Abstract

The significantly increasing divorce rate in Jember Regency has become a serious issue caused by various factors, ranging from economic problems to domestic violence. As a countermeasure, the government has mandated the Marriage Guidance (Bimwin) Program for prospective brides and grooms. This study aims to examine the urgency of the Bimwin Program in supporting marriage readiness and how its legal obligation is implemented at KUA Gumukmas. This study uses a qualitative approach with a juridical-empirical type conducted through field research. Data collection was carried out through interviews, observation, and documentation. The results show that the Bimwin Program holds immense urgency as a preventive measure to minimize divorce rates by equipping prospective couples with marriage insights, mental readiness, and emotional maturity. In terms of legal implementation, KUA Gumukmas strictly enforces this obligation as an absolute requirement for issuing a marriage book. This policy has proven to be more than just a bureaucratic formality; it is a preventive effort and a crucial foundation for family resilience, with its implementation aligning with the values of maqashid al-syari'ah

Abstract

The phenomenon of the modern domestic crisis, triggered by digital disruption, shifting social roles, and increasing mental health vulnerabilities, calls for a reorientation in our understanding of the concept of sakinah. Traditional interpretations, which tend to define sakinah as a descriptive state of tranquillity, often fall short in addressing the dynamics of contemporary relational conflicts. This study aims to reconstruct the meaning of sakinah in QS. Ar-Rūm [30]: 21 through a maqāṣidi exegetical approach. The method employed is a literature review with qualitative analysis of exegetical texts and the modern social context. The findings indicate that sakinah is not merely understood as emotional tranquillity, but as a relational mechanism that serves to preserve the stability of the soul (ḥifẓ al-nafs) and the continuity of the lineage (ḥifẓ al-nasl). This study proposes the concept of resilient sakinah, namely the interpretation of sakinah as an adaptive capacity in managing conflict in a ma‘rūf manner. Thus, sakinah is not measured by the absence of conflict, but by the ability to maintain relationships oriented towards the common good.

Abstract

Divorce due to persistent disputes and quarrels is one of the dominant cases examined by the Religious Courts, so guidelines are needed that can guarantee uniformity in the application of the law and avoid disparities in decisions in similar cases. This is the background to the formation of SEMA Number 3 of 2023 as an amendment to SEMA Number 1 of 2022 which stipulates guidelines regarding the provisions of a minimum separation period of six months as a condition for divorce, unless there is an element of domestic violence (KDRT). This study uses a qualitative method with a normative juridical approach that aims to analyze the position of SEMA in the Indonesian legal system as well as the legal considerations and judge's decision in Decision Number 5960/Pdt.G/2023/PA.Bdg which applies a different approach from the guidelines formulated in SEMA Number 3 of 2023. The results of the study indicate that persistent disputes and quarrels are one of the reasons for divorce as regulated in Article 116 of the Compilation of Islamic Law. The SEMA is not included in the hierarchy of laws and regulations, but has a position as a policy regulation (beleidsregel) that serves to provide guidelines for judges in deciding cases. In the a quo case, the judge granted the divorce suit even though the parties had not separated for six months as the indicators formulated in SEMA Number 3 of 2023. The decision was based on trial facts that showed continuous disputes and quarrels and no hope of living together again. This study concludes that the judge's legal considerations remain based on positive legal provisions regarding the grounds for divorce, with an emphasis on realizing benefits and welfare for the parties rather than fulfilling the formal indicators stipulated in the SEMA.

