Abstract

The development of criminal activities alongside technological advancements demands the evolution of law enforcement instruments to remain relevant and effective. The rampant prevalence of cybercrime in contemporary society has introduced legal complexities in its mitigation. Cybercrimes have evolved and become increasingly intricate. To address these challenges, new legal regulations with a technological approach are necessary. Indonesia has implemented such an instrument, namely the Electronic Information and Transactions Law (UU ITE). However, despite its implementation to combat cybercrime, several complexities persist. This research adopts a normative approach with a descriptive model. It aims to analyze the complexities associated with the implementation of the UU ITE in addressing cybercrime in Indonesia. In the face of rapid technological advancements, cybercrimes have become more intricate and require appropriate legal approaches. The research endeavors to contribute to the understanding and development of the implementation of the UU ITE in combating cybercrime in Indonesia. The findings of this research are expected to serve as a foundation for enhancing the effectiveness and efficiency of cybercrime management, thereby safeguarding society's digital activities. In conclusion, the growing threat of cybercrime necessitates continuous adaptation and improvement of law enforcement instruments. The research seeks to shed light on the complexities of implementing the UU ITE in Indonesia and provide valuable insights for the enhancement of its efficacy. By doing so, it aspires to contribute to the protection of individuals and communities in the digital realm.

Abstract

The regulation of commercial insurance in Indonesia is governed by the Indonesian Civil Code, in which insurance is considered a contract subject to the same general principles as other contractual agreements. Furthermore, the Insurance Law No. 2 of 1992 defines insurance as a business that regulates the conduct of those who operate insurance businesses. This research employs a qualitative approach using descriptive techniques to analyze motor vehicle insurance law according to the Indonesian Commercial Code. The findings suggest that insurance companies are institutions that collect funds from society and operate based on principles of responsible and healthy business practices, in accordance with government regulations. Responsibility is ensured through the issuance of insurance policies that outline the agreed-upon terms between the insurer and insured party, with the payment of premiums signifying the transfer of risk and the establishment of rights and obligations between the parties.

Abstract

Economic development cannot be separated from the financial sector. Financial deepening has been identified as a way to accelerate economic growth. The purpose of this study was to analyze the effect of financial deepening, the rupiah exchange rate and interest rates on economic growth in Indonesia in 1995-2018. This study uses secondary time series data from the World Bank. This study uses Error Correction Model (ECM) analysis through the EViews 10 program. The results of this study indicate that the performance of the financial sector in Indonesia is still shallow. In the long and short term, financial deepening and exchange rates have a negative and significant effect. Meanwhile, interest rates have a positive and significant effect on economic growth both in the long term and in the short term.

Abstract

In the context of development, an adequate legal framework plays a crucial role in creating a conducive and attractive business climate for investors, both domestic and international. The existence of a clear and consistent law gives confidence to economic actors that their rights will be recognized, protected and defended. By using the Economic Analysis of Law approach, efficiency is an ideal guide in designing legal policies. However, there are challenges and complexities associated with strengthening the legal framework for development. Some of the problems that often arise include the weakness of the justice system, corruption, legal uncertainty, and unequal access to justice. This research will try to see how legal economic analysis can be used as a tool to strengthen a country's legal framework in a development context. This study applies a normative juridical approachin order to analyze and interpret applicable law and understand the relevant legal norms. The results show that law plays a very important role in economic development. The law provides a clear and reliable framework for economic actors, protects propertyrights, and guarantees the protection of economic contracts and transactions. The Economic Analysis of Law (EAL) approach and the role of law in economic development are interrelated and influence each other. Through the Analysis of Law approach, an analysis based on legal values, benefits and efficiency can make an important contribution in strengthening the legal framework for more effective and efficient development.

Abstract

The success of a company can be measured through its marketing performance. To achieve success in marketing, companies must adopt a strategic approach that suits dynamic market conditions and increasingly high demands from customers. To achieve this, companies must design the right strategic approach. Having a deep understanding of the factors that influence marketing performance is very important in achieving this goal. Sustainability orientation and marketing orientation have been recognized as key elements that can have a significant impact on a company's marketing success. This study aims to analyze the effect of sustainability orientation and marketing orientation on marketing performance. In combination, sustainability orientation and marketing orientation can give companies a significant advantage in achieving successful marketing performance. This research is a quantitative approach. The number of samples used in this study were 194 samples taken from Small and Medium Enterprises (SMEs) in Central Java Province as respondents in this study. The data source used is a questionnaire with a Likert scale of 1 to 5 points. Analysis test was carried out using SmartPLS software. The results of the research show that there is a significant influence between sustainability orientation and marketing orientation. In addition, the sustainability orientation also has a significant positive effect on marketing performance. Furthermore, this study found that marketing orientation also has a positive and significant influence on marketing performance. In addition, the marketing orientation variable also functions as a reliable mediating variable in mediating the relationship between sustainability orientation and marketing performance.

