Vyavahara Duta: Jurnal Ilmiah Ilmu Agama dan Ilmu Hukum merupakan jurnal ilmiah yang memiliki misi memperluas kajian bidang pendidikan agama sebagai referensi dalam mewujudkan pendidikan agama yang moderat. Abstract

Land conversion in Bali has become increasingly intensive in line with the rapid development of the tourism sector and the increasing need for organizational space and supporting infrastructure. Land conversion, particularly from agricultural land and protected areas to built-up areas, has given rise to various environmental, socio-cultural, and spatial use conflicts at the local level. This situation has resulted in a decline in the environmental carrying capacity and carrying capacity, and has direct implications for the granting of the community's constitutional right to a healthy and good environment. This article aims to analyze Bali's spatial planning regulations for controlling land conversion to ensure environmental sustainability and examine the protection of the right to a healthy and good environment within these regulations. This research is a juridical-normative study through an examination of spatial planning laws and regulations. The results indicate that, normatively, the spatial planning regulatory framework in Bali accommodates the principles of sustainable development and recognizes local wisdom. Guarantees for a healthy and good environment are also enshrined in Bali's spatial planning regulations.

Abstract

The enactment of the National Criminal Code through Law Number 1 of 2023 aims to achieve codification and legal certainty within the Indonesian criminal law system, including the regulation of abortion as a criminal offense. Nevertheless, normative issues remain, particularly concerning the legal status and protection of the fetus as the object of the abortion offense. This study aims to analyze the regulation of abortion crimes following the implementation of the National Criminal Code from the perspective of legal certainty, as well as to examine the implications of the unclear legal status of the fetus on criminal liability and law enforcement practices. This research employs a normative legal research method using statutory and conceptual approaches. The findings indicate that the National Criminal Code has not explicitly defined the legal status of the fetus, nor has it clearly regulated its relationship with the prevailing Health Law. This situation results in uncertainty regarding the limits of criminal liability and creates the potential for divergent interpretations in law enforcement practice. Therefore, normative clarification regarding the legal status of the fetus in the regulation of abortion crimes is necessary to ensure consistent legal certainty following the enactment of the National Criminal Code.

Abstract

The relationship between Hindu Dharma values and humanitarian protection principles inInternational Humanitarian Law (IHL) is an intellectual article that needs a comprehensiveresearch. IHL aims to safeguard human dignity during armed conflicts, which aligns with HinduDharma teachings on dharma, ahimsa (non-violence), and respect for life. Classical Hindu texts,such as the Mahābhārata, Bhagavadgītā, and Manu Dharmaśāstra, emphasize ethics of war(dharma yuddha), prisoner protection, and violence limitation. Modern case studies, includingthe Gaza-Israel conflict (2023–2025), reveal ongoing violations of IHL. This analysisdemonstrates that integrating Hindu Dharma values with IHL principles can strengthen theethical foundation of humanitarian law implementation in the contemporary era.Keywords: Hindu Dharma, International Humanitarian Law, Ahimsa, Dharma Yuddha, ManuDharmaśāstra, Humanitarian Protection

Abstract

This study aims to analyze the various forms of hidden sexual exploitation of women in Indonesia’s informal sector and to examine the ideal model of legal protection for victims from a criminal law perspective. This phenomenon emerges as a result of gender inequality, patriarchal structures, and economic pressures that place women in subordinate and vulnerable positions susceptible to abuse of power. Within informal labor relations, women are often exploited through seemingly legitimate service or employment arrangements that conceal coercive or manipulative practices. In Indonesia’s positive law, Law No. 21 of 2007 on the Eradication of Human Trafficking and Law No. 12 of 2022 on Sexual Violence do not explicitly address covert or non-physical forms of sexual exploitation occurring in informal work environments. This study employs a normative legal research method through statutory, conceptual, and case approaches. The findings reveal a normative vacuum and insufficient legal protection for women in the informal sector, caused by a positivistic and gender-neutral orientation in criminal law. Therefore, a comprehensive criminal law reform is urgently required—one that is gender-sensitive, human rights-based, and oriented toward substantive justice. This research contributes conceptually to the development of a more responsive and humanistic criminal law system that recognizes structural inequality and protects women from hidden sexual exploitation in informal labor contexts.

Abstract

This article examines the normative gap in the regulation of personal data after the death of data subjects and its implications for criminal liability under Law Number 27 of 2022 on Personal Data Protection in Indonesia. The issue is significant due to the rapid development of digital technologies that allow personal data to persist, be processed, and potentially misused even after the data subject has died, thereby increasing legal uncertainty. However, the existing legal framework primarily regulates living data subjects and fails to explicitly address the legal status, protection mechanisms, and representation of post-mortem personal data. This study employs normative legal research using statutory, conceptual, and comparative approaches. Legal materials were collected through a systematic review of primary and secondary legal sources and analyzed qualitatively using descriptive-analytical methods. The underlying assumption of this research is that the absence of explicit regulation on post-mortem personal data weakens the enforcement of criminal liability. The findings demonstrate that this normative gap creates uncertainty in identifying victims, determining violated rights, and establishing criminal responsibility, which in turn hinders effective law enforcement and increases the risk of impunity. Comparative analysis with international practices, particularly interpretations of the General Data Protection Regulation, shows that several jurisdictions provide limited protection for post-mortem data through alternative legal mechanisms. This article emphasizes the need for explicit legal norms governing personal data after death, including regulatory options such as statutory amendment, implementing regulations, or progressive legal interpretation, as well as the recognition of heirs as representative legal subjects. These measures are essential to ensure legal certainty, justice, and effective enforcement of criminal liability in the protection of personal data.

Abstract

Penelitian ini bertujuan menganalisis pengaruh Regulasi Pemerintah dan Kesadaran Hukum Masyarakat terhadap Perlindungan Hak Kekayaan Intelektual (HKI) Komunal di destinasi wisata pedesaan Kalimantan Timur, wilayah penyangga Ibu Kota Nusantara (IKN). Menggunakan pendekatan Mixed Method Sequential Explanatory, penelitian melibatkan 200 responden (pelaku wisata dan tokoh adat) serta informan kunci. Data kuantitatif dikumpulkan via kuesioner skala Likert 1-7, sedangkan kualitatif melalui wawancara mendalam. Hasil uji statistik deskriptif menunjukkan persepsi responden terhadap regulasi dan kesadaran hukum berada pada kategori moderat (Mean ~4.00). Namun, analisis regresi linier menyingkap temuan krusial bahwa secara parsial, pengaruh regulasi dan kesadaran hukum terhadap perlindungan HKI tidak signifikan (p > 0.05). Hal ini mengindikasikan adanya kesenjangan tajam antara aturan normatif dengan implementasi lapangan, serta kesadaran hukum yang belum terkonversi menjadi tindakan perlindungan aktif. Penelitian menyimpulkan urgensi model pendaftaran "jemput bola" dan revitalisasi peran lembaga adat sebagai jembatan hukum formal.
