Abstract

The United Nations as a representation of the international community even accommodates regulations related to human rights through International Treaties agreed upon by state parties in the world through the Universal Declaration of Human Rights. Domestic violence is one of the most violence that occurred in many countries, which happens in Indonesia and Malaysia. Any violence between current or past intimate partners, wherever and whenever the abuse happens, is considered domestic violence (breach of human right). Physical, sexual, emotional, and financial abuse are all potential forms of violence. Indonesian law and Malaysian law define domestic violence as any act against a person, especially a woman, that results in physical, sexual, psychological, and/or domestic neglect or suffering including threats to commit acts, coercion, or unlawful deprivation of liberty within the domestic sphere. Research in a positive direction without excluding the elements of harmonization and legal politics that exist within the scope of the Republic of Indonesia and the Federated States of Malaysia in the realm of Domestic Violence entitled “A COMPARATIVE STUDY OF THE DOMESTIC VIOLENCE LAW IN INDONESIA AND MALAYSIA” according to Law No. 23 of 2004 on the Elimination of Domestic Violence and Domestic Violence Act 521 of 1994 jo. Domestic Violence Act A1538 2017. In this research, the researcher uses normative legal research, there are two types of groupings, consisting of primary legal material and secondary legal material.

Abstract

ABSTRACT . This study aims to find out and describe the implementation of cooperation between service users and wedding organizers during the Covid-19 period in Bengkulu City. The type of this research is empirical legal research, using qualitative research methods. The results of the study that: (1). The implementation of cooperation between service users and wedding organizers during the Covid-19 period in Bengkulu City had fulfilled the elements of force majeure and the Covid-19 pandemic could be qualified as a force majeure, because when the pandemic hit, the Indonesian Government had declared the Covid-19 pandemic a non-national disaster. natural disasters with the issuance of Presidential Decree Number 12 of 2020 concerning Stipulation of Non-Natural Disasters for the Spread of Coronavirus Disease 2019. Marriage permits in Bengkulu City must comply with health protocols and must have recommendations from the Covid-19 Task Force and fulfill the conditions that have been determined, if these conditions are violated then the Bengkulu City Covid-19 Task Force team will not issue a permit even if it continues it will be disbanded. And if the permit has been issued, it must be postponed due to the emergence of the spread of Covid-19. Therefore, directly making the Focus Wedding Organizer no longer considered a default, but only classified as force majeure. Where the delay in implementing the agreement made the Focus Wedding Organizer and the service user settle each other. (2) Settlement of disputes on service user agreements with Wedding Organizers with AA and NE due to the Covid-19 situation. Done by deliberation and consensus where the aggrieved party finally asks for compensation costs which in this case the amount to be paid each month is IDR 1,645,000 (one million six hundred and forty five thousand rupiah) which is divided into 5 months. Installment payments will be made every 20th starting from November and 2020 ending in April 2021. Keywords: Agreement, Settlement, Breach of Contract.

Abstract

Sewa menyewa kapal merupakan suatu bentuk perjanjian yang dilakukan nelayan tradisional dalam memenuhi kebutuhan sarana prasarana penangkapan ikan. Penelitian ini bertujuan untuk mengkaji latar belakang perjanjian sewa menyewa kapal penangkap ikan oleh nelayan tradisional dan pemilik/jurgan penyedia kapal dalam perpektif sosiologi hukum. Perjanjian sewa menyewa secara umum merupakan kegiatan ekonomi. Tetapi dalam hal obyeknya kapal penangkap ikan oleh nelayan, tidak hanya persoalan ekonomi. Oleh karena itu penelitian ini berupaya mengkaji persoalan apa yang melatarbelakangi perjanjian sewa menyewa kapal penangkap ikan oleh nelayan tradisional dan pemilik kapal. Penelitian hukum non doktrinal ini pendekatan socio-legal research, dengan lokasi penelitian di wilayah pesisir Kota Bengkulu. Hasil penelitian menunjukkan bahwa perjanjian sewa menyewa kapal dilakukan secara lisan (tidak tertulis) dalam masyarakat nelayan tradisional. Hubungan sewa menyewa antara nelayan tradisional dengan juragan pemilik kapal pada dasarnya tidak hanya dilatarbelakangi oleh persoalan ekonomi, tetapi juga aspek sosial dalam masyarakat pesisir. Budaya kebersamaan dan hubungan patron-klien sangat mempengaruhi perjanjian sewa menyewa kapal antara nelayan tradisional dengan nelayan juragan pemilik kapal. Abstract

