Perdebatan di seputar watak hukum Islam sebagai hukum yang statis dan dinamis masih terus berlanjut. dua kutub pemikiran yang ada masing-masing menganggap hukum Islam bersifat abadi dan tetap. Sementara kelompok lain berpandangan sebaliknya, yakni hukum Islam sangat fleksibel. Tulisan ini akan mengekplorasi ijtihad seorang sahabat bernama Mu'Ã z bin Jabal dan mengeksplorasi metode ijtihad serta menganalisis faktor-faktor sosial yang mempengaruhinya. Tujuannya adalah untuk mendukung pendapat yang mengatakan hukum Islam tidak kaku akan tetapi fleksibel. Dengan mengajukan tiga contoh ijtihad Mu'Äz dalam masalah hukum bagi wanita hamil, pembayaran zakat dengan harga dan warisan orang kafir, terlihat bagaimana pertimbangan-pertimbangan sosial selain teks juga turut mempengaruhi ijtihad Mu'Ã z. Karena tingkat intelektualitasnya yang tinggi, kesalehan dan kedekatannya dengan Nabi Saw, serta kejeliannya dalam melihat suatu persoalan, ijtihad Muaz mempengaruhi secara kuat para Sahabat saat itu, tak terkecuali Umar bin Khattab. dengan demikian, metode ijtihad Mu'Ã z, yang salah satu pertimbangannya adalah berangkat dari persoalan sosial riil dan empiris, adalah metode yang diterima dan diakui sebagai metode yang valid.

Dalam memberikan fatwa, sebagian ulama Indonesia telah membentuk organisasi dan tiap-tiap organisasi memiliki majlis atau lajnah yang bertugas merespon masalah-masalah yang berkembang di masyarakat. Di antara lembaga Ijtihad Ormas Islam di Indonesia adaiah: (1) Majlis Tarjih Muhammadiyah; (2) Bahsul Masa’il NU; (3) Majlis Fatwa Mathla’ul Anwar; (4) Dewan Hisbah Persis; dan (5) Komisi Fatwa MUl. Pola ijtihad yang dilakukan oleh NU adalah pola bermadzhab, baik bermadzhab secara qauli maupun manhaji. Akan tetapi sebenarnya, mayoritas ulama NU hanya memegang dan mempelajari manhaj imam Syafi’i. Hal ini terlihat dalam kepustakaan mereka dan kurikulum pesantren yang diasuhnya. Kitab-kitab seperti Waraqat, Hujjah al-Wushul, Lam'u al-Jawami’, al-Mushtasyfa, al-Asybah wan al-Nazha’ir dan lain-lain banyak dijumpai pada koleksi kepustakaan mereka dan dibaca (diajarkan) di beberapa pesantren. Perkembangan Hukum Islam di Indonesia tidak dapat dilepaskan dari kontribusi NU sebagai salah satu institusi/ Ormas Islam yang diakui dan diikuti pandangan hukumnya. Hal ini diperkuat sebuah lembaga yang dibentuk oleh NU yang bertugas khusus dalam pengkajian hukum Islam dan pemberi fatwa yaitu bahsul masa’il. Walaupun terdapat banyak perbedaan dalam masalah hukum dengan institusi lain seperti Muhammadiyah, NU sampai sekarang masih tetap bertahan (survive) berkontribusi dalam hukum Islam di Indonesia.

The understanding of a mujtahid toward maqÄá¹£id al-syarīʻah becomes something urgent and significant, since ijtihad must be able to realize benefits, which is the substance of maqÄá¹£id al-syarīʻah both in the general scale (‘Ämmah), special (khÄṣṣah), as well as in scale for specific cases (juz`iyyah). Ibn Qayyim, for example, in most cases is very concerned about maqÄá¹£id al-syariÌ„'ah, which one of its parts is al-maqÄá¹£id al-juz’iyyah. In the case of the necessity of cleaning urine trails, specifically (juz'Ä«) it is not required to the urine of baby boys. This clearly shows that Ibn Qayyim is very concerned about al-maqÄá¹£id al-juz’iyyah, because it is difficult to clean urine traces of baby boys so that it is not required to clean it up but simply by splashing water on the traces. Likewise in other cases, such as the necessity of ablution after eating camel meat, which is not required to be other than camel meat, the sale and purchase of salam (order) and the waiting period of women left behind, also shows that Ibn Qayyim is very concerned with the realization of al-maqÄá¹£id al-juz’iyyah in establishing the law .

