Abstract

This study aims to find the concept of match making or coercion in marriage against women. Women are more sensitive to match making issues and express disagreement with practices that violate women’s rights and endanger their future. However, previous researchers also considered match making coercion, sowe tried to research what if it was adapted to the concept of kafa'ah according to Shariah. The method used in this researchis a literature review by looking at the book an-nikah by Shaykh Muhammad Arsyad Al-Banjari, written in the 17th century AD. Through a hermeneuticalapproach, the researcher explores the marriage problems that her parents thought to becornering women in marriage problems. We try to uncover marriage problems that are sometimes considered to push women into marriage problems by their parents. This research proves that the concept of kafa'ah in al-Banjari theory can eliminate the perception of match making with a coercive system, because in the kafa'ah what is prioritized is a person's faith relationship which is ultimatelyable to maintain the honor of his wife and family. Not only in terms of material, but more inclined to approach immaterial needs. The Immaterial approach is evidenced by the harmonious relationship between the two families of the bride and groom.

Abstract

This article discusses the implementation of the mobile Court conducted by the Manado Religious Court. This research is qualitative field research using empirical legal methods. The aim is to determine the dominant factors that affect the effectiveness of the mobile court conducted by the Manado Religious Court. By using the Legal System theory proposed by Lawrence M. Friedman, the author tries to unravel the problems that often arise in the mobile court process. The results of the study indicate that there is a significant relationship between the knowledge and awareness of justice seekers who use the judiciary, especially the Religious Court. The success implementation of mobile courts is due to the coordination and readiness of judicial infrastructure, including efforts to socialize the practice of mobile courts to related agencies, which are enhanced to achieve the goals of implementation of the mobile court.

Abstract

This study analyzes the changes to Law no. 16 of 2019 on Law No. 1 of 1974 concerning the age limit of marriage. There are various responses in society, socio-cultural clashes and even religion cannot be avoided, where this situation is increasingly difficult to achieve the goal of marriage. This raises the question, why is it necessary to rearrange the age limits for marriage, and what background causes it? This study uses the maqasid sharia approach with the System theory of Jasser Auda. This type of research is descriptive qualitative using the maqasid sharia approach. The object of study is Law no. 19 of 2019 concerning Amendments to Law No. 1 of 1974 concerning Marriage. This study uses secondary data from two sources. First, the primary source is taken from the text of the Law and the Decision of the Constitutional Court. Second, secondary sources such as books, journals, reports, magazines, newspapers, and so on. Then the data are interpreted and analyzed descriptively. The results of this study showed that the determination of changes to the law regarding the age limit for marriage can be classified into the interests of al-dharurriyah (primary), which are important and must be fulfilled to achieve the goals of sharia, namely safety. The analysis of maqasid sharia with six subsystem features explains that protected interests are closely related, which are related to one another, representing age differences in marriage, which is a form of discrimination. The scope of the provisions on the age limit for marriage is classified as maqasid ‘ammah, because it covers all the interests of women in Indonesia. Also, as maqasid khassah, legal protection from the fulfillment of basic rights and constitutional rights as citizens. The level of dharuriyah does not always have the implication of obligatory syar'i (causing sin) but only until obligatory hukm (must), because the legal provisions are explored by mujtahids and are based on the absence of qat'y texts on this issue.

