studi ini menegaskan perlunya penguatan kapasitas kelembagaan, kolaborasi multisektor, dan harmonisasi kebijakan untuk menghadapi perubahan pola kejahatan yang dinamis. Kata Kunci: perdagangan anak, pencegahan, kapasitas institusional, kolaborasi masyarakat, transformasi digital, kebijakan hukum Abstract The phenomenon of child trafficking in Medan City has shown a significant increase in both quantity and modus operandi, shifting from individual patterns to organized, digitally driven networks. This study aims to analyze the effectiveness of police strategies in preventing child trafficking, focusing on crime trend transformations, institutional capacity, preventive initiatives, community collaboration, and legal–policy frameworks. The research employed a qualitative normative–empirical approach, with the Medan City Police as the unit of analysis. Data were collected through in-depth interviews, field observations, and analysis of legal documents and institutional reports. The findings reveal a sharp upward trend in trafficking attempts, accompanied by a shift toward digital recruitment methods. While the police have expanded preventive efforts through community outreach, school programs, and NGO partnerships, these initiatives remain limited by insufficient personnel, funding, and cyber expertise. The study highlights the urgent need to strengthen institutional capacity, enhance multi-sectoral collaboration, and align policy frameworks to effectively address the evolving dynamics of child trafficking. Abstract

Abstrak Perkawinan “Pada Gelahang” merupakan bentuk perkawinan alternatif dalam masyarakat adat Bali yang dipilih ketika pasangan tidak dapat melaksanakan perkawinan biasa atau nyentana. Dalam praktiknya, baik suami maupun istri tetap berstatus purusa di rumah masing-masing dengan segala hak (swadikara) dan kewajiban (swadharma) yang melekat. Kondisi ini menimbulkan persoalan dalam hukum kewarisan karena sistem adat Bali memprioritaskan laki-laki sebagai penerus tanggung jawab keluarga dan pengelola warisan, sedangkan perempuan hanya berperan sebagai penerima manfaat. Penelitian ini bertujuan untuk menganalisis implikasi pelaksanaan hak waris anak dalam sistem perkawinan Pada Gelahang di Kabupaten Buleleng dan Kota Denpasar. Metode penelitian yang digunakan adalah Socio Legal Research dengan pendekatan yuridis sosiologis. Hasil penelitian menunjukkan bahwa kedudukan hak waris anak dalam perkawinan Pada Gelahang tidak memperoleh kepastian hukum yang jelas. Posisi anak sebagai ahli waris menjadi ambigu karena tidak terdapat perjanjian formal yang mengatur status mereka dalam struktur keluarga ganda. Hal ini menimbulkan ketidakpastian dalam distribusi harta warisan, sehingga diperlukan regulasi atau kesepakatan adat yang lebih tegas untuk memberikan kepastian hukum. Kata Kunci: Perkawinan Pada Gelahang, Purusa, Hukum Waris, Masyarakat Adat Bali, Kepastian Hukum Abstract Pada Gelahang marriage is an alternative form of marriage in Balinese customary law, chosen when couples are unable to perform either the common marriage system or the nyentana system. In this practice, both husband and wife retain their status as purusa in their respective families, along with the attached rights (swadikara) and obligations (swadharma). This situation creates challenges in inheritance law since Balinese customary law prioritizes males as family successors and estate managers, while females are regarded merely as beneficiaries. This study aims to analyze the implications of children’s inheritance rights in the Pada Gelahang marriage system in Buleleng Regency and Denpasar City. The research employs Socio Legal Research with a sociological juridical approach. The findings reveal that the inheritance rights of children born from Pada Gelahang marriages lack legal certainty. Their position as heirs remains ambiguous due to the absence of a formal agreement regulating their status within the dual family structure. This ambiguity creates uncertainty in the distribution of inheritance, indicating the need for clearer customary agreements or regulations to ensure legal certainty. Abstract