Penelitian ini dilatarbelakangi adanya pasangan di bawah umur yang sudah melakukan pernikahan sirri kemudian memiliki anak. Setelah pasangan tersebut cukup umur mereka datang ke Kantor Urusan Agama (KUA) untuk menikah ulang dengan tujuan agar pernikahannya tercatat secara hukum. KUA kemudian melakukan pernikahan ulang kedua pasangan yang sudah cukup umur tersebut. Berdasarkan latar belakang tersebut, masalah dalam penelitian ini yaitu bagaimana praktek pelaksanaan nikah pasangan di bawah umur di KUA Kecamatan Sungayang, apa dasar/landasan yuridis KUA Kecamatan Sungayang menikahkan kembali pasangan di bawah umur yang telah menikah sirri dan bagaimana akibat hukum dari disahkannya pernikahan pasangan di bawah umur yang didahului dengan nikah sirri. Penelitian ini adalah penelitian lapangan (field research). Sumber primernya adalah Kepala KUA, penghulu nikah dan pasangan yang menikah ulang. Teknik analisis yang digunakan adalah deskriptif kualitatif. Hasil penelitian adalah praktek pelaksanaan nikah pasangan di bawah umur di KUA Kecamatan Sungayang rata-rata terjadi karena pergaulan bebas sehingga pihak perempuan sudah hamil di luar nikah. Kedua belah pihak melakukan nikah sirri terlebih dahulu sebelum dilakukannya nikah ulang di KUA. Dasar/landasan yuridis KUA Kecamatan Sungayang menikahkan kembali pasangan di bawah umur yang telah menikah sirri adalah: Pasal 53 Kompilasi Hukum Islam (KHI) dan Kaidah Fiqhiyyah yang artinya “Menghindari kerusakan lebih utama daripada mendatangkan kemashlahatan”. Kemudian kaidah fiqhiyyah lainnya yaitu “Gembirakanlah orang yang datang kepadamu, janganlah ditakuti. Mudahkan urusan orang yang datang kepadamu , jangan dipersulit”. Akibat hukum dari disahkannya pernikahan pasangan di bawah umur yang didahului dengan nikah sirri adalah dari sisi akibat hukum terhadap perkawinan adalah pernikahan sirri yang telah dilakukan oleh pasangan tersebut dianggap tidak sah sehingga harus diulang. Akibat hukum terhadap anak adalah bahwa anak hanya memiliki hubungan nasab dengan ibu karena dianggap bukan anak sah. Akibat hukum terhadap harta perkawinan adalah bahwa pasangan tersebut tidak memiliki harta perkawinan selama menikah sirri.

Based on research that there are several mustahiq who divert productive zakat funds for daily food needs, for medical expenses, for education, to repair the kitchen and to pay installments for rented stalls. The reason for mustahiq to transfer productive zakat funds is because there is an urgent need and insufficient income for needs. Based on these reasons, the transfer of productive zakat funds is not contradictory and even in line with the theory of al-maqashid al-syariah. Because for the cost of daily food needs and medical expenses in order to maintain the soul which is classified as an element of daruriyyat (primary needs), the transfer of zakat funds for education costs in order to maintain the mind which is classified as an element of hajiyyat (secondary needs), the transfer of zakat funds to repair the kitchen and pay the daily shop installments which are part of the maintenance of assets belonging to the hajiyyat element (secondary need). While zakat is productive in order to maintain property. Hierarchically, preserving religion takes precedence over preserving the soul, preserving the soul takes precedence over maintaining reason, preserving reason takes precedence over nurturing offspring, preserving offspring takes precedence over preserving property.

This study examines the prohibition of the use of religious facilities as a place for political campaigns in accordance with Law Number 7 of 2017 According to Fiqh siyasah. The problem in this thesis is the prohibition on the use of religious facilities as a place for political campaigns in accordance with Law number 7 of 2017 concerning elections according to fiqh siyasah. Research Objectives The type of research that the author uses in this research is library research with the documentation method. This type of research is carried out by collecting and reviewing existing data information with the help of references in the library such as books, similar previous research materials, articles and various notes and various journals through reading related to the problem under study. The results of the study show Law number 7 of 2017 concerning elections article 521 this prohibition is caused because there will be many impacts that will arise if the campaign is carried out in mosques, fearing slander and hate speech that will arise if carried out, there will be more things negative things that will arise if the campaign is carried out in places of worship. So it can be concluded that using the media of worship facilities that are intended or intended are mosques in Law Number 7 of 2017 in accordance with the Shari'a which is based on Q.S An-Nur verse 36 From the results of the study, it can be concluded that the harm obtained is greater than the benefits obtained from the mosque being used as a place for political campaigns, because the mosque must be free from slander and hate speech, not used to seek names or for personal gain. because there is more harm than benefit it can be concluded that Law Number 7 of 2017 does not conflict with siyasa fiqh.