Abstract

Abstrak Penelitian ini dilakukan untuk mendeskripsikan kondisi BPJS Kesehatan yang real terjadi di kota bengkulu, kemudian dari temuan data dilapangan akan dilakukan analisis secara mendalam apakah terdapat hal-hal yang melangar konsep syari'ah, sehinga apabila dijumpai bentuk-bentuk pelangaran syari’ah tersebut bisa segera dicarikan solusinya mengunakan pendekatan saddu dzari'ah. Dalam mengumpulkan data penelitian, peneliti mengunakan Teknik purposif sampling untuk memudahkan mengumpulkan data dari informan. Sedangkan teknik pengumpulan data yang digunkan adalah wawancara dan dokumentasi. Dari penelitian dilapangan peneliti berhasil membuat dua rumusan penting, yaitu pertama, Program BPJS Kesehatan di Kota Bengkulu ada yang sudah sesuai dengan syari’ah secara kaffah dan ada yang masih belum sesuai dengan syari’ah secara kaffah sehinga perlu diadakan penyesuaian-penyesuaian agar bisa sesuai dengan syari’ah secara kaffah. Program BPJS Kesehatan di Kota Bengkulu yang sudah sesuai dengan syari’ah secara kaffah adalah BPJS Kesehatan yang untuk PBI (Peserta Bantuan Iuran) karena ansih akad tabarru’. Sedangkan program BPJS Kesehatn di Kota Bengkulu yang masih belum sesuai dengan syari’ah secara kaffah adalah program BPJS Kesehatan Non PBI dan BPJS Kesehatan Mandiri. Ketidaksesuaian ini disebabkan masih adanya unsur gharar (ketidak jelasan), maysir (perjudian), Dholim (aniyaya), Ikroh (pemaksaan), Riba dan intifa’ harom (Riba dan pemanfaatan barang haram). Rumusan yang kedua, konsep BPJS Kesehatan agar sesuai dengan syari’ah secara kaffah adalah yang telah terbebas dari unsur gharar (ketidak jelasan), maysir (perjudian), Dholim (aniyaya), Ikroh (pemaksaan), Riba dan intifa’ harom (Riba dan pemanfaatan barang haram). Cara menghilangkan unsur ghoror adalah uang iuran bulanan yang berasal dari peserta BPJS Kesehatan yang tidak pernah digunakan harus dikembalikan ke peserta BPJS kesehatan atau paling tidak ditawarkan ke orang yang iuran dana tersebut mau di ambil dananya atau mau di hibahkan sehinga dana tersebut bisa dipergunakan berobat oleh orang lain. Untuk mewujudkan hal tersebut perlu adanya pemisahan iuran dari peserta BPJS Kesehatan menjadi uang hibah (tabarru) dan tabungan yang dikelola secara syariah (tijarah) yang besaran presentase keuntungan telah disepakati terlebih dahulu. Unsur maysir (spekulasi/untung-untungan yang tidak pasti) yang ada pada BPJS Kesehatan juga bisa dihilangkan apabila ada refund (pengembalian) dana peserta yang tidak digunakan oleh peserta tersebut. Unsur dholim dapat dihilangkan dengan cara melakukan pengawasan terhadap pelayanan kesehatan yang diberikan kepada peserta BPJS Kesehatan, jangan sampai ada hak yang tidak diperoleh oleh peserta BPJS Kesehatan dan jika ditemukan pelangaran maka perlu ada sanksi tegas sehinga dikemudian hari tidak ada lagi hak peserta BPJS Kesehatan yang dilanggar. Yang tidak kalah penting perlu adanya sosialisasi yang lebih intensif lagi kepada para peserta BPJS Kesehatan agar mereka mengerti hak dan kewajiban sebagai peserta sehinga ketika ada pelangaran mereka segera melaporkan. Selain itu, perlu juga dilakukan kroscek penyebab Peserta BPJS Kesehatan tidak membayar iuran tepat waktu sehinga apabila ada unsur keteledoran maka boleh diberikan sanksi denda akan tetapi jika penyebabnya bukan karena ketelodoran tapi memang karena ketidak mampuan maka tidak boleh diberikan sanksi denda. Unsur ikroh (memaksa) sebenarnya juga bisa dihilangkan dengan cara dengan merubah aturan yang ada pada akad BPJS Kesehatan yakni aturan harus ikut menjadi peserta BPJS Kesehatan menjadi takhyir (bebas memilih) untuk ikut atau tidak ikut program BPJS Kesehatan serta persoalan dana yang terkumpul dari hasil iuran harus dihibahkan menjadi tidak harus dihibahkan melainkan peserta diberikan kebebasan untuk memilih. Unsur riba intifa’ harom (pemanfaatan barang haram) sebenarnya bisa dihilangkan dengan cara dengan merubah aturan tentang penyimpanan dana hasil iuran dari peserta BPJS yakni dengan menyimpannya di bank-bank yang telah menerapkan nilai-nilai syari’ah atau dana yang berasal dari peserta BPJS Kesehatan diinvestasikan ke sektor riil yang halal dan dibenarkan oleh syari’ah, misalkan diinvestasikan ke sektor perkebunan, peternakan dan lain sebagainya.

Abstract

This research is motivated by the practice of profit sharing in the management of land by cooperatives in the absence of time clarity in the distribution of results carried out by cooperatives to their members. Islam towards the practice of sharing the results of land management by the Cempaka Biru Cooperative in the Sejangkung District. This type of research is a type of descriptive qualitative research that is Field Research (field research). The study uses a normative sociological approach. The data source in this study uses primary data taken from the cooperative chairman, treasurer and cooperative members. Whereas the secondary data sources are books, mass media and the Law. Data collection techniques used were observation techniques, interview techniques, and documentation techniques. Based on the results of the study, the researchers concluded that the practice of sharing the results of land management by the Cempaka Biru Cooperative did not violate Law No. 25 of 1992 article 45 concerning Remaining Results of Operations, because basically the residual results of cooperative efforts are cooperative income obtained in one fiscal year. In the analysis according to the perspective of Islamic law the profit-sharing in the Cempaka Biru Cooperative is called the profit sharing of the Musaqah plantation estate or mukhabarah. But the practice of sharing the results of land management by the Cempaka Biru Cooperative in the District of Sejangkung is prohibited by syara 'because of the existence of a contract containing the element of gharar (uncertainty) so that it is prohibited by syara'.

