Abstract

This study aims to examine the relationship between the Qur'an as a source of Islamic law and positive Indonesian law from a philosophical perspective. Specifically, this study aims to understand the position of legal values ​​in the Qur'an towards the formation of positive law, as well as to examine the philosophical implications of the differences in the normative basis of the two. This title is important to study because in the practice of the national legal system, there is often a tug-of-war between legal values ​​derived from religion and the modern legal system rooted in the secular Western tradition. Given that Indonesia is a country with a Muslim majority population, the relevance of the Qur'an in the formation of law cannot be ignored, both in terms of legal ethics, justice values, and the formation of written legal norms. This study is formulated through two main questions: (1) What is the position of the Qur'an as a source of legal values ​​in the construction of positive law in Indonesia? and (2) What are the philosophical implications of the differences in the normative basis between the Qur'an and positive law towards the formation of legislation? To answer these questions, the method used is the normative legal research method with a legal philosophy approach and a legislative approach. The main data sources consist of primary legal materials in the form of laws and regulations and interpretations of legal verses in the Qur'an, as well as secondary legal materials such as Islamic legal literature and legal philosophy theories. The results of the study indicate that the Qur'an contains universal justice values ​​that are in line with the basic principles of positive law, such as justice, welfare, and legal certainty. Although there are differences in the form and structure of law, philosophically, both can complement each other within the framework of developing a just national law. This study recommends an integrative approach in formulating positive law that is not only based on legal-formal rationality, but also considers transcendental values ​​that originate from revelation.

Abstract

This study examines the changes in the Constitutional Court’s authority regarding election supervision and its implications for the principle of people’s sovereignty within Indonesia’s constitutional law system. The research adopts a normative legal method employing statutory, conceptual, and case approaches. The findings reveal that amendments through Law No. 7 of 2023 and Constitutional Court Regulation No. 4 of 2023 have expanded the Court’s authority beyond adjudicating election disputes to supervising electoral processes constitutionally. This expansion strengthens the protection of citizens’ voting rights but may disrupt the balance between judicial and administrative functions in a democratic framework. The implications for people’s sovereignty are ambivalent: while enhancing constitutional justice, it simultaneously risks transferring part of the people’s sovereign power to the judiciary. Thus, proportional authority, decision transparency, and institutional capacity strengthening are essential to ensure that the reform reinforces rather than undermines democratic sovereignty.

Abstract

Penelitian ini merupakan penelitian normatif dengan menggunakan pendekatan perundang-undangan (statute approach) untuk menyoroti wacana masa perpanjangan jabatan kepala desa. Hasil penilitian ini menunjukkan bahwa Diskursus perpanjangan jabatan kepala desa yang semula 6 tahun menjadi 9 tahun bertentangan dengan semangat konstitusi dengan adanya pembatasan kekuasaan (limitation power) jika ditinjau dari teori abbuse of power bahwa kekuasaan yang lama akan menimbulkan penyalahgunaan kewenangan yang membuka pintu terjadinya korupsi yang semakin masif, selain itu kekuasaan akan tersentralisasi ke salah satu orang atau kelompok tertentu. Periodesasi jabatan kepala desa 6 tahun selama maksimal 3 periode itu sudah cukup panjang, jika kepala desa mempunyai kinerja baik maka masyarakat akan memilihnya di periode berikutnya. This research is a normative research using a statute approach to highlight the discourse on the extension of the term of office for the village head. The results of this study indicate that the discourse on extending the term of office of the village head from 6 years to 9 years is contrary to the spirit of the constitution with the limitation of power . If reviewed from the theory of abuse of power that the old power will lead to abuse of authority which opens the door for increasingly massive corruption, besides that power will be centralized to one particular person or group. The periodization of the village head's office of 6 years for a maximum of 3 periods is long enough, if the village head has a good performance then the community will elect him in the next period.

Abstract

The development of the current era requires humans to use various technologies, one of which is the internet. With social media or the internet, humans have a very important role in resolving various injustices in legal practice in this country. Because efforts to achieve justice cannot be ignored. A rule of law cannot be ignored. may be apathetic towards the struggle and every effort to uphold justice. the concept of justice is very important so that a rule of law becomes the basis for all parties, both citizens and leaders as certainty in resolving various legal problems they face. so many use social media in solving various cases of injustice what the media can reveal tends to be resolved openly and can be followed and controlled by the public. Today's media is a place for citizens to seek and realize justice in accordance with their role. This mass media also monitors law enforcement and justice in the country. this is it. the role of netizens is a very large mass in raising a case so that it goes viral it is very important without a response from netizens then a case will not go viral. The reason someone uploads to social media for the first time is because there are so many social media users and there are almost all over the world , secondly, because social media is an internet-based technology where news dissemination will be faster than word of mouth, thirdly, if it is viral in the mass media, related parties will handle it quickly. And this is what politics does law in dealing with legal cases that do not get justice before they are viral in the mass media, legal politics also influences the strength or weakness or how important the legal objectives are to be achieved.

