Abstract

This research aims to legally examine the elements of intentionality and negligence in criminal acts as the basis for a person's criminal responsibility. The main problem in this study is how the concepts of intentionality and negligence are understood in criminal law and how they are applied in criminal justice practice. This research uses a normative legal research method with a literature study approach, namely by examining various sources such as laws and regulations, opinions of criminal law experts, and court decisions related to the research topic. The results of the study show that intentionality and negligence have quite fundamental differences in determining the fault of the perpetrators of criminal acts. Intentionality occurs when a person commits an act with the will or awareness that his act may cause consequences that are prohibited by law. Meanwhile, negligence occurs when a person is not careful or ignores the obligation to act carefully so as to cause harm or adverse consequences to others. The difference between the two elements affects the evidentiary process in court, the determination of whether or not the elements of the criminal act are met, and the severity of the criminal sanctions imposed. Therefore, the precise determination of whether an act was committed intentionally or due to negligence is essential to ensure justice, legal certainty, and the application of proportionate punishment in the criminal justice system.

Abstract

The background of this study lies in the importance of students’ learning interest as a primary factor in the success of the learning process in Madrasah Ibtidaiyah, as well as the need for technology-based instructional innovation to enhance student engagement and motivation. This study aims to describe the effectiveness of the discovery learning model assisted by an Interactive Flat Panel Display (IFPD) on students’ learning interest at MI Muhammadiyah Ngreco. This study employed a qualitative approach using a case study method. The research subjects consisted of one class implementing the discovery learning model supported by an Interactive Flat Panel Display. Data were collected through participatory observation, in-depth interviews with students and teachers, and documentation of learning activities. Data analysis was conducted using a descriptive-thematic approach to identify patterns and students’ perceptions related to their learning interest. The findings indicate that the implementation of the discovery learning model assisted by an Interactive Flat Panel Display positively enhances students’ learning interest. Students were observed to be more enthusiastic, active, and motivated during the learning process. The interactive media supported their engagement in exploring learning materials independently and in an enjoyable manner. In conclusion, the discovery learning model assisted by an Interactive Flat Panel Display is effective as a learning strategy to improve students’ learning interest in Madrasah Ibtidaiyah. This study recommends the broader utilization of interactive technology as an instructional innovation in educational settings.

Abstract

This study aims to analyze the comparative nature of public service organizations in Bintan Regency and Tanjungpinang City, emphasizing the role conflict between bureaucrats in implementing sustainable public policies. Public organizations play a crucial role as policy implementers, transforming government decisions into public services. However, in practice, role conflict often occurs due to abuse of authority, unclear division of tasks, and differing interests among bureaucratic institutions. This study applies a qualitative approach and descriptive explanatory analysis methods to observe the differences in the characteristics of public service organizations in the two regions. The research findings indicate that variations in organizational structure, bureaucratic capacity, and regional development focus influence the dynamics of role conflict in public policy implementation. Bintan Regency, which focuses on developing the tourism sector, faces challenges in inter-agency coordination related to development policies, while Tanjungpinang City, as the center of government administration, experiences complex bureaucratic coordination for public services. This study explains the significance of role clarity, inter-institutional collaboration, and increasing the capacity of bureaucratic organizations to improve the effectiveness of public policy implementation and the quality of services to the public.

Abstract

Fiduciary security plays a central role in modern security transactions by allowing creditors to obtain enforceable ownership rights over movable assets, while debtors retain physical possession of the collateral. The effectiveness of fiduciary security depends not only on the creation of enforceable ownership rights in the event of default but also on the clear allocation of legal liability between the debtor and creditor when the pledged assets are transferred to another party. The transfer of fiduciary security objects gives rise to complex legal issues regarding the continuity of ownership rights. This article discusses: (1) how fiduciary security generates enforceable ownership rights in security transactions; and (2) how the responsibilities of the debtor and creditor toward the fiduciary security object shift when it is transferred to another party. This study employs a doctrinal legal research method, combining a statutory approach to analyze the normative framework of fiduciary security with a conceptual approach to examine ownership rights and debtor-creditor liability, as well as the judicial interpretation of Law Number 42 of 1999 concerning Fiduciary Security, specifically Constitutional Court Decision No. 18/PUU-XVII/2019 and Constitutional Court Decision No. 2/PUU-XIX/2021.