The main problem in this thesis is the implementation and impact arising from hunting pigs on household harmony from the perspective of Islamic family law in Nagari Limo Kaum Kec. Lima Kab. Tanah Datar. The type of research used is field research with qualitative methods. The research results that the authors found were; First, the phenomenon of hunting pigs in Jorong Kubu is generally carried out twice a week. Initially, the purpose of hunting pigs was to eradicate pig pests that disturbed farmers' agricultural land and to become a sporting event. But at this time pig hunting is done because it's just a hobby. Second, negative impacts are caused such as reduced time for family gatherings, lack of attention to wife and children, starting to neglect obligations to his wife's children, insufficient family living needs, then frequent quarrels in the household. Third, the analysis of household harmony that hunts pigs in Jorong Kubu Rajo is the disruption of family functions to become a harmonious family.

The phenomenon of marriage registration that often occurs is related to the non-registration of marriages, marriage registration services which are often ignored and the existence of marriage registration services that are not carried out optimally. This study aims to describe the problems in implementing marriage registration services using SIMKAH at the KUA of Dharmasraya Regency. The research was conducted using a qualitative approach to field research. The research was carried out by going out into the field to conduct interviews with the heads of the KUA in Dharmasraya Regency to obtain data. Other data were obtained by studying the documentation of the marriage archive documents at the KUA. The findings were analyzed using the Spradley technique to analyze the general description of the application and the constraints that occur related to the registration of marriage services with SIMKAH. The findings explain that in general KUA in Dharmasraya District have all used SIMKAH in carrying out marriage administration services. The problems that occur are the lack of expert staff, the internet network is not stable, there are only one server in Indonesia which causes frequent server congestion and errors, as well as conventional ways of managing marriage administration.

The main problem in this thesis is that there are differences in the wages of shop employees when they are on vacation at Batusangkar Market. The purpose of this study is to explain the pattern of wages for store employees during holidays at Batusangkar Market and the reasons that are considered as wages at Batusangkar Market. This type of research is field research. This research method is qualitative and describes the pattern of wages for store employees during holidays at Batusangkar Market. Data collection techniques through interviews totaling 9 people. The data that the author has obtained is analyzed by collecting and collecting data on the practice of wages paying store employees during holidays and consideration of wages at the Batusangkar Market. Read, understand, and analyze the data obtained or collected. After the data is collected, arranged, and clarified properly then conclude. The data that has been processed is then analyzed with the fiqh muamalah theory. The results of this study are the pattern of wages for store employees when they are on vacation at Batusangkar Market, namely, wages are deducted and the time when wages are received is postponed. Wages were deducted because the shops were empty of buyers and the time for receiving wages was postponed because that was the system in the market. Wages are paid weekly in cash with a nominal value of Rp. 250,000 – Rp. 300,000. The shop owner does not give all employees any vacation time. Regarding wages being cut and some having postponed the time to receive their wages while there was no vacation allowance at all, some employees felt annoyed and had to accept it because they needed a job and had no other choice to meet their daily needs. Judging from the muamalah fiqh, the wage transaction that occurs in the Batusangkar market has not fulfilled the ijarah requirements because of compulsion from one of the parties and has not paid attention to the principles of justice and eligibility of wages in Islam.

This study examines the background of children's involvement in the implementation of the babalian tradition before walimatul 'ursy in marriage from the perspective of Islamic law. From these problems, the question arises what is the background to the involvement of children in the babalian tradition before walimatul 'ursy in marriage. This study is based on field research. The data were obtained through interviews and then the data were narrated descriptively. The results achieved are to find out the background of the child's involvement in the babalian tradition, namely 1) the child is a symbol of descent and is also a basarayo tampek (person who will be ordered around), because ideally, the person who will be ordered is smaller than the person who ordered. 2) In addition, this tradition does not violate the Shari'a, because even though it is carried out at night, children are free to follow this series of traditions or choose to rest. This child also gets supervision from parents and adults. So it can be said that this tradition is 'urf authentic because it does not conflict with Islamic law and there is no harm to the child