Abstrak Penelitian ini bertujuan untuk menganalisis peran Lembaga Pengembangan Tilawatil Qur’an (LPTQ) dalam mengembangkan kemampuan tilawah anak-anak di Kecamatan Tanah Merah, Binjai. Metode penelitian menggunakan pendekatan kualitatif dengan desain studi kasus. Data dikumpulkan melalui observasi, wawancara mendalam, dokumentasi, dan diskusi kelompok terfokus (FGD). Hasil penelitian menunjukkan bahwa LPTQ berperan penting dalam meningkatkan keterampilan membaca Al-Qur’an melalui program terstruktur, seperti pertemuan rutin tilawah, lomba Musabaqah Tilawatil Qur’an (MTQ), pembinaan karakter spiritual, sosialisasi orang tua, serta penyediaan sarana pembelajaran. Program ini terbukti tidak hanya meningkatkan akurasi tajwid dan makhraj anak, tetapi juga membentuk kedisiplinan, karakter, dan nilai-nilai Islami. Dukungan dari masyarakat, orang tua, dan pemerintah desa turut memperkuat keberhasilan program. Dengan demikian, keberadaan LPTQ di Tanah Merah menjadi wadah strategis bagi pembinaan generasi Qur’ani yang berkarakter mulia dan memiliki keterampilan tilawah yang baik. Kata Kunci: LPTQ, Tilawah, Pendidikan Qur’ani, Karakter Anak, Binjai Abstract This study aims to analyze the role of the Qur’an Recitation Development Institute (Lembaga Pengembangan Tilawatil Qur’an or LPTQ) in developing children’s tilawah skills in Tanah Merah Subdistrict, Binjai. The research employed a qualitative approach with a case study design. Data were collected through observation, in-depth interviews, documentation, and focus group discussions (FGDs). The findings reveal that LPTQ plays a crucial role in improving Qur’anic recitation skills through structured programs such as regular recitation sessions, Qur’an recitation competitions (Musabaqah Tilawatil Qur’an or MTQ), spiritual character-building activities, parental socialization, and the provision of learning facilities. These initiatives have been effective not only in enhancing accuracy in tajweed and makhraj but also in fostering discipline, character development, and the internalization of Islamic values among children. The active support of parents, the local community, and government stakeholders further strengthens the sustainability of these programs. Therefore, the presence of LPTQ in Tanah Merah represents a strategic institutional framework for nurturing a Qur’anic generation equipped with both technical recitation proficiency and strong moral character. Abstract

Abstrak Harta bersama dalam konteks perkawinan campuran merupakan isu hukum yang kompleks dalam sistem hukum Indonesia yang pluralistik. Perkawinan campuran yang melibatkan pasangan dengan perbedaan kewarganegaraan, budaya, atau agama menimbulkan berbagai tantangan hukum, terutama mengenai kepemilikan tanah, hak waris, dan pembagian aset setelah perceraian. Permasalahan ini sering kali menciptakan ketidakpastian hukum dan potensi ketidakadilan bagi pasangan, khususnya pihak asing yang kerap mengalami pembatasan hak kepemilikan. Penelitian ini bertujuan untuk menganalisis bagaimana prinsip keadilan dapat diterapkan dalam pengaturan harta bersama dalam perkawinan campuran, dengan mempertimbangkan perbedaan sistem hukum negara asal pasangan dan kebutuhan untuk melindungi hak individu secara seimbang. Metode yang digunakan adalah pendekatan hukum normatif, dengan fokus pada analisis norma hukum perdata internasional yang berlaku. Data diperoleh melalui studi literatur terhadap undang-undang, peraturan, dan yurisprudensi, serta wawancara mendalam dan analisis kasus untuk menggali aspek teoritis dan praktis dari penerapan hukum. Hasil penelitian menunjukkan bahwa perbedaan sistem hukum antarnegara sering kali menimbulkan ketidakadilan dalam kepemilikan dan pembagian harta. Pembatasan terhadap pasangan asing menjadi hambatan utama. Oleh karena itu, diperlukan harmonisasi hukum perdata internasional, penerapan perjanjian perkawinan yang adaptif terhadap globalisasi, serta reformasi hukum yang inklusif untuk menjamin keadilan dan kesetaraan hak dalam perkawinan campuran. Abstract Joint property in the context of mixed marriages represents a complex legal issue within Indonesia’s pluralistic legal system. Mixed marriages involving spouses of different nationalities, cultures, or religions pose significant legal challenges, particularly concerning land ownership, inheritance rights, and the division of assets after divorce. These challenges often create legal uncertainty and potential injustices, especially for foreign spouses who face ownership restrictions. This study aims to examine how principles of justice can be applied to regulate joint property in mixed marriages by considering differences in the legal systems of each spouse’s home country and ensuring a balanced protection of individual rights. The research employs a normative legal approach, focusing on the analysis of applicable international private law norms. Data were collected through literature studies of legislation, regulations, and jurisprudence, as well as in-depth interviews and case analyses to gain both theoretical and practical insights into legal implementation. The results reveal that differences between legal systems frequently lead to inequities in property ownership and division. Discriminatory restrictions on foreign spouses pose significant barriers. Therefore, harmonisation of international private law, adaptive prenuptial agreements, and inclusive legal reforms are essential to ensuring justice and equal rights in mixed marriages. Abstract

