Abstract

Although the majority of Aceh's population is Muslim, the rules formulated in the form of Islamic Sharia Qanun cannot be separated from social interaction with non-Muslims as a minority community. This study wants to reveal the position of non-Muslims in Qanun (Sharia rules) for the application of Islamic law in Aceh, with the aim of analyzing how Islamic Sharia Qanun is made and their problems with diverse views on the equality of identity in Aceh. This is based on several facts which show that the paradigm of equality of diverse identities in Aceh has not been a major concern among religious communities. This research is library research using secondary data. Data collection techniques are carried out by reviewing the literature and related documents, namely analyzing 13 Qanun (Sharia Rules) of the application of Islamic Sharia and one Aceh Special Region Regulation, as well as other valid and credible sources. The findings in this library research are the rules formulated in Aceh's Jinayat Qanun giving freedom to the choice of punishment for non-Muslims. This freedom is granted through the principle of surrender, which is regulated in article 129 of Law Number 11 concerning the Government of Aceh and Article 5 of the Aceh Qanun Number 6 of 2014 concerning Jinayat Law.

Abstract

Penelitian ini memfokuskan pada analisis pengawasan Dewan Perwakilan Rakyat Kabupaten (DPRK) Aceh Jaya terhadap Program Listrik Gratis bagi masyarakat miskin. Sejak diimplementasikan tahun 2014, program ini masih ditemukan penerima bantuan tidak tepat sasaran atau penerima yang layak menerima tetapi tidak mendapatkan bantuan. Penelitian ini menggunakan metode kualitiatif. Pengumpulan data yang digunakan dengan metode wawancara, observasi dan dokumentasi. Wawancara dilakukan dengan DPRK Aceh Jaya, Bupati Aceh Jaya, Biro perekonomian dan SDA Setdakab Aceh Jaya dan civil society. Data dokumentasi dalam penelitian ini dari sekretariat DPRK, BPKK, Biro Perenomian SDA setdakab Aceh Jaya dan media. Hasil penelitian ini menunjukkan bahwa pelaksanaan pengawasan preventif DPRK Aceh Jaya terhadap program listrik gratis belum optimal. DPRK hanya melaksanakan pengawasan di pengesahan dan penetapan anggaran untuk program ini yang tertuang dalam APBK. Pengawasan preventif dari DPRK dalam hal pencegahan penyimpangan terhadap kebijakan yang akan direalisasikan tersebut seperti adanya penetapan prosedur pengawasan dan pembentukan tim khusus. Sedangkan pengawasan represif, secara kelembagaan belum optimal walaupun secara tata cara pengawasan sudah dilaksanakan seperti pembentukan tim, turun kelapangan dan tindaklanjut/ rekomendasi.

Abstract

In Bireuen Regency, as in many other regions of Indonesia, money politics has become a significant issue. This is evident in various corruption cases involving politicians and government officials. The repercussions include policies that often disregard public interest, instead prioritizing the agendas of specific political factions. This problem persists due to the cultural entrenchment of money politics, which has fostered public skepticism toward politics in Bireuen Regency. Consequently, systematic and comprehensive efforts are needed to combat money politics and establish an integrity-based democracy in Bireuen. The objective of this study is to outline measures that can be taken to counter money politics and build an integrity-driven political environment in Bireuen. Adopting a phenomenological approach, this research will be conducted in several phases, including preparation, implementation, and evaluation. The findings reveal that three key stakeholders play a crucial role in safeguarding democratic integrity and countering money politics in Bireuen: the government as the election organizer, regional leadership candidates, and the public. Should any of these parties engage in malpractice, it would adversely impact the image and quality of democracy in Bireuen Regency.

Abstract

This research focuses on the digitalization of villages through one of the Aceh government policies, namely the implementation of the SIGAP application in each village pioneered by the Community Empowerment Office and Village. This research aims to answer the problems of service and development as well as the urgency of implementing SIGAP in realizing digitalization-based village governance and accelerating digital-based development. This research uses qualitative methods on collecting, analyzing and processing data based on the Creswell model. The data collection techniques are carried out through, observation, FGD and interviews with data validity and data processing. The findings in this study show that the digitalization of village governance in improving services and accelerating development through the SIGAP application is declared to have a positive impact and have a very significant influence on the village government and the community. Through this research, it is also known that SIGAP plays an important role in facilitating data accessibility and accountability of the Village government through the features contained in the SIGAP application. So it is concluded that SIGAP is the right solution in accelerating digital-based services and development in villages.