Abstract

This study examines the implementation of the Himpun Satempap Sajari customary tradition in Malay marriage practices in Muaro Tabun Village, VII Koto District, Tebo Regency, Jambi Province, and analyzes it from the perspective of Najmuddin At-Thufi’s concept of maslahah. The study aims to describe the stages, functions, and social relevance of the tradition in contemporary society. This research employs an empirical legal research method using a field research approach. Data were collected through observation, interviews with customary leaders, religious figures, and community members, as well as documentation studies. The data were analyzed using the interactive analysis model of Miles and Huberman, including data reduction, data presentation, and conclusion verification. The findings indicate that Himpun Satempap Sajari consists of several stages, namely Baangkat Bapak, Ngantar Tando, Himpun Ahli Waris, Himpun Sanagari, and Pasang Patauh. These traditions reflect values of solidarity, mutual cooperation, deliberation, and social harmony. From the perspective of Najmuddin At-Thufi’s maslahah theory, the tradition contains social benefits because it strengthens kinship and social relations within the community. However, excessive economic burdens and social sanctions may potentially create social hardship for certain families. Therefore, the implementation of customary practices should prioritize public welfare and adjust to contemporary socio-economic conditions.

Abstract

Permasalahan lingkungan mendorong perlunya pendekatan yang tidak hanya bersifat teknis, tetapi juga berbasis nilai-nilai keagamaan. Dalam perspektif Islam, konsep filantropi dan ekoteologi Islam dapat menjadi landasan dalam membangun kesadaran ekologis masyarakat. Penelitian ini bertujuan untuk menganalisis implementasi wakaf bibit pohon di KUA Kecamatan Rumbia, mengkaji hubungannya dengan konsep filantropi Islam dan ekoteologi, serta mengidentifikasi faktor-faktor yang mempengaruhi pelaksanaannya. Penelitian ini menggunakan pendekatan kualitatif dengan metode studi kasus. Teknik pengumpulan data dilakukan melalui wawancara dan dokumentasi. Analisis data menggunakan model Miles dan Huberman yang meliputi reduksi data, penyajian data, dan penarikan kesimpulan. Hasil penelitian menunjukkan bahwa wakaf bibit pohon merupakan bentuk inovasi filantropi Islam yang mengintegrasikan dimensi sosial dan ekologis. Praktik ini mencerminkan adanya hubungan antara filantropi Islam dan ekoteologi serta dapat dipecah menjadi filantropi ramah lingkungan Islam . Implementasinya dipengaruhi oleh kesadaran masyarakat, lembaga peran keagamaan, dan dukungan sosial. Selain itu, program ini memberikan dampak positif terhadap partisipasi masyarakat dan upaya pelestarian lingkungan.

Abstract

This study aims to analyze the sukuk investment mechanism in Indonesia from the perspective of maqashid sharia. Sukuk has become one of the strategic instruments in the development of the Islamic capital market and plays an important role in supporting national economic growth through sharia-based investment systems. However, the rapid development of sukuk investment has not always been accompanied by a substantive understanding of the objectives of Islamic law (maqashid sharia), particularly in realizing benefit, justice, transparency, and investor protection. This research employs a qualitative method with a normative approach by examining regulations, fatwas of the National Sharia Council-Indonesian Ulema Council (DSN-MUI), Financial Services Authority regulations, and various relevant scientific literatures related to sukuk and maqashid sharia. The findings indicate that the sukuk investment mechanism in Indonesia formally complies with sharia principles through the implementation of contracts, underlying assets, and supervision by sharia authorities. Nevertheless, the implementation of maqashid sharia substantively still faces several challenges, including speculative investment behavior, limited sharia financial literacy, and the dominance of profit-oriented motives among investors. Therefore, strengthening education, supervision, and the internalization of maqashid sharia values are necessary to ensure that sukuk investment not only fulfills formal legality aspects but also realizes broader social and economic welfare.