Village Fund Direct Cash Assistance is assistance in the form of money given to poor families in villages originating from village funds to reduce the impact of the COVID-19 pandemic. In the process of distributing the Village Fund BLT, there are 6 criteria regulated in Article 33 paragraph (1) of the Minister of Finance Regulation Number 190/PMK.07/2021 concerning Village Fund Management. This study aims to find out how the implementation and inhibiting factors for implementing Minister of Finance Regulation Number 190/PMK.07/2021 concerning Management of Village Funds in Bang Haji District, Central Bengkulu Regency. This research is an empirical legal research. The results of this study indicate that the implementation of Minister of Finance Regulation Number 190/PMK.07/2021 concerning Management of Village Funds in Bang Haji District, Central Bengkulu Regency is not in accordance with Article 33 paragraph (1), where there should be several criteria for receiving Direct Cash Assistance (BLT). Village funds, but in Padang Burnai Village all residents receive BLT regardless of the criteria set by the central government, except for residents who have received other assistance from the government. Meanwhile, in Taba Tengah Village, BLT Village Funds were given to residents who met the criteria determined by the central government. As for the inhibiting factors in implementing the Minister of Finance Regulation Number 190/PMK.07/2021 concerning Management of Village Funds in Bang Haji District, they include the inhibiting factors from the Government side and from the Community side. Abstract

Meningkatnya tindak pidana asusila dikalangan masyarakat salah satunya yang sering terjadi yakni perzinahan. Tindak pidana asusila yang terjadi di provinsi Bengkulu hingga Oktober 2020 terdapat 158 kasus. Delik perzinahan diatur dalam pasal KUHP yang merumuskan bahwa hubungan seksual diluar pernikahan merupakan suatu kejahatan. Penelitian ini bertujuan untuk mengetahui alasan masyarakat Adat Besemah melakukan penyelesaian delik Adat Kerap Gawih melalui musyawarah masyarakat Adat Besemah di Kecamatan Tanjung Kemuning kabupaten Kaur. Metode analisis yang digunakan dalam penelitian ini yaitu metode analisis kualitatif. Data dikumpulkan baik dari kepustakaan maupun dari penelitian di lapangan. Hasil penelitian menunjukan bahwa masyarakat Adat Besemah di Tanjung Kemuning kabupaten Kaur melakukan penyelesaian dengan proses yang lebih mudah dan cepat yaitu melalui proses penyelesaian Delik Adat Kerap Gawih karena hanya memerlukan waktu yang singkat dan biaya yang sedikit. Abstract

This research aims to find knowledge about comparing inheritance distribution according to the traditional Kaum inheritance law system with the Islamic inheritance law system in Kota Mukomuko District, Mukomuko Regency. The method used is an empirical research method with comparative and qualitative approaches. The research results are as follows: First, in traditional inheritance, girls receive more inheritance assets than boys, except for high inheritance assets and sukang/soaring assets, because the people of Mukomuko City District adhere to the matrilineal principle in determining inheritance rights, low inheritance assets, livelihood assets, following matrilineal principles. Second, the division of inheritance in Islamic law has been stipulated in the Al-Qur'an in detail using mathematical calculations, as in the Al-Qur'an Surah An-Nisa verses (7), (11), (12), (33), and (176). Every heir from Dzawil Furudh, Ashabah, or Dzawil Arham gets a clear, systematic and unmixed share. In the principle of distribution of Islamic inheritance, sons receive a larger share than daughters; in principle, men are responsible for their children and wives; women have personal rights to their property, such as women's property from the results of their work, women's property is her property, apart from her husband's property. Third, the Kaum customary law system "privileges female heirs" with matrilineal principles, and the Islamic inheritance law system "privileges sons." there is an opinion that Islamic law follows patrilineal principles. The traditional Kaum inheritance law system is individual-collective. In contrast, the Islamic Law inheritance system is individual-bilateral, prioritizing balanced justice in life, placing the best and fairest principles in transferring a person's ownership after death to his heirs; all heirs get rights, without distinguishing between men and women, big or small.