Abstract

Corruption in Indonesia is increasingly becoming a topic of discussion along with the debate over the revision of the KPK Law and the election of a new chairman of the "anti-racial" institution to cause a wave of protests among the public, the revision of the KPK Law is considered not to take into account public aspirations and the points of change are feared to weaken the performance of the institution in eradicating corruption. There are two techniques that have legal flaws in conducting hand-catching operations. Wiretapping is only regulated in general only in Law No. 30 of 2002, while entrapment is not known in various regulations on corruption in Indonesia which were previously contained in Article 31 paragraph (1) of Law No. 11 of 2008 concerning Electronic Information and Transactions but have been abolished. In order to eradicate corruption, the law authorizes the KPK to intercept, therefore, if these two techniques are used, it often gives rise to the assumption that the KPK has violated the law and human rights, namely violating the confidentiality / private of a person. This study aims to find out the extent of Law No. 19 of 2019 concerning the KPK in minimizing corruption cases in Indonesia, as well as obstacles after the implementation of the latest KPK Law This research uses empirical juridical research methods, or also known as field research, namely research that examines applicable legal provisions and the reality of what happens in society with empirical and sociological juridical approaches. The data used are primary, secondary, and tertiary data. primary legal materials consist of the Criminal Code (Criminal Code), KUHAP (Criminal Procedure Code), Law Number 20 of 2001 concerning Corruption Crimes, Law Number 30 of 2002 concerning the Corruption Eradication Commission, Law No. 19 of 2019 second amendment to Law No. 30 of 2002 concerning the Corruption Eradication Commission (KPK), secondary legal materials in the form of scientific journals, book and other related documents, tertiary legal materials in the form of legal dictionaries. After Law 19/2019, there was the authority of the KPK which was finally transferred regarding wiretapping, seizure, and searches before did not need permission, immediately given a warrant the direct leadership could arrest. Meanwhile, after the enactment of Law 19/2019, there must be permission from the supervisory board Regarding Law 19/2019 after the Constitutional Court's decision because there was a material test, then the Constitutional Court decision number 70 of 2019 regarding material testing emerged, the Supervisory Board was given the authority to supervise the Leaders and Employees of the Corruption Eradication Commission, and it was not appropriately positioned and functioned as 57 licensing organs (vergunningsorgaan). From an Administrative Law perspective, the Board of Trustees cannot act as a vergunningsorgaan. based on Article 37B paragraph 1 letter b of Law No. 19 of 2019 which reads; "Granting permission or not granting permission for wiretapping, search, and/or seizure" contains discretionary meanings held by the Board of Trustees

Abstract

Indonesia sebagai negara yang menganut sistem negara kesatuan dengan prinsip dasar pemerintahan yang berdaulat. Namun, konsep negara kesatuan yang dianut Indonesia tetap menerapkan desentralisasi. Pemberian kewenangan terhadap daerah dimaksudkan agar mampu mengendalikan dan mengelola rumah tangganya. Sebagai cara untuk memperkuat semua peluang ekonomi yang dapat dijadikan sebagai Pendapatan Asli Daerah (PAD). Sumber Pendapatan PAD terdiri dari pendapatan pajak daerah, pendapatan retribusi daerah, pendapatan dari badan usaha milik daerah, dan pendapatan dari pengelolaan kekayaan daerah lainnya, serta pendapatan lain yang sah. Pengaturan terkait dengan pajak dan retribusi daerah telah mengalami beberapa kali perubahan hingga pada tahun 2022, disahkanlah Undang-Undang Nomor 1 Tahun 2022 tentang Hubungan Keuangan Antara Pemerintah Pusat dan Pemerintahan Daerah, sebagai peraturan yang dimaksudkan untuk merevitalisasi regulasi pajak dan retribusi daerah. Dengan adanya pembaruan terhadap regulasi pajak daerah dan retribusi daerah memiliki tujuan yang hendak di capai dengan adanya penyesuaian rezim UU HKPD, sebagai salah satu upaya untuk menciptakan hubungan keuangan yang efektif, efisien, transparan, akuntabel, dan adil antara pemerintah pusat dan pemerintah daerah.