Abstract

The objective of this research is to determine and analyze the working capital turnover in increasing profitability at PT. Hadji Kalla, Palopo Branch. The research method used in this study is quantitative data. Quantitative data in this study includes the company's financial statements in the form of balance sheets and profit and loss statements. Data sources for this study used primary and secondary data. Primary data, namely data obtained through observation and interviews, aimed at refining this paper. Secondary data, namely data obtained from other parties or indirectly from the primary source (the company) related to the research problem. The company's financial data to be studied spans five years, from 2012 to 2016. The results of the study explain that cash turnover, inventory turnover, and accounts receivable contribute to increasing profitability at PT. Hadji Kalla Palopo Branch has been quite effective this is because the number of company sales activities has increased annually and the profitability ratio measured by ROE, ROI, NPM is quite good according to the standards of experts. The standards for ROE, ROI, NPM according to Lestari and Sugiarto 2007 are good, namely > 2% based on the proposed hypothesis which states that cash turnover and receivables turnover at PT. Hadji Kalla Palopo Branch have not been able to increase the company's profitability so that the proposed hypothesis is accepted because cash turnover and receivables are not efficient.

Abstract

This study aims to describe the implementation of the center-based learning model in early childhood education, its implications for child development, and to identify its strengths and challenges at TK Negeri Pembina Pacitan. This research uses a qualitative approach with a field research method. Data was collected through observation, interviews, and documentation. The results show that the implementation of the center-based learning model has been carried out quite well through planning, learning environment arrangement, core activities in learning centers, and closing activities. The model positively impacts children’s development, including cognitive, social-emotional, language, and motor aspects in a holistic way through play-based learning. In addition, the model increases children’s activeness, independence, and enthusiasm. However, several challenges were found, such as limited facilities, time management issues, and varying teacher competencies in managing learning centers.

Abstract

This study aims to analyze the effectiveness of using recycled-material Educational Play Tools (APE) in improving early childhood fine motor skills. The background of this study is the low ability of children in activities such as cutting, pasting, and threading, as well as the suboptimal use of creative learning media. The study employed a quantitative approach with a quasi-experimental design using a One Group Pretest-Posttest model involving 12 children aged 3–4 years. Data were collected through observation, performance assessment, and documentation, and then analyzed using descriptive quantitative techniques. The results showed a significant improvement, indicated by an increase in percentage from 25% to 83.3%. Improvements were observed in cutting, pasting, threading, and hand-eye coordination skills. These findings indicate that recycled-material APE is effective, innovative, and environmentally friendly, and can serve as an alternative learning medium to optimally support children’s fine motor development.

Abstract

This study aims to examine the effectiveness of gross motor-based outdoor activities in improving the learning concentration of children aged 3–4 years at PAUD Plus Az-Zalfa Pacitan. The research employed a quantitative approach with a quasi-experimental design, specifically a nonequivalent control group design. The sample consisted of 42 children divided into two groups (Class A and Class B), namely an experimental group and a control group, each consisting of 21 children. The instrument used was an observation sheet measuring learning concentration with indicators of focus, following instructions, and task completion. The data were analyzed using a paired sample t-test. The results showed a significant improvement in the experimental group, with an average increase of 9.95 compared to 1.67 in the control group. Statistical analysis revealed a significance value of p < 0.001. These findings indicate that gross motor-based outdoor activities are effective in enhancing the learning concentration of early childhood learners.

Abstract

This study aims to describe fine motor stimulation strategies in improving children's pre-writing skills through cutting activities at KB Pelangi. This research employed a qualitative descriptive approach involving 17 children as research subjects. Data were collected through observation, interviews, and documentation, while data analysis used the Miles and Huberman model, including data reduction, data display, and conclusion drawing. The results indicate that cutting activities conducted in a gradual manner, supported by engaging learning media and intensive teacher guidance, can effectively enhance children's fine motor skills. This improvement is reflected in children's ability to hold scissors properly, better hand-eye coordination, ability to follow simple line patterns, and increased readiness for pre-writing activities. Therefore, cutting activities are effective as a strategy for stimulating fine motor development in early childhood.

Abstract

This study aims to improve the gross motor skills of children aged 5–6 years through Gambang Suling dance learning based on YouTube media. The background of this research is the low level of gross motor skills among Group B children at Tunas Ananda Kindergarten, as indicated by limited balance, coordination, and ability to follow rhythmic movements. This study employed Classroom Action Research (CAR) using the Kemmis and McTaggart model, conducted in two cycles, each consisting of planning, implementation, observation, and reflection stages. The research subjects were 15 children. Data collection techniques included observation, interviews, and documentation, with data analyzed descriptively using quantitative percentages of learning mastery. The results showed a significant improvement in children’s gross motor skills in each cycle. The mastery percentage increased from 42% in the pre-action stage to 68% in Cycle I, and reached 87% in Cycle II. This improvement occurred because the learning process integrated dance activities involving large muscle movements, utilized YouTube as an audiovisual medium, applied playback speed features to facilitate understanding of movements, and implemented a challenge-based learning approach that enhanced children’s motivation and engagement. Thus, it can be concluded that Gambang Suling dance learning based on YouTube media is effective in improving the gross motor skills of children aged 5–6 years.
