Abstract

This study aims to design and implement risk management in Public Accounting Firms (KAP). This research combines field research and literature research. This research uses a qualitative approach and utilizes descriptive data from interviews and brainstorming to obtain field data. Literature research uses literature studies and previous research. The process of designing and implementing risk management starts from risk identification, risk analysis, risk evaluation, and risk treatment. The results of risk identification show that KAP has several risks that can result in complaints from clients, audit delays, wrong opinions, and financial losses. Risk analysis shows that 3 events are at the medium priority level and 2 events are at the low priority level. A risk evaluation was conducted and showed that 5 risk events actually at medium priority. Finally, risk response analysis shows that risks can be mitigated by mitigation and avoidance. Researchers recommend KAP and similar companies to consistently apply risk management in the audit process so that companies can reduce the adverse effects of risks or take advantage of risks in a direction that benefits the company.

Abstract

Bale-Bale Beach in Batam has significant potential as a marine ecotourism destination, but it remains underutilized. Key challenges include poor road infrastructure and low tourist interest in coastal activities, largely due to the dominance of floating restaurants. This limits the use of natural assets like mangrove forests, which could support conservation and sustainable tourism. This study aims to develop a sustainable ecotourism concept that integrates natural resources, local culture, and community participation. Its novelty lies in applying a multifunctional zoning approach—conservation, education, and recreation—based on sustainable architectural principles. Using a descriptive qualitative method, the study analyzes regional potential, community needs, and ecological design principles. Data was collected through observation, interviews, and documentation. Findings suggest that Bale-Bale Beach can be developed through an integrated zoning model that connects ecological preservation with educational and recreational activities rooted in local culture. This strategy supports adaptive and participatory coastal tourism development. The proposed concept offers practical insights for stakeholders and local authorities in managing coastal areas sustainably and can serve as a model for similar ecotourism initiatives in Batam and other coastal regions.

Abstract

Coastal areas have great potential to be developed as recreational spaces that not only attract tourists but also preserve local culture. Sambau Beach in Nongsa, Batam, faces challenges from rapid development that threatens the identity of Kampung Tua, environmental sustainability, and socio-cultural continuity. This study aims to explore how the Sambau coastal area can be utilized as a recreational space that integrates cultural values and sustainable principles. A qualitative descriptive method with a Research-Based Design (RBD) approach was used, combining literature studies, field observations, and contextual analysis. Findings show that local cultural activities, such as the Tepuk Tepung Tawar ceremony, traditional music performances, and exhibitions of local crafts, play a significant role in attracting tourists while maintaining local identity. Based on these findings, design strategies were developed by incorporating culture into spatial planning, including spaces for cultural performances and communal activities. These spaces are designed to resemble traditional balai adat, functioning as cultural landmarks and community hubs. The resulting design concept emphasizes sustainable development based on local wisdom and aims to enhance tourism potential, support environmental conservation, and reinforce cultural identity. These strategies are visualized through conceptual sketches, spatial diagrams, and 3D models.

Abstract

Digital transformation has significantly reshaped the landscape of economic crime, particularly in the context of money laundering offenses (TPPU) involving or facilitated by corporations. This study examines Indonesia’s positive legal framework governing corporate criminal liability in cases of money laundering, with a specific focus on proceeds derived from online gambling activities. The analysis is grounded in a case study of PT AJP, a corporation designated as a suspect by the Indonesian National Police (Bareskrim Polri) for allegedly receiving and managing funds totalling IDR 40.56 billion originating from online gambling operations. These funds were subsequently utilized for the construction and operation of Hotel Aruss. The corporation's conduct is deemed to fulfil the elements stipulated in Articles 3, 4, and 5 of Law No. 8 of 2010 concerning the Prevention and Eradication of Money Laundering, particularly regarding concealing, disguising, and utilizing criminal proceeds. This article also explores the application of the principles of strict liability and corporate criminal liability, under which a corporation may be held criminally liable irrespective of subjective fault, provided the act is committed by an authorized individual acting on behalf of the corporation. The findings highlight the urgent need for robust and adaptive legal enforcement in addressing technology-driven economic crimes and underscore the importance of regulatory reforms that can effectively respond to the increasingly sophisticated methods employed by corporate actors in the digital era.

Abstract

The advancement of technology in the digital era has significantly impacted various sectors, including banking, particularly in the management and protection of customers' personal data. Banks are legally and ethically responsible for safeguarding the personal information entrusted to them. This study aims to analyze the legal protection and liability of Bank Central Asia (BCA) in cases involving the misuse of customer personal data by third parties. The research is grounded in an empirical legal approach, supported by statutory analysis. It examines key regulations in Indonesia, including Law No. 27 of 2022 on Personal Data Protection, OJK Regulation No. 44 of 2024 on Bank Secrecy, Law No. 1 of 2024 in conjunction with Law No. 11 of 2008 on Electronic Information and Transactions, among others. The study explores the extent of bank obligations, customers’ legal remedies in the event of data breaches, and institutional accountability. Field data were collected through interviews and case analysis involving banking practices and third-party collaborations. The findings indicate that while the regulatory framework provides a solid foundation, gaps remain in enforcement and monitoring mechanisms, especially in third-party partnerships. The study emphasizes the need for stricter regulatory implementation, enhanced legal literacy among customers regarding their data privacy rights, and improved institutional oversight to ensure more effective protection of personal data in the digital banking landscape.

Abstract

The development of digital technology has increased the number of patent infringements globally, while the patent protection system in Indonesia is still unable to accommodate digital dynamics. Regulatory backwardness, slow bureaucracy, and low public awareness are the main obstacles in patent protection. This study aims to analyze and compare the patent protection systems of Indonesia and China in facing the challenges of the digital era. This study uses a normative legal method with a comparative law approach based on Schlesinger's theory, with descriptive-qualitative analysis through a study of regulatory literature and related legal documents. The study shows that Indonesia faces serious challenges such as the length of the patent registration process, weak law enforcement, and the non-recognition of patents for software and algorithms. On the other hand, China has established a progressive digital patent protection system, including a special IPR court, an integrated digital evidence system, and a blueprint for an IP protection strategy until 2035. China's system also adopts an efficient approach to patent examination, with a duration of only 15 months compared to Indonesia's 3-5 years. Both countries refer to the TRIPS standard, but their implementation is very different due to varying institutional capacities and country strategies. Indonesia is advised to carry out legal reforms and strengthen public education to support patent protection that is adaptive to the digital era.