Abstrak Transformasi digital menuntut peningkatan kompetensi teknologi pada seluruh sektor kerja, termasuk industri tradisional. Penelitian ini bertujuan untuk menguji efektivitas pelatihan digital terstruktur menggunakan aplikasi Gmail dan Zoom dalam meningkatkan kinerja karyawan pada Departemen Tebu di salah satu perusahaan gula di Bijnor, India. Penelitian ini menggunakan desain kuasi-eksperimental one-group pre-test–post-test dengan pendekatan kuantitatif. Sebanyak 10 karyawan laki-laki berpartisipasi melalui teknik convenience sampling. Data dikumpulkan menggunakan kuesioner biner (Ya/Tidak) sebanyak delapan item yang diberikan sebelum dan setelah pelatihan. Analisis statistik menunjukkan adanya peningkatan signifikan pada kemampuan digital karyawan, dengan skor rata-rata dari 1,90 sebelum pelatihan meningkat menjadi 7,20 setelah pelatihan. Nilai t hitung sebesar 6,283 pada df = 9 signifikan pada p < 0,01, yang mengindikasikan bahwa peningkatan tersebut bukan terjadi secara kebetulan. Temuan ini menegaskan bahwa pelatihan digital terstruktur berkontribusi terhadap peningkatan literasi digital dan kinerja kerja sehingga menjadi strategi penting dalam pengelolaan modal manusia pada era digital. Kata Kunci: Pelatihan Digital, Kinerja Karyawan, Gmail, Zoom, Modal Manusia Abstract Digital transformation requires improved technological competency across all sectors, including traditional industrial environments. This study aimed to examine the effectiveness of a structured digital training program focused on Gmail and Zoom applications in enhancing workforce performance within the Cane Department of a sugar industry in Bijnor, India. A quantitative approach was applied using a quasi-experimental one-group pre-test–post-test design. A total of ten male employees were selected through convenience sampling. Data were collected using an eight-item binary (Yes/No) questionnaire administered before and after the training. Statistical findings revealed a significant improvement in employees’ digital performance, as the mean score increased from 1.90 before training to 7.20 after training. The obtained t-value of 6.283 at df = 9 was significant at p < .01, indicating that the observed improvement did not occur by chance. These results confirm that structured digital training plays a crucial role in developing digital literacy and strengthening employee performance, making it a strategic component in modern human capital management. Abstract