Abstract

This research aims to investigate the influence of auditors' optimistic and innovative attitudes on their intention to conduct audits using Computer-Assisted Audit Techniques (CAATs). The study adopts a quantitative approach and gathers data from 224 respondents employed in 20 Public Accounting Firms located in Central Java, selected through random sampling techniques. Structural Equation Modeling (SEM) is employed for data analysis. The research findings reveal that auditors' optimistic and innovative attitudes have a positive and significant impact on their perceived ease of use of CAATs and their perception of improved performance when utilizing CAATs in conducting audits. These positive perceptions subsequently influence the auditors' intention to adopt and incorporate CAATs in their audit practices. The results of this study contribute valuable insights into the importance of auditors' attitudes in shaping their intention to adopt CAATs, emphasizing the significance of positive attitudes towards technological innovations in the audit profession. These findings hold implications for audit firms and professionals, highlighting the need to foster optimistic and innovative mindsets to facilitate the integration of CAATs into audit practices effectively. This research provides a foundation for further studies in the domain of audit technology adoption and underscores the significance of fostering a forward-thinking culture within the audit profession to enhance the use of CAATs and optimize audit performance.

Abstract

The existence of Supreme Court Regulation Number 1 of 2022 Concerning Procedures for Completion of Applications and Granting Restitution and Compensation to Victims of Criminal Acts has, in fact, postponed the right of victims to ask for compensation from the perpetrators, but the perpetrators in this case alone cannot carry out the compensation that has been decided. Based on this, this study aims to examine the power of implementing restitution for perpetrators as a form of recovery for victims of criminal acts in Indonesia and the concept of effective restitution for perpetrators as a form of recovery for victims of criminal acts normatively. The research results show that restitution for perpetrators as a form of recovery for victims of criminal acts in Indonesia has weak executive power. The concept of effective restitution for perpetrators as a form of recovery for victims of criminal acts in Indonesia requires the concept of reward in return for good faith and punishment in the form of resolving certain rights, the concept of tracing assets and confiscation, and the authority of judges to calculate the victim's losses themselves.

Abstract

The purpose of this research is to provide a comprehensive description of the research object, to clearly outline the state and condition of the object in order to gain a profound understanding of the situation/events and to discover patterns of relationships among situations/events, thus revealing the interconnection of data variables resulting from this study. The objective of this research is to gain an overview and understanding of how restorative justice is implemented in resolving cases of hate speech occurring in digital spaces or social media, where such criminal offenses are regulated by Law Number 11 of 2008 concerning Information and Electronic Transactions. The results highlight the implementation of restorative justice in resolving hate speech on social media, based on Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 on Information and Electronic Transactions, and analyze the challenges faced by the Police Institution in handling hate speech criminal cases on social media. The theoretical findings of this research are expected to serve as a source of information, enhance knowledge, and contribute to the field of criminal law, especially regarding the implementation of restorative justice in resolving hate speech cases conducted on social media.

Abstract

This research addresses the pressing issue of increasing unemployment among college graduates in Palu City, arising from the lack of opportunities in the formal job market. To combat this problem, the study proposes fostering creativity, initiative, innovation, and independence among graduates through entrepreneurial activities. The research aims to design and develop a model that stimulates students' entrepreneurial intentions to preempt the rise in educated unemployment in Palu City. The specific objectives are as follows: 1) Identify the level of entrepreneurial interest among students; 2) Test and analyze the implementation of the Student Entrepreneurial Intention Model, considering entrepreneurship education, achievement needs, and self-efficacy among students at Tadulako University, Palu; 3) Develop a Student Entrepreneurial Intention Model based on the Theory of Planned Behavior, tailored to the unique characteristics of Tadulako University students. Employing a survey method with a quantitative and qualitative descriptive approach, the research utilizes primary and secondary data, including questionnaires, interviews, and observations. The unit of analysis comprises students who took the Entrepreneurship Course during the Even Semester of 2014-2015 at Tadulako University. Data analysis employs descriptive and inferential techniques, specifically Partial Least Square (PLS). This research is expected to contribute to addressing the growing issue of educated unemployment by empowering students to embrace entrepreneurship as a viable career option and pave the way for a more sustainable and enterprising economy in Palu City.

Abstract

One way to obtain competitive human resources is by making employees aware of their potential according to their skills. To make employees aware of their potential, one program that companies can implement is a planned and continuous career development program. The purpose of this study is to determine the influence of career development on auditor performance. The research was conducted using a quantitative approach. A total of 250 respondents of auditors were collected for this study from auditors working at public sector organizations in Indonesia. The sampling technique used was random sampling, and the data analysis technique employed was Structural Equation Modeling (SEM). The results of this study show that career development has a positive effect on motivation, affective commitment, perceived organizational support, and performance. Furthermore, motivation, affective commitment, and perceived organizational support are able to mediate the influence of career development on auditor performance.