Abstract

States send their representatives to other states for diplomacy, these state’s representatives are referred to in Diplomatic Law as 'diplomatic agents'. According to Article 3 of the 1961 Vienna Convention, a diplomatic agent has a diplomatic mission in the form of: representing the government of the sending state; protecting their citizens where they accredited; promoting their country; negotiating; and reporting all tasks that have been done to the government of their state. However, in practice, it is not uncommon for diplomatic agents to carry out activities outside of diplomatic missions. This study analyzes the state's responsibility to diplomatic agents who carry out missions outside of diplomatic missions based on International Law and the legal implications for diplomatic agents who carry out missions outside of diplomatic missions. The research method used normative legal research with statutory, case, and doctrinal approaches. Responsibility can be done as long as there are objections from the state that impact some disadvantaged. Consider the diplomatic law based on an agreement between the two states that establish diplomatic relations.

Abstract

The purpose of this research is to find out: 1). What are the efforts to protect Traditional Knowledge of the Gulai Ikan Mungkus special food carried out by the Kaur Regency Regional Government, Kaur Regency traditional restaurant entrepreneurs, and Kaur Regency Communities, and 2). What is the role of the Kaur Regency Government in Registering the Gulai Ikan Mungkus Special Food as Traditional Knowledge of Kaur Regency. This research is an empirical legal research, using a sociological juridical approach. Data collection was conducted by interviewing selected respondents/samples, observation, and document study. Data processing was started with coding and continued with data editing. After all the relevant data was complete and there were no errors, then data analysis was conducted using qualitative analysis. To further be described in order to answer the research objectives. The research results showed that: 1). the effort to protect the Traditional Knowledge of the Gulai Ikan Mungkus special food conducted by the Regional Government of Kaur Regency was by collecting data on restaurant actors who sell the Gulai Ikan Mungkus special food to be included in the festival events held by the Kaur Regency Government, appealed to all elements of society to register the Gulai Ikan Mungkus special food to the Education and Culture Office, cultivate Mungkus fish, as well as introduce this special food to foreign tourists came to visit Kaur Regency. Efforts to protect traditional restaurant business actors while maintaining the noble values and taste of Gulai Ikan Mungkus traditional food, 2). The Kaur Regency Government has not played a role in registering the special food Gulai Ikan Mungkus.

Abstract

The head of the Nusantara's authority has been granted the power to manage the finances of the Nusantara's Capital by the President, even though it is not explicitly stated in the State Finances Act. This has led to confusion about the nature of the financial management authority referenced in the Nusantara's Capital Law. This study aims to examine the institutional characteristics of the Nusantara's Capital Authority and the position of its Head as a manager of state finances, based on the President's power according to the concept of state finance. Using a normative law approach with a statute and conceptual approach, the research found that the Nusantara's Capital Authority has been established based on national law, with its headquarters in the national capital and directly responsible to the President, without a Regional House of Representatives and not led by a governor. Given these characteristics, it is more appropriate to categorize the Nusantara's Capital Authority as a Central Government. In terms of managing state finances in the Nusantara's Capital, the Head of the Authority is in the position of a minister/head of an institution as referred to in paragraph (2) letter b, serving as the Budget User/Goods User for Nusantara's Capital.

Abstract

The advanced development of science and technology also has an impact on the development of a country's economy. The rapid development of the economy, especially in the financial sector, has made the capital market a source of financing for a company. Companies that enter the capital market are public companies that have made public offerings on the stock exchange. One of the risks in selling on the stock exchange through the capital market is delisting. This study aims to analyze the legal basis for delisting and the responsibilities of delisted issuers to investors in the capital market. The research method used in this study is a normative juridical research type and uses statutory and conceptual approaches. The results of the study show that the responsibilities of issuers who are delisted to investors in the capital market are regulated in the Capital Market Law, the Limited Liability Company Law and the Financial Services Authority Regulations which regulate the mechanism for repurchasing shares and the legal protection given to investors for acts of negligence rather than issuers, in the form of sanctions given to forced delisting issuers. However, the regulation still does not explain in detail what form of responsibility the issuer should provide for the losses experienced by investors. In order to overcome these problems, clear arrangements are needed regarding the form of issuer's responsibility and legal protection for investors due to delisting, so as to provide legal certainty for investors.