Abstract

This research departs from a paradigm that the freedom of judges is a form of court independence, which requires that decisions taken must consider objectivity without pressure from any party. This study focuses on the attitude of judges' independence from factors that can influence court decisions, both internal and external factors related to the interests of certain groups. Based on these problems, this study addresses the issue of the independence of judges in cases of blasphemy. This type of research is empirical normative with a qualitative descriptive approach. The data sought for this research is data that comes from the facts of the application of material and formal law by judges in court. In addition, this data is also strengthened by interviews. This study concludes that the analysis of the application of the blasphemy article proves that judges as law enforcers have difficulty translating the substance of blasphemy because of the unclear formulation of Article 156a letter 'a' of the Indonesian Criminal Code. The judge's decision in the blasphemy case does not reflect the independence values of the judges who decide the case. Judges in making decisions on cases handled must be based on their ability to think and will freely (independently) but within the limitations of responsibility and objectivity. The panel of judges in blasphemy cases tends to adopt a more general and situation-oriented attitudes.

Abstract

Manusia sebagai ciptaan Allah SWT mempunyai banyak kekurangan dalam berbagai hal seperti yang dimaksud dalam konteks al-Insān al-Kāmil dan al- Insān al-Hayawān yang merupakan sudah ketentuan. Manusia sebagai mahkluk sosial (zoonpoliticoon) tidak bisa berdiri sendiri dalam mempertahankan hidup dalam bermasyarakat terlebih khususnya dalam bernegara (politik) yang saat ini semakin berkembang dan tuntutan perkembangan dan perubahan yang semakin pesat dan sebagai manusia harus mengimbangi antara kebutuhan hidup dan keimanan. Dalam kajian hukum Islam pembicaraan tentang manusia dan politik (kekuasaan) adalah dua hal yang melengkapi. Manusia sebagai khalifah di dunia ini dan politik (kekuasaan) dalam kajian hukum positif adalah cara dalam mencapai tujuan bersama yang diinginkan dalam mewujudkan Negara yang makmur, aman dan sejahtera.

Abstract

This paper aims to reopen the discussion on the plurality of thoughts in interfaith marriages from the perspective of Islamic law and legislation in Indonesia. The method used is the literature study. Where the author tries to understand clearly the concept of interfaith marriage through books, documents and related research results. Whereas, in analyzing these data using the verstehen method. In this method, an interpretative analysis process is carried out on the concept of interfaith marriage. This interpretive analysis requires the writer to provide scientific arguments and criticisms in interpreting research data. In many cases in the community, interfaith marriages always create resistance. Religious arguments are always raised to oppose the marriage. One of the verses of the Koran which is popular for opposing interfaith marriages is QS al-Baqarah verse 221. But strangely, some people (muslims) continue to carry out interfaith marriages in the Civil Registry Office. The conclusion of this paper confirms that the legality of interfaith marriage is still debatable, both in Islamic law and regulations in Indonesia. Therefore, the new rules are needed that are clearer about interfaith marriages, because they are binding on each individual citizen, so that legal certainty and justice will be created.

Abstract

This paper questions how to respond to the publication of political dreams in relation to efforts to reduce radicalism in Indonesia according to Sadd al-Dzari'ah's study. This research is qualitative in nature and its presentation uses descriptive analysis method. Publication of dreams is a common thing in society, moreover dreams that are disseminated are good dreams. However, sometimes the publication of a dream, according to people who experience it, is suitable for public consumption, on the other hand it may have an impact on the emergence of radicalism in a country. An example that recently occurred was the dream of Haikal Hassan who met Rasulullah SAW regarding the shooting of the Islamic Defenders Front (FPI) laskar by the police in Mega Mendung, West Java. The publication of this dream seemed to have political nuances and caused turmoil among the FPI, because in this dream Rasullullah SAW seemed to blame the police for handling the FPI laskar and on the contrary defending the FPI laskar who was killed. This paper concludes that the act of publishing dreams which was previously immutable is not permitted if the publication creates a radicalism movement that may threaten the integrity of the country. In the study of siyasah syar'iyyah, security and public order (maslahah) is a very important part of state politics. Therefore, according to Sadd al-Dzari'ah's study, the legal position of publishing dreams, which has so far been converting, can become haram if it causes harm to a country.

Abstract

The purpose of this study was to ascertain the murafa’at fiqh (Saudi Arabian Law) and the Indonesian Criminal Procedure Code's perspectives on a convict's plea for i’adah al-nadzr (reconsideration). This was a normative juridical inquiry, which entailed poring over relevant material to gather data, assess content, and draw similarities between positive law and Islamic criminal law. The findings of this study indicated that review in positive law, referred to in Saudi Arabia's murafa’at fiqh as i’adah al-nadzr/al-muhakamah, attempted to ensure legal justice and judge justice in their rulings. There were parallels between positive law and murafa’at fiqh in terms of the justifications for filing reconsideration. There were, however, distinctions regarding the giyabi case as a basis for submitting reconsideration. In Saudi Arabia's murafa’at fiqh, the reconsideration application in the giyaby case could be accepted, although positive law did not cite the giyaby ruling as a reason to seek reconsideration. Positive law, on the other hand, provides for the possibility of resistance (verzet) if the defendant was not present in court and has not protested Verstek's ruling. Another parallel between positive law and Saudi fiqh murafa’at was seen in the reconsideration application regulations, which prohibited suspending the execution of rulings. However, the researcher notes that this rule cannot be applied universally.