Abstract

The rapid development of digital technology has transformed trading practices, one of which is the growing implementation of the dropshipping system across various marketplaces, including Shopee. Dropshipping enables individuals to sell products without directly owning or maintaining inventory, as the procurement and delivery processes are handled by suppliers. Despite offering convenience and accessibility for business activities, dropshipping raises several issues from the perspective of Islamic economic law, particularly concerning ownership of goods, clarity of the transaction object, payment mechanisms, delivery time, and the seller's responsibility toward consumers. This study aims to analyze the practice of dropshipping at MBU Store on the Shopee marketplace and examine its conformity with the principles and requirements of the salam contract in Islamic economic law. This study employs a library research method by examining various written sources, including classical Islamic literature, books, scientific journals, and other relevant references related to the salam contract, online transactions, and the dropshipping system. The findings indicate that the dropshipping mechanism at MBU Store involves product promotion by the dropshipper, ordering goods from the supplier after receiving a transaction from the consumer, payment prior to delivery, order confirmation, and direct shipment of the goods by the supplier to the consumer on behalf of the dropshipper. This practice demonstrates conformity with the characteristics of a salam contract, particularly regarding advance payment, clear product specifications, and the delivery of goods at an agreed time. Furthermore, the relationship between the dropshipper and the supplier may be understood as a form of parallel salam, provided that each contract is established independently and is not contingent upon the other. Nevertheless, such conformity depends on the fulfillment of the pillars and requirements of the salam contract, as well as transparency of information, certainty of delivery time, and responsibility toward consumers. Therefore, the dropshipping practice conducted by MBU Store through the Shopee marketplace may be considered permissible from the perspective of Islamic economics, provided that it is carried out honestly, transparently, fairly, responsibly, and in accordance with Sharia principles.

Abstract

This study aims to analyze the practice of online rotating savings and credit associations (arisan) using a decreasing contribution system in Kembang Village, Tlogosari District, Bondowoso Regency, and to examine its compliance with Islamic Economic Law principles. This study employed a qualitative approach using field research. Data were collected through interviews, observations, and documentation involving the administrator and members of the online arisan. The data were analyzed descriptively and qualitatively by examining the mechanism of the arisan, differences in contribution amounts, the timing of fund disbursement, and the balance of rights and obligations among participants. The findings indicate that the decreasing-contribution online arisan is conducted through WhatsApp using a number or slot selection mechanism. Participants who choose earlier numbers receive the funds sooner but are required to pay larger contributions, whereas participants choosing later numbers pay smaller contributions and receive the funds after a longer waiting period. In practice, the administrator also receives administrative fees and additional get payments in each arisan group. From the perspective of Islamic Economic Law, this mechanism has characteristics of a debt contract (qardh). However, differences between the contributions paid and the funds received create an imbalance in the rights and obligations of participants. This condition is considered to contain elements of gharar and riba and may result in injustice among participants. Therefore, the practice of online arisan with a decreasing contribution system identified in this study is considered inconsistent with the principles of Islamic Economic Law

Abstract

This study aims to analyze the practice of gold jewelry trade-in transactions at Srikandi Store in Asembagus District, Situbondo Regency, and to examine their conformity with the principles of Islamic Economic Law. This research employed a qualitative approach with a field research design. Data were collected through observation, interviews, and documentation involving parties directly related to the implementation of gold jewelry trade-in transactions. The data were analyzed descriptively through the stages of data reduction, data presentation, and conclusion drawing and verification. The findings show that the trade-in transaction begins when customers submit their old gold jewelry to the store for evaluation based on its weight, condition, and characteristics. After the value of the old jewelry is determined and agreed upon, customers select new jewelry. The value of the old gold is then calculated as part of the payment for the new jewelry. When the price of the new jewelry exceeds the value of the old gold, customers are required to pay the difference. Conversely, when the value of the old jewelry is higher, the remaining amount is returned to the customer. From the perspective of Islamic Economic Law, the transaction should not automatically be categorized as a direct exchange of gold for gold involving an additional payment that constitutes riba al-fadl. Based on the actual mechanism, the practice can be understood as a series of two separate sale and purchase transactions: the sale of old gold jewelry by the customer to the store and the purchase of new gold jewelry by the customer. Therefore, the validity of the transaction depends on the clarity and separation of the contracts, transparent price determination, transfer of ownership, mutual consent, and payment mechanisms that prevent elements of riba, gharar, and injustice