Abstrak Era disrupsi secara fundamental menantang model disiplin guru tradisional yang berfokus pada kepatuhan, menciptakan kesenjangan signifikan antara praktik konvensional dan kebutuhan holistik pembelajar abad ke-21. Studi konseptual ini bertujuan mengatasi kesenjangan tersebut dengan merumuskan kerangka kerja konseptual adaptif yang terintegrasi untuk disiplin guru di Sekolah Menengah Pertama. Dengan menggunakan metodologi tinjauan integratif (integrative review), penelitian ini secara sistematis menganalisis dan mensintesis literatur ilmiah terkait profesionalisme guru, inovasi pedagogis, pembelajaran sosial-emosional, dan etika digital melalui analisis tematik. Hasil utamanya adalah Model Disiplin Guru Adaptif, sebuah kerangka konseptual baru yang terstruktur berdasarkan empat dimensi yang saling terhubung: Profesional-Adaptif, Pedagogis-Inovatif, Relasional-Empatis, dan Digital-Etis. Model ini diklaim sebagai arsitektur holistik yang melampaui manajemen kelas konvensional, menawarkan basis teoritis baru bagi profesionalisme guru. Ini memberikan implikasi praktis untuk reformasi pengembangan guru, kebijakan sekolah, dan strategi pendidikan di era disrupsi. Abstract The disruptive era fundamentally challenges traditional, compliance-focused teacher discipline models, creating a significant gap between conventional practices and the holistic needs of 21st-century learners. This conceptual study addresses this gap by aiming to formulate an integrated, adaptive conceptual framework for teacher discipline in Junior High Schools. Employing an integrative review methodology, the study systematically analyzed and synthesized scholarly literature related to teacher professionalism, pedagogical innovation, social-emotional learning, and digital ethics through thematic analysis. The main result is the Adaptive Teacher Discipline Model, a novel conceptual framework structured around four interconnected dimensions: Professional-Adaptive, Pedagogical-Innovative, Relational-Empathetic, and Digital-Ethical. This model is argued to be a holistic architecture that transcends conventional classroom management, offering a new theoretical basis for teacher professionalism. It provides practical implications for reforming teacher development, school policies, and educational strategies for the disruptive era. Abstract

Children have an important role in household life, where the position of children is not only as a complement but a gift given by Allah SWT to parents, so that parents have an obligation to educate children based on the Qur'an. This study aims to examine the role of fathers in children's education based on the provisions of Surah Luqman verses 12-19 with the Ibn Katsir interpretation approach. In these verses, Allah SWT presents the figure of Luqman as a wise and responsible father figure to teach his children faith, worship, and morals. The results of the study show that the father is the main teacher who shapes the character and faith of children. To produce a generation that is faithful and has noble morals, education that is given with full wisdom, gentleness, and example is very important. This study confirms that the active involvement of a father in the process of educating a child is very important, as indicated by Luqman al-Hakim.

Abstrak Penelitian ini menganalisis penerapan sanksi pidana terhadap anak yang dengan sengaja membujuk atau melakukan persetubuhan, melalui studi kasus Putusan Pengadilan Negeri Medan No. 03/Pid.Sus-Anak/2023/Pn.Mdn. Permasalahan utama difokuskan pada bagaimana pertimbangan hakim dalam memutus perkara anak pelaku persetubuhan, serta peran prinsip keadilan restoratif. Studi menggunakan metode yuridis normatif dengan analisis kualitatif terhadap dokumen hukum, putusan pengadilan, dan bukti visum et repertum. Hasil penelitian menunjukkan hakim menyusun pertimbangan hukum secara sistematis, memadukan aturan normatif dan bukti empirik. Upaya diversifikasi berbasis keadilan restoratif telah dipertimbangkan namun gagal dilaksanakan akibat gagalnya rekonsiliasi. Akhirnya, sanksi pidana dijatuhkan dengan tetap memperhatikan faktor yang meringankan dan memberatkan, serta asas perlindungan anak. Temuan ini menegaskan pentingnya pertimbangan hukum tertulis dan pelibatan prinsip perlindungan anak, meski di sisi lain memperlihatkan keterbatasan implementasi keadilan restoratif dalam praktik. Kata Kunci: Sanksi Pidana, Anak, Persetubuhan, Keadilan Restoratif, Perlindungan Anak Abstract This research analyzes the application of criminal sanctions towards children who intentionally persuade or engage in sexual intercourse, using the Medan District Court Decision No. 03/Pid.Sus-Anak/2023/Pn.Mdn as a case study. The main issue centers on how judges formulate their legal considerations in such cases and the role of restorative justice principles. The study adopts a normative juridical method with qualitative analysis of legal documents, court verdicts, and medical evidence. The findings reveal that judges systematically construct legal arguments, combining normative statutes with empirical evidence. Restorative justice and diversionary efforts were formally considered but ultimately failed due to unsuccessful reconciliation attempts. Consequently, the court imposed criminal sanctions while considering both aggravating and mitigating factors as well as child protection principles. These results emphasize the necessity for written legal considerations and highlight the limited realization of restorative justice in judicial practice.