Abstract

This study aims to analyze the participation and commitment of program implementers in the Bioflok program within the context of a food security initiative in Tanjung Harapan Village. The focus of the research is on neighborhood heads (RT) and youth organizations (Karang Taruna) as local-level actors. The study employs a descriptive qualitative approach using in-depth interviews with key informants, including RT leaders, members of Karang Taruna, village officials, and BPD members. The findings reveal that participation in decision-making was minimal, characterized by a top-down approach with no deliberative process. During the implementation and benefit utilization stages, participation varied greatly; some RTs demonstrated collective involvement and local initiative, while others operated individually with limited engagement. The level of commitment also varied: successful RTs showed strong affective, continuance, and normative commitment, whereas unsuccessful ones tended to be involved only administratively, lacking emotional attachment or long-term responsibility. This study concludes that the success of the Bioflok program does not solely depend on participation, but also on the extent to which implementers possess a sense of ownership, personal responsibility, and social structures that support program sustainability.

Abstract

This study analyzes the legal considerations used by judges in granting marriage dispensation based on engagement at the Mahkamah Syariyah (Sharia Court) of Kota Sigli during the period 20222024. Using a case approach and statutory approach within a normative juridical framework, the findings show that judges considered the existence of an engagement, the physical and mental readiness of the couple, and family support. The Islamic legal principle preventing harm takes precedence over attaining benefit served as the main basis for the ruling, aligning with the concept of maslahah (public interest) in Islamic family law. However, from the perspective of child protection policy, this practice still carries potential risks to children's rights, especially in terms of education and protection from early marriage. It is concluded that the dispensation was granted based on maslahah, but it needs to be balanced with stricter adherence to child protection principles.

Abstract

Digital transformation in population administration is an important part of the modernization of public services in Indonesia, including in the city of Bandung. This study analyzes the effectiveness of the implementation of Digital Population Identity (IKD) in 2023-2024 using Robert B. Duncan's theory of effectiveness, which includes three main indicators: goal achievement, integration, and adaptation. The results show that the realization of the use of IKD is still low, with an achievement of only 1.91% in January 2024, far below the target of 25%. The socialization of the program is still limited to certain groups, while the general public's understanding of IKD is not optimal. In addition, the limitations of digital infrastructure and human resources are the main challenges in the implementation of this system. Therefore, a more comprehensive strategy is needed through increasing socialization, strengthening infrastructure, and increasing the capacity of apparatus in managing digital systems. With these steps, it is hoped that IKD can be more effective in improving the efficiency and accessibility of population services in the city of Bandung

Abstract

This research refers to the problem of improving employee performance and discipline at the Bintan Regency Education Office and the alternative step taken by the Government is to create the SIKAB Application. The purpose of this study is to evaluate the steps taken by the Bintan Regency government in overcoming the problems caused by the SIKAB application and the impact felt by employees after using it. The method used is descriptive qualitative with a case study approach, data collection is done by means of observation, interviews, and documentation. The results showed that the application still had an impact on increasing employee discipline, but not with applications that still experienced errors and did not have a remote radar feature. Not only that, special development and further evaluation are still needed in overcoming application problems and what kind of performance is carried out by employees of the Bintan Regency Education Office. The conclusion in this study found that the SIKAB application has been running well, as evidenced by the existence of application development and various other problems related to improving employee performance and discipline at the Bintan Regency Education Office.

Abstract

Agrarian conflicts in Indonesia, are deeply rooted in the tensions between customary land rights and state development projects. The enactment of Law No. 5 of 1960 and West Sumatras Regional Regulation No. 7 of 2023 aimed to address these conflicts, yet the legal framework remains inadequate. The strategic location of Nagari Air Bangis, coupled with its rich natural resources, has attracted state and corporate interests, leading to conflicts over land that has been traditionally managed by local communities for generations. This study explores the dynamics of these agrarian conflicts, focusing on the impact of national strategic projects, such as industrial developments. Despite regulations that recognize the community's rights to their customary land, these rights are often overlooked in favor of state interests, resulting in significant socio-economic implications for the local populace. The research employs a literature review. revealing that conflict resolution efforts have primarily relied on negotiation and mediation, yet often fall short. This study emphasizes the urgent need for stronger policies that balance state development goals with the preservation of indigenous rights. By highlighting the challenges faced by the Nagari Air Bangis community.

Abstract

Stunting is a chronic health problem that affects the growth and development of children and is one of the highest causes of death in children in Indonesia. To address this, the government issued Presidential Regulation Number 72 of 2021 concerning the acceleration of stunting reduction. This policy was followed up by the Tarakan City Government through Mayor Regulation Number 1 of 2024, in line with the vision and mission of the regional head which emphasizes improving the degree of public health. This study aims to evaluate the effectiveness of the strategies implemented by the Tarakan City Government in reducing stunting rates and their impact on the community. The research was conducted using qualitative methods through in-depth interviews with purposively selected informants, as well as document analysis and secondary data from official reports and other relevant sources. The results showed that the strategy was effective, received a positive response from the community, and showed a downward trend in stunting rates. Policy implementation also shows inter-agency collaboration in accordance with the duties and functions of each regional apparatus, supporting the achievement of national targets.