Abstract

Penghinaan Presiden dan/atau Wakil Presiden baru-baru ini kembali dimunculkan dalam Undang-Undang Nomor 1 Tahun 2023 tentang Kitab Undang-Undang Hukum Pidana (KUHP) tepatnya pada pasal 218, isu kekaburan muncul karena pada penjelasan pasal 218 ayat (1) tidak memberikan batasan yang jelas mengenai perbuatan-perbuatan apa saja yang bisa membuat Presiden dan/atau Wakil Presiden merasa harkat dan martabatnya direndahkan. Metode penelitian yang digunakan adalah yuridis normative, menggunakan pendekatan perundang-undangan dan pendekatan konseptual, serta analisa bahan hukum pada penelitian ini adalah interpretаsi grаmаtikаl. Hasil yang diperoleh dari penelitian ini adalah dengan adanya kekaburan norma dari tindak pidana penghinaan Presiden dan/atau Wakil Presiden adalah yang pertama menimbulkan multitafsir, munculnya kesewenang-wenangan, dan tidak mencerminkan asas kejelasan rumusan

Abstract

It is well-known among the public that Indonesia is a country where development in various sectors, especially in the economy, is consistently successful and supported by the government. One of the most prominent sectors is the industrial sector, which is significantly encouraged by the government. This is the aim of this research: first, to explore the legal protection provided for workers whose employment is terminated due to absenteeism. Second, to investigate the legal recourse available if a worker's employment is terminated due to absenteeism. In this research, the author employs a Normative Legal Research Method. In this study, the author contends that the judge correctly interpreted Article 27 paragraph (9) letter e and Article 27 paragraph (10) of the Collective Labor Agreement (CLA) of PTFI (PT Freeport Indonesia) for the periods of 2015-2017, as well as Article 26 paragraph (10) of the CLA of PTFI for the periods of 2017-2019, and Article 168 paragraph (1) of Law Number 13 of 2003 concerning Manpower, along with relevant prevailing laws. Consequently, the decision was accepted, resulting in the termination of the employment relationship between PT Freeport Indonesia and Ferdinandt Mamangkey upon the enforcement of this decision.Keywords: Legal Protection, Absenteeism, Termination, Judge

Abstract

The sea and its resources, especially fishery resources, are a gift from God Almighty for the welfare of all Indonesian people. Based on the state's right to control the earth and the natural resources contained therein, which originates from Article 33 paragraph (3) of the 1945 Constitution of the Republic of Indonesia, the government must regulate fishery resources for the greatest prosperity of all people. The use of fishery resources is carried out with various legal products ranging from laws, government regulations, and presidential decrees to ministerial rules. Regulations on using fishery resources include prohibiting using trawl nets to catch fish in certain waters. This prohibition aims to prevent damage to the marine environment, ensure the sustainability of fishery resources, and protect small fishermen. However, in its implementation, it is still hampered by the problem of law enforcement, which is hindered by disharmony of regulations, the availability of professional law enforcement officers, and the lack of support for facilities and infrastructure considering the vast area of law enforcement. One thing that is no less important in enforcing the law on the prohibition of the use of trawl nets is the low legal awareness of fishing communities, especially industrial fishermen who only care about themselves without paying attention to the preservation of marine ecosystems, the sustainability of fishery resources, and the protection of small fishermen or traditional fishermen.

Abstract

This research aims to analyze the legal arrangements regarding the recognition of the law that lives in society in the 2023 Criminal Code (KUHP) and examine the urgency of integrating customary sanctions in the national penal system, especially in Biak Numfor Regency, as a manifestation of restorative justice. The research method used is normative-empirical legal research, with a legislative, conceptual, and sociological approach, through literature study and analysis of customary case settlement practices in Biak Numfor. The results of the study show that normatively, Article 2 of the 2023 Criminal Code provides a clear legal basis for the recognition of living law as a source of national criminal law. Philosophically, the recognition is in line with the values of Pancasila, the theory of Volksgeist Savigny, and the principle of restorative justice that emphasizes the restoration of social relations. Meanwhile, sociologically, customary settlement practices in Biak Numfor have proven effective in creating peace, strengthening legal legitimacy, and reducing the burden of formal justice. This study emphasizes that the integration of customary sanctions into the national penal system is a strategic step towards a legal system that is humanistic, socially just, and rooted in the local values of Indonesian society.
