Abstract

Penelitian ini mengkaji dampak perubahan kebijakan ketenagakerjaan dalam Undang-undang Cipta Kerja terhadap kesejahteraan tenaga kerja di Indonesia. Melalui metode studi literatur dengan pendekatan kualitatif normatif, penelitian ini menganalisis perbandingan kebijakan ketenagakerjaan antara Undang-undang Nomor 13 Tahun 2003 dan Undang-undang Cipta Kerja serta perubahan yang terjadi. Hasil penelitian menunjukkan bahwa reformasi kebijakan melalui Omnibus Law memberikan dampak berarti pada aspek perjanjian kerja waktu tertentu (PKWT), pengalihan tugas (outsourcing), sistem pengupahan, dan pemberhentian kerja (PHK) serta kompensasi yang diterima. Perubahan tersebut berdampak pada berkurangnya tingkat perlindungan bagi pekerja, bertambahnya durasi status pekerjaan, dan berpotensi meningkatkan potensi risiko eksploitasi melalui kontrak yang diperpanjang. Di sisi lain, pemerintah berfokus pada peningkatan investasi dan penciptaan lapangan kerja dengan cara menyederhanakan regulasi dan prosedur perizinan. Namun, penerapan kebijakan ini masih menghadapi berbagai tantangan, terutama dalam menjaga keseimbangan antara kepentingan investasi dan perlindungan hak-hak tenaga kerja. Studi ini menekankan pentingnya pengawasan yang ketat dan evaluasi yang berkesinambungan terhadap pelaksanaan Undang-undang Cipta Kerja agar tujuan peningkatan kesejahteraan tenaga kerja dapat dicapai secara maksimal

Abstract

International humanitarian law (IHL) has an important role in providing protection for individuals involved in humanitarian assistance, especially humanitarian workers operating in conflict zones. Humanitarian workers are often targeted in armed conflicts, which threatens their safety in carrying out their humanitarian duties. This research aims to explore how IHL can provide legal protection for humanitarian workers, both in the context of international law and practice in the field. Drawing on the Geneva Conventions and Additional Protocols, as well as international court decisions, this article analyzes the challenges facing humanitarian workers in conflict zones and the legal steps that can be taken to improve their protection. The findings of this research show that despite clear protections in international law, effective implementation is often hampered by legal violations occurring on the ground, lack of law enforcement, and uncertainty about the status of humanitarian workers. Therefore, strengthening international cooperation, increasing awareness of humanitarian law, and stricter law enforcement mechanisms are urgently needed to protect humanitarian workers in conflict zones.

Abstract

This article attempts to comprehend the ideal concept of factual action and analyzes factual action as an object of dispute in the Administrative Court ("Peratun") in relation to the prohibition of misleading the administrative decision ("KTUN") and the factual action. The research method uses normative research with conceptual, statutory, and case approaches. The results show the complexity of factual action related to examine the factual action and also the double checking system of administrative tort. First, by classifying an object as the factual action or KTUN, and second, by examining factual actions as the administrative tort by government agencies/officials which are clashing/not clashing to the statutory regulations nor general principles of good governance. Furthermore, the misleading lawsuit can occur when the lawsuit disrupes/reverses the definition of each object, both KTUN and factual actions. The cumulation of objects among KTUN with factual actions is possible as long as there are interrelated legal character (innerlijke samenhang) of objects, prioritize the speedy trial, simple, and low cost principle, and the principle of utility (bring justice closer to the people).

Abstract

Pelayanan publik merupakan perwujudan utama tanggung jawab negara dalam memenuhi hak-hak dasar warga negara. Kualitas pelayanan publik sangat ditentukan oleh kepatuhan pemerintah terhadap prinsip-prinsip Hukum Administrasi Negara, seperti legalitas, akuntabilitas, proporsionalitas, transparansi, dan kepastian hukum. Namun, praktik pelayanan publik di Indonesia masih menghadapi berbagai persoalan serius, antara lain maladministrasi, penyalahgunaan wewenang, rendahnya kualitas pengawasan, serta diskriminasi yang berpotensi melanggar hak asasi manusia. Penelitian ini menggunakan metode penelitian hukum normatif dengan menelaah peraturan perundang-undangan, doktrin, putusan, serta literatur ilmiah terkait. Hasil penelitian menunjukkan bahwa perlindungan HAM dalam pelayanan publik hanya dapat terwujud apabila prinsip-prinsip administrasi negara diterapkan secara konsisten dalam seluruh proses layanan. Studi kasus maladministrasi PPDB di Sumatera Selatan memperlihatkan bagaimana manipulasi data, ketidaksesuaian prosedur, dan intervensi pejabat dapat mengakibatkan pelanggaran hak anak atas pendidikan yang adil dan nondiskriminatif. Temuan tersebut menegaskan pentingnya penguatan mekanisme pengawasan, penegakan sanksi, dan peningkatan integritas birokrasi. Dengan demikian, penguatan hukum administrasi dan tata kelola pelayanan publik merupakan langkah strategis untuk mewujudkan layanan yang berkeadilan, berintegritas, serta berbasis perlindungan hak asasi manusia.

Abstract

The era of digital technological disruption has structurally altered the press ecosystem in Indonesia. The presence of media entities operating online without established institutional infrastructure — academically termed "homeless media" — raises fundamental legal issues not yet adequately accommodated by Law Number 40 of 1999 on the Press. This research aims to analyze the legal framework for the digital press in Indonesia in the context of technological disruption, identify existing normative gaps, and formulate a legal framework reconstruction capable of realizing responsible freedom of information. This research employs a normative juridical method with four approaches: statutory, conceptual, historical, and comparative law. Comparative studies were conducted on the digital press regulatory systems of South Korea, the United Kingdom, Australia, and Germany. The findings identify five main normative gaps: (1) the absence of an inclusive definition of digital press legal subjects; (2) the inadequacy of online media verification mechanisms; (3) the weakness of digital journalist protection; (4) ambiguity in liability regimes; and (5) normative disharmony between the Press Law and the Electronic Information and Transactions Law (EIT Law). Legal reconstruction is required through a progressive legal paradigm that prioritizes the social function of the press over institutional formalism

Abstract

The rapid growth of cryptocurrency adoption in Indonesia has created significant challenges for the national Anti-Money Laundering and Counter-Terrorism Financing (AML/CFT) regime. The dualism of regulation between Law No. 8 of 2010 and Bappebti Regulation No. 8 of 2021 has generated legal uncertainty, particularly regarding the legal status of crypto assets, supervision of Virtual Asset Service Providers (VASPs), digital evidence, and asset tracing mechanisms. This study aims to analyze the Indonesian legal framework governing cryptocurrency-based money laundering and examine how regulatory dualism affects the effectiveness of law enforcement and harmonization with Financial Action Task Force (FATF) standards. This research employs a normative juridical method using statutory and conceptual approaches. Primary legal materials consist of laws and regulations related to anti-money laundering and cryptocurrency governance, while secondary legal materials include institutional reports, statistical data, and scholarly literature concerning digital financial crimes. The study finds that Indonesia’s cryptocurrency regulatory framework remains fragmented due to overlapping authority between Bank Indonesia, Bappebti, and the Financial Services Authority (OJK). Such fragmentation weakens AML/CFT implementation, particularly in identifying beneficial ownership, tracing cross-border transactions, and enforcing compliance standards. The transition toward OJK supervision through the P2SK Law represents an important step toward integrated regulation, although institutional and technological challenges remain significant in addressing increasingly sophisticated crypto-based money laundering schemes.
